Kmi na bumili ang babayad ng 10% cap gains . Nakakuha na kmi ng transfer certificate of title mula sa ROD. Sa surveyor na po ipnakatiwala ng seller ang paglabas ng title at babayad lng kmi. Noon 1995 sinabihan po kmi ng mayari na puede na nmin kunin ang aming title ngunit sabi ng surveyor babayad muna kmi ng 80 thou.ang amount pi ng nabili nming lupa ay 5 mahigit na ma 869 sq meters po. Dahil sa kakaposan ng pera hindi na nmin kinuha ang title dahil confident nman kmi sa aming deed of sale. Ngsyong may mga trabaho na ang mga bata ay binuhay nmin ito muli ngunit ang surveyor at ang seller ay patay na at ang asawa ng surveyor ang namahala ng mga titulo. Kailangan daw magbayad kmi ng 100 thou dhil itransfer pa ang title mula sa mag asaw papunta sa amin at dahil ptay na ang magasawa kukuha muna kmi ng kanilang death certificate ngunit hindi nmin alam address ng mga anak. Atty simula ng mabili nmin ang lupa ay nagbabayad na kmi ng landtax hanggang ngayon at noong nakaraan bwan ay nakakuha na ako ng tax clearance at tax declaration.Babayad na lng ba kmi Atty mg 100 thou? Itatanong ko lang po kung paano ang proseso sa paglipat ng ownership (bahay at lupa) sa buyer kung ganito po ang situation:
Ang dating may-ari, ayun sa ipinakitang plan or map, ay pumanaw na, subalit buhay pa po ang asawa. Non-title po ito. Nang ipinakita sa akin ang tax declaration ay anak ang nakapangalan. Updated naman po ang tax at separated na rin ang tax dec sa land at improvement.

Yet, in my case I may want to ask you if I just want to have the Deed of Sale signed by me (the buyer) and the seller. But since I don't have enough money for now to pay for the Capital Gains tax, doc stamps and transfer taxes, as I agreed with the seller, is it okay for me to postpone the notarization of the Deed of Sale in order, also to postpone my payment of the Cap.Gains and related taxes? But actually, I may be able to come up with the needed money within a couple of months and not in ten or more years as what you mentioned as a scenario in this video. Thanks again, atty!
we have same issues, one year na ang deed of sale ko hindi pa na permahan ( one yr ko na fully paid at na purchase yung property).
@@peppersalt9712 kaka purchased ko lng din po ng lupa. At ang ginawa po ng mama ko ay during exchange of payment, nag sign na din ang seller ng deed of sale. Parang nag exchange lng sila ng product. At lahat yon nangyari sa harap ng attorney with another witness from the general public which is yong kaibigan ko. Transparency is the key. Kapag po involved ang malaking pera, secure nio po din ang sarili nio. Wag po kayo maglabas ni piso na wala kayong makukuhang kapalit. Ang hirap pa nman kitain ng pera. Hope ma settle po yan
You still need to notarized it your deed of sale. Then, make agreement for the new deed of sale if you are ready to pay the capital gains tax. Circumstances occur wala u hawak na ebedensya na notarized.
@Gus C, as much as possible do not postpone the notarization of Deed of Sale (DOS), kc ang DOS needed yan para ma-transfer ang Title sa name mo. Pag di mo yan ginawa at binenta sa iba ng seller at yung 2nd buyer naunahan kang maka-kuha ng Title, kawawa ka.
Pwede, gumawa ka ng Deed of Sale na ang petsa ay ilang buwan ang layo para maka-ipon ka ng pambayad ng Cap Gains Tax at DS tax, pero ang Deed of Sale dapat palaging Notarized para may habol ka. Pero tandaan mo, mas pinapatagal mo na di ka nakakuha ng new title sa name mo, tumataas ang risk mo na mawala ang lupa sa iyo. So ang payo ko, Action, action, action.

Good day po attorney, nagpasurvey ang in laws ko recently dun s lupa na ibinigay samin (which we recently constructed a simple house), pero less than ung area ng nasa tax dec namin po bec yun ang napagkasunduan ng in laws ko and yung ktabing lupa ( verbal agreement lang). Ang problema po nmin mag asawa is 300sqm ang nawabas.. ang lumabas s survey ay 508sqm lng ang nasurvey, our tax dec is 820sqm...
Q: do we have the right po to find or demand po n hanapin yung area na nawawala po?
The documents that we have po are tax dec (old and updated CTC from assessors offc under the name ng inlaw ko, plus original copy of deed of sale with notary po).
During the survey since matatanda n ung inlaws ko out of fear n magkaroon ng away ay pumayag nlng sila po.( no documentation or black and white po n naganap).
The land next to us which may be nandun yung kulang is tax dec din po tulad namin.
If the land is unregistered or not yet titled and it is only under Tax Declaration Certificate, the area, descriptions and the boundaries of the land are not precise. This is the reason why when applying for land title you need to have the land surveyed by a geodetic engineer and come out with a subdivision and lot plan with approved technical descriptions from the LMB-DENR, tracing cloth plan, blue print, among others. It is not clear what kind of survey was made that you mentioned. If the survey made was a RELOCATION/VERIFICATION survey with approved technical descriptions from the LMB-DENR, then this is the most appropriate survey, as the main purpose of the relocation and verification survey is to determine the overlapping and conflicting boundaries of adjacent and surrounding land owners. You mentioned that you in-laws had a verbal agreement with adjacent land owner to the effect not to disturb the existing property or boundary lines. As the new owner/transferee, it's a judgment call on your part to maintain the status quo considering that 300 sq.m. area variance is a huge area.
Note further that , if the physical boundary of the 508 sq.m. area has been established already for decades by the adjoining owners , as shown by fence, physical barrier, or raws of trees indicating land boundaries or any visible marker which the adjacent owners have recognized or respected over the years as their property lines ,then this could an indication that the missing 300 sq.m. area actually belongs to adjacent owner. The verification/relocation survey is supposed to address the overlapping and conflicting boundary lines. If the result of the relocation survey supports your position and the parties cannot agree to settle their disputes amicably, you have no recourse but to go to court to settle the boundary disputes.

We went to the engr, who surveyed our lot way back march 2021 amd found out that he has not progressed into any legal changes in our lot since he claimed that the documents submitted by my inlaws are incompletw (which is confusing for us, but somehow an advantage po para ma adress muna namin prob ng location nya).
The engr recomnded to have a RESURVEY to situate the 820sqm area of the lot po.
Just 2days ago we were able to secure a CTC of our tax dec from.the municipal assessors and found out po that our lot is even bigger than the 820sqm writtn in the deed of sale( 840 as per the updated po na documents ng municipal assessors office).
Moreover po, hopefully po maging maayos po yung usapan namin ng adjacent nmin and finally recover our area po.

Hi Attorney, May remedyo pa po ba kung nakabili ng isang maliit na bahagi ng lote lamang (mula sa malaking lote) tapos walang ginawamg Deed of Sale. Ang tanging hawak ng bumili ay sulat kamay na resibo na tinanggap ng bumili mula sa may ari ng lupa, katunayan na may natanggap ang may ari na kabayaran sa lote na binili. Hindi po notaryado. Pwede po ba balikan daw ang may ari ng lote para mag-issue ng Deed of Sale kahit 8years na naganap ang bilihan nila? Thanks so much :)

Kung mga buhay pa ang seller at buyer ay mas makakabuti na mag pagawa na lang kayo ng deed of absolute sale at mag pirmahan uli ang seller at buyer sa harapan ng notary public. Take note na dahil portion lang ang inyong nabili, ay mas makakabuti na fully identified ung portion na binili particularly ung sketch plan , area, boundaries, location, ng nasabing property at iba pang detalye. Pinaka the best ay kung nag pasurvey na kayo at nagkaroon kayo ng subdivision and lot plans with approved technical descriptions galing sa LMB-DENR, at ung mga technical descritions ay particularly described sa inyong deed of absolute sale.
Dapat at pinanood at tinapos ninyo ung video. Nandoon ang kompletong kasagutan ng inyong tanong. For purposes of showing na na-ibenta na na seller ung lupa sa pamamagitan ng deed of absolute sale it may serve the purpose pero dahil hindi notaryado the document is only considered as private document ay hindi ito tatanggapin ng Register of deeds upang ma resistro ang bilihan without proof of due execution, tulad ng pagpapanotaryo nito. Kung hindi notarized upang ma prove ang due execution ng nasabing bilihan ay kailangang dumulog pa sa korte sa pamamagitan ng pag file ng Petition. Maaring mas malaki pa ang gastos sa pag file ng petition kaysa sa pagpapanotaryo nito.

Hello po Atty. We just discovered that our late father had deed of absolute sale of agricultural land of more than 6hectares unregistered in the yr 1957. We checked this in CENRO and found out that he has his own folder that the lot no of that docs was in his name with technical description by the geodetic engr. He also file for free patent application of the same year of purchased but it was not completed. We check with the Assessors ofc but different name ang nag apply ng tax declation in the yr 1962 until up to the present the same name who paid the property tax. May i ask where do we start to claim our new discovered agricultural land from our late father?
Based on your narratives, where the deed of absolute sale of the agriculural land which was purchased by your deceased father was registered in the records for conveyances of unregistered land in the Register of Deeds , there could be a glimmer of hope for the heirs and assigns of your deceased father over the subject property. Otherwise, whatever rights that your father may have under the deed of absolute sale may have already PRESCRIBED in the event that someone else has already claim ownership of the same property and registered the same in good faith.
Moreover, it is not clear whether the free patent application that your father applied refers to the same property that was earlier purchased by him and which application was not completed and approved by the DENR notwithstanding the completion of the required survey under his name with the approved technical descriptions of the subject land. If the same property was issued a Tax declaration certificate way back in 1962 and the corresponding real property tax or amilyar is paid by the person named in the tax declaration certificate, the said individual is PRIMA FACIE considered as the owner of the subject land, assuming that no land title yet has been issued. To further peruse the documents that you may have as regards the foregoing , it is suggested that you confer with your lawyer for further professional guidance as to what appropriate remedies and course of action may be taken by the heirs and assigns of your deceased father over the subject lands.

Yes pwedeng magamit ung inyong notarized na deed of absolute sale sa pag file ninyon ng unlawful detainer laban sa occupants ng inyong nabiling lupa. Take note na by operation of law, from the time na nag pirmahan ng deed of absolute sale ang seller at buyer kaakibat sa kabayaran ng lupang binili, ang FULL OWNERSHIP at lawful poseesion nito ay nailipat antemano sa buyer. At bilang bagong may-ari ay karapatan mong ma-enjoy ang full possession ng lupa na inyong nabili.

Hello Atty. Bumili po ako ng lupa sa Coron, Palawan at meron po kaming pinirmahan na Absolute Deed of Sale for the amount of P500K. Inaayos po yung transfer ng title to us ng real estate agent. However, na misplaced yung Titulo at hindi na po namin mahanap.

Mag execute ng affidavit of loss ung tao na nakawala ng original na titulo and have it filed in Register of deeds(RD) where the title is issued. Ang lupa ko ay may may total na babayarin of about kulang kulang 2K for the past 5 years na hindi ko nabayaran..Noong babayaran ko na sana ang tax hoping na maka avail ako ng tax amnesty, napagtanto ko doon sa treasury office na na subasta na pala yong lupa ko..Kaya ang nangyari, ang buwis ng bahay nalang ang binayaran ko dahil sa lupa na yon nandoon nakatirik ang bahay ko po..At ang isa pang problema noong hinatid ng treasury office agent ang notice doon niya binigay sa dating may ari ng lupa na binilihan ko.At yong dating may ari ang nag perma sa notice..Hindi ko talaga alam na may notice na po ako..Kung pinaalam sa akin o hinatid sa bahay ang notice na yon imposibleng hindi ko mabayaran ang total na less than 2K..
At isa pa attorney pwede ba na isubasta nalang ng city hall ang lupa ko without my signature na natanggap ko ang notice nila..
5 years na hindi ko nabayaran ang buhis which totals to less than 2K...

Hello po sir attorney tanong ko lang po kung valid na po ba iyong papel galing sa brgy. hall bale dun po sila nagpirmahan sa pagbili ng lupa. Sa ngayon po kasi hindi pa napagawaan ng deed of sale kasi ang sabi nasa manila pa daw po ang 1 pang kapatid bale magkakapatid po kasi sila ang pumirma sa kasulatan. Ano po ang mapapayo nyo para mapabilis po ang paggawa ng deed of sale pwede po ba na iyong mas matanda na lng sa magkapatid ang makipag negotiate samin bale sya na lng po ang representative nila para magawa na ang deed of sale? Atty may tanong din po aq... Nagbenta po ang papa q ng part ng lupain namin pero 15 yrs na po at yong nakabili sa part sa lupain hindi po nabibigay ng share sa buwis... Maari po ba namin na kunin uli kasi hindi sila sa gumawa ng aksiyon pra ipalipat ang pangalan ng lupa?
Tulad ng sabi ni atty.wong walang expiration ang pagbenta lalo may Deed of Sale, so di mo pwede kunin. Ang dapat mong gawin ay pumunta sa Registry of Deeds at ipahiwalay na yung naibenta sa Mother Title at pumunta sa City Assessor para ma-update yung parte lang na dapat nyong bayaran na buwis.

Good day po atty..ask lang po ako kasi yong lupa ng lola namin na mdyo matagal ng panahon ay may na i donate na portion doon sa close friends nya ang tanong po namin kasi pareho na po silang patay pero wala pong kasulatan na makikita namin na na donate ang lupa or titulo na katunayan na may legal documents sila. hi sir, dependi po yan sa agreement ninyo both parties. It can be either the seller or the buyer. But pwede rin hatiin both parties.
Ang talagang may shoulder ay ang seller. But sometimes it depends sa agreement nyo kung tumawad u ng super sagad sa price at pumayag ka na sau lahat gastos, no choice ikaw na buyer ang gagastos. But kung walang agreement na ganon, ay si Seller ang mag shoulder po pati capital gains tax.
Depende po sa usapan nyo noong inalok sa iyo ang lupa..

Tanong ko lang attorney, nag assume po ako ng bahay and then yung balance po ay nasa 25 years to pay pa po, ang hawak namin is deed of assumption of mortgage lang po. Hindi po kami nagpa execute ng deed of sale kasi nga po dahil dun sa penalty kasi matagal pa bago ma transfer yung title which is 25 years. Ano po bang dapat gawin para ma secure po kami pagdating ng panahon? Need your light po, salamat and stay safe :)
To secure your property: Punta ka ng Registry of Deed, ipa-annotate mo sa Titulo yung Deed of Assumption of Mortgage, para kung may bibili may ebidensya na nakatatak sa Titulo na meron kang rights sa property. Ang tatak sa Titulo ay tatawagin na Encumbrance

Umiiral pa po ba ang batas sa ilalim ng CARP na kung kinasuhan ng ejectment ang isang magsasaka sa regular court dapat ba itong i-endorse ng lower court sa DARAB o PARAD
Depende kung anong cause of action at allegations ng complaint ng land owner ang mag determine kung sa regular courts ba papasok ang ejectment sa ilalim ng Civil Code at in conjunction with Batas Pambansa Blg. 129 , as amended. In short hindi automatic na pag mag sasaka ang dependant sa DARAB na ang jurisdiction.
Take note pag agricultural land ang usapin at ang cause of action is ejectment of agricultural tenant at ang usaping ay may kinalaman sa tenural issues, ang mayroong exclusive at original juridiction nito ay ang DARAB subject to the following , ayon sa Supreme court, " For the DARAB to acquire jurisdiction over the case, there must exist a tenancy relation between the parties. "[I]n order for a tenancy agreement to take hold over a dispute, it is essential to establish all its indispensable elements, to wit: 1) that the parties are the landowner and the tenant or agricultural lessee; 2) that the subject matter of the relationship is an agricultural land; 3) that there is consent between the parties to the relationship; 4) that the purpose of the relationship is to bring about agricultural production; 5) that there is personal cultivation on the part of the tenant or agricultural lessee; and 6) that the harvest is shared between the landowner and the tenant or agricultural lessee."42In the present case, it is quite evident that not all of these conditions are present.
