      Agree 100%. Problem is the law. Once that 30 day window passes the law considers them residents. If you catch them on day 29, then you can press charges for breaking and entering. That is my understanding.

      Nice idea, but the real landlords or owners never see the squatters until they have taken up residence in the home. One solution would be to require lease paperwork to be notarized. Costly though for real renters.

      That's what I was wondering about. If someone breaks into a home in a Stand Your Ground state, can they not be shot by the homeowner? Even if the homeowner is not actually living there? And I don't know if Florida is Stand Your Ground.

      let me explain. if you walk into your home and notice a squatter and then call the cops saying there is a squatter in your home. then shoot him.. you will have a very hard time when it comes to court. because you were stupid. you just admitted that you knew it was a squatter, not that it MIGHT have been an intruder.
      if you don't call the cops and then get into a yelling match with the squatter and let the squatter make a move towards you, you can shoot because you can claim "but officer the person came at me in my own home, i was scared for my life." .. no way to prove that the was no physical danger. not very likely that there were cams in the house. now if you are stupid and tell the officer "but officer the SQUATTER came at me" .. the officer is going to ask how did you know it was a squatter? .. you were stupid and now you are screwed.
      now why do you want the squatter to come at you? simple. the squatter might have a web cam or something running that you don't know about. let the idiot come at you.. then well.. you get the idea.
      i am not an attorney. but pretty sure if you check with an attorney they will tell you the same thing.

      Hotels are a business renting rooms out for travelers and tourists whereas squatters are invading the private property of an owner. As long as a hotel guest pays his or her hotel fee, does not create a ruckus or causes damage inside the room, they should not be evicted.

      That's not actually true. If the home is currently occupied, then the would-be squatters are just trespassers, and they can be removed by police immediately. If the house is vacant, they have to occupy the property for a set amount of time to have any rights to the property. I looked it up. In some states, it's 20 years. In others, it's 10 years, and in others (including Florida), it's 7 years. Less than that, squatters have no rights except they have to be evicted through the courts, and the problem is that the eviction process is usually at least 90 days, which is a huge problem for the owner. This just expedites that process. Which is good!

      It still beggars belief that anyone can "take over" your property, claim rights to it and clear it out of everything and trash it before being forced to leave by court order with no repercussions.

      ​@@loriar1027That's not true. In many states, including Iowa, a squatter gets tenant's rights after 30 days or once they receive mail at that address. Even if you discover them before then, you aren't allowed to physically evict them. And once they have tenants rights, you have to go through the legal eviction process, which can cost a fortune and takes years. In Illinois, it's that bad and worse. If you invite someone into your home, you cannot legally force them to leave without going through the eviction process. It's called Guest Rights.

    There should also be a law that every lease for property must be signed and dated by both parties AND NOTARIZED. This simple low-cost contractual requirement would probably prevent 99 percent of all phony lease claims used by squatters.

      Insurance is shared risk. This is where everyone pays into a fund to cover losses incurred by someone in the group. Think of it as a Go Fund Me type system. The issue is, rates must rise to cover losses in times of a high number of houses being damaged / high repair costs. You could start an insurance co with your like minded friends and do a better job.

      @@bobroberts2371that’s how it’s supposed to work but in Florida not so much. The lawyers got in with their buddies in the legislature and made it a slam dunk to sue the insurance companies. So much so that the insurance companies were required to contribute to a indemnity fund to pay the suits. All a homeowner had to do was hire the lawyer , then he sent the paperwork in and a check was cut. That’s the entire reason that rates have gone through the roof. People say “What about storms?” There have ALWAYS been storms. If you look up the stats on lawsuits against insurance companies, Florida has 98% of those suits. But they passed laws to fix the problem recently. However in the week before the legislation took effect, over 250,000 lawsuits were filed. So we have to wade through all of those before things start going back to some semblance of normal. My insurance went up 40% last year but this year it only went up $60, so I’m hoping we turned a corner. Wait and see, I guess.

      Not as long as this administration is in power. I am assuming they look at it as housing they don't have to come up with for their influx of illegals.       I know what you're asking, but the laws protecting squatters were not written to protect the squatters, but to protect legitimate tenants. If a landlord decided he didn't want to go through the painful and expensive process of eviction (you wouldn't believe what's involved to do that), he could just call the cops and say the tenants are squatters and get them tossed - so the laws protect actual tenants. The problem is that squatters use the same laws that protect tenants. Worse, many squatters stay in properties for years as the ineffective laws now on the books give them too many options for dragging out relief for the owner.

      It's only considered trespassing if the property is currently occupied when the squatters move in. Like if they move in while the owners are on vacation. It has to be a vacant property to be considered squatting.

      Because laws that come in effect immediately usually cause troubles as nobody has the time to adjust. In this case all of the government agencies involved so policies are created and personnel is instructed so it can be enforced properly.

    I own 4 lots in PCL and have held off for years to build on them due to squatter concerns. As I am out of State, I am at the mercy of the useless laws. Hopefully this will change things.

    So it seems that if a tenant stops paying rent, they are not squatters and therefore must be removed by a lengthy eviction. ALL loopholes need to be eliminated. This is a great start to fairness for homeowners.

      Renters had a legal contact and when they stop paying it is a breach of contract and needs to go court. This is the cost of doing business. Breach contracts.

      ​​@@shantae8247 Yes but going to court over a breached contract can take months or even years to resolve. Meanwhile the renter stays there without paying while the landlord still has to pay mortgage, taxes, and possibly utilities. The system is broken like many in our country and any law that takes the side of a criminal like a squatter or a renter who has breached their contract needs to be overturned in a reasonable amount of time to protect landlords from financial ruin. This happened to a friend of mine during COVID. Her husband died shortly before and they had multiple rentals. They had so much difficulty getting rid of the people who use the COVID law pertaining to not being able to be forced out for non-payment of rent. It went on with some of them for years. She and her family lost so much money during this time. The laws don't protect the owners and it needs to change.

    But why do squatters go for houses from regular people instead of squatting in houses bought by corporations or investors? THOSE are the houses that should be squatted, not the houses of middle class americans struggling to afford their mortgage.

      There was a recent story of a Hollywood Hills (California) home that was occupied by squatters. Several of them moved in, had furniture, were cooking meals, etc… For some reason those squatters were removed immediately. No court needed. That tells me that whoever owns that house is wealthy and very well connected.

    Smart move! It is not fair, nor just that these squatters take over a property that the owner worked hard to pay off or is still paying mortgage on it nor should these squatters have the right to steal what is inside the home that is not theirs. Allowing this is criminal.

    Of course squatters are claiming everything and why wouldn’t they? The law in many states is on their side and they know that it will take several months for them to be legally “evicted”. In that time the squatters live for free in the property, often times causing very costly repairs. You might get a judgment against them, but they will NEVER pay. Politicians don’t care because those squatters are probably voting for them. There was a recent story of squatters taking over a Hollywood Hills (California) home. For some reason those squatters were forced to leave immediately. That tells me that someone wealthy and powerful owns that home.

      @@elysianmuse6260 Trespassing and squatting are different in California. Once squatters have moved in it’s no longer considered trespassing. At that point the legal owner of the property needs to serve the squatter(s) a legal 3-day notice to vacate. This, in theory, gives the squatter(s) time to move out. Once the 3-day notice expires and the squatter(s) haven’t left THEN the owner needs to start the eviction process. The squatters in the Hollywood Hills house had moved in and we’re no longer trespassing therefore, according to the law, should have been given 3-days notice and then served with eviction papers if they hadn’t yet moved out. Then starting the months long eviction process. Instead the police were allowed to evict them right away. I agree that they should have been thrown out right away, but it looks like the owner was given special consideration and didn’t have to go through the long legal process like the average person.

    This agent bought a property from a woman who didn't know how to handle squatters. When did he buy it? He must have known legislation was imminent on squatters. Did he advise his client on the legislation? If he bought it recently he probably got it at a big discount. Seems shifty to me.

      I felt like she was probably in a situation where she just didn't want to have to deal with any of it. She probably felt like she was getting a good deal just to get out from under ownership of that house. I've known people that had their family members die in another state and they didn't have the time or energy to deal with clearing out the house and selling it. So they sold the whole thing at a discount just to get some money out of it and not have to handle it themselves. Maybe this is a similar situation.

      I way looking for this comment. Seemed like he was saying he got himself a sweet deal to take the property off her hands for a discount because he could deal with the issue where she should have had law enforcement on her side so she could make a decision in her best interest not to get out from under it. Wonder how many real estate guys like this are “helping out” elderly home owners by purchasing instead of law helping out tax payers to keep their property safe?

      Just so you know, this law was passed unanimously by the Florida legislature. That means all Democrats and Republicans voted for it. DeSantis couldn't have vetoed it even if he had wanted to. So the legislature gets the real credit. Just saying.

    If someone steals a car the police will run the thieves down and arrest them - because all they have to do is run the plates (among other things) to verify the rightful owner. - It should be the same with “squatters” /thieves, there are numerous ways to verify the owner including county records which police need to have same access to - just like running plates- (and if the people do not have a lease signed by the owner to prove they have an agreement with the owner to live there for x amount of time according to a lease as actual legal renters) and the owner is willing to give a statement to police that the people are not on a lease and are in fact unlawful intruders - that statement should be enough because there are already laws regarding filing false report etc to police that can be used to prosecute the owner if they make a false claim and the owner could also be sued for alot of money for breaching the lease/rental agreement etc- if that were the case so it is highly unlikely anyone would ever claim people were unlawful intruders - BREAKING AND ENTERING- if that were not the case. The criminals 2:07 should be arrested for breaking and entering immediately and prosecuted and sued to pay for the damages and distress they cause to families that worked hard to own the property and pay taxes to community and state that is suppose to uphold laws to protect communities from such crime.
