- The plaintiff says a ceiling leak destroyed his big-screen smart TV, but he claims his landlord - the defendant - denies any responsibility. He’s suing him for the value of the TV. The defendant’s legal counsel says the TV is seven years old and isn’t worth anything. The defendant has filed a countersuit for malicious prosecution.

That's like the lousiest lawyer ever - no witnesses, no reasonable arguments, and worst of all, he even countersued for something that cannot be sued for in civil cases!
and talked over the Judge that's a no no ! he was way unprofessional
....But he had this egghead expert who made an graph....and 'building commission" records...and the records from the "housing preservation bureau" ...and scientific water leak ceiliung bubble analysis.. and very detailed documents from the department of Air Conditioning leak history... and also the paint and plaster drying vs bubble leak studies and charts.. Did I mention the 'building commission" records???....
I'm wandering if gathering all these records and hiring the expert and making the graph and going to court cost more than brand new TV like that.

I love it when Judge Milian roast these so called "lawyers" that come into her courtroom representing a defendant. And that lawyer was fighting so hard on the landlords behalf for something that should have been taken care of by the landlord all the way through. But you can tell the lawyer guy hasn't been a lawyer for very long, but tried to come off like he's been practicing law for 25 years.

The lawyer on the defendant's side is a joke- I would stay as far away from him as possible if I ever needed a lawyer. How embarrassing for him! And the plaintiff should have taken the $500 and be done with it.

I do not think Plaintiff is very worried about the money. They probably treated him like shit, and he decided to put their asses on national TV. And the defendant's lawyer, he has done more damage to himself coming on TV than loosing 10 grand. Because anyone who watched this clip will run when he sees him.

@@2LitProduction He is, but he went to basically the Vatterott of law schools. He did his undergrad at St. John’s, which tells me he couldn’t get into their very decent law school. His CV on LinkedIn is a hot mess-he wrote everything in future tense as though he hasn’t done any of it yet. Yikes.

He knew if he brought the super that his client’s defence in this case would have been blown because their sworn testimony would have supported the plaintiff’s side, so on that end he is a smart lawyer. The fact that he doesn’t know the difference between malicious prosecution and abuse of process is what makes me scratch my head regarding how he passed the bar.

I hate that judges only give what someone else says a TV etc. is worth because it's not that easy in real life. Yes, someone might be able find that used TV that someone wants to sell but that price is usually that low because you are expect to find some friends and climb three flights of stairs and maybe it has the cords maybe not. They never take that into consideration.
I am guessing (just a guess) that the standard is gross negligence for a crime involving this, like if someone had drown after the pipe burst. This is a civil case, he is not being charged with a crime.

The lawyer didn't make himself look good in this case with one too many blunders though he seems like a good guy who just wanted to do his job as best he could. I hope this experience helps him improve his strategy in future cases.
