That's only true for trademarks, not copyrights. With copyrights, you have discretion. The design of the shoe is a copyright, not a trademark, so they're not required to sue.
As a graphic designer I constantly take original ideas and redesign or spice it up to make something new. I would never copy and paste and call it my own. However the general shape is always there. The rest of the design is all me. This is like if Nike had a trademark on baseball caps (they wish). How many different ways can a baseball cap look? The general shape is always there, but materials and designs will set different baseball caps apart.
To many people think they have a "brand" because they are legit copying about 98 percent of the look and design and having it made in china...how about american made Nike products or counterfeit?
Nike has some legitimate gripes here, but this is shoes and it's just weird to me that people collect shoes. Derivatives that are stealing the same look and feel of the original design are as problematic as replicas, to me. On the other hand, overly expensive items are going to be cloned and I have little problem with the market exploiting some of the deliberate scarcity issues created by the big guys.
There is a difference between "stamping out their competition" who would be Adidas, Puma, etc. However, this kid this taking a well know design and established brand in order to make a profit. If he is such an incredible "artist and designer" why can't he develop a shoe that is completely unique?

Well it is no longer copy and paste, or laziness. Since it is being changed from C to P. I remember when Apple sued Samsung for curve of their smartphone on which the judge dismissed the st_pid lawsuit, as they stated Samsung copyright their iphones.
