As a burglar, this HOA is genus. It used to be that you’d have to put time and effort into finding a house to rob, but now I can just walk in and take whatever I want! Thanks HOA!

Isn't a violations of 4th A unreasonable search to force people to have their interior rooms open for public display? Also to sort of flip the finger at the HOA if they force me to leave my garage open I would install a floor to roof metal bar or chain link inner door so no one could enter my garage. Also most garage have a interior door letting you in to the main house which may not be as strong so they are inviting home burglary or a potential home invasion --- that could be argued as a serious safety issue.

My husband is a vet and in order for him to receive certain benefits (loans, healthcare etc) we are required to stay in the city. And here in Chicago the taxes and cost on anything is outrageous and the HOA is in every building thats either not an actual house or a privately owned building. So ppl like us who are only making 46000 with 4 kids don't have many options bec of how expensive things are here. So another example of of not having enough to not have to pay for something unnecessary. I know that sounds dumb but its true.

The HOA or community concern is limited the view of a person walking on the curb: the curb appeal of the home. Yes, maintaining property value is important. That's it. Nothing else. Don't let them boss you in your own home.

HOA's are managed BY THE HOMEOWNERS! SOMETIMES these are farmed out to HOA MANAGEMENT companies....... BUT, regardless of WHO is the representative manager. The HOA members must abide by COVENANTS AND RESTRICTIONS. Most in the community are probably HOMEOWNERS while some are RENTERS. IF A HOMEOWNER "RENTS" their home, they general are responsible (per the HOA legal documents) that renters are informed of the rules. Look to these documents (including legal HOA RESOLUTIONS for "changes") to resolve conflicts.
All depends on the level of corruption the court in question has developed. Power corrupts, it is inevitable for every institution known to man. But there's always a chance it hasn't happened yet.
The "HOAs" ARE thieves. They're writing down everything in those garages and handing it over to their partners in crime to steal. That's before the "HOA" makes up some ridiculous "violations" and racks up tens of thousands in "fines" on you so "HOA" mafia can steal your home too.
I'm in the same field, naturally I also agree with this HOA rule as well. It would be nice to see this rule implemented in a state with stricter gun control, this neighborhood is in Texas, so we could still be dealing with some work safety issues even with the removal of these unnecessary garage doors.
@Kaleela Edwards some don't allow you to leave them open. This case is specifically because they suspect folks are letting others use the garage as living space.

You're required to honor your side of the contact. There already is a system in place to fight against your HOA through their own CC&Rs, running for positions on the Board, and finally through the Stirling Act. If you do not wish to have to abide by the HOA's rules, then do not purchase a property within a HOA or reside in one as a tenant. The government is not going to get rid of HOAs. They're a type of land use which government has no right to deny.

HOAs were supposed to be to keep the neighborhoods nice and clean, to make sure everyone's lawn was orderly by hiring landscapers with what was essentially a group discount. Imagine signing a contract to have a huge tree taken down in your yard for $400. They come and take the tree down and you decide. Well.. 400 is a lot and you really only want to pay $200 instead. Should you take the tree trimmers to court and sue them to have them reduce the bill? When you agreed to 400 and signed the contract and moved forward with it? The tree trimmers are the ones that need to sue. And in this case the HOA needs to sue and fine people who don't abide by the contract.
@@guidedmeditation2396 Contracts aren't written in stone and there are aspects of contracts that can be deemed illegal, or unenforceable. Not that this may or may not be the case here but it is a thing. In your example, it would probably fail in court, I agree. But if the contract stated something like, if we feel like it, we don't have to do it, that might win in court.

My ex wife wanted a HOA so badly. The exclusivity that came with the gated community was very appealing to her. Everything was so prim and proper. She loved all the little rules and stuff like that. Apparently not enough as she moved out not long after I stopped paying for it. 🤔
I would stick a bill to the HOA office window in fine them $200 for not open when they're supposed to be see how they like it and then every time I see they're not open when they're supposed to be they would be getting bills every time I bet you liked it would stop real quick
Will the HOA take responsibility if items get stolen during the hours the garage doors get left open? Then compensate the homeowners? If someone is illegally renting out or otherwise allowing occupancy of a property, how is this the HOA's business? Is this not the jurisdiction of the Authorities IE: Government? So what happens if a HO removes the garage door and installs a wall, making this space internal to the house, and then has someone occupying it? What id the HO is not member of the HOA. Presumably the tell the HOA to get stuffed. Glad I leave in country where this doesn't happen.

It should be voluntary and not mandatory as common sense dictates. The state of your garage door should be up to the homeowner and not a group of people that think they know better than the owner what is right or wrong.

It's entirely possible that somebody is bribing the HOA so that they can get a good look at the resident's cars, either to find somebody by their number-plate or to plan out car-thefts.
That’s also an easy access point into your house. Unless the garage is facing a neighbors window or the street it can be the perfect cover space for someone to break in.

Generally an HOA to protect their home values by preventing your neighbors from leaving broken down cars in the front yard or never mowing their lawn. HOAs that get power hungry like this are absurd and need to be fought against. Ultimately it’s your own neighbors making these rules so if the majority speaks up against them they should be able to overturn the rule.
It’s a balance. In most parts of the world, the common areas deteriorate pretty quickly, since nobody wants to chip in for upkeep, but inside a unit might look first class since they have extra pocket money that would have went to HOA. It depends if it’s worth it to you to pay a group to perform upkeep on the common areas.

Its so the HOA can scope out your property and steal it. Everyone has a constitutional right to privacy and yes your garage, backyard, house, etc is constitutionally protected under your right to privacy.
HOAs are not the government and therefore not subject to the rules of the Constitution. Which is why power-hungry busybodies love to use HOAs to control their neighbors.

@Dave I believe when the older generation sees the younger calling for some sort of change and improvement, they often leave it at entitlement. I also believe that it isn’t the fault of the older generation, I think it’s just a physic of change and part of why it’s so hard to change society in general. @Dave I started with an advantage? The economy dropped. Jobs were less available. Banks didn't want to loan and money inflated. It isn't just your generation. It truly is each one's before it fault. When my grandfather was a kid he was paying 5 cents for a bag of candy now I'm pulling out 5 Bill's to pay for that same bag. And before that, my 80 year old grandfather was buying cars for 1000 dollars but his grandfather was buying cars for 100 dollars. Money became more scarce and inflated with each generation. There are tons of economical studies made by people who are paid the big bucks to find this out for you. It's one Google search away. But this isn't the point. HOA's are more than just a few 'rules' Dave. It's a ball and chain on freedom. I can't close my garage door? What's next? Can't close my windows when I change? How about lock my doors when I go to work? Open your eyes.
Update: HOA newest rule, residents now need to leave their windows open and doors unlocked between 9pm and 6am so pesky alarms won't be triggered do to burglary disturbing other residents
Hoa Update: You must leave your houses this Friday between 6am and 9pm, open your doors and leave all valuables in easily accessible places and unscrew all anchored flat screen televisions. Hoa inspectors will remove any suspicious objects found in your home.

your right i dont get it, i have a family member locked into a HOA subdivision and he has like 4 choices of colors he can use 7 choices of outdoor structures that can be in the yard and they all vote on changes/ decisions in the neighborhood, pool and clubhouse

First of all, don't buy a house in an HOA neighbourhood. Paint a mural of the inside of an empty garage on the outside of the garage door. Leave it shut and locked.

HOA is such a scam. Even though you bought the Townhouse/Condo, you essentially have to pay monthly rent to HOA for an extremely overpriced gardening service, and to make sure your neighbor doesn't paint their house a weird color.

My parents had problems with their HOA. All it took was 51% of the members to get together and agree to dismantle the HOA. End of HOA and it's problems!
NaKaRa it's usually takes 10% of membership to call a special meeting. Then you have to get, in my case 2/3 supermajority,to dissolve the HOA. It's all in your HOA documents. Look it up
Lil Crumb when making a major change in an HOA, it's critical to have a team that goes door to door and gets voter proxies (if you cc&rs allow proxy votes). Then you can get enough to make the changes. I've been there and done that!

Drake Harris That was one of the things I looked for when buying my home. I did not want an HOA. My friend’s sister lived in an upscale neighborhood with an HOA. It sounded like a nightmare. You were not allowed to park trucks in front of the homes. You were not allowed to have parties on the weekend. All dogs had to be behind a fence in the backyard, even if you had a fence or gate up front. Other ridiculous things as well. She was always being fined and taken to court. She always won her cases, but she eventually got fed up and left the area.
I'd never ever in a million years live where they have an HOA with their ridiculous rules. And to top it off, you have to PAY to live under those ridiculous rules.

The neighborhood I used to live in as a kid, that has one has recently started putting out actual little patrol cars with the neighborhood name in the side of the Car. These people need to consider talking to attorneys about this! In my opinion the HOA people are over stepping their authority and not following the laws in their states.
unfortunately they are just an American thing, or the HOA specifically. other countries have some similar organizations but they don't have the power nor the malicious intent that the American HOA has. what I've been reading online and from talking to people from different countries, the problem is the president's of these places either grew up never being told no, or only being t9pd no so either way they don't take No for an answer and a majority will break the law and not care just so you do what they say.
Maybe ,it is just the point taken, that children live in these homes, also. They have rights to protect their things, too. Even a child does not want his families things to be stolen, or vandalized. Just letting you know, even a child has more reasoning ability than those giving the orders.
IF the HOA is requiring owners to leave their homes unsecured, then they should also be required to cover any loses as a result. A poorly thought “solution” to a maybe problem.
I wonder if people’s insurance companies could put pressure on the HOA. If the HOA is exposing the homeowners to greater risk, then the insurance companies are more likely to have to pay out. The insurance companies could increase premiums or cancel policies, I suppose, but the best option for the insurers is to keep collecting premiums, without ever paying out. The best way to avoid paying out is to have the doors shut and locked.
I do not understand why homeowners associations exist and why anyone would be dumb enough to sign up for one. This is one of those idiotic big city ideas.

The thing is, even if the HOA of the neighborhood you move into isn't that way now, it could always become that way at any time. My husband is a vet and in order for him to receive certain benefits (loans, healthcare etc) we are required to stay in the city. And here in Chicago the taxes and cost on anything is outrageous and the HOA is in every building thats either not an actual house or a privately owned building. So ppl like us who are only making 46000 with 4 kids don't have many options bec of how expensive things are here. So another example of of not having enough to not have to pay for something unnecessary. I know that sounds dumb but its true.

HOA's are managed BY THE HOMEOWNERS! SOMETIMES these are farmed out to HOA MANAGEMENT companies....... BUT, regardless of WHO is the representative manager. The HOA members must abide by COVENANTS AND RESTRICTIONS. Most in the community are probably HOMEOWNERS while some are RENTERS. IF A HOMEOWNER "RENTS" their home, they general are responsible (per the HOA legal documents) that renters are informed of the rules. Look to these documents (including legal HOA RESOLUTIONS for "changes") to resolve conflicts.

I'm in the same field, naturally I also agree with this HOA rule as well. It would be nice to see this rule implemented in a state with stricter gun control, this neighborhood is in Texas, so we could still be dealing with some work safety issues even with the removal of these unnecessary garage doors.
Also they need to disable cameras for safety too! Wouldn’t hurt to leave doors unlocked too! It makes our job easier

Imagine signing a contract to have a huge tree taken down in your yard for $400. They come and take the tree down and you decide. Well.. 400 is a lot and you really only want to pay $200 instead. Should you take the tree trimmers to court and sue them to have them reduce the bill? When you agreed to 400 and signed the contract and moved forward with it?
The tree trimmers are the ones that need to sue. And in this case the HOA needs to sue and fine people who don't abide by the contract.

Generally an HOA to protect their home values by preventing your neighbors from leaving broken down cars in the front yard or never mowing their lawn. HOAs that get power hungry like this are absurd and need to be fought against. Ultimately it’s your own neighbors making these rules so if the majority speaks up against them they should be able to overturn the rule.
It’s a balance. In most parts of the world, the common areas deteriorate pretty quickly, since nobody wants to chip in for upkeep, but inside a unit might look first class since they have extra pocket money that would have went to HOA. It depends if it’s worth it to you to pay a group to perform upkeep on the common areas.

I also believe that it isn’t the fault of the older generation, I think it’s just a physic of change and part of why it’s so hard to change society in general. When my grandfather was a kid he was paying 5 cents for a bag of candy now I'm pulling out 5 Bill's to pay for that same bag. And before that, my 80 year old grandfather was buying cars for 1000 dollars but his grandfather was buying cars for 100 dollars. Money became more scarce and inflated with each generation. There are tons of economical studies made by people who are paid the big bucks to find this out for you. It's one Google search away.
But this isn't the point. HOA's are more than just a few 'rules' Dave. It's a ball and chain on freedom. I can't close my garage door? What's next? Can't close my windows when I change? How about lock my doors when I go to work? Open your eyes.

Drake Harris That was one of the things I looked for when buying my home. I did not want an HOA. My friend’s sister lived in an upscale neighborhood with an HOA. It sounded like a nightmare. You were not allowed to park trucks in front of the homes. You were not allowed to have parties on the weekend. All dogs had to be behind a fence in the backyard, even if you had a fence or gate up front. Other ridiculous things as well. She was always being fined and taken to court. She always won her cases, but she eventually got fed up and left the area.
It still baffles me that people would willingly choose to live in an HOA neighborhood.
Sometimes it's your only choice if you want to stay in a certain location.
In the state's region of my home town, HOAs are almost unavoidable if you're living in a subdivision.

I wonder if people’s insurance companies could put pressure on the HOA. If the HOA is exposing the homeowners to greater risk, then the insurance companies are more likely to have to pay out. The insurance companies could increase premiums or cancel policies, I suppose, but the best option for the insurers is to keep collecting premiums, without ever paying out. The best way to avoid paying out is to have the doors shut and locked.
