      As an EU citizen you should register your intent to reside within 90 days.
      183 days is about fiscal residency which is a whole different kettle of fish.

    Hi - I feel like there's another paradox in there. You need an NIE to get an apartment/address and you need an address to get an empadron and you need the empadron to get the NIE. Right? How would you solve this?

      Just one slight error there. You don’t need to be on the Padron to get an NIE, you need it to get the TIE. So there’s no paradox.

    What if you are employed abroad but want to live in Spain?
    Does the proof of healthcare cover mean a private insurance, or could it be obtained from the national healthcare facilities in your country of origin?

      Hi, good questions.
      Yes, with an EU passport you can be working elsewhere, there may be tax and national insurance questions to check with your employer and the Spanish authorities but it’s allowable.
      Healthcare cover needs to be with a company that has a Spain compliant policy, hospitals and doctors in Spain are affiliated with certain companies so it’s best to be with the company that your local hospital is connected to.

    my question is = if you are doing the application for yourself and a family member who lives with you, does that family member have to be present at any appointments if you have all their relevant documents. thanks.

      Yes you should both be there. There may be exceptions to that rule if you have power of attorney, I’m not totally sure, you could ask Chris on the live show next week.

      thanks for the response. that's a shame would've been a lot easier in my circumstances to do it myself. I look after my disabled mum so would've been easier to leave her with a family member and went over and got all that out of the way first.     I am an EU senior citizen, not working. I am only register and register for NIE, not residecy because they asked me to have private insurance wich is very expensive for my age, €180/month. I have a tarjeta sanitaria that I renew every 6 month since I have an EU medical card issued by my country. They do not accept in Alicante state insurance, only private insurance. What a pity!

    Hola Skatz and all the You Too Spain Contributors. I find your videos very helpful. I've got a cunning plan. As a retired, single, Irish (EU) Citizen living in the UK, can I live in Spain for the six months over winter (October to March, less than 183 days) without having to pay tax in Spain? I will be living in long term rental accommodation in Spain. I will not be working in Spain and I will be living on my UK savings and pensions. I will be spending April to September back in the UK. I look forward to hearing your advice. Keep up the good work Skatz. Hasta luego Tom

      Hola Tom. That is indeed a cunning plan. Officially if you want to stay for longer than 3 months in Spain you should register as a resident. However, this is difficult for Spain to police as you could be travelling around the Schengen Area by land without crossing an ‘outside border’, and frankly they’re more concerned with non EU citizens breaking the 90/180 rule. What you need to be careful with is the 183 days. The tax year is Jan-Dec so make sure you don’t exceed the 183 days in that period. Also, while you may be under the radar as an EU citizen, if you rent a property long term it may appear that you’re living here, which could cause an official to ask questions.
      Driving, car insurance and travel/health insurance might also be tricky areas for you.
      Brits used to do it all the time before Brexit. And boast about it. Probably best not to do that.

      ​Thank you for getting back so quickly. This is really helpful. That leads me to my next question. I understand I need to register as a resident after 90 days in Spain. But if I leave Spain after 85 days example and go back to the UK for a week, so that it is registered that I am outside the Schengen Area, will the 90 day clock reset when I come back? Thank you for the tips on driving and car insurance but I will be going to Valencia and I don't intend to have a car or drive in Spain. As regards health insurance I have already got my UK European Health Insurance Card. I will back it up with a Private Health Insurance Plan.       @@tomcrotty7708 well, as an EU citizen, the Schengen 90/180 rule doesn’t apply to you. Your 90 day limit is a Spanish residency rule. It’s said that if you leave Spain for a few days and return, that ‘clock’ resets. But you don’t get passport stamps and there’s no chance of getting thrown out of Spain for overstaying because EU law gives you freedom of travel and work.

    Hey! Got a few questions about registering as autonomo as an online tutor (I have a PhD in physics/biomterials):
    I'm Polish, trying to register in Valenica.
    I have already:
    NIE (just the number on a paper stamped by the immigration office)
    Padron in Valencia
    Private health insurance that covers me in Spain with no co-pays
    Spanish bank account (with upwards of 12k eur on it)
    EU passport/ID card
    I read that I have to go to the tax office, fill out a 037 form, and then bring documents from the tax office to register with social security. Then I can register as autonomo.
    After have all of the documents I listed above plus the registration as an autonomo, will that be enough to become resident here in Valencia, even before I have acquired any income or clients? Or do I need to show that I have already earned money as an autonomo and show that I have a certain lump sum/regular income from my self-employed work? Not sure what financial situation is expected of me.

      Hi, you have enough with your savings in the bank for the financial requirement to register, but it always helps to show you can support yourself so take proof of earnings too.

    If you're an EU citizen but want to stay longer than 90 days (but not much longer - anything from 91 days to less than a year) then what would you do? I'm guessing you can't get a permit as that requires proof of residency with a rental contract etc.

      You can stay for 90 days, pop over the border and stay two nights in a hotel, then stay another 90. If you stay in Spain longer than 183 days in a calendar year you’ll become a tax resident

      @@youtoospain but how would they know you'd left Spain? If they don't stamp EU passports or even have border checks if you're going to say, Portugal or France on a bus or train.

      @@osantiagues keep the travel tickets and hotel receipts as proof. You’ll only need them if you’re challenged on it, but EU citizens are rarely policed on the 90 days.

    Hi! Thank you so much for the information! I have one question, hope you can help me with it.
    My boyfriend is from Belgium and we just move to Spain and we had the empadronamiento last week 😊. The fact is that he was working in a Belgium company and as they dont have headquarters in Spain, to keep the job they offered him to work as a freelance, so he will be “self employed”. I understand that he needs to do 2 procedures? First the NIE and then the UE Citizen Registration in Spain? Did you do all this paperworks with a lawyer?

      Hi Nathaly, there are 3 procedures for him, first the NIE, then register with Social Security (which gives you both healthcare cover), then register that he’s resident. What passport do you have?

    Could you please update the description with the links? I can see your generic links only, the forms links and others don't seem to be there. I'd to know the tax office link to pay for the registration.
    I'm on the same situation as you/wife were initially, me and my son are EU, wife is British.
    My sole question at this stage is how would get empadronado if you still don't have a long term (12 months) contract? Although a good idea I don't see the empadronamiento been mandatory for residency applications for both EU and EU spouses, is that correct? Could I apply to the residency because that has a 3 months deadline, and get the padron later on?

    Hello and thanks for the very helpful video. I have a couple of questions I was wondering if you could help me with. I want to relocate to Gran Canaria. I applied for an Irish passport which I now have. I then made an appointment at the Spanish consulate and applied for my NIE. I am just waiting for that to be sent to me. I want to rent an apartment and will be working when I get to the island. Problem is no one will let me an apartment without a work contract and without somewhere to live I can’t apply for residency, bank account etc. and it will be impossible to work with no where to live. In a bit of a catch 22. Any advice?

      This seems to be a common problem on the islands where property is in shorter supply. What I did (on the mainland) is provide a large deposit of 4 months advance rent on top of the deposit to seal the deal on a rental contract. It was a good persuader.

      Depends on their income. The rate changes the more you earn. The base rate is 19% though.

    hello again Skatz, thank you for your video, it was very helpful. I have a few questions if you could answer to me:
    1) Do I need to already have an NIE and write it down on the EX18 form? If I apply for an EU registration certificate will they also provide me with an NIE, so i won't have to do two procedures?
    2) I'll be a student in Spain so I'll need proof from the institution that I will attend (which I already have that) and health coverage. Now concerning the latter, while I do have my European Health Insurance Card (EHIC), unfortunately it expires two months from the time that i'll arrive in Spain, and I'll have to renew it. I'll stay in Spain for at least 8 months. Renewing it is not difficult but it means that i wont be covered lets say for about 1-2 weeks till i receive the new one from my country. I have already contacted the responsible authority in my country and they can't issue me a new one till the other one expires or is close to expiring. Do you think this would be an issue or should i wait till i have the new one that will last for a whole year?

      You’ll get allocated an NIE at your residency appointment so no need to get one in advance.

    Hi all. Another EU & non EU spouse question I'm afraid.
    I understand that an EU citizen can obtain Spanish residency in a day and the the spouse can on the back of theirs.
    My question is, do these residencies need to be renewed in the same way as the NLV requirements, as in after 1st and 3rd year or are they permanent, needing no further action?

      Hi Patrick, good question. There’s no renewing, there’s only the change to permanent residency after five years, and for that you only need to show you’ve not left Spain for more than 6 months each year.

      @@vktz10 Bank statements is usually the best way. They can show spending in shops which shows you were there, so it’s a really good idea to use your bank card regularly.

      @@ScenicWay that’s a tricky one, your residency requires you to have an address so you need to choose where you really want to live first, but that could clash with your need to get your residency card quickly. Can I ask why the rush to get it?

    Hi there, so I intend to move to Spain, I will be moving likely with a) my Irish job b) no job and hope to find work in Spain. Does not being employed affect the residency application? I am an Irish citizen. Our intention is to move from Ireland to Spain, my partner is Brazilian so hoping she can join me as a family member (we have joint lease, car insurance, bank accounts but are not married). Would the process be approximately 1. We move to Spain, here on a tourist visa 2. I sort out the residency for me. 3. We present to an immigration service in our local police to apply for her to get residency as family member? Thank you for your advise and videos :)

      Not being employed when you arrive in Spain isn’t a dealbreaker if you have enough savings in the bank to show you won’t be a drain on the state.

    Hello
    I'm preparing the documents for my application, and I'm trying to figure out how to prove my source of income. My employer is located in Denmark, and my wages go into my danish bank account.
    Do you know if it will be enough if i bring my last 3 payslips, or should i bring a statement from my bank with for the last 3 months? Do i also need to get these documents translated into spanish?
    I guess my work contract should also be translated into spanish?

      I would take 6 months worth of payslips and bank statements. The statements just need to be stamped by the bank, I would have the contract translated though. But check with Chris’s office to be sure of this, let him know which part of Spain you’re in too. info@upsticks.es

      We have changed our tactics slightly. We have moved to Germany to work for a few years, I’ll then apply for dual citizenship here so I get a German passport which will make it much easier for us. We don’t really want to go down the NLV route.
      I’ve lived here in Germany before and have German college qualifications so that makes it better for me. 😊

Me contestaron que todos los documentos están en regla solo nos faltaría certificado convivencia que incluye a mi marido también . Mi pregunta es: como hacer esto si el está en Pakistán?     I have an Irish (EU) passport and a UK passport. I am looking to retire in Spain and have sufficient pension income to qualify. Can I use S1 form from UK DWP to qualify for health cover as opposed to having health insurance?

    Hola! Do you know if it is possible at all to get residency, if I do not have an address in Spain? I am living in a motorhome, and everywhere I try to find information it says, that Padron certificate is necessary in that process. I am an EU-citizen.

      You do have to have a long term address so a motorhome or caravan won’t suffice even if it’s parked in a campsite. Do you have any friends who can put you on the Padron at their address?

I've been here only for two weeks now, so I don't have any friends 😁 I would like to be here for like 4-5 months before returning to Finland, and if circumstanses are favorable, then most likely to come back for next winter. So far I have liked a lot of things here, but at the moment I would not like to settle down permanently. Thus I feel this 90/180 rule to be a bit frustrating, would be so much easier if 180-day consecutive stay was allowed!

      @@samppuli you’re an EU citizen, you’re not constrained by Schengen 90/180 rules. They’re only for non-EU citizens. Drive around a bit and pop over the border for a few days, make sure you buy something in France or Portugal to prove you’ve not been in Spain all the time.

      @@samppuli well, it’s unlikely to be a problem as long as you don’t spend more than 183 days in Spain within a tax (calendar) year, or any other EU country, because you’d become a tax resident.
      As an EU citizen you’re protected by a charter, you have freedom of movement. Spain has 90 day residency rules, but it doesn’t seem to be policed heavily with EU citizens, as long as they don’t take the p*ss. If I were you I’d travel around anyway, visit Portugal too, the more you move around the easier it is to prove you’re not intending to settle long term anywhere and break any tax laws.
