  • The plaintiff was married to the defendant’s brother when he was murdered. After her husband’s death, the plaintiff says the defendant stole money from him, so she’s suing. The defendant says the money went toward the funeral.

    I believe the wife 100%. His family is toxic and greedy . They stole her money because what's his and hers. I believe the arrangements was paid for by other people and they probably did not come out of pocket for anything. The audacity of the trifling sister trying to sue in order to recover the gift that she gave the plaintiff and her kids. Girl bye!

    A lot of y’all are thinking with emotions, and not THE LAW. BY LAW, she is his legal next of kin,and there was no will. So by law, that was HER money, and they should’ve understood that before they went and spent it

    This is this man’s WIFE so nothing else even matters if he didn’t have a WILL! THE WIFE has the benefits. The family had no business going after his cash. Putting your feelings and emotions to the side, LEGALLY she’s his wife and she won her case.

      Period I went through something like this and I was just the niece and my HUSBAND ended up paying for the entire funeral not 1 cent came from another place I got the receipt and I was just hurt because my unc died he had no insurance at all his wife didn’t either

      The funeral director/ funeral home can actually be sued for allowing the family to make arrangements with the official next of kin which was indeed the wife.

      My dad left my mom moved to another state we pay for her funeral without my dad but we had to serve him via certified mail just so he wouldn’t come to court to get a judgment by default to legal take ownership of house n car but they was wrong but they was right to plan his funeral everybody toxic 😂

    When my mother passed away the only people who paid for her funeral were me and my sister... my mother had several siblings and a large family, too. We took care of everything, us two, and left town right after the funeral. That was it (my mother's life insurance was in my name).

      My mother passed, literally me and my mama's husband at that were the only ones that came out of pocket.... There was a life insurance policy but my mother had it under my grandma's name. So I, nor my brothers, nor my mother's husband aqw anything. I literally had to trust what they were saying and still come out of pocket so my mama can have a head stone

      A beneficiary doesn’t mean you owe anybody anything. My sibs were mad with me. My sis lived upstAirs in my moms home, it went into foreclosure. I stepped in the day before a sheriffs sale of the home, just to do a quick sale, pay for my moms funeral. 5 of us agreed on $200 ea, for the burial. I had my older bro to collect, I gave $200 ,on weds, by sat the funeral home was calling my Pastor, the 10 k, insurance policy fell thru. I called my bro, me; hold all money that was collected. Him; he spent it on plumber, got grass cut, this that, everything this money wasn’t allotted for. Funeral Monday, we had to start , again. I gave $200, got $300 from oldest son , @ the funeral, we still don’t have enuf, my bro; I need to go to ATM, really? I’m pulling monies out of cards, then another card, still don’t have enuf, now $1’s were applied , smh . Finally, she died June 11, finally got house sold ( lost $1,000’s of dollars ) Jan 26, 2 days b4 , another sheriffs sale, had them give me $7,000 check for funeral home, $1,500 for this that I was running to pay that. It was in my name, my social, so they didn’t care. My mom had liens on that house, $1,500 x 3. My sis; I coulda got $125,000 for that house , really? Me: why didn’t you,? sis: everybody listening to you. Ima nurse, they drilled in my head , documentation. Everything was documented, 7 sibs got copies of all. From mortgage company to selling of house. They still talking bout S… 21 yrs.later . I hadn’t lived in that house, in > 20 yrs. To step in& do anything. Only thing I was thinking, this lady had this house 23 yrs, I kept thinking , we need to pay $7,000 balance on that funeral. It was a hot mess, I had to run 2 months, getting this that legal paper, going to court( alone) finally in Oct ( from Aug) got lawyer.

    Man, this is sad. If this man was bi-polar, but once they get off the medication for an extended time, their behavior is extremely erratic. Yeah, if they were together that long, who knows the craziness she endured. The family was wrong, no explanation needed, just wrong on every level.

    If someone dies without a will, the next of kin is automatically the whoever the deceased is married to. I'd feel for the family if they were really struggling to come up with the money, but they can't just take it like that irregardless 🤷‍♂️🤷‍♂️🤷‍♂️

    A Living Trust is the way to go with any assets, big or small, you intend to leave to your heirs, including your spouse and children, grandchildren, etc.

    The funeral home should hav3 been liable became they illegally accepted money from the family when he had a wife. She is the next of kin by law and she was the only one who had the right to bury the husband.

      I work for the state and I had to deal with funeral homes.
      Let me tell you something these funeral homes do a lot of fraudulent things behind the scenes including falsifying documents to cover up
      Their mistakes

      Yes and also growin up alot of folks PRETENDED for a check you didnt need too much proof or dr referrals like you do know. I remember bein 5 years old n my aunt went to the public aid office n acted crazy n she got her benefits on the spot 🤦🏽‍♀️

Every box don't have to be high end. Most people want to be sent off in lavish luxury. But if you not thinking about life insurance or paying for your own funeral.     Whew I can tell a lot of ya'll don't know how the law works. Being the wife takes precedence over EVERYTHING. Everything they did was outside of the law. They should've put their feelings about her to the side and worked with her for the funeral arrangements instead of trying to ice her and her children out of the event. Smh.

      A will is ALWAYS contestable. In biblical law and established U. S. law, spouses come before family of origin until the marriage has been dissolved LEGALLY. As the OP @holy6142 said "they did what they HAD to do" to break the law.

    This is sad all the way around. If she did have him arrested for domestic violence, maybe he shouldn’t have been being violent towards her??       @@PrincessZaire100No I agree about that. My buddy would've never done anything like that, he's a good guy. His family owns the funeral home which is quite literally up the street from my house. I think his parents mostly retired to Florida or something like that years ago, leaving it to him and his sister. We're the same age so we grew up together, going to school together and everything. I'm actually really glad to have had him as the funeral director: he's a really good guy, he does a really good job of it and he's a good friend.

    This is sad but true. It happened to me. My Daddy had been gone 7 weeks and I didn’t know. I’m the eldest of 3, but his mom took over everything claiming she couldn’t reach me, which was a lie from hell. I talked with her 2wks b4 he passed. Long story short, my kids & I never got to say goodbye to him, and she magically found me when it was time to sign for the insurance check, she needed my signature to get her money. This messed me up for years. This truly was a true meaning of money being the root of all evil!! The wife was the captain as was I!

    I agree with the sister and aunt. First if all he had no life insurance, they were full of drama. At the time of his death there were restraining orders out and they werent even together and on top of that, they had to come together to pay for the funeral. So she wanted the money for what…just to spend?

      Finally someone with logic. She didn’t have any money to burry him & the aunt & sister knew she wouldn’t have given him a proper burial. She was going take that $2500 & blow it. I understand legally she was entitled to it but they knew she wasn’t going to do the right thing. I wouldn’t even trip because my husband was put away nicely & I didn’t pay a dime for. Also the sister give her $1200. She actually got more.

    She should be suing the funeral home as well next of kin is the ONLY one who can proceed with making arrangements I had to teach my cousins and the funeral home this lesson by winning a lawsuit when my father died my cousin lied and said she was his sister my father was an only child and Im his only child he never married they had to pay punitive damages as well.

      I agree. There was no evidence that the money did not go towards the funeral arrangement. What efforts did the wife make to take charge and get the arrangements made? She took the 1k that was offered. When exactly did the outrage over them taking 2k occur?
