If you build a fence on someone else's property, you're basically giving them a fence. You have right to do what you want with a fence no matter who put it there if it's on your property. If I park my car on your driveway, you have every right to have it towed away because it's your property.

I would think that he would be well within his rights you are simply run a loader to that and dispose of a defense debris on his property. I thought it was a very kind gesture to take the fence down carefully so that it could be put back up. If he had taken the old fence down, and completely erected a brand new fence on the proper property line, she's still would have been, because he stepped on her grass or got sawdust on her property.

This was a civil matter, the fence shouldn't have been removed without a court order.

The buyer is going to be a horrible neighbor. All he/she needed was a written agreement to move the fence om a timely manner. Problem solved instead of having a hostile neighbor.

Briscoe Homes handled the incident wrong all day long. At best is was unprofessional. Briscoe Homes knew for YEAR'S the fence was on their lot. He admits that he was aware of the problem BEFORE the lot was listed for sale. An emergency for Brisco Homes to go to closing NOW does not constitute an emergency for the neighbor. In fact, if Briscoe Homes had approached the neighbor BEFORE the sale, the neighbor would have purchased it. Bottom line: Be vary careful if you're planning to do business with Briscoe Homes in that they knowingly withhold information.

So, she knowingly bought the house that way. You should have also asked for names on who told her what she claimed because I think she was lying.
