- Malaysia has opposed the Philippine submission to a United Nations body to formally recognize the extent of its undersea continental shelf, saying it is projected from the baselines of Sabah. In a note verbale to UN Secretary General António Guterres on June 27, Malaysia’s permanent mission to the United Nations said Malaysia has never recognized the Philippines’ claim to Sabah.
Earlier, China had also protested against the Philippines claims. In a note verbal on June 18 communication, addressed to UN Secretary-General António Guterres, the Permanent Mission of the People’s Republic of China to the UN, said the Chinese government seriously requests the Commission not to consider the submission by the Philippines.
Malaysia requested the UN Commission on the Limits of the Continental Shelf not to examine and qualify the Philippines Partial Submission. The Government of Malaysia categorically rejects the Philippines’ Partial Submission on the basis that the Republic of the Philippines’ continental margin is projected from the baselines of the Malaysian state of Sabah.
This clearly disregards Malaysia’s indisputable sovereignty over the state of Sabah, the mission said. The mission said Sabah has always been an integral part of Malaysia, and has been recognized by the UN and the international community as part of Malaysia since the formation of the Federation of Malaysia on Sept. 16, 1963.
It argued that the Philippines’ claim to sovereignty over Sabah is incompatible with its erga omnes obligation to recognize and uphold the legitimate exercise of the right to self-determination by the people of Sabah in 1963. The Government of Malaysia wholly rejects the claims by the Republic of the Philippines that the latter has legal ownership and sovereignty over the Malaysian state of Sabah, the mission said.
It is clear that the Republic of the Philippines claim to Sabah has no basis whatsoever under international law. The Philippines asked the UN body last month to formally recognize the extent of its undersea continental seabed in the South China Sea, where it would have the exclusive right to exploit resources.
Through the Philippine mission to the UN in New York, the Philippine government submitted information to the UN Commission on the Limits of the Continental Shelf on the extent of its undersea shelf in the South China Sea, off western Palawan province, after more than a decade and a half of scientific research.
The Department of Foreign Affairs (DFA) explained that under Article 76 of the UN Convention on the Law of the Sea or Unclos, a coastal state such as the Philippines is entitled to establish the outer limits of its continental shelf. This comprises the seabed and subsoil of the submarine areas extending beyond 200 nautical miles but not to exceed 350 nautical miles from the baselines from which the breadth of the territorial sea is measured.
The National Mapping and Resource Information Agency led the Extended Continental Shelf Technical Working Group that worked on the submission for over 15 years.
The DFA underscored the significance of the submission in securing the Philippines’ sovereign rights and maritime jurisdictions in the WPS, noting that the 2016 award on the South China Sea arbitration confirmed the Philippines’ maritime entitlements and rejected those that exceeded geographic and substantive limits under the UNCLOS.
Philippine permanent representative to the UN Antonio Lagdameo said the move “can reinvigorate efforts of states to demonstrate their readiness to pursue Unclos processes in the determination of maritime entitlements and promote a rules-based international order. Former foreign affairs secretary Teodoro Locsin Jr. said the Philippines will not abandon its territorial claim over Sabah despite aggressive financial offers.
He bared the repeated offers in the past involving huge amounts of money for the Philippines to drop its claims over Sabah, formerly known as North Borneo. Meanwhile, visiting Malaysian Foreign Minister Dato’ Seri Utama Haji Mohamad Bin Haji Hasan will meet with Foreign Affairs Secretary Enrique Manalo to discuss the current state of Philippines-Malaysia relations, the DFA said.

There is a court case recorded in 2001 by ICJ (International Court of Justice, The Hague) about the Philippines' claims on North Borneo. It is a special 37-page report by ICJ that was published in 2001 and is easily accessible from the ICJ official website. It was a trial within a trial in the main court case between Malaysia and Indonesia over the ownership of the islands of Sipadan and Ligitan in Sabah. Philippines which is not a party to the trial requested permission to intervene. To comply with Article 62 of the Statute of the Court, the Philippines stated the objectives for the intervention (Section 7 & 84) namely, to safeguard and preserve the Philippines' historical and legal rights (only found in the 1973 PH Constitution) over North Borneo and to inform the court of the effect or effect of the court outcomes of the trial on its claim to the territories. In that trial, Philippines lawyers explained their case especially the Sulu-Ovenbeck 1878 agreement (primal reference) and related information to the court (Section 44 & 83). The same 15 main court judges were sitting at the bench and Malaysian and Indonesian lawyers too were present. On 23 October 2001, by a 14 to 1 vote, the court rejected the Philippine's request on the ground that there is “no interest of legal nature” (Section 93). @@hopelope1703 The Malaysian government pays RM5,300 per year as rental for Sabah to the heirs of the Sulu Sultanate. Malaysia doesn't call it rental or lease but cession money and has been paying this since the formation of the Malaysian Federation in 1963.
And please refrain from using terms like pirates and mafia. These are affluent, distinguished, honorable people. The amount of money (an apartment rent for a month) for the cession is not much of an issue here. It's more on the agreement they made.

Don't blame the British. Can Sulu show evidence that the Brunei Sultanate (original owner) gave Sabah to Sulu as a gift for assisting in Brunei’s civil war? So far, the record said NONE. Only pirates will do such a thing claiming something that does NOT belong to them.

The word “grant” has been used, and it has never been challenged or protested by Brunei, even when the British turned North Borneo into a British Charter (1881), Protectorate (1888), Colony (1946), and finally British Parliament under the Malaysia Act 1963 incorporate it into Malaysia. Secondly, let's assume North Borneo belongs to Sulu. The Sultanate of Sulu signed many agreements to relinquish his territories and dependencies (including North Borneo) to the colonizers. These include the Bases of Peace and Capitulation Agreement with Spain on 22/7/1878 and the Carpenter Agreement on 22/3/1915 with the US. Later Spain and the US relinquished North Borneo under the Madrid Protocol of 1885 and Anglo-US Border Convention 1930 to the British respectively. In the end, Sulu has nothing. Thirdly, PH claims North Borneo (Sabah) is null and void. For any colonized colony that seeks independence, the territory (sovereignty) is based on what has been given by their colonizer. In this regard, the principle of uti posseditis juris is applicable, acceptable, and recognized internationally. PH got their independence from the US in 1946 and under this principle, there is NO North Borneo. Rebut with facts and references. Not hearsay. The UN has recognized Sabah in Malaysia since 1963.

Where is Sulu Sultanate? It's non existent. According to International Law Malaysia owned it. According to UN Malaysia owned it. According to ICJ Malaysia owned it.

Sabah was ceded by the Sultan of Brunei to Sultan of Sulu in 1704 and Malaysia was only formed in 1963. People live in Sabah paying their rent through taxation to Malaysia and Malaysia paying rent to the family of the Sultan of Sulu. This is a classic feud between renters and owners...

The mere fact that Malaysia was paying an annual payment to the heirs of the Sultanate of Sulu means they're just renting it from the Philippines.

Sulu/PH needs to resolve 3 legal aspects before making any claim on Sabah from Malaysia. Firstly, Sulu needs to show undisputable proof that earlier, the Brunei Sultanate (original owner) gave North Borneo (Sabah) to Sulu as a gift for assisting in Brunei’s civil war. This is to rebuke the existence of the 29/12/1877 agreement (consisting of 4 agreements) signed by the Brunei Sultanate that grants the whole of North Borneo to the British North Borneo Company (BNBC). These agreements exist and are kept at the National Archives in London. The word “grant” has been used, and it has never been challenged or protested by Brunei, even when the British turned North Borneo into a British Charter (1881), Protectorate (1888), Colony (1946), and finally British Parliament under the Malaysia Act 1963 incorporate it into Malaysia. Secondly, let's assume North Borneo belongs to Sulu. The Sultanate of Sulu signed many agreements to relinquish his territories and dependencies (including North Borneo) to the colonizers. These include the Bases of Peace and Capitulation Agreement with Spain on 22/7/1878 and the Carpenter Agreement on 22/3/1915 with the US. Later Spain and the US relinquished North Borneo under the Madrid Protocol of 1885 and Anglo-US Border Convention 1930 to the British respectively. In the end, Sulu has nothing. Thirdly, PH claims North Borneo (Sabah) is null and void. For any colonized colony that seeks independence, the territory (sovereignty) is based on what has been given by their colonizer. In this regard, the principle of uti posseditis juris is applicable, acceptable, and recognized internationally. PH got their independence from the US in 1946 and under this principle, there is NO North Borneo. Rebut with facts and references. Not hearsay. The UN has recognized Sabah in Malaysia since 1963.

Sabbah belongs to the Sultanate of Sulu. Sultanate of Sulu are Muslims and they are Filipinos. The Philippine government has the right to protect and defend its teritory. Moreover, it is clear that the 2016 UNCLOS and arbitral rulling that the 200 neutical mile EEZ belongs to the Philippines.
