Pre - 2012 you couldn't get Kobe in America, yet people where still paying hundreds to buy falsely labelled Kobe (actually Wagu). That had nothing to do with "excellent marbleization" and all to do with restaurants knowing the market.

Main point is that it's not certified as kobe beef, which also meant that it's quality does not meet the required criteria.
