      Where is the "BLATANT INJUSTICE "?
      People are being evicted for nonpayment of rent or mortgages or the property owner wants their property back.
      The first lady did the restoration on her cottage without the approval of the council or verification of what was on her property and what was on her neighbors.

      Not exactly. With Private Enforcement Agents yes, the Police should not facilitate them (although they often do) but should only be present in order to prevent a breach of the peace. Enforcement Agents are not allowed to force entry and if they do the Police should stop them. But I think these were Court appointed Baliffs and that's different. They do have the power to force entry into a residence and the Police can and will arrest anyone that obstructs them.

      If the warrant issued by the court gives them the power to force entry, then yes, it's a criminal offence to obstruct them usually.
      People seem to think warrants mean nothing - what people forget is that a warrant has usually been heard by a judge who is more qualified than any "internet lawyer" and has often been practising law and presiding on cases for years.@@hullabaloo9824

    The only way to fight these evictions is by the "Do unto others" universal law. It doesn't just work one way just because one side has a piece of paper and some uniforms. What needs to be done after every eviction such as the first Indian lady, is to find out where those bailiffs live and go smash their doors in and take their property from them. See how they like it done to them. I guarantee you if bailiffs started to know and understand that if they smash someone's door in and steal their property then the same will happen in retaliation... they won't be half as willing to do it. They will think "I can't have my wife and kids put through that terror" while they are completely willing to put us and other peoples through it no problem.

    Ive been close to eviction - go to Court then get whacked £400 more on your bill for the privilege!!! I avoided actual eviction and have now been 20 years in my house rent paid. There's no better feeling once you've almost lost your home before. Kudos to this man.

    *FORMER councillor who was convicted of breaching a court order has avoided an immediate prison sentence.*
    Ex-Maldon district councillor Chrisy Morris, 47, had denied breaching two court orders made to protect his alleged victim.
    The woman claimed she saw Morris outside her new home the day after she moved to the address in Witham on July 22, 2019.
    He was banned from going near her by a non-molestation order imposed in 2018.
    Morris claimed he was unaware of the terms of the order despite the court hearing he was present when it was made.
    Morris admitted to being in the street but claimed he did not know she had just moved there and it was a “complete coincidence” as he was looking for a friend's address nearby.
    The jury at Chelmsford Crown Court also heard he went to the woman's address when her and her partner's car windscreens had allegedly been smashed on January 5, 2020.
    The defendant denied this offence and claimed he was at Langdon's Mill House Hotel the whole night.
    A jury unanimously found Morris guilty of the earlier offence which took place in 2019 but cleared him of the second charge from 2020.
    Morris faced Chelmsford Crown Court for sentencing today (February 28).
    Ms Taylor told the court the victim lives in dread and had not wanted to move to the new address in 2019 but felt she had no choice.
    Morris told Judge Timothy Walker: "I'm not the monster that this is trying to make me out to be."
    Judge Walker said he was in agreement with the prosecution that the breach of the non-molestation order was deliberate.
    He told Morris: "Putting your offending where I do and the distress caused, the matter is plainly so serious that custody is the only option I can adopt."
    Mitigating factors noted included Morris' relative lack of previous convictions and lack of recent convictions.
    The Heybridge West councillor was handed 8 months imprisonment, suspended for 18 months.
    He was also ordered to complete 30 rehabilitation activity requirement days and 200 hours of unpaid work.
    A restraining order has been made, in place for five years, to protect the victim.
    Maldon District Council has confirmed he is now no longer an elected member with immediate effect.
    Richard Holmes, head of paid service at Maldon District Council, said: “Based on the sentence handed down by his Honour Judge Walker at Chelmsford Crown Court today, I can confirm that Chrisy Morris with immediate effect is no longer an elected member of Maldon District Council.
    “Section 80 of the Local Government Act 1972 states, 'If a custodial sentence of three months or more is handed down, then the elected member is automatically disqualified'.
    “If members of the public need to contact their local Councillor for the Heybridge West ward, please contact Councillor Edwards.
    “The council takes this matter very seriously.
    "For now, I can say that the council has carried out its own conduct investigations and these have shown Chrisy Morris to be a person who has the capacity to ‘lie, mislead and intimidate’.
    "A number of staff and Councillors have been impacted by Chrisy Morris’s conduct and today’s sentencing strip’s him of his ability to continue to behave in this way as an elected representative.”

    The system goes before a competent judge who decides on enforcement action if any. Ms Patel knew or should know she had a listed building and should have employed suitable qualified builders which I dare say was played out in court. The Inspector tried to get resolution but in the end facilitated enforcement and performed excellently.

    Its a great thing he is trying to do. But a swift N244 application down the court is going to have more effect. Also I hope they are using the courts or negotiating with landlords or banks, but this is not shown. I worry when people turn up outside houses to argue with bailiffs and its not clear what has been done before to stop the enforcement. It takes so much more than arguments with bailiffs to keep people in their homes long term... & the residents getting evicted are the ones who pay

    Perhaps contacting the debt seekers BEFORE it gets to eviction would be a better answer then turning up looking for trouble, or have ppl with you who truly understand law and can act for the family to see IF the paperwork is lawful

      Keep it up,you want to help as many people as possible,that are getting evicted,this is going to get a lot worse,now if you can show the establishment that the eviction notices they have served,are written in fraudulent language and if they carry on,the person working for the establishment could face a lengthy time in HMP for false and misleading information, committing perjury.
      There are many ways to skin a cat.

    The only problem with these situations is that in some cases it's the tenants fault that they are in such a situation, blatantly not paying rent for example which has an affect on the those paying the mortgage.

    Police can't intervene by law unless a breach of the piece is made, nothing happened, I would sue them for unlawful arrest 💯

      If the bailiffs have a court warrant then they see themselves as helping them implement "the law"; but you're right, question is always: What is the right tactic on the day and strategy in general?

      Breach of peace is relatively difficult to claim unlawful arrest against cos the nature of the legislation can be down to what may happen rather than what has already happened. It's an odd law for that reason.

    Good work, big effort and very commendable by all who got involved with what was morally right in helping this lady save her home but did anyone see the warrant was in fact legitimate? If it was sealed with the official court stamp and signed by a JP I fail to see why the bailiff would be reluctant to show it? Most warrants bailiffs use are often unenforceable due to an abuse of process making any arrest of obstruction also unlawful! Legislation and Statute law do not overwrite Common Law or the 1689 Bill of Rights
