    Under American Immigration Law, you basically have 5 choices for obtaining a green card:
    (1) Family-Based through an Immediate Relative;
    (2) Family-Based through a Preference Category;
    (3) Employment-Based through your work;
    (4) through the Diversity (DV) Program Lottery; and
    (5) through Asylum.
    As a subset of "Employment-based" Creen Cards, there is also an "EB-5" Investor Visa (sometimes called the "$500,000" or "$1 million" Green Card); but, if you have questions about the EB-5 Green Card, please contact me:

    You need to be a permanent resident (green card holder) for 5 years before you can apply for U.S. Citizenship. If you obtain the green card through marriage to a U.S.Citizen, then the wait to apply is 3 years instead of 5 years

    Don't isolate yourself. There are people who have been through what you might be facing right now and they overcame it. Don't push people away, surround yourself with people who are spiritually mature and get the help that you need. Isolation when you are in pain and don't know if there's a way out is dangerous and that's why we have suicide cases. Listen, there's nothing that you can be facing that God is not able to solve for with God nothing is impossible. Hold on. Jesus loves you.

    Hmmmm -- are you ready for this? Under the U.S. immigration system, you have to get the job offer FIRST, then you apply for the work visa. Most jobs are based on having a 4 year college degree.
    If you do not have a 4 year college degree, you could perhaps come to the USA as a student or as an H-2B worker.

    It’s so depressing looking at how to get one. I have a computer science degree and I’m from the U.K. it’s next to impossible 😭😫

    Either way -- visiting family or tourism both get you a "tourist visitor visa." The other type is a "business visitor visa," but this is for people who come to the USA representing a business outside the USA coming in to the USA to go to meetings.

    Sorry, an Aunt cannot sponsor you for a green card. Only your mother, father, brother, sister or husband could sponsor you for a green card -- but THEY would need to either have a green card or be U.S. Citizens.

    I once won in 2003, then went to for six years, finished my bachelor degree in US, and then went back to my country overstated for over one year, and now I am trying to win again and no luck. It seems you have one chance in life, but was worth going there. I would say to be young and win is the best thing what can happen.

    The F-1 student visa is the way to go -- get admitted to a USA college or University, then WORK AS AN F-1 STUDENT (the college or university will know the F-1 work rules under "CPT" and "OPT" and then the F-1 work leads to your meeting an employer who could get you a work visa. You need the employer offer of work before you can apply for the work visa. Want more info? Please let me know. But, the "experts" are the people in the office of International Student Services on the campus.

    Hey Arthur, quick question please:
    It clearly states on the Diversity Visa Lottery website the following "If a person was born in a country whose natives are ineligible, but neither of his/her parents was born there or resided there at the time of the birth, such person may be able to claim nativity in one of the parents' country of birth."
    I was born in England to parents who were residents of England at the time of my birth, however they were both born in Kenya. Can I apply to claim through a parent in this case?

    Hi there,
    Just found and watched your video and I hope you can help me out here.
    I’m 19 years old and I have a Dutch European citizenship. I’m born here, I live here and after next summer I’ll be starting a new study here.
    I've been a big fan of America since I was a little kid. At the age of 15 I went to the US for the first time to visit our American family (and a second time when I was 17 years old). But they are no immediate family members to me: they are my mom’s cousins and uncle. They are so close to us that even I consider them my uncles and cousins. During my stay I was fascinated by this great country. Ever since that moment my destiny is to live life in the US whenever I get my chance. And it’s still my goal to get there.
    As I said I’m about to start a new study here. If everything goes as planned I will be getting my bachelor degree at the age of 23. But where do I start after getting my bachelor degree here in the Netherlands in order to move to the US ? I've been thinking of the diversity lottery, but the chances of “winning” are so small (but I’d still try!). I just want to be sure of what could be my best options: a new study or getting a job in the US? What kind of visas could give me a chance? I hope you can give me some advice so I know what to expect soon.

      The DV-Lottery is ok . . . SOMEONE has to win! . . . but do not plan on it: about 17 million people "enter to win" and only 55,000 DV-Lottery visas are available.
      Most young people come to the USA through (1) school or (2) work . . . I vote for these 2 choices as the most realistic . . . unless you have a U.S. Citizen that you l-o-o-o-o-v-e and want to marry (marriage is the BEST choice).

    Getting a job offer is the way to get a temporary work visa -- then, in certain cases, the work visa can be converted to a green card.
    Do you have a job offer? Normally, job offers that lead to a green card require a bachelors degree from a college or university.

    I would say you have higher chance to reach by boat than winning lottery. You can find in state.gov website about the quotas for each country.

    This may seem like a simple question, but it is very very complicated. K-1 and K-2 are temporary & Permanent Residence (immigrant Visa) is for the green card.
    If you and your mom are in Canada, you need to get a visa. If you 2 are visiting in the USA, you can get green cards here -- you need to follow certain rules -- and skip the Embassy.

    To get F-1 student status, you will need to be admitted to a school in the USA. The school helps you get the F-1 visa.

    People normally graduate from high school and then come to study, in college, on an F-1 student visa. To do this, the FIRST THING you need to do is apply to, and get accepted by, a U.S. College or University. Did you plan on being a student here?
    The only other realistic ways of getting here involve working visas or an immigrant visa (green card) based on marriage to a U.S. Citizen. Your f-1 student option is your best choice.

    To enter the Diversity Visa Lottery, you must be a "Native of a qualifying country." In most cases, this means the country in which you were born. Being born in Saudi Arabia = you can apply!
    Two other ways to qualify. DV rules are at travel.state.gov

    I am willing to give my life to the US Military, all i really want is the chance to serve under the flag of the United States of America and be a professional soldier to uphold the Constitution. I know about the MAVNI program but i am in High School (Will be finished soon), i don't speak a foreign language (I am British), and i do not possess any Medical training, the type of things that are in need.
    I personally believe that the United States is the country for those who seek freedom and a chance to create something for their selves, so how would i be able to join the US Military as a foreigner?

    As a DACA beneficiary, you are not in any legal status. The government has simply agreed to "defer action" on deporting you. As such, you are in legal limbo and can not apply for anything else until the law changes. Remember to renew your DACA work card before it expires to stay in the US legally until Congress changes the law!

    Also, what country are you from -- there is a unique category called the E-1/E-2 visa, and if your country has an E-1/E-2 treaty with America, then you will have a couple of other choices to come here and work.

    Well, fashion models are eligible for the H-1B temporary work visa, and then you would get an Employment-based, #rd Preference Green Card. Go to:

      @quaking, as he stated, you would have to apply for the EB-3, and that takes a very long wait time, if all your have is a Bachelor's degree. If you have a masters or a PhD in Biomedical sciences, nanotech, environmental engineering etc that falls withing the National waiver, you can apply for an EB-2 which is a second preference but have shorter waiter times. What is not clear in this video is if you can apply for the EB visas from outside the country, or if you are required to have a job offer. All the best

    Your brother would have to have citizenship to sponsor you for a green card, but even then the wait for a green card through a citizen brother is 10+ years. The Visa Bulletin" is the place to find the definitions of the green card categories and the corresponding wait times. The Visa Bulletin is at this website (the U.S. Department of State): travel. state. gov

    Yes, employment is one way to get a green card if you are a student, but there are some others. One way is through marriage if you fall in love with an American citizen, and another way would be through the diversity visa lottery if you are from a country that allows you to "play" in the lottery.

    You may be eligible . . . As one example. you are eligible if you have an I-94 card to show that at one time in the past you did enter the USA legally, and maybe overstayed the visa for reasons beyond your control.
    In other words, if you entered the USA legally, then a marriage to a U.S. Citizen "forgives" any overstay that you may have.

    I am a sixteen year old dutch student, I am planning on studying international business here including a bachelors degree and a masters degree. After these studies I am planning to move to America to either work for a company in a sales position or start my own company. My question is at what age should I start applying, and should I immediately hire a lawyer. Thxs to anyone who can help me with these questions.

    Mr, Arthur, thanks for your educative video on Green Card. Please I need an information on a Nigeria sister. She is on a visitor visa in USA. She is not medical fit to go back to Nigeria due to chronic kidney failure (Stage 5). To make her case worst is that she have being on dialysis three days in a week.
    Her going back to Nigeria is going to impose her in danger, because of the following reasons
    1. She can not stay out of dialysis for about 2 days
    2, Political crisis in Nigeria, biafra, herdsmen, etc
    3. Lack of medical facilities in Nigeria, example, there is no dialysis Centre in the state she lives, and that will make her to travel to other state for dialysis, traveling a day on the bad road to get to another state where there is dialysis unit, a day on dialysis and another day going back to her location. (i.e 3 days to get one dialysis which will put her health in danger list, because Doctors prescription is 1 dialysis every other day)
    5. She can even get there and face other challenges like, no electricity, the staff in charge did not come to work or they are on strike etc Very terrible situation.
    Please, Arthur can she get Asylum/Refugee or is there any green card category, she can fit in to stay in USA and be alive. Her going back to Nigeria is as good as death sentence.

    For U.S. citizen filing for a brother or sister, You mentioned if the
    brother is married it passed onto the spouse and children if they are
    under 21, What happens if the I-130 has been submitted as an unmarried
    brother or sister ?

    Yes, either using the E-1 or E-2 nonimmigrant work visa or the EB-5 "million dollar green card" EB-5 option. I prefer the E-1 or E-2.

    Hello!
    They "run" the lottery every Fall (you will need to keep checking for Fall 2013 -- it is sometime between Sept and December 2013). They will accept -- FREE OF CHARGE, ONLY AT THIS WEBSITE -- your application for the DV Lottery 2015:

    I know that sounds nuts, but the lottery you enter in the Fall of 2013 announces "winners" in the Spring of 2014; THEN, the "winners" have 1 year (from 10/1/3014 to 9/30/2015) to get the DV-visa.

    Last year -- I think (double check this with a Google search) -- 17 million people applied, and there are only 55,000 DV lottery winners. The odds are very long, but SOMEBODY has to win -- so why not you? Good luck!

    First, you have to marry him. Are you married yet?
    Next -- where do you live (in the USA I am guessing)?
    If you live in the USA, you would need to apply for him to get a green card. This could take some time. If he is in Greece, you would end up getting him an immigrant visa at the U.S. Embassy in Greece.

    If your sister becomes a US Citizen, then she could sponsor you for a green card -- but the wait is many, many, many years. If you ARE NOT FROM India, or China or Mexico or the Philippines, a sister case for a brother takes 12 years

    If the family members in the USA are eligible to sponsor your green card, and the income is too low, you can get a CO-FINANCIAL SPONSOR (this is any US Citizen or Green Card holder that is willing to help you & your family). The F-1 student visa requires one important thing -- you must be FIRST accepted to a U.S. College or University. Have you applied to, and been accepted by, a U.S. College or University? That is the first step. Your family in the USA can help you find a school.

    Hello Mr Arthur i'am in a Relation with a US Citizen now over one year and this questions is By me and your wife. me and my wife we love each-other and her family all of them know me so well and my family know her so well but we have a big age difference for that's she is 62 and im 23 the thing is we know everything about each-other cause we talk really so much in the day always and she will come to my country to stay with em for 2 years after we Married here then when we will apply for VISA

    I have a question. my boyfriend is a green card lottery 2 years ago. He was married before he won so her ex wife was also given the same opportunity. Now that they are divorce for more than a year. We want to be married soon and have baby since we are at the right age. But I am a filipino and my country is listed on my the "not eligible". Philippines . I hope that there will be other way so we can be together as soon as possible. He introduce me green card lottery but he was not aware that Philippines is listed under this "not eligible" countries.

    Good question. Here's my guess -- in the good old days -- when the Statue of Liberty really meant something, America NEEDED human beings to fill-up the spots in the manual labor workforce. The new workers would work, earn and spend. And the economy would grow . . . Now the economy is flat, and I fear we are at a point where the people of the world want America more than America wants them. So, we are limiting the number of people who can live permanently to skilled workers & family members. Sad

    After researching all of this, I am left wondering what is stopping a foreigner from coming here illegally and getting married to a US citizen? How would they be discovered? Obviously with a non-immigrant visa, they usually know where you're staying and where to find you, correct? But what if you just jumped the border without any documentation? The system is so broken that it oppresses the ones who do it legally and it provides loopholes for those illegally. If only it was easy and affordable that everyone could do it at an equal opportunity. Please answer my questions. I an really wondering. Thank you

      Austin Feldkamp Hi Austin,
      The law is tougher than you think. Since 2001, the only type of undocumented person that can become a permanent resident through marriage to an American is a person who crossed the border legally with a non-immigrant visa and then simply over-stayed (simply don't leave the U.S. when they are supposed to). So, if someone sneaks in illegally, there is currently NO WAY to become legal even through through marriage to an American.
      But you are absolutely right. We have a porous border and an IRS system (google IRS tax form W-7) that seemingly encourages people to hop the border fence, work and stay illegally and BUT ALSO LEGALLY PAY TAXES (but without any legal rights or options to become legal residents). And on the other hand, we have a USCIS system that makes it exceedingly difficult for international workers and students to lawfully become permanent residents through employment.
      Regarding your question about what is stopping people from marrying an American for a green card: In 16 years, I have had 4 marriage cases come through my office that I later learned, from USCIS investigators, were not real marriages. In my experience, USCIS is EXTREMELY good, better than I am apparently, at sniffing out fake marriages. They read body language, behavior and general vibe in a way that is almost freaky accurate! So, few fake marriages get by them. Thank God for USCIS because these couples tricked me, but not USCIS...

    First of all, Thank you for the videos. They are helpful. Our position is that we are married in Thailand for 5 years. I am an american citizen. I have lived outside of the Us for 10 years. I filled 3 I-130's for my wife and 2 step daughters last week. Since I reside in Thailand I was able to file with the USCIS via DCF. Can you tell me what to expect at the embassy interview. My understanding is that all the paperwork will remain in Thailand is that correct.

      7rucus11 Yes -- you are requesting Immigrant Visas from the U.S. Embassy . . . when they are issued, THEN you arrive at the USA Border at the airport, and then when the Immigrant Visa is stamped, the visa holder -- like magic -- BECOMES a permanent resident upon entering the USA at the airport. Some additional paperwork gets actual green cards mailed to your USA address . . . this is sometimes a lot to coordinate and piece together -- lots of paperwork happening at USCIS, at the Embassy, at the airport, and then again at USCIS . . . if you have questions, please email me at immigration.art@gmail.com

    If you are BOTH in Egypt now, do it through the U.S. Embassy -- the forms you need are the I-130 and the DS-230. Contact the Embassy and they will help you. Save your money -- if you follow the directions, you may not need a lawyer. If the paperwork is too confusing, email me at

    In theory, yes . . . . but you'd be "lumped-in" with Europe -- see this link, near the end of the document, where they show the Lottery Country "Area Groupings" -- Africa, Europe, etc, etc . . .

    I am not sure what part of the form you mention -- does it ask for a street address? A phone number? An email address? Do they tell you WHY they need contact information?
    Normally -- if you win -- they need an email address (or a street address) to tell you that you won. I hope you are applying at the official DV Lottery site: travel.state.gov
    Entry is FREE and never ever never pay to enter the lottery -- if you pay, that is fraud and someone is stealing your money.

      kemar brown EB-1 Extraordinary Ability is one category. You'd first need to get a U.S. work visa. Maybe an E-2, if you are from a country that has an E-visa Treaty with the USA. I really dislike the EB-5 Green Card. It is a rip-off and represents America at it's most crass. But, some people LOVE the EB-5. I have a video about it.

    I got married to my American husband and applied 4 my papers. I got my work permit but since I changed my address, it went to my old address.. (even though I did change the address to my new place) now it’s been 5 months nd I have asked them to send my work permit to my new address, nth is happening!! They dont know what’s wrong nd they r doing nth about it.. I m super worried!! What can I do and why is this happening??

    Hey arthur i had a question, if i have an immigration lawyer who worked with me for my deffered action, i was to be aproved. Can i still apply for a green card.
