This issue of same-sex marriage not being recognised is not just an outcome of ignorance, but also an outcome of a colonial/western mindset of a social and biological binary, when eastern cultures (like south asia) have almost always had a fluid relationship with gender and sexuality (even as seen in hindu mythology). it is genuinely disheartening to see this persist for this long when i and so many others deserve the same basic rights to love and marriage as any other person because it is human nature to love who you love.

@@Rudra-rf5cn what do you mean "hamara hissa"? pehle ke zamane mein marriage was only considered to be something for procreation but then log pyaar ke liye shaadi karne lage. toh same sex marriage doesn't come under that issue unless we talk about love marriages in today's times. however, in ancient hindu texts, homosexuality has not been considered a crime or a sin or anything like that, balki in many cases, homosexuality has been seen in regular circumstances, for example lord ayyapa was born of vishnu and shiva (mohini's form showing gender fluidity). therefore, it has not been explicitly called to be anything because it is considered nature to love whoever you do. the material world is of less importance than the soul's and it's wishes.

If you go to a prostitute and both are consent to have sex (by agreeing to the price and hour of service), does that mean you are now married to that prostitute?
That is the difference between sex through marriage (which could create family) and sex through hook-up culture. You cannot equalize both with a simple nonsense like "consenting" and basic rights. You are human living in a human society, not a stray dog.

I listened to most of the arguments made during the 10 days of hearing spread over almost a month and this argument from Guruswamy was the most succinct and the most compelling argument. She delivered a masterclass. It is sad to know that the majority of the judges were not persuaded and our brothers and sisters from the LGBT community continue to be treated as second class citizens.

As per PC-PNDT ACT (undeveloped genitals by birth), SC forbade parents to decide for their kid's surgery in favour of a Son before 18 yrs. Such kids after 18 may have difficulty being a boy and engulf into mixed emotions to homo or hetero sex. They may have harmonal urge of a girl to love a boy i.e. the surgical boy will love a boy - So no question of "marriage is b/w a *biological* male-female " can avert these unconventional conditions, as by NATURE itself such babies are born.

Biological sex and sexuality are different things.
Sexuality is about what you are attracted to, so either same sex or different sex or both.
Homosexual means same sex, heterosexual means opposite sex and bisexual is both.
Sex is either male or female, but due to gender dysphoria, you do not identify with the sex assigned at birth. Hence, you undergo transition. These people are what we call transgender.
Both gays and transgender are very different.

This is absolutely stupid. Look into the arguments put by advocates and Justices in this matter. Chief Justice just announced that the Honourable Supreme Court cannot entertain popular morality because if they go by what young people feel then they afterwards have to listen to what many other people feel. Listen to the arguments put forth by the Solicitor General and how the bench agreed on the devastating effects and ramifications of legalising same-sex marriage on the personal laws, Special Marriage Act, Constitutional laws, Criminal and Civil Procedure, and provisions and laws and safeguards for women. The problem is that people are seeing this without even a smidgeon of technical knowledge, and it is not a problem but people should restrain from speaking on the matters which are exceedingly severe. Same-Sex Marriage entails Identity-crisis (just like what is happening in USA) and after that Identity Politics. There would be thousands of petitions on the identity issues with the defence of 78th paragraph in NLSA v. UOI (2014).
Attorney General is not wrong when he said to thr bench that no one id stopping them from marrying whomever they want without registering it. He even said that his marriage is not registered, and they don't depend on thr State in the matter of marriage.
Same-sex marriage also entails people wanting special provisions, reservation, and so on. There is so much into this, and people are behaving like they understanf everything. First look at the severity of the matter, then think if you should dive into it or not.

Forget the moral obligations, even technically, when a male and a female parent is required in every verification and confirmation, long processes, etc, saying that we can just replace words with those gender neutral things is too soon. One problem with legalizing same sex marriage is normalization of the LGBTQ views. Just like you're not supposed to force your religion down someone's throat why should the LGBTQ agenda be forced down people's throat . People want to be gay, great keep it yourself. You want to be a Muslim or Hindu keep it yourself.
Don't try to change the law or add laws for your own selfish gains. You want traditional rights and norms you need to stick to traditional rights and norms.

If I'm not wrong you still maintain the same rights as an Indian regardless of your faith. What I meant by shoving it down people's throat is when religious people (of any community) go around preaching that others should do what they believe in and believe that special laws should be created for their people.
Marriage has always been between a man and woman. What is your reason for changing that law now? If you choose something out of the norm why do you want everyone else to adhere by it.

Religion wise, it doesn't make sense that a Hindu country does not have same sex marriage. It should be natural considering that all living beings have divinity (Om) in them equally. Besides the philosophy of Ardhnarishwar is all gender embracing. Thousands of years back, it was a more Inclusion based society than it is now.
