  • The New Mechanical Licensing Collective (MLC), a mechanical royalty collection agency, will collect mechanical royalties from digital service providers (DSPs) and pay those royalties to music publishers, songwriters, composers, and lyricists!
    Taken from the MLC website, “Starting in January 2021, The MLC will issue and administer blanket mechanical licenses to eligible streaming and download services (digital service providers or DSPs) in the United States.       @@Lilmoe24 Digital distributors pay you for the interactive streaming royalties for the sound recording (owners of the master), not for the composition! The interactive streaming royalties for the song itself is currently collected from HFA and MR in the US. Please also watch my video titled, Distributors vs Music Publishing Administration.

    Great video as always! Very helpful. I have a question. Is it necessary to register for Songtrust or Audiam if I register for MLC?

      Songtrust and Audiam are Music Publishing Administrators, meaning they would do the registrations with MLC and then pay you if you currently use one or the other. We are still waiting to see how it all will roll out. Also, these are for US royalties only. If you will self administer, then I would recommend joining HFA as well to license to get your international royalties.

    Thanks for the info! Question: How can a company become a listed as a music distributor? Seems like a majority of platforms force publishers/artists to upload via 3rd party distros.

      You’re welcome! You would need to develop agreements with all of the services that provide subscribers, streams, downloads in the US, and abroad international relations if that's your interest.

    do I need to register for both to collect all of my royalty harry fox agency and music report I have Songtrust but just want to make sure.. please help?

      If you have Songtrust, you won't be doing any registrations. They will register for you at both.

    Would affiliating with HFA as a publisher have any effect on us (as self-administered songwriters) using the MLC when it launches?
    I only ask because I'm not sure if they will be competitors like ASCAP to BMI - where we can only be affiliated with one at a time.

      No, it won't. HFA will be the organization giving info to the MLC at first. HFA will still be relevant for other licensing that you will need as well.

    Does this list of "Things to do" look right for someone who's about to release music on streaming platforms and the radio.
    1. Sign up with a distributed... (Distrokid, CDBaby ect)
    2. Sign up with a PRO... (Ascap, BMI)
    3. Sign up with a Publishing Administrator... Songtrust
    4. Sign up to collect digital performance royalties with.... Sound Exchange
    5. Sign up to collect mechanical interactive streaming royalties with.... MLC.
    Is this right and will this have all my bases covered as far as collecting royalties? Am I missing anything?

    Once I sign up to MLC, will I no longer receive checks from Music Reports and HFA?

      You will for any other licenses you signed up with them outside of the streaming (digital service providers) services. Also, you will continue receiving checks until the MLC opens in Jan.

    Please help me understand this from the perspective of an individual songwriter with no publisher. If we don't have an "publishing administrator," we need to sign up with a distributor (e.g. CDBaby), a mechanical license company (e.g. HFA), and a performing rights org (BMI). How do these three communicate with each other? Finally, they each send me (the songwriter) a check.

      Here's a quick overview. The distributor distributes your music to all digital platforms. That money will come back to the distributor, they'll take their cut and pay you the rest. You join BMI to collect performance royalties when your music is played on the radio, clubs, tv, concert venues, restaurants etc. Join SoundExchange to collect royalties as an Artist and/or owner of the master recording for your music (the sound recording-recorded version of the song) that's played on internet radio (non-interactive streaming royalties). HFA and Music Reports collect mechanical royalties from interactive streaming royalties (spotify, apple music etc). You need to make sure all of your registrations are done in order to collect all of your royalties if you are a self-administering publisher.

    Difference between Harry Fox Agency and Songtrust? Do I need to have both?

      No, you do not need both. If you use Songtrust, they will register and collect from HFA then pay you from the money they collect. Songtrust is a Music Publishing Administrator. HFA is one of two Mechanical licensing and royalty collection agencies in the US. If you self-administer you would register with HFA directly to collect your mechanical royalties.

      That I'm not absolutely sure. As of now, I know them to collect only in the US, so if you're releasing music here, I don't see why you wouldn't be able to collect those. Go ahead and sign up for now and we'll have to wait to see how it all unfolds. They are only giving so much information for now.

    I have a question for you. It is about applying for publishing cms. We applied via the google form two months ago, but we still haven't received an answer (I don't think we will get an answer). We are one of the biggest publishers in Serbia and we need a publishing cms to protect our catalog with over 50k songs. Is there an easy way to get it? We are ready to provide the necessary legal documents. Do you have any advice? Thank you for your reply. Kind regards

      I'm so sorry... I'm not abreast of the laws in Serbia. I would however make sure that all of your music is properly registered and protected according to the laws in your country, and they should be able to guide you on all of your international protections as well.

      It's more like the Harry Fox Agency and Music Reports in that the MLC will collect directly from the DSPs. Songtrust collects from HFA and MR, then sends that money to you. Songtrust is a great Music Publishing administrator! The MLC will pay you directly unless you have a Music Publisher or administrator. So in this case, Songtrust would probably collect also from the MLC and send that payment to you as an administrator. We'll see how it all plays out!

    Mummy please I am confused and almost going insane choosing between BMI and Ascap right now. Because I heard that BMI pays more than Ascap I wanted to join BMI but before I decided to still make a little bit more review then I found out that BMI is affiliated with CISAC as client instead of a Member while Ascap is afflicted as a member. Also they want to sell it to someone else. Again right now joining as a songwriter on BMI is not free like they said it was. There's now a 75 dollar one time fee.
    Mummy I am confused right now, I really don't where they are heading to. I don't know if they will end up disappointing their members?
    Please help me out, do you think I should still join them regardless of all this, or should I join Ascap to avoid regretting if any of my fear happens?

      If you are this fearful you shouldn’t do anything until you study their websites, and make a decision based on information and not based on what you heard. Yes, BMI was bought by a private equity firm and now charges a fee to join. It is no longer a non profit but a for profit organization and things will change. What those changes are? They haven’t been established fully yet. As with us all research is necessary in making final decisions. Reach out to them and ask what you need to know.

    I have a few detailed questions Ms.Watkins. Before hand, I want to thank you for all you do for us who scour the internet for knowledge on the content you provide.
    Question (1);
    When registering as a songwriter with either PRO, why would I enter my LEGAL name and not my entity/LLC name?
    (a)If I wanted to keep my legal name private, would my PRO pay out songwriter royalties to a company or an actual person?
    I ask because of THIS article | www.edmsauce.com/2017/08/02/marshmellos-real-name/
    Famous DJ "Marshmello" was able to keep his identity private for years. It wasn't until a royalty sheet leaked with his legal name attached to the writer and composer credits.
    (2) Wouldn't anyone be able to search any of his songs and check the songwriter/composer credits and identify his legal name?
    *Lastly, registering songwriter alternative names with ASCAP gives each name it's own IPI#. To keep his identity private, could he have simply registered his song under his stage name or listed his stage name IPI# on a split sheet?

      1. Because your legal name is your name as the songwriter unless you use a pseudonym.
      a. If you don't want to use your legal name, then sign up with a pseudonym. Meaning a made up songwriter name, but once you do that, you have to do that everywhere. When copyrighting your music too.
      2. Not necessarily if he was always consistent across the board.
      3. He could have. Anybody can choose whatever name they want to use.
