- According to UNCLOS "Philippines has a legitimate right or legal basis to operate anywhere in the West Philippine Sea".
The Spratly Islands have been at the center of the debate in the South China Sea. In July 2016, the Permanent Court of Arbitration at The Hague issued its ruling on a claim brought against China by the Philippines under Unclos, ruling in favor of the Philippines on almost every count. While China is a signatory to the treaty, which established the tribunal, it refuses to accept the court’s authority.
In recent years, satellite imagery has shown China’s increased efforts to reclaim land in the South China Sea by physically increasing the islands’ size and creating new ones altogether.
In addition to piling sand onto existing reefs, China has constructed ports, military installations, and airstrips-particularly in the Paracel and Spratly Islands, where it has twenty and seven outposts, respectively. China has militarized Woody Island by deploying fighter jets, cruise missiles, and a radar system.
To protect its political, security, and economic interests in the region, the United States has challenged China’s assertive territorial claims and land reclamation efforts by conducting freedom of navigation operations and bolstering support for Southeast Asian partners.
Also, in response to China’s assertive presence in the disputed territory, Japan has sold military ships and equipment to the Philippines and Vietnam to improve their maritime security capacity and deter Chinese aggression.
The United States has a role in preventing military escalation resulting from the territorial dispute. Washington’s defense treaty with Manila could draw the United States into a potential China-Philippines conflict over the substantial natural gas deposits and lucrative fishing grounds in the disputed territory.

An EEZ is not territorial water, but enforcement of international laws is within the obligation of the nation or nations controlling an EEZ. If two nations have overlapping EEZ's, then it is their obligation to talk in relation to sharing of resources within the shared EEZ. China, in this regard, is regarded by UNCLOS as an outsider in any such talks regarding Spratly's. The only ones who can are the Philippines, Malaysia, etc, who shares the overlapping EEZ. In regards to Scarborough shoal which is not part of Spratlys, the claims of China (and by extension, Taiwan) was also effectively rejected by the same court ruling. The Philippines is the sole legal claimant of the said shoal, and anyone else is basically an illegal settler.
Also, speaking of natural islands, China doesn't even control ANY natural island in the Spratly group of islands. Even Taiwan is ahead of them in terms of controlling a natural island so they are relegated into destroying coral reefs to have some semblance of a claim. And that's the contentious part since reefs cannot be considered as territory, but falls under an EEZ and extended continental shelf which can only be exploited by the nations surrounding it.
Taiwan controls the largest island, Vietnam controls 9 large islands, the Philippines controls 7 islands, and Malaysia controls 1. China's claims is basically flimsy. If the Philippines is as aggressive as China, then we can easily militarize any one of those islands. But we're a peace loving country.

It's all basically a bunch of story of Chinese tourists setting up camp, alluding to an ambiguous island, and not even claiming that those belongs to China. By that very logic, then Ancient India belongs to China just because they visited it, which is absurd. In regards to the islands, the CCP throughout the decades kept moving which island is which based on convenience. Even the so-called observatories were never found and could never have possibly existed due to size on the rocks (this one specifically referring to Scarborough Shoal, where the CCP claims to have built an observatory in Ancient times) that China has been claiming. As I have said, China neither owns nor controls ANY natural island in the area. What was clarified in the 2016 ruling under UNCLOS, which China is a signatory of, is that a country can only claim territories based on NATURAL ISLANDS. The Philippines, Vietnam, Malaysia and Taiwan are the only ones who controls natural islands in the Spratlys and therefore are the sole countries with legal claim to an EEZ within those territories. China, in effect, is an illegal settler. China's claim of ownership over the sea itself has also been overturned by UNCLOS due to its incompatibility with modern international treaties, laws and agreements. Not to mention, what's been stated in history as part of China's seas has been ambiguous at best, and could also have been simultaneously claimed by any of the other nations. That doesn't make it a valid claim in any modern internationally recognized world order.

Legal rights and the ability to defend are 2 different things. Spain, UK, Dutch, US, and Japan have no legal rights to take any part of the Philippines but Filipinos have no ability to defend so they did. There is no West Philippine Sea. South China Sea is the proper name given by cartographers since world map was drawn. Does not mean belongs to China or the Indian Ocean to India or Gulf of Mexico to Mexico. Sure there is this same sea west of the Philippines, south of China or east of Vietnam.
