None of this applies if the spouse didn’t have the benefit of being here illegally then married and filed a waiver and I-130. Most people who married their spouse is still in their native country and the US citizen filing within the US.
@@gustavoaragon4194 I-130 is just a petition for an non-US citizen spouse or family member. It literally says in the form that they can be in the US already. There are many types of visas that allow people to live and work and go to school here where they would meet someone and marry.
@@anthonypetracca1502 that is so true but the thing is most of the time that spouse don't have a work permit or a social yet which mean that 99% of everything in this video can't apply to them, you can hardly open a bank account without a social, it's impossible being on lease, having filed for joint tax, paying bills together because in general if you don't have a social you can't have your name listed on anything. what would be your advice for someone in this kind of situation? thank you
Good video, but I have some observations: Most of the documents you talked about are for Removing of Conditions (form I-751) but not for I-130. The reason is that, without SS number you can't have any insurance, some banks will not allow you to have Joint bank accounts, Joint tax returns, you can't be on Lease, etc. You need to have your initial case (I-130. I-485 approved) or Work authorization, then you can apply for all those documents you talked about. So you see, the documents you referred to are for filing I-751 not for I-130.

Be careful fining taxes together. If your spouse has a tax liability filing taxes together now means that his or her liability is now your responsibility. Say for example your new spouse owes the IRS $80,000. That also becomes your debt when you file joint returns. My American spouse owed $60,000. I filed separate return. But when I was asked at the interview as to why, I told them he has high tax liability that I didn’t want to become my liability. I provided proof of the liability and his payment plan. ( I am a tax accountant and made them aware so they know I know the rules) They didn’t ask me anymore questions on it.

We filed two letters from our friends (one of them is a US citizen, hers was notarized & we included copy of her ID, the other friend is Russian and her letter isn't notarized but we still included it just in case as well as the copy of her ID), scans of mail that came to our joint address (for example, letter from city hall with our marriage certificate inside with both our names on the envelope), bank statement + transactions (our joint account is just a month old but we're using it actively and planning to do so in the future, so we thought we should show it), lease (it's in my name only as we moved in together just a couple months ago, but at least it shows this particular address is indeed where we live), pictures of us together (I took screenshots on my phone that show the date when it was taken and just printed 4 on one page), and also screenshots of our instagram posts with each other and our friends (to show we're actively engaged in each other's social lives). Another thing we included in the package is mail from family and friends, my husband has a big family and many of them were sending cards after we got married / Easter cards / happy bday cards, etc. So even though we got married less than 2 months ago and basically don't really own anything together, we truly love each other and if it's the case for you it's totally possible to assemble some convincing package to prove it

My soon to be husband and I are 67. Both are retired. I own a house outright from my last marriage that ended in the death of my spouse. We have not comingled our finances due to us both having pensions, and I also have SS with Survivor Benefits. We plan on having a pre-nup agreement as each of us has grown children from our previous marriages. We are marrying with in a few months of meeting, but the marriage will be legal and real. What can we do to prove our relationship/marriage? Is the fact that neither of us has "Earned Income" going to be a problem to prove financial stability? Everything we have read presumes the couple is much younger and going to start a family.
didn't live together, spouse was in different country. its not possible to file taxes together/ joint account or other joint services. Pictures together/ Marriage Certificate are the options i used for my i-130.
In relation to your point about getting affidavits from family and friends who know you as a couple, at the 5:27 mark you say "That person should be a US citizen or resident." I have a current (March 2019) RFE letter from USCIS wherein under a section headed "Affidavits," the letter states "The persons making the affidavits may be relatives and need not be citizens of the United States."
"The I-130 affidavit can be written by any third-party that is familiar with your marriage. The person who writes an I-130 affidavit is an affiant. The affiant can be a friend, family member, or religious leader. There is no requirement that the writer must be a U.S. citizen or even live in the United States. But remember, he or she should be a close confidant that is familiar with the couple’s life together. So the writer should very familiar with the couple." citizenpath.com/i-130-affidavit-sample-spouse/
Many of these don’t consider that the non US citizen doesn’t live in the states and also many landlords and banks need a social security number. My husband still lives in Ghana and I can’t add him to my lease or bank without a SS#. How are couples living together during the I130 process?
If you have you married certificate and text messages something that prove that you have any contact with him pictures together or fly tickets that shows you’re still married!!
My sis, an American citizen, filed I-130 for me about 12+ years ago. We are expecting a notification from NVC soon. Now, my wife & I are outside the USA while my two kids (one son working, one studying, but both have legal status) are inside the USA. How are we supposed to file our applications when the notification comes? My kids were under 21 years when the petition I-130 was approved. Please add this in one of your future videos. Thank You

Question, my girlfriend lives in Jamaica. She comes to America on a tourist visa to visit me. While here, we decide to get married. She leaves at the end of her vacation to go back to Jamaica. She didn't overstay her visa. Can I file for green card and work permit and what is the process time. Also can I file for her travel to come here while waiting for her green card. Thanks Also, we have been seeing each other since 2018. We both travel to see each other.
Is it necessary to fill out the 1st phase on the usci sensus Bureau, school records, and religious baptism certificate? As additional evidence...it don't make sense to me but hoping u can answer asap. Thanks.
My lawyer told me that conversations on WhatsApp is good to send to immigration. Because we've had problems with social medias. Because me and my husband don't have joint accounts or anything in the US because he hasn't gotten here yet. We do have joint accounts in his country we have land together in his country that we are building a house on.
I believe if you get married outside the USA you would file for your wive's green card with consular processing. This is presuming you are a US citizen. And your wife is the immigrant or foreigner trying to immigrate to the US.
Hi Sharon! We are filing online, and have to upload or scan documents. Would it be easier for them if I made a photo page on a word document? Rather then sending them 10 separate pics. We have been doing long distance for 2 years and we don’t have any assets or live together yet.

Hey I have a question I hope I can explain it. I did my I-130 sent it to USCIS first update November after months went by I got a new update April 30 and a letter for what I have to do next I did all of it. Pictures together conversations with dates times and a letter how we met. And get the notary. Well here’s the question my wife had to write a letter and get the notary too and sign it like I did but the U.S and Philippines can’t get mail from each other because of the virus around the world yes she made a copy and emailed it to me with notary on it will the USCIS be ok with the copy of the letter also I print out from google about U.S and Philippines can’t get mail from each other. My due July 20 2020
What are you're fees to handle a case for me to bring someone from the Philippines to America, & what's the best way to go in a situation like this, is it easier to get married in the Philippines , or get married in the United States ?, or is it better just to sponsor them & then marry them in the United States later
you say stuff that require a social security number for my spouse. She is foreign and does not have a ssn. She lives in her country, I live in the USA. Cant get bank accounts and cant file taxes with her

Hello. I hope someone could lead me towards the right path. My sister's husband married her so he could come to the usa. Shes a usa citizen but currently living abroad and waiting for her husband to get a job and buy an apartment etc..... now she needs him but hes sort of backing off. They have been married for 3 years. And the number 1 biggest problem is that she was sort of a special child. Now an adult btw. If she was 100% normal, this wouldn't be happening. So he basically used her. Is there anyway he can be deported?
What if they are not in the country? Been fighting to get my wife here for 3 years. Embassy denied my wife saying our marriage is fake but didn’t give proof and even have not sent the case back stateside for appeal since 2018
for purposes of taxes, I had to file Married, filing seperate. Time was a factor, and the process for ITIN seems to be more convoluted than I could figure out. I do have the tax transcript that shows both of our names. Will this work for process of bona fide marriage?
Can you talk about I-1129F for K3 and K4 visas? Just wanna make sure what I did was right. I'm a USC and Married for 8 yrs. My spouse and two children are 5 & 2 yrs old, and I'm the biological father. They're all living abroad. Three I-130's already filed then filed one I-129F after receiving three I-797C. All forms were filed within the last 30 days. Also, are we allowed to choose which service center you want your forms to be processed or it's based on geographically whichever closest to your location? Thank you.
I sent I-130 and I-130A and forgot to send the fee money order what will happen, USCIS will give me time to sned the fee money order or simply reject the case and resubmit the papers.
I made a mistake on 130 item 61a that beneficary lives here and they ask for 485 which submitt and chaged by uscis after they asked for RFE for proof 194 which my husband dont have because never entered USA and he explained in cover letter what mistake we made on 130 ...now what should we do
I marry my wife in Africa and how about the joint account..? Is it important to do and am not in US ....? And am already submitting my application petition 130

We got married in the US last September 2017. And my husband is a us citizen, I am from Philippines. He filed i130 on August 2018. How long would it take to process? Im waiting for 10months now and still no update. 😞
My husband is a us citizen he was on foodstamp since one year but since he works .can he apply now for cr1 visa or he is in-éligible? What is the financial conditions to apply thank you
You can get a second person to financially sponsor you if your husband can't at the moment. You will need to fill out another form and get some info about your second sponsor to prove he's able to "take care of you financially"
Yes, lawyers can help you. I would suggest writing your own first with all the things you think would be hardships. Then having an attorney polish it up. Kind of like first, and second drafts.
Thanks Sharon for the video - Id like to ask, are the suggestions of proof that you have outlined in your video to be sent in with the i-130 form as a package? or is the marriage evidence only necessary to take with us to the interview? or at both stages? Thank you

You have to send those documents when you file your case and its better every of your document you submitted those copies your spouse also take with them to their interview. the attorneys usually not going to answer as because they charge certain amount of money while you call them and ask for information. And so they want you to call them. Usually for 15 mins talk they charge $75 dollar. { I gave all info based on my experience. } Thanks
To apply for cr1 visa (spouse) U have to use i-130 form it's better to create an account in USCIS website then u can do your form it's better faster and safer u can pay the fees online to They gonna ask you for the documents they need so Just apply they gonna tell u what they need, When the NVC set u an appointment they gonna ask for proof And they will tell u what's it Don't make it complicated it's easy and simple, Don't worry they gonna give u all the instructions
Spouse is a gc holder living in usa when we marry just registered our marriage and he had fly to usa and file my case i130. He just attached our marriage certificate. So what you say in our case because I am still in my country therefore no joint account etc . Thanks for your reply. ..!!
If he only added the marriage certificate, then USCIS may reject it as incomplete. Need copy of birth certificate and passport. Will need at least 2 letters from someone attesting to your marriage that is notarized. If rejected then just need to file again. If accepted as it was, then you get priority date and then wait until it gets processed and can add more documents later when they ask.

Hi, my mom in law (US Citizen) has sponsored my wife (Indian citizen) for a green card by filing the form I 130 petition for alien relative back in 2014. She received the I 797 informing her of the approval and the next steps. My wife however has moved from the international address in Singapore provided back in 2014 and need to update her new address in Singapore to be able to receive all the communications from NVC. Please advise how could she change her international address? Thank you
One question: To prove my marriage to my fiance is real what proofs other than the marriage certificate, if any is needed to make process go smoothly? Thanks.
if you filed form I-130 petition online and later wanted a copy of your petition. Is that possible to get a copy once already send and approved but still needed a copy?
Hi, when filling out the I-130, it doesn’t say to that we can add personal photos of my wife and I. So we didn’t add any. Does this mean it won’t be approved ?? However, we did provide proof of house ownership, rental agreement, joint bank accounts, brith certificates. Will this be enough without having supplied any couples photos? (Again, because it doesn’t explicitly say that it was an option to do so).
How can you file taxes if the person doesn’t have legal documents to be here? My husband doesn’t have a tax I.d or social. Again how are people getting insurance without documents? I need realistic answer and examples please
I’ll look into this. My husband and I are expecting a baby so that helps us. We did submit evidence of that. I just pray they hurry and approves us. Cause we are 6months and. Moving into a bigger place. I have a great salary and he works “off the books” but it’s hard work for long hours and little money 😞. But my brother is a union construction worker, and will get him in when once he has a social. We do have joint account and he is the beneficiary on my 401k and life insurance.

Mam I am going to marry within few months. He is USA citizen and age gap is 28 years. I live in Bangladesh so how I pay utility bills and joint account and Otherthing .i just can put pictures. My parent don't allow this relationship so I can't get pictures of them too. So my case will be weaker??? Plz ans me.
I'm a US citizen with passport. My parents live in Ukraine. Mother has a 10 year B type visa, she's been to US several times already, never over staying her allotted time. My father does not have a tourist visa and has never been to US before. My questions and where I get confused: 1) Beneficiary has been to the US before but is not currently in US Part 4 questions 45 thru 46d. She arrived as (class of admission)? if she's not currently in US do we need to answer this question? she doesn't have green card just a tourist visa 2) Has anyone filed for petition for beneficiary? We never filed for immigrant visa for my parents only for tourist visas. Do we answer yes or no or unknown. Part 5 question 1 3) Part 4 questions 57a thru 58f. I filled out the form in Ukrainian using Cyrillic letter, as that is how I understand the instructions are worded. Box for 58f won't accept written out word Ukraine in cyrillic while all other entries were pasted without a problem. Do we absolutely have to enter the name and address in Ukrainian here? Can I just fill the country name by hand in black ink. I know typed up version is preferred, but pdf format is not accepting cyrillic entry here. 4) Her father's name in his travel passport is spelled Serhii. I am using Sergiy as his proper spelling. Will that be a problem? 5) Part 1 question 2 says if filing for child or parent then the rest of the choices pertain to children only. What do I choose? Nothing about parents, unless they mean if the petitioner was born to married parents?? Very vague. I think some of the sections could be a lot more stream lined, and straight forward. A lot is left to imagination and/or guessing. 6) affidavit of support form and change of status form is sent together with i-130 or after? Appreciate if you can clarify some of these. thank you!
Hello! Can someone help me with 2 questions? 1. if i`m only married once and the online petition is asking for the date the marriage ended and the answer only take numbers and not letter (so i cant put N/A) should i leave it blank and justify it anywhere? 2. on province, in case my country only has states, where do i fill up the state since it only has american states on the options? thank you

@@mehhrbaba No, you submit the form i130 to the lockbox for your state. Once the case is transferred after approval to the national visa center that's when you can upload documents. You would have to print out the photos, etc to submit as a packet with the I-130.
Hi! Were you married only once? if is, what did u do on the "date marriage ended"field? thank u
@@renatam.2637 Just once . I left it blank.
@@renatam.2637 write N/A for any fields that don't apply to you. If you were previously married you would enter the date the divorce was finalized.
Marriage certificate, bank accounts, and photos, because if your spouse is in another country.
Thank for this video! It's really helpful. I was stressing about this but I think I get it now.
Hii sharon i want to ask you,i am a green card holder, i married last year from overseas ,how long it take to bring your wife plus what tips to help during the interview
Pictures together/ Marriage Certificate are the options i used for my i-130.
hi, my wife still in my country, to prove my mirriage with her i can send a couple pics during the wedding from my country even honey moon?
my husband is not here yet-- the USA will not open up a bank account with him and I until he has a social security number.
In relation to your point about getting affidavits from family and friends who know you as a couple, at the 5:27 mark you say "That person should be a US citizen or resident."
I have a current (March 2019) RFE letter from USCIS wherein under a section headed "Affidavits," the letter states "The
persons making the affidavits may be relatives and need not be citizens of the United States."
So the writer should very familiar with the couple."

Many of these don’t consider that the non US citizen doesn’t live in the states and also many landlords and banks need a social security number. My husband still lives in Ghana and I can’t add him to my lease or bank without a SS#. How are couples living together during the I130 process?
Plz make a video about those spouses who are not living together. In other country living and need to prove their bona fide marriage
What are the tips
Thanks for the suggestion. I will work on this with you in mind :)
Same petition here
I would really appreciate if she would. I am stuck with getting evidence.
If you have you married certificate and text messages something that prove that you have any contact with him pictures together or fly tickets that shows you’re still married!!
Please make the clip that the partners living different states because the jobs. How could we proof for it?
My sis, an American citizen, filed I-130 for me about 12+ years ago. We are expecting a notification from NVC soon. Now, my wife & I are outside the USA while my two kids (one son working, one studying, but both have legal status) are inside the USA. How are we supposed to file our applications when the notification comes? My kids were under 21 years when the petition I-130 was approved. Please add this in one of your future videos. Thank You
Does the picture evidence and social media go on the interview?
Hi Sharon. In relation to item 6, if the US citizen is living AND submitting an i130 from outside the US, do the affidavits still have to be from US citizens? Thanks
Thank you so much!! Your information has helped us.
I am a US Citizen. He lives in Abidjan Ivory Coast Nigeria. I wish to travele to his country. We marry we both return back to US together to start our life. you are so much talented person and also beautiful ❤

Thank you so much for your words. I am here to help!
My lawyer told me that conversations on WhatsApp is good to send to immigration. Because we've had problems with social medias. Because me and my husband don't have joint accounts or anything in the US because he hasn't gotten here yet. We do have joint accounts in his country we have land together in his country that we are building a house on.
what if both of you live outside the US and got married outside the US?
I believe if you get married outside the USA you would file for your wive's green card with consular processing. This is presuming you are a US citizen. And your wife is the immigrant or foreigner trying to immigrate to the US.
Hi Sharon!
We are filing online, and have to upload or scan documents.
Would it be easier for them if I made a photo page on a word document? Rather then sending them 10 separate pics.
We have been doing long distance for 2 years and we don’t have any assets or live together yet.
Hi My wife got an interview for a CR1 Visa petition on 12/20/2022, but we got Divorced on 09/18/2022 can she still go for the interview and get approved for the CR1 Visa and came to the United States?
How about if u r USA citizen but u go get marry in another country and you have that country marriage certificate. Do we still need other evidence? Because we have marriage certificate
I want to get married online in Brazil and what is the legality of this marriage. Please let me know.
How can ww have joint lease bills bank accounts if he doesn’t have an Id I don’t understand !! I have four kids with him from 17 years to 2 years old isn’t that enough?!
Hi my sister sponcer 2006 march i am from guyana how long more do i have to wait
My question is how can all those be done when we are in different countries? I live here in the USA she is in Colombia. We got married in Utah virtual marriage.
How it's possible when my wife is out of united state of America, please if possible let me know, thanks
I am getting married to a person not live in the states. How can a file to my wife coming to the US
What are you're fees to handle a case for me to bring someone from the Philippines to America, & what's the best way to go in a situation like this, is it easier to get married in the Philippines , or get married in the United States ?, or is it better just to sponsor them & then marry them in the United States later
How do you prepare a photo album for a immigration interview?
you say stuff that require a social security number for my spouse. She is foreign and does not have a ssn. She lives in her country, I live in the USA. Cant get bank accounts and cant file taxes with her
Hello Ernie, we can assess your situation! Call us at 310-803-3040!
I want ask about DS-260 they asked social media so i deleted all my social media account cause for me it wast of time so what i do in the form ? I write nothings for them or what

What should we do if we don't live together? My husband is going to be living in Morocco until he gets his visa?
Hello Mary, we can assess your situation! Call us at 310-803-3040!
Wow you so great in explaining. Bless you
Thank you!
The Law Office of Sharon Abaud you so great. God!
The Law Office of Sharon Abaud bless you
What if they are not in the country?
I made a mistake on 130 item 61a that beneficary lives here and they ask for 485 which submitt and chaged by uscis after they asked for RFE for proof 194 which my husband dont have because never entered USA and he explained in cover letter what mistake we made on 130 ...now what should we do
I think some msgs or letters before getting married can be useful .thank you that was really helpful
This was a very helpful, straight to the point and clear video. Thank you
What if my husband lives in Mexico and doesn't have a visa to come to the usa?
I marry my wife in Africa and how about the joint account..? Is it important to do and am not in US ....? And am already submitting my application petition 130
What about if the US citizen marry me here already in Philippines and he want me to live there with him in USA what requirements we need to provide so that i can go there and live there with him?please help me...
We got married in the US last September 2017. And my husband is a us citizen, I am from Philippines. He filed i130 on August 2018. How long would it take to process? Im waiting for 10months now and still no update. 😞
Genevev Budiongan Young we're same 😔
My husband is a us citizen he was on foodstamp since one year but since he works .can he apply now for cr1 visa or he is in-éligible? What is the financial conditions to apply thank you
You can get a second person to financially sponsor you if your husband can't at the moment. You will need to fill out another form and get some info about your second sponsor to prove he's able to "take care of you financially"
Some of what you talk about is impossible because you need a social security number for a bank account and with out one you can not get joint account
Was wondering can a lawyer help me write a extreme hardship letter .. like not what to say of course but how to set it up right.
Yes, lawyers can help you. I would suggest writing your own first with all the things you think would be hardships. Then having an attorney polish it up. Kind of like first, and second drafts.
What if you have been homeless for 15 years what proof could you have?
What if you're not living together?
joint bank account is impossible for us as I do not have ssn ?
we do have 2 bank cards
Thanks Sharon for the video - Id like to ask, are the suggestions of proof that you have outlined in your video to be sent in with the i-130 form as a package? or is the marriage evidence only necessary to take with us to the interview? or at both stages? Thank you

Same question here. Pls comment if you know the answer. Thanks
{ I gave all info based on my experience. }
Thanks
To apply for cr1 visa (spouse)
U have to use i-130 form it's better to create an account in USCIS website then u can do your form it's better faster and safer u can pay the fees online to
They gonna ask you for the documents they need so
Just apply they gonna tell u what they need,
When the NVC set u an appointment they gonna ask for proof
And they will tell u what's it
Don't make it complicated it's easy and simple,
Don't worry they gonna give u all the instructions
please I said am married when applying but was not n got married days after what do I do?
I have almost ready my RFE but I think I used to much pictures ... it is 132 photos ... do you think I should reduce it ?
How did it go??

You should explain I 130 for military sponsor who live in Sadi USA and outside the USA, there is not much information UA-cam in those cases. Than you
Thank you for sharing from all the list of documents u mentioned for proof of relationship are we supposed to pick one of the documents or try to get all.

Thanks.
Back in 96 my sister file petition i been in court 3 yers judge granted my work permit I represented myself should I bring a lawyer on August 29
Jorge Sajuan dude yes! Get an immigration lawyer
if you filed form I-130 petition online and later wanted a copy of your petition.
(Again, because it doesn’t explicitly say
that it was an option to do so).
Now 22 years i quary usa girl for love& marrige
But no found
How can you file taxes if the person doesn’t have legal documents to be here? My husband doesn’t have a tax I.d or social.
Again how are people getting insurance without documents? I need realistic answer and examples please
Danna Dennis my husband got an ITIN # and we file taxes together, I use to be in his insurance from work and now he is on mine
Danna Dennis good luck to the both of you and congratulations on your baby, I did a petition for my husband and he will have his interview April 16 praying everything will be ok
mayra8686 how long after you filed did you get the interview?
Danna Dennis 7 months
children is out we don't have children together or out of previous marriages
My boyfriend is in prison I don’t know how to prove it ?
How long after you get married . you can file your paperwork? (i-130? )
Will the USCIS accept it if the joint health insurance plan the couple bought is a federally subsidized one?
Are wedding cards a good form of evidence to submit I know a bit random just wondering thanks 😊

Hi how long takes to uscis decide I 601 A waiver ? I heard trump administration slow down all processing?
If me and my spouse are married for 1month but been together for 6 years and have 2 kids I can still do the I 130 form?
I'm a US citizen with passport. My parents live in Ukraine. Mother has a 10 year B type visa, she's been to US several times already, never over staying her allotted time. My father does not have a tourist visa and has never been to US before. My questions and where I get confused:
1) Beneficiary has been to the US before but is not currently in US Part 4 questions 45 thru 46d. She arrived as (class of admission)? if she's not currently in US do we need to answer this question? she doesn't have green card just a tourist visa
2) Has anyone filed for petition for beneficiary? We never filed for immigrant visa for my parents only for tourist visas. Do we answer yes or no or unknown. Part 5 question 1
3) Part 4 questions 57a thru 58f.

2. on province, in case my country only has states, where do i fill up the state since it only has american states on the options? thank you
