    The fence was declared on neighboring property 7 months ago. She waived the 6 months notice when she was made aware 7 months ago by survey discovery .

      @texasslingleadsomtingwong8751 I seriously doubt you can make that statement. Perhaps you have the dates since you seem specific with 7, 6, months? Do you know these people? Are you an employee? I ask because not even the guy in the video was specific about the dates of his actions. State laws vary, but in a number of states, if you know for years a neighbor has encroached on your property, you forfeit it in the end.

      @smartazz61 Yes, because it didn't become an urgency requiring the fence removal until closing day when the buyer used the fence encroachment as a way OUT of the purchase contract. Once that happened, HOMES in an unprofessional manner made the issue an immediate problem. They didn't want to lose the sale, and in an attempt to not give the buyer an out clause at settlement, they acted unprofessional.

      AS a home owner before buying the property get the survey done that shows the property lines. Never trust any agent. Her fault trust but verify....

      Calm but incorrect. There’s no state that allows anyone to tear down someone else’s fence, even if it is on your property, not without an injunction. As a surveyor, you should know that from having to testify in such cases. If I had a dollar for every time I hear the cops tell someone “if it’s on your property, it’s yours and you can just tear it down.” I could just retire and they will still be wrong.

      He didn't go out of his way when he initially knew there was a discrepancy when he bought the property did he. He bought the property before she even lived there and that fence was there before she was. at 11:11 he states that 80%of the fence that was being taken down was 15-20 years old. She did not build it. He was hoping to pass the issue to the buyer but they called him on it. This is what he is teaching his kids with him.

      To be fair, many people don't get a fresh survey when they buy a house, they just trust the old one that could have been last done when the house was built. Add to that, the mapping data that your state has may not actually match the survey data and if you didn't know that was a thing you could encounter someone thinking they are correct when they aren't.

      @@reallunacyas I work in the industry, the survey is king regardless of when it was done. The only reason you'd need to get a fresh survey is if the land was being re-sectioned into new plats. And even then, the practice is still the same, the only difference is that we use GPS in order to plot the survey digitally in CAD. Otherwise the process and the result are the same now as when Washington was surveying.

      @@One_Bar I just know that the survey for my house was done in the 50s and was a pain in the rear to find because of the county having changed systems and that if you go online and view the GIS data which is all that the website for the county tax assessor's office has, it doesn't match the survey data. I know my survey is king and the GIS data doesn't truly matter, but most people don't know either exists, much less the difference. If the lady bought the house and only saw the GIS data and saw the fence was already there when she bought it, I can understand the confusion.
      Her biggest issue is not responding to them when they reached out.

      @@reallunacy iirc, she said she saw the fence on her plat or survey, one. If you bought the property, then there was a physical plat description which is just as good as the survey but would have allowed for an easy resurvey into the current system. We have plats through all the time from the land rush days so I get it.

      Disagree: She stated that she brought the property six months prior, she paid for a survey, and provided that survey to the fence installers. It's typical for some new home owners to purchase a land survey after buying a property if one was not provided at settlement.

      i'm not sure, also the little print somewhere in a 200 page contract is not really the same as disclosing. when buying a house you need a survey conducted by someone who you pay and reports to you only!.

      @@williamrose8944 No, they don't. All fence companies have agreements you sign before they build your fence, that if you don't purchase their site survey service (if they even offer it. Many of them don't) then YOU have done due diligence, and that by signing you are proclaiming that your fence or outline for your new fence has been properly surveyed. Any property disputes fall solely on the owner. The fence builder is there simply for that purpose - to build the fence where they are told.

      @@paradigm4703 yes but...he had notified previous owners of the issue ling ago...so not sure just because she bought 6 months ago that it applies. Also, part of it was his old fence that she redid and mated up with her fencing.

As a surveyor i know that just because a lot line shows the fence over the property line it doesn't mean that that fence is on his property. She may have acquired that property through adverse possession. He should have notified the property owner as soon as he became aware of the encroachment and notified his lawyer . now he has set himself up for a lawsuit he may very well lose.

      It's not always as easy as using the piece of property. Do we know that she has been paying the property taxes on the piece that she adversely possessed.

      Well there’s no way around this - she should have known better. I guess she just assumed that, judging by the appearance of the fence, it seemed to have been up there a while, she guessed that nobody had complained about it, etc. But she definitely should’ve gotten in touch with the other property owner to resolve this, before she attached new fence to the old fence.

      @Oracladeus Actually she had the property surveyed when she bought the house and knew the fence was going up on his property. And when she had it fixed and new stuff put up she did not tell her fence man to fix the problem. So she takes him to court and their is a good chance she will lose! As for that six month notice, if you “unknowingly” build something on my property and I want you to move it. That is when that notice comes into play!
      If you don’t know law then STFU and move on! The guy could have taken the fence down and kept all the fencing material for crying out loud!

      @Oracladeus If someone built a fence on my property, regardless of how many years I let it slide. You can count on me tearing it down whenever God giveth me strength and the desire to do so. Because that's MY land, that I worked for. They would get a visual notice. Their fence would be gone.

    I had a similar experience. Two weeks before closing my lawyer informed me that the fence was installed over 2ft on MY side of the property. In other words my neighbor was on MY property. Multiple verbal and written attempts were not responded to. I paid for another survey & hired a fence company to remove the chain link & replace with PVC. I informed him of the non response. He responded "happens quite frequently but the survey is definitive. The old fence came down, new fence went up, neighbor never said a word. Fences make good neighbors.

      @@BriscoeHomes I just have a question. Was there a fence all the way around her property when she bought it? She has a beautiful new fence around her on property on 3 sides. I didn't notice one around the lot that you owed. Sometimes fencing is put up as purely a screen from a nosey neighbor or an unsightly yard.

      She should have put up a new fence on her property line and not attached her fence to his. She had a survey of her property line. You don't have to put up a fence on the property line. If you want it 4 feet inside your property line you can do that. You still own the 4 feet to mow, grow flowers, etc.

    According to the Texas Agricultural code, a neighbor can’t remove your fence or a jointly owned fence without giving you a 6-month written notice first. They’ll first have to consult with you to get your approval for the decision.
    If your fence is attached to the neighbor’s fence, they still have to give you a six-month notice before removing their fence.
    However, if the fence lies on their side of their property line, they can remove it without your consent.
    So, You have the Right to Remove the Fence without Their Consent if it is over the Property Line. But UP to the Property Line Only.
    Adverse possession also works in Texas, where a neighbor can lose part of their property to the encroaching neighbor. Under Texas Civil Practice and Remedies Code § 16.024, the neighbor can claim the portion after 25 years if you’re yet to contest their encroachment.

    You guys did everything right. She had 2 days to get ahold of you & didn't, heck she had months to resolve it because she knew the fence was over the line. You preserved her fence material which will save her from added costs. You did the work that she should have paid for with the uninstall.

Seems like she figured out how to communicate REAL quick once she learned that he actually followed through with taking the fence down like he said he was going too😂 They weren't even finished taking it down and in that short time she finally learned how communicate! It's impressive how fast these "single mothers" learn when it's down to the wire.. should have made contact and worked something out when you had the chance like a respectable land owner and human being 🤷‍♂️

      @@BriscoeHomes Well the situation is unfortunate all the way around. Her fencing guy failed her, the title company failed her, her home inspector failed her, and her real estate agent failed her. They are the paid professionals that are supposed to catch these things and inform her, not you. You are a real estate professional she is not. And you shouldn't have to be a real estate professional to buy a home, you shouldn't have to be a doctor to go to the doctor. That is what professionals are paid for, and the ones she paid and didn't perform their duties are the ones she should be suing for this. It is their job to notice these things and make sure she understands.
      Yet Briscoe Homes comes out as the bad guy, not the people the single mom paid with her single mom money and didn't do their job. I mean just ask the dispatcher.
      P.S. If you notified the previous owner about the fence it should have been on the disclosure forms for the house when she was looking at it. She might have a case against the previous owner as well.

      Was kind of crappy that in the note left came across that he would come by later and hopefully come to a resolution. But instead didnt wait or talk to her, just started taking the fence down. Yes, at the end of the day it was her responsibility but only bringing it up 2 days prior then not handling it like note read, I can for sure understand her frustration.

    She knew exactly what she was doing. Fence installers know how to read surveys and I bet they warned her she’d have this trouble if someone ever tried selling the property and they did a survey and found out her fence was on his property but no she wanted to steal that extra land for more space.

      "Fence installers" probably don't know shit about a survey. They say where do you want it... maybe spray a line and build. Don't assume what anyone knows. Assume their idiots.

      In NY state you can not put up a fence without a survey of the property. In some towns (mine specifically) the fence has to be 2 feet from the property line.

      This situation seems a little different. It appears the fence has been there for years and when she bought the house she hired someone to repair the existing fence which resulted in some new panels being installed. I'd suspect most people repairing a fence wouldn't ask for a survey.

    I'm reminded of the house I grew up in. It backed up to a busy street and my dad had built the fence 6 feet too far down the bank. We had always mowed both sides, along with the strip between the sidewalk and the road, and it hadn't been an issue for years until it suddenly was. So my dad moved the fence and we stopped mowing the side that was community property.

    The neighbor lady was 100% wrong of course. She had a survey and knew it was wrong when they put it up so whatever happened after that is her own fault. The only thing I would say to Mr Briscoe that if this type of scenario happens again is to immediately alert the neighbors they are on your property and give them a reasonable deadline to move their fence. Again, the neighbor is at fault, however, much of her frustration had to do with having to react immediately to correct this. And finally, not sure about Texas, but some states have adverse possession laws which means if you allow someone to use your land for a long enough period they can legally be declared owners of that property.

    Neighbor asked if it was ok if his horses could eat the grass on my property - I said sure. Then he wanted to build a fence on my property to keep the horses from going to far onto my property. I said only if he wanted to sign a lease agreement to rent the property the fence was to be built on - I was only going to charge 5 dollars a year lease, and I asked for a lease to prevent him from coming back later saying the property was hid because I never complained about the fence. Never heard a word from him after this. You need to be careful about people using your property with no written agreement or understanding what the property lines are.

    You should've told her that you were going to bill her. I experienced the SAME exact scenario a few months ago after buying a home here in Iowa. I tried to be cordial and work with the neighbor and even offered to remove and replace the fence at my cost, but was met with the statement "I've been here 20 years and I'm going to do whatever I want. My attorney advised me to take down the fence, and while doing so my neighbor called the cops during the process. The cops came out and said they couldn't do a thing.

      Maybe next time she should not make a sneak move and get the fence guys to put up the fence further than what it should be so she gets MORE yard. Backfired didnt it.
      Had the fence been ON THE BOUNDARY LINE, then the rule about notice period would have been correct, but the fence was ILLEGALLY put in the wrong position. Stiff shit Karen.

      She understands the law. Texas Code Sections 143.121-.123 says that if your fence is on someone else's property, they are required to give you six months notice before taking it down. The developer thinks he can ignore the law because he has more money than her.

    I've had to go through this twice.
    1. Neighbor claimed my fence was 2-3 inches on their property. My fence had been up for a year and they were putting up theirs. I had about 4 hours notice. I still took mine down because it was likely - though no certain - that my fence was on their property. But they were going to adjoin mine anyway so what the hell. No big deal. I removed mine inside 2 hours.
    2. HOA had their fence on my property but had no easement. I bought the house and gave them a year to move mine, including offering to sign an easement if they'd draw one up. They didn't. So I yanked theirs out of the ground. They were upset and threatened to fine me but I told them that (A) it was clear their fence was on my property; (B) that they had no easement; (C) they had a year to rectify the issue and did nothing; and (D) Given those facts, the minute I got fined I'd sue the HOA and the entire board personally (though that'd probably get dismissed) - and that I had more money in the bank than the HOA so my entire goal wouldn't just be to win but to bankrupt the HOA. They decided to let the matter drop and never tried to put the fence back up or even move it, even though I tried to take it out so it could be reused.

    As a business owner myself I just want to say congratulations, you should be proud you did everything the right and honorable way, and you put on an absolute clinic in patience and respect, you went above and beyond to accommodate for the other home owner, plus you paid to have it gently taken down and neatly given to her, I mean you even put in the hard work and sweat of busting that concrete out yourself and you definitely didn't have to go above and beyond like that, just so she could still reuse the posts if needed, it was on your property and the old portion of fence was yours also regardless, and you could have went the easy route and got below ground level with the posts and just cut them and covered them up, it is an unfortunate situation but you handled it like a true gentleman...

    Me being in the fence industry for almost 40 years, you can install chain link fence panels within two hours to keep her dog and kids in.
    With the fence being on his property, it's his fence. Her bank, real estate agent, and her surveyor should have given her better advice.
    When our company installs a fence, our contract very clearly states that the client is responsible for telling us exactly and specifically where their property lines are and where they want the fence. That is their responsibility, not ours.

    We had something similar with my property. City ordinance states if neighbors share a fence and the fence is damaged, it is the responsibility of both parties to split the cost to repair the fence. My fence fell one night during a winter storm and the neighbor went to my parents home at 0700 in the morning wanting it fixed now. We did not even realize yet that the fence had fallen. We were trying to work with him on it and he wanted to part in it. So I had the property lines marked and moved the fence 12 inches to where it would be on my property and he was responsible for his side. He tried to tell the company that was putting my fence up to connect to his fence and they told him they were not working for him to connect the home owner. He told me I had to have them connect his fence to mine and explained that the fence is now on my property and the fence on his property is his responsibility… he was not happy but he could not force me to do anything. Luckily, I have new neighbors who are awesome.

    A snippet of this video came up on IG reels and being that it was Denison, TX, I was instantly interested. I did a few projects at the Ruiz plant there. Between establishments like Huck’s and Loose Wheels and the overall great community, Denison quickly became one of my favorite towns in Texas. As for the video, you handled things well.       I'll add, Kudos to Briscoe. He's well aware of his rights and treated her with kid gloves. I recently went through this with an investment property and met the same resistance; shock, disbelief, futile arguments and ultimately acceptance that they had no rights to my property. It's tough to see that what you knew wasn't in fact your property but had grown accustomed to using as if it were yours is now over. She argued the best that she could with little to no knowledge of property rights for something she had grown to accept as her domain. She'll get over it and learn some lessons of life along the way. She at least wasn't belligerent. In these times that's something.

    If the fence was in place for fifteen years, then it is possible the single mother now owns own that three to four-foot section of land up to the fence line in question unless sometime in the first seven years of that fence's existence someone make a written agreement the fence line does not constitute the legal boundary. I believe the law is the same in every state, that an uncontested fence line establishes the legal boundary after seven years in place, especially if the person uses her neighbor's land within the fenced in area the entire time.
    She should go check the law, because removing the fence after fifteen years would not automatically reverse her adverse possession of the three to four-foot sliver of land.

    Like a lot of responses below, she acknowledged that she had received notification of a problem 2 days prior. The first person she should have called was the real estate office to work out what could have been done or what her intentions were. With the realtor having no contact or information to work from with from her, he had no choice but to take the action he did.

    My dad ran into something like this. He had a house and the lot next to it. He built the deck for the front door that wrapped around to the back side and came down onto the other lot. The back door deck also came onto the other lot by several feet. When he sold the house, he told the buyers the lot next to it was sold separately and if they didn't buy it, then the new owners could make them remove the decks. The buyers said they would buy it, too, but would need a couple of months to get the financing ironed out. He gave them 6 months, and they stopped returning his calls to set up a closing date for the other lot. They finally refused to buy it and said they didnt have to move the decks. My father informed them since he did not include an easement in their deed when he sold it, they were not allowed to keep the deks as is without buying the other property. Lawyers ended up involved, and my dad won the case. He was told he could go up to the property line and remove anything on his side of the line. That is exactly what he did, but not as nicely as this guy. My dad took a chainsaw and cut off what was on his side.

      She should be thanking him for all the labor and material costs he saved her! Because she's the type to blame others for her failure to do what needed to be done, she's the type that was most likely doing all this so he'd put the fence back up on her property, and paint the entire thing too! LoL.

      @@BriscoeHomes we had a neighbor who claimed our fence was on his yard, we have survey person come out and proved it was on our lot. the neighbor was pretty mean. He once moved our sprinkler rake because a DROP of water landed on his car as he was pulling in... conclusion, with that and many other things (he called the cops making up stuff.. ugh), we had a new house built, moved and a lot happier. Now if I can get my son to clean up his legos...

      Justin, it is obvious to me why you were max fined. You drive a Lexus, you own property all over town, you are all over the internet, you have the air and arrogance of success, but yet, you are delinquent paying Denison and you don't know the law. That pisses both Denison and other people off. Denison goes after you hard because of the Willie Sutton rule-YOU HAVE OR CAN GET THE MONEY, yet you refuse to give the money to them. The owners of the other ill-maintained houses you show in your video are likely owned by people with fewer resources and a lower profile. If Denison makes an example out of you, a perceived big fish, they will increase collections through fear from people who can't afford to hire a lawyer. The IRS uses the same collection tactic because it works. I used to defend clients before the IRS.
      You also admit that by allowing your properties to fall into disrepair, you are minimizing your property taxes, while Denison wants to maximize their tax base and make Denison look better, so there is an obvious tension. The city wants you to timely pay, and as you admit, you have plenty of non-liquid assets with which to pay, but through your financial mismanagement, you are cash poor, from time to time. Your LLC needs to use a bank line of credit secured by these non-liquid assets, so that you can timely pay your bills instead of waiting until you close on a property. Waiting to close to get a sip from the cash flow spigot has caused you at least two problems you have self-reported on youtube: this warrant and Maggie's fence. Maggie's fence is two lots over--clearly shown in this video. I have previously commented on you tearing down Maggie's fence and her adverse possession claims against you.
      Because you were under cash flow pressure to close on your vacant lot between your old Victorian house and Maggie's lot, you trespassed on Maggie's lot and tore down her fence, while you knew she was at work, all because the buyer for your vacant lot between Maggie's lot and your old Victorian house lot was thinking about backing out at closing because Maggie's fence was over the property line by several feet, as clearly shown on the Plot Plan you published in the Maggie video. But see how that Plot Plan facts can be used to help Maggie prove adverse possession in the Miller below.
      Ignorance of the law is no excuse. Through the adverse possession of Maggie's predecessor's in title and herself, Maggie now owns both the fence and the sliver of land that runs 3-5 ft thick for the length of the fence (50-100 ft or so) that the misplaced fence enclosed. Through a legal concept called adverse possession, neighboring lot owners lose slivers and strips of land along misplaced fences and hedgerows all over the nation, including Denison, Texas. If Wang was the original buyer who was thinking about backing out, then he knew he was buying a lawsuit with his vacant lot.
      In addition to an adverse possession case, Maggie could bring a claim for unfair business practices against Briscoe Homes LLC in that you used self-help instead of the Court to resolve the fence line dispute, while rapidly clearing away your perceived impediment to closing on the vacant lot, so that you could get your cash flow "fix" from the closing "dealer." Again, use a line of credit, to smooth out your cash flow, so you can timely pay people and not be so desperate to close.

    Here is a way to be nice even if you don't have to.
    The fence contractor is there right now.
    Get him to quote a on the spot deal to step over 4 feet drill holes and put it up where it needs to be.
    Help her out, make a friend and get some good will as a Real Estate Investor. Pay it forward my friend. It will come back to you.

    Instagram sent me here. Having installed 230ft of vinyl privacy fence on my property (after a survey), I dealt with issues from my neighbors. Having done my homework and following every town ordinance, I knew I was totally in the clear and any "issues" my neighbors had were irrelevant. Now I have complete privacy on all 4 corners (I installed 8ft tall panels!) it feels oh so good! Just wanted to share my experience

      @ wonderer1983, I would not gloat over it too much since one gallon of gasoline can melt quite a bit of plastic fence. It always pays to be nice to your neighbors, your privacy fence will not save you from an endless string of accidents in the middle of the night. Cameras can be disabled, animals can be poisoned, cables can be cut, which cost a lot more than a fence in the long run. Neighbors can do all kinds of things that are counter productive, just remember that before you even move into any neighborhood.

    If you leave a fence on your property, MANY states will allow this to persist, and even legalize it, due to "adverse possession." You have to be aggressive from day one, IN WRITING.

    That lady's realtor should had told her, but maybe they did and she just ignored the information.. I know when buying a home a ton of papers are thrown at you and it is overwhelming at times I am sure she was excited at the time.. If her fence contractor ignored the property line then she should go after them for a new fence

      Realtors lie to make sales. Happened to my father. He owned the vast majority of a large pond including a peninsula. Someone purchased the lot next door and then proceeded to use our land thinking it was theirs due to the realtor lying to them. It led to a messy situation.

      The biggest thing I don't understand is her saying you should have given me some time. You just notified me 2 data ago. If this was my house and I was notified I would have called them that evening or the very next morning and let them know I'm aware of the problem. I'll get it taken care of. Could you give me a couple of days to line up a fence guy. That way the seller had something that he Could of taken back to the buyers and let them know the fence is being dealt with. But now she goes with I didn't get enough time and for sell I know you could of have given my daughter a bogus survey. She thought she Could do things her way and it will ok.

If one of them were to remove the fence without the other knowing, cattle would be free roaming all over Texas. 🤣🤣🤣 Someone gave her bad information.

      He didn't go out of his way when he initially knew there was a discrepancy when he bought the property did he. He bought the property before she even lived there and that fence was there before she was as noted around 11:11. He was hoping to pass the issue to the buyer but they called him on it. This is what he is teaching his kids with him.

    Both parties have reasonable objections concerning the fence. Briscoe Reality and the Single Mom who has only been in her newly purchased home of 6 months could have mutually found a resolution to this issue. Since Briscoe Reality has known about the fence prior legal issue it should have been taken care of by them when it came to their attention.

    Knew a family that got into a land dispute. Previous owner of one of the two properties declared his property line was actually a 2 - 3 feet into his own property than what it actually was. And both parties just went with it. This went on for years. Then that person sold the property to new owners. Who did a survey and built a fence about a foot from the actual property line but way past the mark that both previous neighbors had agreed to as the property line. Raised a huge stink. The wife of the neighbor refused to believe that the new neighbors hadn't crossed the property line and was making comments about suing the new neighbors. Ordered a survey. Got a dose of reality. Neither woman (wife of both neighbors) are on speaking terms with each other. And this was years ago. But this is like the demilitarized zone between North and Sourth Korea. Both women keep to themselves and don't cause any additional flare ups. As for the husbands, they both know they are dealing with hard headed women. But worked together to remove some trees that both parties needed gone and where right on the property line. The women stayed out of it. The last time I asked, I asked if things had improved with the neighbors. He just shrugged. That is life I suppose.

    If you build a fence on someone else's property, you're basically giving them a fence. You have right to do what you want with a fence no matter who put it there if it's on your property. If I park my car on your driveway, you have every right to have it towed away because it's your property.

    She knew enough to contact her fence guy, but didn't call back the agent that was attempting to reach her? She was given notice and she chose to avoid said notice. You handled this beautifully, BTW.

      But it’s just as much his fault for not working to get it fixed before then and for not doing a survey before he put it up for sale or as part of the sale process .
      These house flippers are a shady lot … I used to work in the mortgage industry . From the flippers to the realtors to the loan companies … The housing market is what I call the children of darkness .

    I know that in the state of Missouri, in my town, you have to get a survey done before you put up any fence to ensure that there is the establishment of boundary lines. If the surveyor finds that the fence is not on the boundary, they will will note it and make it legal. Those contractors that installed that fence should have know better and should have wanted to see the legal descriptions of the lots.

      Never trust the location of an old fence. LOL
      In Missouri, property lines are a little fuzzy. Most land paperwork will say "give or take" on the dimensions.

      She had a leg to stand on. She was right, he broke the law. Texas Code Sections 143.121-.123 says that if your fence is on someone else's property, they are required to give you six months notice before taking it down.

      @@JimmyACLU that pertains to fences that exist on the property line or fences that are attached to other owners fences. He had no fence. That fence was built on his property and he even left 12" pieces on both ends for the next installer to cut back and attach it to. I wish I lived next door to you, so I could build a fence 15' into your property and say it's mine now!

    The "Karen" knew that fence was on the neighbor's property. During any real estate deal, a survey is ALWAYS done so the buyer knows exactly where the property likes are and know what they are buying. She was hoping no one would say anything about it and they could keep the extra land.
    Under Texas law, a property owner has a legal right to exclude others from their property. If you put a fence on someone else's property without their permission, you are essentially trespassing on their land, and they have the right to take action to protect their property rights. The person has the legal right to simply remove it from their property. NO notice needed.
    She was just blowing smoke..........
