      Youre making people angry by saying that they had it coming because it's not just Airbnb. Elderly people are having to deal with squatters in their homes when they left for 6 months to find them occupied. People who aren't doing this for a business, but just trying to live.

    A guy I know removed Squatters from his rentals by paying associates to move into the rental as Squatters themselves that basically forced out the original Squatters because they made living there a living hell. Typical within a week the Squatters are gone and the associates move out having done a great job....

    My sister had a rental in Arizona. Squatters moved in. Pay 1 months rent. She went through the courts, 6 months. Then got the eviction notice. The cops would not serve the eviction. They claimed they were to busy. She called me. I did some quick research. Once a tenant stops paying they no longer have a right to the property, and the property owner can re rent the property. I rented the house. I pulled up in the front yard, in my F150. Turned lose my Rottweiler. I had key's. I let my self in. They were flipping out. Called the cops. The cops left. I began dissembling the home. Removed door, water heater, disabled the A/C, the morning of the third day they left and were never heard from again.

    If the judge says "tenant" owes no rent because its not a rental then hes not a landlord and landlord tenant laws don't apply.

      A tenant has a private entrance and private utilities (kitchen, bathroom, etc). Since that ADU was no longer considered a distinct, legitimate rental unit, it reverted to being a "room" of the main property; and the renter would become a "boarder" (as in room & board). Boarders don't have as many/strong of rights in many places, but CA is different. I'll have to look but I believe they are treated most similarly in CA than most other places.

    I had someone try to squat in my Airbnb.
    As soon as I realized what he was doing I kicked the door down and told
    him he either leaves peacefully or we are going at it. He replied “you legally can’t kick me out”, without saying a word I grabbed him and physically threw him out the door with his belonging.
    The next day police came and told me they were notified that I kicked out a squatter. I replied “I have no clue what you talking about, I’ve never had anyone squat in my place”. With no evidence they left and that was it. Nice and easy, no money lost, no violence and no courts involved.

    Since the guest house was built out of the code, the owner can be able to shut off the utilities for the safety of the premise since it was not code compliance.

      The thing is, these nightmare stories often start with the renter saying, "Hey, can I just stay a few extra days? I'll pay you directly." to which the landlord agrees. The landlord then immediately loses all AirBnB protections since they're no longer under the AirBnB contract. Then getting them out depends on the laws where you live. You don't want to be a landlord with a loose contract in CA.

    Here in Phoenix an owner of an apartment building that became a drug trap den and he wanted to get the dredges out. He offered to let the local fire department run drills on all the floors of the building making it unbearable. It worked. Thank you for the fantastic video!!! Keep up the great work.

      My uncle in Fort Worth rented his house to a young couple, by putting up a note on the Police Station bulletin board. He gave it to Police officers at a big discount, and they always were the best tenants, and the neighborhood got a lot nicer.

      We are not saying she is right.. we are saying the landlord started it all wrong, no permits for the ADU, etc. If you are in California (like me), you know that Los Angeles city doesn't give short term rental permits to ADUs. If he had permitted his ADU he wouldn't able to get the STR permit to list on Airbnb. So he cut a lot of corners to make it happen illegally.

    The thing I don’t understand is if the landlord doesn’t have landlord rights and can’t charge rent how is she considered a tenant and how does she have tenant rights? Just per definitions, a tenant is someone who rents a space and pays rent.

      Does it say hot water in the agreement? No hot water then. What about quantity and quality of water? You can turn down the water pressure and or maybe add some stink or colouring to the water. Right now myself I pay low rent and the landlord doesn't like it so I am under a sonic attack, but you can't photograph sonic, and record sonic (sound). So I can't file any kind of complaint because I got no proof.

    My Uncle had some real squatters move into his home and claim they rented it furnished from "Joe Smith" (Not a real name), so he asked for the best advice, then printed 10 copies of a ONE Percent purchase contract for the home, gave one copy to each of his 5 big friends, and took the other 5 to the courthouse and registered them. Then they all took their sledgehammers and sleeping bags and went to the house, broke in the barricaded back door the squatters had got in through, and when the cops got there the men had papers and the squatters had nothing. Cops arrested the squatters for threats. House was repaired and sold in a month. After it was all over, her gave a big barbeque, and 100 dollars, to each friend and burned the papers at the BBQ. (His lawyer gave him the advice.)

    You may not be able to shut off utilities like Internet, but you can slow down the speeds so much that it becomes impossible to do anything online. Just ask a network engineer like me.

    What people keep leaving off this story is that she was booked off the Airbnb platform when her original stay ended. He let her stay on without getting the proper protections: Lease, deposit, credit references, etc. So she wasn't an Airbnb guest at the time she started squatting. she was a former Airbnb guest. He did screw up by not making sure the ADU was legal but also in not getting a lease agreement and deposit. Pretty dumb. That said though, the woman is a leech.

      Finally, someone else mentions it! People keep trying to cite this story against AirBnB or California landlord protections and don't even know the facts. ALWAYS have a contract when you let someone live with you, and have a lawyer look it over, even for some friends--maybe especially.

Plus, you can always deny someone's request to stay on AirBnB. He wouldn't be obligated to justify why she couldn't stay longer

      There was like a week left in the stay and she complained of moistness coming from somewhere. He went in to inspect and told her he would book her a hotel for the rest of the stay so he could fix the damage. She declined saying she was allergic to cats, then refused to move.

      i really dont get that case: IF the guest house has no CoO - it is legally considered a SHED or a WAREHOUSE, right? Yes, you can not "collect rent" from it, but it also means it is NOT a livable space. It's a shed. So how in the world "you cant stop water supply, electricity, heat" etc? It's a freaking shed! I have no obligation to pay for water/sewer in my shed. The fact the CoO is not issued means even the authorities have never confirmed this space CAN be "occupied" (by a human being).

    When I was renting units I always had them sign that all rooms were common areas…that way if they don’t pay rent..I can also have access to all common areas..which is everywhere. Bring my friends over and watch the tv..eat the food…and use the crapper…crawl into bed when they are in bed..lol..they leave after a few days..

    My uncle once had a situation where he rented a tiny house to an old lady, and in a few months some piece of shit went to live with her and refuse to pay rent because "he knew the law". Instead of threatening them, he just went to the municipal cemetery and grabbed from the garbage dump a bunch of wreaths (those circle things with flower things people put on graves). The next day, he drove to the house, hang it all over the fence and went to work. During lunch, he drove back there to check it out, and the door was open and the house empty.
    Superstition is a hell of a drug.

      @@indiannajames8428 My country is filled with VERY superstitious people, like, the type that make the cross sign when then need to pass a cemetery and believe in all sorts of witchcraft (generally, the poorer the country, the most "ignorant" the people are). And nothing scare them the most as death. Brazil is probably the last place on earth were spiritist and african based religions are still practiced in a significant number. The place is a golden mine for charlatans.

      YES... I've been telling STR landlords this, for years! (i.e. MAX 29 day, stay!) Notice how (Rocker fella, Aspen Institute funded) ABB, etc. don't even ALLOW, for this!! They had this ALL pre- planned, years... ago, as par.

    All these rules against a Landlord that he can't turn off electricity/water etc is against law is contradicting to what the judge just pointed out. He's not a landlord to a property that isn't permitted to be rented out. There for, he should classify it as a storage unit and turn stuff off. Two can play this game.

      @@vickynoname9860 I feel that laws protect squatters far more then they do the owners themselves. Owners/landlords shouldn't have to go through hoops to remove a unpaying tenant. What's fair is fair. Pay to stay or don't and get on out. This isn't charity, owners have bills too. Imagine if you're late on your car payment, that gets immediately repo'd if you're late just a couple months.

    This was an incident involving an empty house being occupied by crackheads. A cop told us, dont label the "incident" as a squatters, because sqautters have rights....say, "tresspassing"....then they have a better chance of getting the boot. Of which happened. The cops came in gave them the boot, threatening arrest, they left and never came back.

      I bet if a squatter tried to break in and squat in a corporate property, when they provide their fake lease to the police the corporation will say "that's not from us, we have policies and procedures in place to produce specific leases." Then the police will arrest them for breaking and entering and forgery. A small time individual using a management company probably does not have that luxury. Also the corporate properties can easily take the financial hit from a few squatters, a small time individual cannot. People that think squatters are sticking it to rich landlords are wrong. Squatters only scare off small time individuals from competing with rich landlords.

    I'm finding this hard to believe. Would the judge actually force a property owner to subsidize a non-paying tenant? She could skyrocket his utilities to heaven with a deal like that. Plus, if this ADU/guest cottage is illegal, why would a judge agree it is okay for her to continue to live there? The politicians need to put the brakes on tenants who scam the system!

    The neighbor had the house tented for termites. Deadly poison and all doors and windows were opened everything removed from the rooms and cabinets to eliminate staining and health contact harm from laying on treated mattress. Nothing can survive the process, everything living that needs to continue living has to leave.

    Build a kennel next to garden cabin for small yappy dogs. Feed and play with dogs at all hours of the day and night. Joking aside, I was traumatized by a false accusation by a monthly tenant. Had to hire a lawyer. Lost money on Airbnb rentals and legal fees. Tread carefully and legally on evictions.

    in Mexico i am not so sure about squatter laws concerning STR's . But I do know that there is a guy for EVERYTHING down here . I would pay 4 of the biggest , meanest looking local men to go over to the house and walk right in the house and tell them they have 20 mins to gather up their belongings and get out ... or else . I assure you the problem would be solved . Things are different down here

    I know a guy that will look for rooms that are not up to code (usually a basement) and rent it. He will pay for a few months and then suddenly stop paying. He usually complains that something is wrong in the room and becomes a squatter. The owner that may live in the house or not, then is stuck knowing no one is supposed to be living in the basement to begin with. He realizes he cannot be kicked out because there are no windows or two points of egress (exits). Eventually, when the owner starts to threaten him seriously he calls the fire department and reports the apartment as illegal. He then moves and everyone else in the basement has to move within a few days. He then goes to another illegal basement and does the same thing. He barely ever pays rent and ruins the lives of many homeowners.

    I have an awesome lawyer in Illinois who helps me evict bad tenants. It starts with a good rental agreement that voids the agreement on any bad conditions that could happen. Illinois law makes it easy to evict if the tenant doesn't have a valid rental contract.

    If the court refuses to recognize the owner as a landlord because they didn’t do you things correctly, then they need to stop referring to the squatter as a tenant. Since the property was never deemed OK to occupy in the first place. This is clearly a judge afraid of facing a human rights issue.

    IN THE OLD DAYS, you just notified the tenant that you had to do some repairs to the external doors on the place, you REMOVED THEM and disappeared
    Didn't take them long to figure out they would loose all their shit without doors on the place, and they left. VERY ILLEGAL NOW I assume.

    Renters that play landlords are criminals.
    I planned to use Airbnb on a cross country tour, after trying to get my first one, I gave up on the whole concept because: 1) took too long to secure one, 2) no disclosure of the neighborhood which was one if I left my car there, I wouldn't have had wheels and 3) impossible to talk to anyone with a problem. I decided to sleep in car and shower at LUV truck stops which I highly recommend - their showers are like the Taj Mahal complete with big screen TV (!)

      This isn't a tenant vs owner even though it keeps getting framed that way.
      Most people don't support the tenant even if they are on the "other" side of this argument. The tenant is shady. However, the owner ultimately caused this by repeatedly and likely intentionally failing to do his part. Now he doesn't want to take responsibility.

History is full of people taking advantage of poorly-made agreements--doesn't matter which state or even country. Always have them rebook on AirBnB if they want to stay longer. This would not have been a problem if he'd just done that.

    I (as a sophisticated actor) would rent it to some outlaw bikers legit for a dollar a month with the understanding that there were squatters in the house and they must be willing to coexist with the squatters until the squatters leave then the bikers must be willing to leave. I'd tell the bikers to eat, drink and be merry while they were there, co occupy the bedrooms share the towels bathrooms etc...

      You don't want outlaw bikers unless you're one of them. Believe me. Don't you know any big guys with motorcycles? Or even big guys with big trucks and guns, add in a few big scary dogs. The guys can clean their guns in the living room. It's even better if they have beards and tattoos, but tattoos are just a bonus. They're easy to fake with temps. I know a couple of enormous men with beards and big dogs and guns AND motorcycles, one of whom is my son (who has a flaming skull tattoo on his head) and one is my husband's oldest friend (who's 6'5"). Both are the sweetest guys, but the squatter wouldn't know that. They're loud, they drink beer, they have big gun collections and my son has 5 huge dogs. Sounds like fun.

    Although I am in favor of ALWAYS do things correct and in line with the rules and regulation, it is also VERY frustrating that tenants who "use" the system to their benefit have more rights than a person who paid for his house and guesthouse. ....even if technically its an illegal guesthouse, its still his property and the law should always be in favor of the paying property owner.

    Interesting Sean but you are not an attorney. A good attorney can find a way. One flaw that I see is that if the unit is NOT CODE approved then the permit office can require them to leave. Also AR bb is a contract and she is still liable for the balance. A good attorney will find a loophole.

      I believe every action has a consequence. Personally I would find a quick loop hole and get them out immediately. If I mis-stepped it's on me. That's why I have a business Attorney and wouldn't allow this to go past 1 day. I've been in the business for 9 years and I would NEVER allow a tenant to use the system against me. I would tear the building down bf I allow that.
      It's unfortunate! Had the same chat with colleagues and that guest would be out no later then 4hrs past checkout.
      She used Covid and the amended landlord tenant laws to squat. The host was probably too busy with a full time job to nip this in a timely manner and here we are.
      To all the hosts out there, be careful. STR isn't welcomed so the system will most likely NOT side with you.
      Their are alot of moving parts to this case. I wouldn't be surprised if the court system uses this host as an example. I also will not be surprised if this case is overturned.
      Just Google weird laws in random states, just bc its a law doesn't mean it's not violating a constitutional right.. laws change because they don't work for the collective. Example STR laws.

    If this building is not supposed to be occupied, then it is not supposed to have any utilities going to it, so in this case, yes he can shut off the utilities because they were not permitted in the first place.

    Well if the judge says the guest house is not a guest house because the surgeon never got permits then it's just a box in the back yard and you can turn the utilities off. It can't be treated like a rental if it has not permits.

    I had a landlord in Austin that refused to fix any of the items in the house that were very worn out, such as all of the windows leaking. I stayed there for ten years and took care of the place as it was my own. When I left, he didn't give me my deposit back and said he had to use it to fix damaged items. The items he claimed were damaged were due to his own cheapness and neglect. There were holes in the sheet rock when I moved in that he said "i'll just waive the cleanup fee for you" about..... I repaired them myself even though I had nothing to do with them. He charged me for that.
    I wanted to sue him but i digressed. I don't know what I could have gotten out of the deal or how I could have proven that he neglected the property while I lived in it.

      I just use my deposit as my last month's rent so they can't screw me like that. They're never happy about it, but what can they do? If you leave the place in Good condition, there's no reason for them to steal your deposit anyway.

    There's that new character who went and got a signed lease from the owner and moved in with the squatters. He installed security cameras and basically made life hell for the squatters. In court his lease was recognized over the false lease of the squatters and they were evicted.

    Quick question on that Doctor with the unpermitted AirBnB. If the structure is unpermitted why hasn't there been a notice posted as not fit for habitation by the inspection department and squatters forced to move out, hmm?

    There is a guy in California who agrees to squat in a rental, when the original squatter is not at home. I believe he asks for a rental agreement, but I'm not sure
    If he gets the squatters out, he the collects a fee.
    Since he has just as equal if not greater claim to the house as a "squatters/renter" the squatter can't get the cops to kick him out. He even invites five or six of his big buddies over every night so that he's protected.

    I rented out my basement apartment (I lived in the upper level) and the tenant stopped paying rent. While she was out for the day, I changed the locks and boarded up the windows. I saw her come home later that day, park her car and go around the house to her apt. and then a few minutes later, get in her car and leave. The next morning at 6 AM, cops came to my house and arrested me and I spent the day in jail waiting to get bailed out. She also sued me in civil court for $8K but I ended up settling for $2K plus attorney's fees. I learned a valuable lesson of what NOT to do!
    Now, I choose tenants VERY carefully!

      Your mistake was not going through legal channels. Notice, then 30 days to reply, then forced eviction (removing her stuff, changing locks).

      The basic human right to shelter is protected. You cannot waive your/others human rights. Even if a contract was signed. So existing in a dwelling for any real period affords you the human right to reside. No matter how you got there

    I was taught your roof over your head should be your most important payment. I have a young kid living above me, has a job that pays better than mine, has not paid rent in 11 months! Our landlord is the nicest landlord you could ask for. Anything goes wrong ( which happens rarely) and he is right here to fix it. He's taken him to court several times and the judge just gives him more time to pay and he still pays nothing. Even though I barely make it paycheck to paycheck, I still pay my rent. Sickening. And who does snow shoveling? Not him. He'll watch a 65 yr old woman do it! He never puts his garbage out to the curb. Just spends his money on partying and playing. Lazy is what he is! This world has gotten ridiculous! Integrity doesn't matter I guess.

    Can the owner go to the city and get code enforcement to say the unit is uninhabitable? Would it then be illegal for anyone to live there until he makes the appropriate repairs and gets a certificate of occupancy? It will cost him but she will be out.

    In Texas it’s pretty simple get the eviction which is pretty much automatic then move their sh$t to the front curb.

    If a guest decides to stay longer and wont move out. Can you not just file a no trespassing order for the property? I would think if same day or next day past their stay this should be in your rights?

      Yes, you have ways to get a problematic tenant out, but you need an enforceable contract in place between you and the renter to do that. This guy let her stay without a clear contract after the AirBnB ended.

      I know someone who purchased skunk scent and piped in the scent through a tiny hole he drilled. The person couldn't figure out where the smell kept coming from and vacated within week.

    It's good to hear this perspective on that illegal landlord/squatter situation. I had an issue with mold in my (Florida) apartment's A/C. I called and called. Maintenance came multiple times and tried to patch the problem. I found the Florida statute that said a landlord has to resolve a black mold problem. The tenant can withhold rent and the landlord would get penalties. I wrote a letter to the property manager citing the law and the problem was fixed promptly. The property manager tried to tell me that I was imagining the problem. I said, "No m'am. I've purchased a $700 air purifier and I've doubled up on my asthma prescrption." I reported her to corporate. She suddenly disappeared from the onsite management office. Hmmmm.

    If it's not to code, without a certificate, he's legally not a landlord. The owner can ABSOLUTELY shut off the utilities and start disassembling it, starting with the windows and doors.
