Arundhati Katju and Menaka Guruswamy are Indian public-interest lawyers, renowned for litigating the 2018 Supreme Court case that struck down elements of Section 377 of the Indian Penal Code, thereby decriminalising homosexual sex in India. The case was a watershed for LGBTQ+ rights in India, and has been celebrated domestically and internationally as a victory for human rights.

I as an Indian and as a gay in closet, am left awestruck and feeling pride that no words could express. I grew up with fear that I will have no rights and no freedom of expression in my own country but that view seems too pessimist now when times have brought such learned lawyers in our country. Thank you to both of you.

When India being boasting as a Hindu or Sanatan Society had this section 377 in the Indian Penal Code (introduced by Britishers) in 1861. It's an insult to the Sanatan. A society where Shikhandi was celebrated, The Shemale avatar of Arjun was celebrated yet we denied to learn anything from our past and inserted a section which is a crime to put it in first place. Someone's personal life is nobody's business, let it be on their karma. We are no one to judge anyone based on their skin color, sexual orientation, education etc. Thank god some lawyers stood up against this brazen "law" which restricts the fundamental rights of the people of the republic of India. Thank you.

Absence of penal laws is not equal to acceptance. The traditional approach to these things was to sweep it under the carpet.
You mention Shikhandi. You need to remember the deep sense of humiliation Shikhandi had to endure despite being a prince. He was also said to be the third gender because he was a reincarnation of one the princesses Bhishma abducted for marrying to his nephew Pandu.
It was her resolve for vengeance from Bhishma that led to her reincarnation as Shikhandi because as an abducted woman, she was "defiled". And had "no option to guard her honour but to self-imolate.

The effects of that judgment are not limited to the boundary of a country. It changes the conversation on this issue all over the Indian subcontinent. In a country like Bangladesh, people are now talking about homosexuality. Yes, most of them are indeed negative conversation, but starting a conversation is a big step in a conservative Muslim society. People began to know about it. Hopefully, they will get more and more information rather than just taboos from society.

Change is to start from our schools, not just Law Schools. Our textbooks, the ones which engage students at the Kindergarten level, showcases the perfect family as comprising of a Man and a Women, stereotyping gender specific roles in the process.
The textbooks need to be revamped broadly enough to accept the notion of a family consisting of a Man and a man, or a woman and a woman.
More so, the spectrum of sexuality is broad. Being straight, gay or lesbian is just the tip of the iceberg. And while Navtej Johar is providing legitimacy to all of them, by atleast not criminalising it, we are a long long way of in getting societal acceptance towards all the hues and shades.

So many in the comments talking about how the British brought this law. Well that was 200 years back and Britain itself has scrapped this law more than 50 years back.Although Hindu mythology has many examples of human sexual diversity, Indian culture has not accepted and still does not accept LGBTQ+ people.
I don't understand how they are justifying that LGBT were accepted before the British just because some gods were apparently sexually diverse. If it was, we would've have heard gay or lesbian couples from writings (not religious ones) before British came. Ppl might point out Kamasutra but I'm talking about a gay couple living their lives together not just the sexual act. And their acceptance in general society. If it were true, society would have had many gay couples till atleast the British came.

Saw her (Menaka) emotional and erudite plea for same sex marriage in the constitutional bench and was deeply moved by her passionate plea. And also found Arundhati' s answers to the CJI's questions reflect her legal prowess. Hope they finally have a married life legalized in their country.
Look at the confidence and body language of Menaka ... How was the previous bench not convinced by her. If she tells me anything I will agree within seconds she has that aura .

Liberal voices have no place in the vernacular and the English-speaking constituency is very small in India.
