  • The plaintiff says his brother, the defendant, punched him in the face during a fight one night and broke his eye socket bone. The plaintiff required medical treatment, and he’s suing his brother for the bills, as well as pain and suffering. The defendant claims the plaintiff was intoxicated, and he punched the plaintiff in self-defense.

    I really wanted to wipe the smug look on the Defendants face off! What a POS. I don't believe anyone believed his story that he hit the Plaintiff once and did all that damage. He was looking for a reason to beat his brother senseless.

    The plaintiff is so hurt by his brother's actions. You can tell he was ready to cry. I'm glad he got a little bit of justice and I really do hope he pursued this as a criminal manner.

    He says his mother is an 'old lady' when she's only 54 OUCH! The plaintiff is so emotionally hurt by his brother, yet it seems the defendant is so jealous of his older brother his hate has become vicious. The defendant should prosecute him for felony assault and battery...

      I never understand why it’s up to the victim to press charges!?! He broke the law! Is it because they think they won’t have a case unless the victim is 100% in? You think the evidence would be enough in a case like this, but what do I know!!🤣

      It depends on the laws in the area and the crime committed, but the police can absolutely press charges even if the victim doesn't want to. They just need to have enough evidence that the crime occurred.

    I'm glad she didn't try to pull the "family is family" bit here because that would've been toxic AF. The defendant will absolutely brutalize (perhaps kill) someone else someday. I don't think his heart rate went above his normal resting rate the entire case. Scary ass dude.

    I'm so sick of violent people getting away with things .... he should have a huge amount of community service and fees and such - our jail system is whacked out by profit companies - but SOMETHING needs to nip the way people don't have any skills to solve things but fists

    I feel so bad for the plaintiff even though you can tell he is a bit dramatic he didn't deserve the beat down he received especially from his brother. Hopefully the def realizes he was wrong... If not just stay away from him if he brings that anger out of you.

    I really like this plaintiff!
    The way he explains what happened on the day of the incident makes me absolutely believe his version of occurrences.
    In his voice one can hear his passion, his sincerity and his pain.
    The way he talks and moves and the look in his eyes all show that he is pure, honest and respectful.
    (Regardless if he maybe isn’t always a little angel in every situation in his life)
    After all: This man clearly is a passionate human being and he is just as susceptible as the rest of us to maybe sometimes react too emotionally, but I truly doubt he would ever do bad/wrong intentionally and premeditated.
    His pain truly is palpable through the screen and through the many years…!
    Unlike his arrogant and seemingly unreliable, mean spirited and dishonest brother, whose behavior in this case doesn’t show ANY remorse, shame or empathy.
    There isn’t even the slightest hint of responsibility for his actions!
    The defendant is NOT a trustworthy person and HIS whole demeanor only shows that he does NOT act with respect or honor!!
    He should be very ashamed of himself, but I doubt he is capable of feeling shame in general!
    Unlike his brother, the plaintiff, this defendant is nothing but a waste of space.
    This episode is of course filmed and broadcasted many years ago and time has the power to make real significant changes in a person’s life.
    But my own life experience and human knowledge seriously wonders if time was able to change the defendant into a better human being…
    I would not put any money on it…

    He could have ended his brothers life. And in the police report his baby mom even said all he did was ask her to leave. She lied to him to cause this and he still backs up that trash woman. Sad dude so sad.

    About 15 years ago my uncle (who has been more like my Dad my whole life) and his wife were spending their weekend at the campground where they had a caravan (the kind that doesn’t move to different places, unlike a camper or a RV).
    My uncle enjoyed doing some DIY to make their caravan really nice and that was what he was doing that day.
    Apparently one of his neighbors didn’t like the fact that this DIY-ing made some noise, like hammering and/or drilling some holes and after that neighbor yelled that my uncle should stop ‘or else’, he decided to put his yelling into action and came, in a rage, over to my uncle’s place.
    My uncle was about 68 years old at that time!!
    The neighbor stormed into their spot and immediately started to punch my uncle, who until that moment didn’t think his neighbor was really serious about it all.
    He wasn’t prepared for this attack and fell backwards and as he was laying there the insane (AND COMPLETELY DRUNK!) neighbor kept on punching him.
    EVERY SINGLE PUNCH ON MY UNCLE’S RIGHT EYE!!
    (My Aunt tried to made him stop, but to no avail)
    After a while the neighbor simply stopped and he left.
    Ambulance and police were called and my uncle was rushed to the hospital.
    There they found out that the madman had completely DESTROYED MY UNCLE’S EYEBALL!
    He had lots of surgeries and ended up with a glass eye.
    The man was arrested but did not end up in jail. He was however sentenced to pay my uncle some money, but no ‘USA-amounts’ that we see often. It was something like 20.000 euro or so.
    Certainly not worth an eye!
    This defendant was in fact doing the same thing and is a disgusting POS!

    There's obviously a lot of family dysfunction going back years here. I'm not defending the defendant in this action but I do believe the plaintiff has been beating him up since he was a kid and he finally had enough. They should leave each other alone and the girlfriend needs to stay away from the mom. No way did she go into the house just to say Merry Christmas.

      Even so, what she claimed happened does not merit the beating that he gave to his brother. Just like the judge said...animalistic behavior! Even if the plaintiff had actually put his hands on the gf's back & gave her little shove out of the door...it still wouldn't justify the defendant's brutality. He could have killed him. If I were prosecuting him I would go for attempted murder. Once he had the plaintiff on the floor & unconscious & then continued to pummel him in the head...& with prior knowledge of his brother's epilepsy; I'm sure a jury would agree.

      He wanted an excuse to do it. You can see it in the amount he inflicted on the plaintiff. I believe that he kept pounding on his older brother. He probably was jealous of the attention the Plaintiff received from his mom as a younger brother because the plaintiff was sick with epilepsy. It probably made the defendant feel unloved.

      I'm from SoCal, born & raised...& I know a lot of ppl that talk like this. It doesn't necessarily mean that they're criminals. It has a lot to with with where you grow up/neighborhood, who you hangout with, etc. Yes, they definitely sound like cholos, but you can't just assume it's bc they are/were in a gang. I have tons of friends, male & female, that speak this way & they have never even had a speeding ticket.
