  • On May 16, 2024 around 1:11 AM, Officer Aaron Font with the Hoboken Police Department observed a 2024 Hyundai Tucson fail to stop at a stop sign in the vicinity of 12th Street and Madison Street. He initiated a motor vehicle stop at 1200 Monroe Street. He made contact with the driver, later identified as 27-year-old Nicholas, and detected the odor of alcohol as he was speaking with him.
He asked Nicholas if he had been drinking, and he acknowledged consuming alcohol in Jersey City earlier that evening. Officers Joshua Campoverde and Shawn Sodora arrived on scene to assist shortly afterwards. Officer Font also requested an officer who was certified in field sobriety exercises to respond, and Officer Daniela Simone also arrived on scene.
Officer Simone started with the Horizontal Gaze Nystagmus (HGN) test, followed by the Walk and Turn and One Leg Stand tests. Nicholas failed to perform the field sobriety exercises in a satisfactory manner. Based on his erratic driving, the odor of alcohol, his admission to consuming alcohol, and his inability to perform the field sobriety exercises in a satisfactory manner, Nicholas was placed under arrest for driving under the influence.
He was transported to the Hoboken Police Department for further processing. Officer Simone administered the breathalyzer test, and the results indicated a BAC of 0.16%, which is double the legal limit of 0.08%. He was released to his sister at 2:52 AM pending his court appearance after she signed the Potential Liability Warning form on his behalf. He was issued the following summonses: Operating under the influence (39:4-50), reckless driving (39:4-96), and failing to stop or yield (39:4-144)

The New Jersey Supreme Court has previously affirmed in Salzano v. North Jersey Media Group, 993 A.2d 778 (2010) that “The fair-report privilege reflects the judgment that the need, in a self-governing society, for free-flowing information about matters of public interest outweighs concerns over the uncompensated injury to a person's reputation.” This video advances a compelling public interest. The summary of events was based on records that are “open to public view through open access to public records” as defined in the Salzano case. In Ramos v. Flowers, 429 N.J. Super. 13, the Appellate Division of the Superior Court has also affirmed the right to film law enforcement interactions.

8:33 Yes ma’am?! Officer “Daniella” certainly has a distinctive voice. This fella seems to have had an interaction with this cop only a few nights prior. Guessing, that also involved him being inebriated. Not sure he’s the right rep for liquor distribution as their theme is DRINK RESPONSIBLY.

I just don’t understand why you wouldn’t call an Uber?
You can stay in the club longer, get into a warm car, and be chauffeured right outside your home.
People drinking and driving need harsher punishments.
Too many innocent people get injured and killed each year from these selfish idiots.

DUI could of easily been avoided. He drank at Light Horse Tavern around the corner from the Essex St Light Rail Station in Jersey City and got pulled over looking for parking on 12th St, three blocks from the 9th St station in Hoboken. Was pointless to drive.

While it's true 1st DUI's are not criminal in NJ, penalties are actually much stiffer than many states. Here in FL, my neighbor is on his 5th after violating his interlock orders and smashing into parked cars. He jokes his biggest punishment are his insurance rates. Most of the nation treats drunk driving this way. Even if you kill someone driving drunk the sentence is often less than selling drugs. #BrokenSystem

I understand cop’s need to look for drunk drivers to arrest.
Some cop’s really get off when they suspect they have an Oder of alcohol on their breath.
The cop gets all excited and can’t wait to get the dizzy driver performing during a FST.
Cop’s love to sit around the donut shop and relive the experience by giving a play by play breakdown to there fellow cop buddies.
I can hear him now “ and when I started to put the handcuffs on him he pissed his pants and cried for his mommy “ ..

@@FM19MONTH Yeah it’s all a big pile of crap in today’s world with some law enforcement as well as the law breaker’s.
It seems young people are using what they see and learn on UA-cam and other channels on how to treat the cops.
And many adults are dealing with mental health issues making the job of law enforcement challenging.
