I am applying for my spouse and soon we will have our Interview in the RD. I sm learning to speak Spanish, is ok if I explain briefly that I have good relationships with my inlaws and that I learned to speak Spanish for my husband and his family who do not speak English????
Good video, but I have some observations: Most of the documents you talked about are for Removing of Conditions (form I-751) but not for I-130. The reason is that, without SS number you can't have any insurance, some banks will not allow you to have Joint bank accounts, Joint tax returns, you can't be on Lease, etc. You need to have your initial case (I-130. I-485 approved) or Work authorization, then you can apply for all those documents you talked about. So you see, the documents you referred to are for filing I-751 not for I-130.
@@leprince2140 Yea, for utility bill you may have without ss# as some utility companies ignore the rule bcos of profit, some use prepay arrangement, others also can ask for cosigners. You're right with the utility bill, but the points I made in my earlier post are still valid.
not true at all. i have my wife (without ssn at the time) be be on joint bank account, join tax return, joint lease, insurance. my utility doesn’t allow any sort of joint ownership. you often need other types of documents in place of the missing ssn like foreign passport for banks.
Be careful fining taxes together. If your spouse has a tax liability filing taxes together now means that his or her liability is now your responsibility. Say for example your new spouse owes the IRS $80,000. That also becomes your debt when you file joint returns. My American spouse owed $60,000. I filed separate return. But when I was asked at the interview as to why, I told them he has high tax liability that I didn’t want to become my liability. I provided proof of the liability and his payment plan. ( I am a tax accountant and made them aware so they know I know the rules) They didn’t ask me anymore questions on it.
None of this applies if the spouse didn’t have the benefit of being here illegally then married and filed a waiver and I-130. Most people who married their spouse is still in their native country and the US citizen filing within the US.
@@gustavoaragon4194 I-130 is just a petition for an non-US citizen spouse or family member. It literally says in the form that they can be in the US already. There are many types of visas that allow people to live and work and go to school here where they would meet someone and marry.
@@anthonypetracca1502 that is so true but the thing is most of the time that spouse don't have a work permit or a social yet which mean that 99% of everything in this video can't apply to them, you can hardly open a bank account without a social, it's impossible being on lease, having filed for joint tax, paying bills together because in general if you don't have a social you can't have your name listed on anything. what would be your advice for someone in this kind of situation? thank you
we just went thru this process and the best advice is get a carry on size suitcase and fill it up with documents when they see you walk in to the interview whit that much evidence they will just ask you for the basics only . joint taxes very important , pictures with relatives, joint living conditions either or own or rent and packages you had bought on like bring in the shipping labels make sure you have both names on your account joint and single bank account we have both . Fill that suit case up ha ha ha it will help alot with the interview . we did it without councel but i would sugest if you are not comfortable get a active lawyer not someone who is not involved with the USCIS Daily
In relation to your point about getting affidavits from family and friends who know you as a couple, at the 5:27 mark you say "That person should be a US citizen or resident." I have a current (March 2019) RFE letter from USCIS wherein under a section headed "Affidavits," the letter states "The persons making the affidavits may be relatives and need not be citizens of the United States."
"The I-130 affidavit can be written by any third-party that is familiar with your marriage. The person who writes an I-130 affidavit is an affiant. The affiant can be a friend, family member, or religious leader. There is no requirement that the writer must be a U.S. citizen or even live in the United States. But remember, he or she should be a close confidant that is familiar with the couple’s life together. So the writer should very familiar with the couple." citizenpath.com/i-130-affidavit-sample-spouse/
We filed two letters from our friends (one of them is a US citizen, hers was notarized & we included copy of her ID, the other friend is Russian and her letter isn't notarized but we still included it just in case as well as the copy of her ID), scans of mail that came to our joint address (for example, letter from city hall with our marriage certificate inside with both our names on the envelope), bank statement + transactions (our joint account is just a month old but we're using it actively and planning to do so in the future, so we thought we should show it), lease (it's in my name only as we moved in together just a couple months ago, but at least it shows this particular address is indeed where we live), pictures of us together (I took screenshots on my phone that show the date when it was taken and just printed 4 on one page), and also screenshots of our instagram posts with each other and our friends (to show we're actively engaged in each other's social lives). Another thing we included in the package is mail from family and friends, my husband has a big family and many of them were sending cards after we got married / Easter cards / happy bday cards, etc. So even though we got married less than 2 months ago and basically don't really own anything together, we truly love each other and if it's the case for you it's totally possible to assemble some convincing package to prove it
I think financial documentation of support and travel to see your spouse is helpful... A summary of ALL expenses and support should be included... Because at the next step, new regulations are going to require you to show financial support and proof of ability to support once the Visa is granted.
My husband's case is in administrative processing in Nigeria, and i cannot even go to Nigeria now because of the kidnappings, and killings going on there. My husband is scared for my security and i am afraid too. He has been to the embassy twice znd still did not get his visa, so we are just waiting for the administrative process is complete. My lawyer told me that conversations on WhatsApp is good to send to immigration. Because we've had problems with social medias. Because me and my husband don't have joint accounts or anything in the US because he hasn't gotten here yet. We do have joint accounts in his country we have land together in his country that we are building a house on.
My soon to be husband and I are 67. Both are retired. I own a house outright from my last marriage that ended in the death of my spouse. We have not comingled our finances due to us both having pensions, and I also have SS with Survivor Benefits. We plan on having a pre-nup agreement as each of us has grown children from our previous marriages. We are marrying with in a few months of meeting, but the marriage will be legal and real. What can we do to prove our relationship/marriage? Is the fact that neither of us has "Earned Income" going to be a problem to prove financial stability? Everything we have read presumes the couple is much younger and going to start a family.
Many of these don’t consider that the non US citizen doesn’t live in the states and also many landlords and banks need a social security number. My husband still lives in Ghana and I can’t add him to my lease or bank without a SS#. How are couples living together during the I130 process?
My question is how can all those be done when we are in different countries? I live here in the USA she is in Colombia. We got married in Utah virtual marriage.
didn't live together, spouse was in different country. its not possible to file taxes together/ joint account or other joint services. Pictures together/ Marriage Certificate are the options i used for my i-130.
Hey I have a question I hope I can explain it. I did my I-130 sent it to USCIS first update November after months went by I got a new update April 30 and a letter for what I have to do next I did all of it. Pictures together conversations with dates times and a letter how we met. And get the notary. Well here’s the question my wife had to write a letter and get the notary too and sign it like I did but the U.S and Philippines can’t get mail from each other because of the virus around the world yes she made a copy and emailed it to me with notary on it will the USCIS be ok with the copy of the letter also I print out from google about U.S and Philippines can’t get mail from each other. My due July 20 2020
Is it necessary to fill out the 1st phase on the usci sensus Bureau, school records, and religious baptism certificate? As additional evidence...it don't make sense to me but hoping u can answer asap. Thanks.
Hi Sharon. In relation to item 6, if the US citizen is living AND submitting an i130 from outside the US, do the affidavits still have to be from US citizens? Thanks
How about if u r USA citizen but u go get marry in another country and you have that country marriage certificate. Do we still need other evidence? Because we have marriage certificate
I was outland so you can do the same get your spouse name on your lease or rent, my bank account and mother in law visit was late but we made it possible you can get a screenshot photo of conversation with your spouse if traveling is not possible. My process is for Canada but most cases are different but required almost the same documents. Another thing for outland is to practice for the interview and even though as I say all cases are indeed different. My niece was different than mines most definitely because she got through fiance sponsorship to the USA also my schoolmate was so different than me she went their through marriage. Just have proof that you are indeed a couple and have your life in order also.
Spouse is a gc holder living in usa when we marry just registered our marriage and he had fly to usa and file my case i130. He just attached our marriage certificate. So what you say in our case because I am still in my country therefore no joint account etc . Thanks for your reply. ..!!
If he only added the marriage certificate, then USCIS may reject it as incomplete. Need copy of birth certificate and passport. Will need at least 2 letters from someone attesting to your marriage that is notarized. If rejected then just need to file again. If accepted as it was, then you get priority date and then wait until it gets processed and can add more documents later when they ask.

Hi My wife got an interview for a CR1 Visa petition on 12/20/2022, but we got Divorced on 09/18/2022 can she still go for the interview and get approved for the CR1 Visa and came to the United States?
Question, my girlfriend lives in Jamaica. She comes to America on a tourist visa to visit me. While here, we decide to get married. She leaves at the end of her vacation to go back to Jamaica. She didn't overstay her visa. Can I file for green card and work permit and what is the process time. Also can I file for her travel to come here while waiting for her green card. Thanks Also, we have been seeing each other since 2018. We both travel to see each other.
Yes, lawyers can help you. I would suggest writing your own first with all the things you think would be hardships. Then having an attorney polish it up. Kind of like first, and second drafts.
My husband is a us citizen he was on foodstamp since one year but since he works .can he apply now for cr1 visa or he is in-éligible? What is the financial conditions to apply thank you
You can get a second person to financially sponsor you if your husband can't at the moment. You will need to fill out another form and get some info about your second sponsor to prove he's able to "take care of you financially"
What are you're fees to handle a case for me to bring someone from the Philippines to America, & what's the best way to go in a situation like this, is it easier to get married in the Philippines , or get married in the United States ?, or is it better just to sponsor them & then marry them in the United States later
Thank you so much!! Your information has helped us. I am a US Citizen. He lives in Abidjan Ivory Coast Nigeria. I wish to travele to his country. And thank you again for your sharing your knowledge...
for purposes of taxes, I had to file Married, filing seperate. Time was a factor, and the process for ITIN seems to be more convoluted than I could figure out. I do have the tax transcript that shows both of our names. Will this work for process of bona fide marriage?
How can ww have joint lease bills bank accounts if he doesn’t have an Id I don’t understand !! I have four kids with him from 17 years to 2 years old isn’t that enough?!
Thank you for sharing from all the list of documents u mentioned for proof of relationship are we supposed to pick one of the documents or try to get all.
Hi Sharon! We are filing online, and have to upload or scan documents. Would it be easier for them if I made a photo page on a word document? Rather then sending them 10 separate pics. We have been doing long distance for 2 years and we don’t have any assets or live together yet.
Yeah, yeah, uh hu, If I were in a standard marriage I would have separate bank accounts as there are a bunch less hassles that way, but if the Government is looking at you then you have to mix them? The whole thing is insane.
I marry my wife in Africa and how about the joint account..? Is it important to do and am not in US ....? And am already submitting my application petition 130
What about if the US citizen marry me here already in Philippines and he want me to live there with him in USA what requirements we need to provide so that i can go there and live there with him?please help me...
My sis, an American citizen, filed I-130 for me about 12+ years ago. We are expecting a notification from NVC soon. Now, my wife & I are outside the USA while my two kids (one son working, one studying, but both have legal status) are inside the USA. How are we supposed to file our applications when the notification comes? My kids were under 21 years when the petition I-130 was approved. Please add this in one of your future videos. Thank You
Can you talk about I-1129F for K3 and K4 visas? Just wanna make sure what I did was right. I'm a USC and Married for 8 yrs. My spouse and two children are 5 & 2 yrs old, and I'm the biological father. They're all living abroad. Three I-130's already filed then filed one I-129F after receiving three I-797C. All forms were filed within the last 30 days. Also, are we allowed to choose which service center you want your forms to be processed or it's based on geographically whichever closest to your location? Thank you.
I'm sure you figured this out by now but you just have them fill out I864A then prove your relationship (Birth certificates) and domicile (utility bill, social security statement, something with the address on it) and then you submit it along with your I864. (Writing this in case someone else has the same question) just don't forget that you as the petitioner sign section 5 of the I864A that your parents fill out/sign.
I believe if you get married outside the USA you would file for your wive's green card with consular processing. This is presuming you are a US citizen. And your wife is the immigrant or foreigner trying to immigrate to the US.
So like we got married 2 months ago when we can start the process times wise ..? We pretty much sure we meet all the requirements we own a house we got joint back account and we are expecting a baby girl ..
Thanks for your very educative video. But I have a question. My husband and I are going for B1 B2 visa but we did the Nigerian traditional marriage. Will the American interviewer approve of the traditional certificate? If not, what should I do now? Cos my marriage is 18years old and I have 6 children. Although am going for 3weeks so, I don't hope to travel with them
Hello whatching your vedio from Hongkong....let me ask you please on how to process fiancee visa as i know my bf visit me already here in Hongkong a month ago...since we don't know yet..
If you want to come to USA as a fiancee, your boyfriend will need to apply K1 Visa which takes around 5 to 8 months until visa gets approved. You may visit USCIS official website for more information. Good luck 👍😘
What if they are not in the country? Been fighting to get my wife here for 3 years. Embassy denied my wife saying our marriage is fake but didn’t give proof and even have not sent the case back stateside for appeal since 2018
Hello. I hope someone could lead me towards the right path. My sister's husband married her so he could come to the usa. Shes a usa citizen but currently living abroad and waiting for her husband to get a job and buy an apartment etc..... now she needs him but hes sort of backing off. They have been married for 3 years. And the number 1 biggest problem is that she was sort of a special child. Now an adult btw. If she was 100% normal, this wouldn't be happening. So he basically used her. Is there anyway he can be deported?
you say stuff that require a social security number for my spouse. She is foreign and does not have a ssn. She lives in her country, I live in the USA. Cant get bank accounts and cant file taxes with her
I made a mistake on 130 item 61a that beneficary lives here and they ask for 485 which submitt and chaged by uscis after they asked for RFE for proof 194 which my husband dont have because never entered USA and he explained in cover letter what mistake we made on 130 ...now what should we do

Pictures together/ Marriage Certificate are the options i used for my i-130.
hi, my wife still in my country, to prove my mirriage with her i can send a couple pics during the wedding from my country even honey moon?
You should explain I 130 for military sponsor who live in Sadi USA and outside the USA, there is not much information UA-cam in those cases. Than you
Hey I have a question I hope I can explain it.
Very nice video mam
Is it necessary to fill out the 1st phase on the usci sensus Bureau, school records, and religious baptism certificate? As additional evidence...it don't make sense to me but hoping u can answer asap. Thanks.
Madam are you talking about I-130,or condition resident, because I-130 process is different,so you are confusing here
Hi my sister sponcer 2006 march i am from guyana how long more do i have to wait
Video starts at 1:43
You're welcome🤗
Melody Indigo Estell thank you!
I have question but I don’t speak very well English...
God bless U my sister you are lifted in Jesus Christ Mighty name!!!
clear and helpful video. Subscribed now.
Regards
Hi madam My daughter 21 year old she should be married than she can petition for parent's ? Can I talk to you.
I did all this and my husband was still deported. With no criminal background and no criminal issues.
Wow!
Why

Was wondering can a lawyer help me write a extreme hardship letter .. like not what to say of course but how to set it up right.

Hello Mary, we can assess your situation! Call us at 310-803-3040!
for purposes of taxes, I had to file Married, filing seperate. Time was a factor, and the process for ITIN seems to be more convoluted than I could figure out. I do have the tax transcript that shows both of our names. Will this work for process of bona fide marriage?
Excelent video. Can you do the video ( or future videos ) in spanish if is posible.

Can we work before get green card or work permit.
I marry my wife in Africa and how about the joint account..? Is it important to do and am not in US ....? And am already submitting my application petition 130

Thank you.
Please how do we write affidavit of support for situation where we leaving with our parents.
I have almost ready my RFE but I think I used to much pictures ... it is 132 photos ... do you think I should reduce it ?
How did it go??
what if both of you live outside the US and got married outside the US?
Although am going for 3weeks so, I don't hope to travel with them
So am I. 20 years in marriage. Just got my citizenship about 3 months ago.
Now, I'm filing for my husband
All things will work together for your good
Hello whatching your vedio from Hongkong....let me ask you please on how to process fiancee visa as i know my bf visit me already here in Hongkong a month ago...since we don't know yet..
If you want to come to USA as a fiancee, your boyfriend will need to apply K1 Visa which takes around 5 to 8 months until visa gets approved. You may visit USCIS official website for more information. Good luck 👍😘

Thank you for your video.. very good. Me and my husband got married in 15 days. Do you think it's gonna be a problem.
More information would be needed, however, this might raise a flag for the officer.
Hey
Please what’s the difference if I marry a citizen or a green card holder
What if they are not in the country? Been fighting to get my wife here for 3 years. Embassy denied my wife saying our marriage is fake but didn’t give proof and even have not sent the case back stateside for appeal since 2018
ok is this the right form we got married in philippines an i have to go back to usa
How do I retain you? Im trying to get my husband
I'll send my daughter information to make sure my is bonify
you say stuff that require a social security number for my spouse. She is foreign and does not have a ssn. She lives in her country, I live in the USA. Cant get bank accounts and cant file taxes with her
