    So would we be okay if he comes on a tourist visa and we get married right AFTER 90 days? This is making me so nervous and the K1 visa takes forever and requires so much paperwork!

      @@LisaMarieMJ he preferred to mess around with other people, so I got to keep the thoundsands of dollars I saved for myself HAHA.
      But regarding my initial question, it would probably be risky to do it that way. Better to go by the book and do the K1 visa so there's no risk of getting in trouble or rejected, but I'm not a professional

    Does the 90 day rule still apply to those who is visiting the U.S for the second or third time?? If its my second time in the U.S and I plan on marrying a girl I fell in love with the first time that I visited, and my intent is to marry her the first month of my arrival. Does the rules still apply to me??

      Wait for about 4-6 months and when they ask say you were dating for 4 months and only decided to get married. In normal situations in the US people date before getting married so ideally stay for more than 4 months and then get married.

    I love your explanation on this video...
    Anyway, I have a question on this matter for someone coming to the States 🇺🇸 either using a "tourist visa" or the "visa waiver" (ESTA) who came intentionally for visit/pleasure and like you said suddenly fall in love and get married after the 60 days....
    Can he or she apply for adjustment of status after the 90 days under tourist visa without leaving the US?
    Will it be different case for a visa waiver (ESTA) if he or she get married after 60 days or more to get such adjustment be made since it was a waiver, not on a visa?
    I appreciate if you can reply to both questions. Thank you

    Hi a question for anyone. My friend got married in USA on a B1/B2 visa he only went to usa for 15 days got married and returned uk.. Now my question is
    1 - can his wife put in for a permanent resident ?
    2- while his application of permanent resident is on going, can he still travel backwards and forward to usa and back to uk? On his B1,B2 visa
    3. Or will his B1,B2 visa get cancelled

    I appreciate this video. I recently got proposed to while in the United States on a 28 day trip from New Zealand. Are the rules on marriage different if I was the one proposed to by a US Citizen?
    I am looking at pursuing a K-1 visa or some other method to allow me to be married to my beautiful fiancé Stateside

    Hello there Mr Serratelli, Thank you for the information; My question now is When do they start the "couting" Does it counts from the first time the person came to US or it counts 30/60/90 days from the last entry which will be the time the person will be applying for the status change.     I would like to marry a us citizen but what will he get?? what advantage will.he get marrying me??? that is though cause i will get a green card but he get nothing. seems like i have to use a person completely, that is harsh.

    Mr. Serratelli, my question is this, my fiancé comes to the USA, we marry on the 120th day after his arrival (he is brazilian). then he goes back to his country, do I file a K1 or I can adjust his status while he is in Brazil??? Thank you.

      Yes, cuz apparently even if you overstay your visa you are still eligible for a green card (except if you do some illegal stuff). Like he said, the rules are DUMB.

      Yes - what Nicole Rodriguez said -- but also, you can marry around Week 10 or 11 of the 12 week (90 day) period, and file the Case before day 90 . . . It all depends on the facts of your case and your travel history in and out of the USA . . .

    If a UK Citizen gets married to a US citizens on B1/B2 visa, then the UK citizen goes back to UK, Then US Citizen puts an application from USA for his/her for green card or whatever it is. Can he/she still use the B1/B2 visa to visit until the green card or immigrant application is granted?
    My friend is married on B1/B2 Visa, 2018 he didnt want to get married on k1, as he only stayed for 2 weeks or 3 weeks, but he came back to his home country due to his job and family ties. He sends money from uk to support his wife. 2-3 years down the line he will want the sort his family ties in uk, get his company to transfer him to Miami. But before he does that, his wife will put application in... will they ask him that when he went on B1/B2 visa why did you get married etc... ???

      Yes, you can still use a b1/b2 visa to visit the US even though you're going through Consular Processing outside the US. But, as any tourist visa holder, you can be denied entry. Having a pending petition can influence your chances for admission.

    What if I come in to get married? Do I still need to wait for that 90 days? I'm currently trying to save up to move to America my boyfriend and me are planning to get married in court once I get there around next year but now I'm worried about this. Not sure about working yet but I do plan on looking for a job once I get settled there. My boyfriend and me met online and we really love each other it might sound stupid but we really do want to get married someday. I'm just looking into what I would need to prepare myself for the move.
