    This was fun to watch, almost makes spending an entire day and 30 emails over this worth it.
    For anyone counting-I’m still banned, and chargeback is pending. I LOVE the idea of the repair community coming together to build an even better version of game console software TOGETHER! Can’t wait to get started, right after I look up this WinRAR stuff….

      Sorry this happened to you and best of luck with the chargeback! You wrote such a thoughtful and way too considerate reply. :) If he actually believes in his "DRM" he should be fine "open sourcing" it. I've just never heard of any serious software developer being so gung-ho that is solution is infallible, especially on different client environments. As I snarkily commented earlier, one could prolly shasum the installer files and the installation and show nothing's changed and make him look like the mug.

      On that note, while this is not super relevant, I hope the Xbox 360 modding scene gets resurrected sometime. A modded Xbox 360 is already such a powerhouse of a system. It would be so awesome if it received some more love on the emulation/general software support side! Right now, it seems all the devs have left. :(

      That smells of the the Brittish post office thing that recently came to light where a bunch of good people went to jail and paid huge fines because the software was broken, but the vendor, who knew the software was broken, kept saying everything was fine.

      If it is more than 90 days since they paid, it is too long to chargeback on most credit cards. Company I worked for lost $5K because the charge was 6 months prior for something that didn't get delivered.

      In her responses she keeps having to "zoom out" to address the problem on a bigger scope than it initially started on. This is very hard for many people, because they just don't understand the wider dynamics of human interaction, so they falter (I know I do too often). But she has this stuff down and can deliver a solid critique KO. Over and over.

      @@gblargg Yeah, it's a real effort to ignore someone deflecting and derailing and to keep concentrating on the real problem. It's a skill I developed in my late 30s and, while it doesn't always help, it makes me feel a lot more confident about my own position and behavior when I'm not getting dragged down and manipulated into arguing about stupid details the other person has contrived as massive strawmen to derail the conversation and deflect all personal responsibility.

    If BwE is based in Australia, maybe a good way to fight back would be for anyone who is a victim of this to file a 'subject access request' under Australian data protection law, to receive a copy of all personal data the company holds on them. This isn't just to inconvenience them, as if that data received does not have any information on the reason for the ban that opens up the possility that the company has not fully complied with the access request (and you can report them to the data regulator). Or if they insist they have complied... you have evidence the ban was arbitrary & unjustified.

    Please Louis please!! Read his terms and condistions! It is just brilliant... I could laugh all day just reading that.
    here are some funny bits:
    "We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion."
    He makes the rules and he changes them however he wants :))))

    You are not allowed to buy the software more than once!!!!!!!!
    But I need to buy it because I have several PCs and one software is only for one PC. Pleaaaaaaaase! :)

      Not that I'm trying to defend this guy but reserving the right to modify the terms is a common clause in these types of agreements. Also they're only preventing purchasing multiple times with different details. The same details (like usual) is fine. Seems inconvenient but not insane.

Unless he's monitoring the IP of where the purchases are coming from, what does he have to go on that they are "multiple purchases?" Seems odd. What if two different people who happen to use the same Wi-Fi buy the software? Could they get banned because that was "multiple purchases" with different cards, names, and emails? It's a bizarre wording that seems like it would need more detail to make any sense as to what he's actually forbidding/trying to prevent.
      Edit: I guess, maybe it applies to multiple purchases within the same "account" or something along those lines? But if that's the case, what's the problem? Is he trying to prevent credit card fraud or something? Seems odd. My name is one of those that seems a bit different when shortened. I also have multiple credit cards and email addresses I use for business purposes. Would I be banned from using his software if, at some point, I purchased another copy and entered a card with a different version of my name and/or using a different, business email?

    the T&C "We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever" does it for me. Over the years ive had so many software vendors bury crap like this into custom license agreements with my employers, when i see it, its terminate negotiations and migrate the product out the business.

      It seems incredibly scary to me that a business can be shutdown overnight (even if temporarily) because some of the software they use has that language in the eula/tos.
      If you were to inform share holders who have a strong minds they will realize it puts there money at risk.

      @@heroslippy6666 its much worse than that. there is "stiffing" clauses in the T&Cs. in the 90's/20's there was a real problem with zombie mainframe app venders who failed to adapt to mid range systems obliterating the mainframe market. they used a variety of techniques to maintain income as maintenance contracts dryed up... to keep the cash flow up they used a variety of techniques... "we noticed you changed your company name... you will need to by a whole new license.... and this is what is going to cost you" "we noticed you have been taken over.... that will be a whole new licence... and by the way its going to priced on the total size of your new owners holding company and everything it ownes" etc.
      the worse offenders were computer associates... it was so bad as soon as CA acquired a product... we would check to see if any of our clents used it and immediately start working with them to replace that product.
      I belive CA was itself aquired by broadcom who decided that what the harware/software market really needs is a good stiffing... i.e. recent events in vmware land.

    Louis, Check the new EU law that passed. 2 points of intrest :
    1) repairing in warranty extends warranty by 12 months AND companies are forced to repair old stuff - no more "to old, buy a new device"
    2) it is now forbidden to install code / software / equipment on devises that affect / stops repairing capability !!
    Hope some of these terms cross thee Atlantic as well..

      hope so, here ford made a connector to the crankcase ventilation so it can release pent up gases, its not something that gets swapped frequently like an oil change every 3k-5k miles, but every two years, the instructions are to literally use a knife to cut it apart when similar fittings on previous models were reuseable and those same connectors are used on other parts of the more current model. it would be like having to break a side view mirror just to realign its position

    This guy is just like Oracle. Their hit squad tried to milk license money from my org for JRE that I downloaded once for some testing, never used in production. They were the most threatening, pushy, a**holes, that wouldn't give up, and kept threatening legal action. Oracle and this guy need to just go away.

      Oracle bought a company I used to work for. My division got spun out as an independent company. We had developed software only we used for internal purposes. After buying the company, Oracle made US license our own software and pay them every month for it, even though Oracle wasn't using it, could not use it, and we were the people who wrote it. We had to pay. It pushed our managers to abandon that platform, which they had designed and built and was effectively their life's work. Oracle never wanted anything more than than license fees.

      Anyone using Oracle et al is only doing so because of hidden kickbacks somewhere, tech support agreements usually. OpenJDK is the same thing, but without a tech support contract, which you don't need if you have access to source code. It's all politics, I was using open source software to troubleshoot networks at an old corporate gig I had. I was chastized, written up, and put on a PIP for replacing task manager with process explorer and using process hacker to track down rouge DNS servers, poison wells, on paths etc. Something about the contract with microsoft. I quit that job the next day, their networks went down, and it took six days to bring up the cold site, and it was a six month old image.

    I don't get lambasted by Google the one time I wanted to try Apple Music.
    Linus Torvalds doesn't attempt to remote into my laptop when I load up Windows.

    I have screenshots of him saying I'm mental. Then he deleted his entire side of our Discord DMs to try and prove it.
    I was a mod/admin in his discord. I agree about 95% with you Louis.. Except the part where you say you don't think he's doing it for money. That's the EXACT reason he's doing this. He's greedy, narcissistic, and paranoid AF. I forwarded what info I could to Jessa in her discord. But, sadly due to the 2 years of not directly communicating to him, and him nuking his mod/admin chats after I left, I couldn't prove much. I'm glad this video is out here now. It's finally time to put my multi year beef to rest. I hope.

      but that presumes that the ToS are even valid since they probably occurred after sale without providing consideration (can't change the deal without providing something).

      I'm pretty sure the OP is correct, even in the USA. Contracts have to be reasonable in order to be binding, contracts can not make criminal actions become marginally legal, a contractual agreement for cannibalism is invalid, etc., etc. "For any reason" may grant the contractor some flexibility, but it does not allow they to behave unreasonably without potential legal consequences. I don't believe civil cases are ever decided by jury in the US, and most judges and arbitrators are not going to be inclined to defend arbitrary irrational behavior without a good reason, because doing so could open themselves up to potential consequences. If I sell you a product or service, and then refuse to provide that product or service, because it says in the contract that I reserve the right to change terms and conditions at any time and at my sole discretion, no matter what I added to, removed from, the ToS, it can't make theft legal. If there was a reasonable expectation of goods or services when money changed hands, then there must be reasonable efforts to supply either those goods or services or a refund. When you take something that someone has paid for, without their consent, that's theft, or at the very least, it's skirting dangerously close to theft, and theft is a crime that falls into the jurisdiction of criminal law, while contracts are a matter for civil law. Contacts can not deflect criminal charges. Even within civil law contracts must be reasonable to be binding. The sky is blue, is definitely not a valid reasonable cause for revoking a client's access to goods which they paid for in good faith, and no judge or arbitrator would entertain such a notion, regardless of what was in the ToS. Does that mean you can't do it, and, then try to trick the victim into believe that they can't complain because of their agreement to the ToS? Of course not, but then just hope they don't take you court, or maybe even press criminal charges against you. If they do, you'd better take a note out of the big corporation's books, and come up with a more reasonable story before arguing your case.

    Borderline Personality disorder, unfortunately, is not easily treatable. It's less about medication and treated mostly through therapy and self awareness. The hardest part is convincing the patient to actually seek treatment. I hope these paranoid software developers get the help they truly do need.

    If in the next few years AAA gaming companies start revoking licenses and banning accounts because people bought games from competing companies, I'm blaming this guy.
    Also, I think we're about half a step away from Apple deactivating iPhones if they're ever hooked up to a PC running Windows, as well as Samsung doing the same thing with their phones being hooked up to a Mac.
    This clown needs to stop giving all these companies even worse ideas than they already have. He definitely needs therapy.

    Years down the line this guy is going to be kicking himself, when he finally realizes it was a small error in his code that misled him into blowing up his business.
    Setting aside the surveillance of dubious legality and absent morality, the real issue is that he attacks rather than suspecting a flaw in himself or his product.
    Paranoia is a dangerous state of mind, needing only the spark of confirmation bias to ignite and self-destructively immolate anything previously suspected.

      If you know about the founding of Fairchild Semiconductor.....
      Nobel laureate Bill Shockley basically caused a mutiny of 8 of his best and brightest employees. Shockley Semiconductor went from being an encouraging upstart to being the corporate equivalent of East Germany, through his own obsessive paranoia. The situation ultimately got so bad, he forbade people in different divisions from communicating, all work papers had to be locked up at the corporate HQ, and he even once tried to force all employees to take lie-detector tests because he was fishing for a (probably nonexistent) mole.
      Those 8 guys left en-masse, got funded by Fairchild to start their own company, and with a few years Shockley was out of business (he ultimately sold out his interest to Beckman). He never forgave them for what he perceived as a "betrayal", even though it was pretty much only his paranoia and abusive tendencies that drove them to leave.
      Some people just have the wrong personality to be in charge.

    Fun fact: IDA installs with some c++ runtimes so it's on tons of computers. There is no reason to believe someone actually knows how to use it just because it's on their computer though. That's like saying you installed visual studio to program with so you plan to write your own version of windows to save money. One thing has nothing to do with another. Many people have IDA installed and have no idea it's even there or what it can be used for. He must be parodoid that people will reverse engineer his code to even worry about it. That said all you need to do is hook up a logic analyzer on the same pins while using BWE and you should be able to record what his software does from the analyzer side of things. It would be that hard to setup at all

In order to get a handle on things and do so thoroughly, he would probably want to be running some form of system report and software environment report to determine potential confounds to his hashing methodology. Which seems like it's probably unnecessarily complex if it's giving all these false-positives.
      FWIW, couldn't anyone just get on a screen share and run a hash of the executable and show him nothing's changed? Shoot, 7zip has a built-in ability ot do an shasum on a contextual menu, or. GNU tools on WSL can do it, or Cygwin. Frankly anyone who seems so confident in the execution of their code on very different environments is a fool. Even something like Docker isn't fool-proof.

    My government just struck down a bill that would have required farm machinery vendors to provide repair manuals or sell farmers parts, software or other tools that can be used to repair the machinery out of concern that "the vendor would just open across the provincial border anyway".
    I'm seething. This isn't the company alone eroding our rights, it's my own government!

      Sorry to be pedantic, but you don't need Ring 0 (kernel level access) to see what apps are installed in Windows OS. Only need Administrators group privileges and standard API calls. Kernel level access (Ring 0) would be for a rootkit malware to avoid antivirus or similar actions where the author cannot rely on OS API calls to get the job done.

    People who wanted to pirate the software wouldn't have bothered paying, and they wouldn't have bothered dealing with you by email either. People who wanted to resell the software especially wouldn't because connect themselves with a paper trail to your software, destroying their own plausible deniability. The reality is if someone wanted this software for free, they'd have it for free, and there isn't a god damn thing anyone could do to stop them. Every software payment should be viewed through the lens of a donation and a pledge of support, because of just how voluntary it actually is. Acting entitled and predatory is a surefire way to lose that support. The only reason large corporations get away with that nonsense is because other large corporations are forced to pay for the software to avoid obvious lawsuits. Major companies are going to have an extremely difficult time pirating several hundred copies of something for all their employees without getting caught a sued. This problem practically does not exist for individuals or small businesses with only a handful of people. Value your users or devalue your software

    I've also purchased Linux, Red Hat specifically, back in the mid 90s when I was getting into computers (and in my early teens). I did get a 2 inch thick manual with it, and a CD Rom which would have taken a week to download on a 33.6K modem so it was definitely a good purchase. I don't think it was really all that expensive either.

I was never on his side per se but I don't like seeing someone get hammered without proof and this video provides that proof. BwE obviously has a problem and has gone way too far in protecting his IP and whilst I understand some of what he does I can't condone it.     We need a modification of the warranty act that says that the terms of on-premises software licenses (or the on-premises portions of a hybrid on-premises/cloud software) cannot be modified after the purchase. In addition, if the software uses any kind of DRM, that if the company ceases to support the software for any reason that they have a legal obligation to release a patch to remove the DRM to maintain any kind of copyright. And if they don't release a patch within 30 days prior to ending support, the program binaries automatically become public domain without any copyright of any kind. In that way anyone is allowed to legally use, modify, abuse, whatever, them to remove the DRM and all the company is left with is whatever copyright they may have in the source code alone.

      He uses logs from your usage as it's all logged so he wins every case. It's a very unfortunate situation for customers who have had their money stolen. It would be great if enough people reached out to PayPal to explain the situation so that maybe they would resolve cases in the customer's favor in the future. This would go a small way towards undoing the injustice of taking back somebody's ability to use what they bought and paid for. And I think if enough people emailed them, this would change. I feel like the only reason he is even winning these chargebacks is because of a misunderstanding on the part of the PayPal agent making the decision.
      This wouldn't be that bad if he gave people their money back when he revoked access. It would still suck, don't get me wrong, but a refund for the product you paid full price for that he has taken away from you would at least provide some relief or sand off the edge of anger people feel.
      It makes me sick to see people in my own community contributing to the _"you'll own nothing"_ nonsense we've been fighting against the entire time.

      how you word and reason your chargeback is very important. if you just bought it and it immediately started throwing incompatibility errors and you have logs of him denying a refund, you should be able to win.

    You could put it in your terms of service that by using this software, you agree that the software author can come to your house and take any of your stuff that he wants... but that would not make it okay to actually do that. Just putting something in the EULA does not mean it is valid. It's valid when a judge says it is; until then, who knows?

    IDA is a disassembler and debugger and is often a tool of choice when reverse engineering software. Some software, usually games but other kinds as well, will scan running processes on the computer and hash the informaiton about each process and send it back to the developers. This may be a flawed detection scheme especially if the hashing is weak and results in a high probability of "collisions" (when multiple entries have a like hash code). From what I've seen, developers which use this of similar techniques usually have some mention in their Terms of Service or End User License Agreement stating that they scan the user's computer.
    I hope a (F)OSS solution comes about as a result of all of this.

    I've done developmental research in engineering, and one of the early "ethics lessons" boils down to understanding that you will not be able to absolutely control how anything you develop ultimately gets used. You need to be OK with that before you start work on a project.
    This is especially true of things like projects that have military applications, and even more so if they have potential offensive capability. If your sponsor is, say, a branch of the armed services, you have to be aware that if you develop something useful, someday, someone will use it in a conflict. If you're not OK with that (and you don't HAVE to be OK with it), then don't do the project. (see also: "Metal Gear launches nukes???? Nooooooo!")
    Military projects might be an extreme case, but it's still the same, whether you're an arms designer for FN or a guy making blenders at Hamilton Beach. Once the product goes out into the world, you don't get to dictate how each customer uses it. You can try to cut down on misuse, but ultimately you don't get an absolute level of top-down control to audit each customer - nor should you. You have to accept that you will never have that level of control to prevent ALL uses you don't like. (e.g. If you work at an auto maker, you'd prefer that the car you build only gets used for benevolent purposes, but whether you like it or not, someone's eventually going to use one as a getaway car, and someone's going to end up in a nasty accident in one as well.)
    Apparently this guy at BwE didn't get that lesson, and he's trying to enact dictatorial control over his product. It's immature, and unrealistic.

If I ever need a PS4 and/or PS5 repaired I will be asking if they use his tools and will not give money to shops that do.

    I've been in contact with software distributors before (usually coupled with hardware), and it has been my experience that most of them will bend over backwards to accommodate you. Even if we own a perpetual licence, and aren't currently getting any money out of us right now, they'll still bend over backwards to make sure our decades old hardware continues to function flawlessly.
    As such, we may purchase a software upgrade, or even a hardware upgrade later down the line.
    I can't say we really recommend this software or hardware to anyone, as it was in an Education setting, and most of it isn't the sort of thing the average person will want, but we've never said a bad thing about any of it.

    Adobe, used to make some good software, for a good price... now they still make good software, but the price is insane. It's one of the few softwares that I regularly use, which I pirate on principal

    He’s got a bunch of weird stipulations in the terms of service too, like you can’t run any of his software on a virtual machine, has to have a connection to the internet and to his servers at all times. His software gets flagged as a virus by most antiviruses too, weird…

    Can we restart using the word "stiffing" to describe what BwE are doing to their customers.
    i am old and one of the time consuming issues i had in the 90's was mainframe app venders ripping off their remaining customers. This was the name for this activity which nicely captures the contempt we had for the businesses doing this.

    It is interesting that people consider terms of service binding, since they are a change to a purchase after the fact without providing "consideration". What consideration is provided? Usually software updates are required to uphold the sellers already existing side of the bargain... I understand the fear of what happens if all eulas are suddenly voided, but they need to follow proper and reasonable legal practices like any other industry or this kind of nonsense will continue.

    As a complete noob/novice in software development, this is ridiculous. In my CS degree my instructors drilled into me “all software is buggy or has problems and test test test” make sure to test your software based on user inputs add features and make sure you provide features users want that fit within the scope of the project. Him saying his DRM isn’t buggy or flawed is insane, anything can be broken and flawed. I fail to understand why he isn’t using a log in credential system like Apple uses for GSX. Who knows maybe I’m just talking out of my ass but I always think every script, program, or even line of code I write is flawed and can be improved somehow.

      even the wheel has been improved, car tires are actually quite improved compared to the general consumers have on their cars right now, its just that what they have is the most affordable both for the manufacturer and the car companies.

    Instead of creating a dongle, just register a specific device the user chooses. Can be a USB stick, can be a GFX card, can be anything. Just has to be present on the local machine for the software to permit usage of itself.

    Automatically giving refunds to people that get their license revoked wouldn't fix anything. That's not how money work. If I pay for something I pay for it because I decided that the product/service I'm getting is more valuable to me than the money I'm spending. If the seller accepts this (by taking my money and giving me the product) they don't get to undo my decision later.
    If I buy a fridge and fill it with food that needs refrigeration I expect to keep that fridge. If someone from the store I bought it in comes to my house, takes the fridge and gives me a refund then that's not acceptable. I didn't want to return the fridge and I got a bunch of food that's gonna spoil. Not to mention that the refund most likely wouldn't be adjusted for inflation.
