    Growing up in Texas, my uncles used to carry their riffles on a gun rack by the rear windows of their trucks.

      Same experience when I was a kid. Technically you can still do this, but these days parking outside for more than 30 mins or so would mean coming back to a smashed window and guns gone.

    I live in Texas as well. If I walk out the door I'm armed, shoulder hostler, when I get back home I am armed as well, with my shoulder hostler. I trust nobody. Thank you for his video.

    I got pulled over in Beeville, TX and I was asked if I had any weapons. I informed the officer that I had a pistol in my console. He asked me to open it so he could see it. I did and I had it in a holster. He said that I was all good since it was in a holster. I respectfully told him that he needed to review the law because it actually doesn’t matter since it wasn’t in plain sight. Never assume that the police know the law. He was cool about it and It was a good experience.

      I was recently stopped because of brake light issue and gave my carry license and had my gun inside the center console and DPS officer told me the exact same thing. She was reciting that a gun in the state of Texas if you are carrying in the vehicle should be holstered, that really surprised me.

    I responded to a sheriff station a few months ago to do an evidentiary blood draw on a man who was arrested for DUI. They were also charging him with unlawful possession of a handgun. It was wrapped in a towel, under a seat. They said it would have been fine if it had been in a holster under the seat. There was an algorithm on the wall behind where the man was sitting that bore this out. You could be legal to possess in all respects and still get charged if the gun is not in a holster. If I have handguns in the vehicle, they are either in a holster on my hip, or in a holster inside my range bag., or in a holster in the center console. I'm in Texas.

      Under those circumstances, arrested for DWI, someone will probably get charged with unlawful carry even if it is in a holster under Texas Penal code 46.02.

    In Texas, your vehicle is an extension of your home. Texans have been allowed to carry in the vehicle well before the constitutional carry laws were passed.

    Good vid. I'm sure everything I'm about to comment on is somewhere below, but I'll comment anyway. I truly understand the demonstrations of placing a firearm out of sight in the cargo area, door pocket, etc. People get confused when the law changes. However, we are far more likely to get into an MVA many times over the likeliness of having to defend ourselves (the reason we carry). I've worked enough wrecks to know stuff gets scattered all over the place. Don't want our firearm off running around in the bushes after we've put our pumpkins through the wind screen. Centre console, especially the deeper ones, is probably a safe space, maybe the glove box, but again I've seen glove boxes pop open like a jack-in-the-box during a wreck. Anyway, good vid. We always need a reminder, especially when laws change like they did here in TX.

    Please do not just toss your firearm in a seat, under a seat, or just lose in your cargo area. If you need it and you have to stop or accelerate abruptly, chances are it will move and not be where you expect it to be. That's not something you want in a situation where you need to get to it quickly. I have a kydex holster the the belt clip attaches nicely to the side pocket and map pocket on the side of my center console. You can also get magnets meant retaining handguns in automobiles. If you have a large center console, I suggest affixing a kydex holster in there so it's always in the same position, preferably with the grip oriented in a way that makes it easy to grab.

    ~ Before Sept/1st, 2021 the unlicensed carry in the vehicle was specifically pemitted by statute.
    "Not in plain sight". This was passed several sessions back to combat the carjacking.

      If you are under 21, you can't carry it out of your car in a public space without a license to carry.

    I asked last video about open carrying with your gun holstered in the cup holder. Today I actually seen a cop getting lunch and asked him and he said as long as the firearm stays in the holster you can place it wherever you want. You just can’t have the firearm it’s self sitting in the cupholder.

      Thats how I read the law. But that goes only for people 21 and over, or people under 21 with a license to carry. Me personally, if I were to stop someone with a gun in a cupholder, 21 or not, I wouldn't care. It's their business.

      I will never understand why people dont just leave the gun on themselves when driving. My conceal carry doesnt come off from the minute I leave my house to the minute I get home. Why take it off in the vehicle? I have great access to my 4 o'clock position while seated.

      Improper display of a tag, handgun was in plain view in a holster in between driver seat and center console, im older than 21. No criminal record.

    Went to high school in the Valley in Texas in the 80's and students carry rifles on a rack by the rear window of a pickup. It was a common sight and no one stole anything.

    in the late 80s in texas we depended on the texas travelers law for carrying a gun in your car, live in one county, travel from that county through another county into another county, it was okay to have a gun in your car, in texas. i made the mistake of thinking the truth is always best, going from texas to New Orleans i got sleepy and pulled off the highway to grab a quick nap, not being familiar with the layout of the parrish's i couldn't find my way back on the interstate, 3 am and driving up and down streets looking for an on ramp, so i get pulled over, first words from the officer, do you have weapons in the car, yes i do, so after a long discussion, several hours and finally taken to a judge later that morning, i lost the gun and was finally on my way. they don't give a crap in Louisiana how legal it is in texas it ain't legal here.

      They do accept the Texas LTC though.

    I'm from Texas and have guns loaded and out in the open in my home (no kids), but am still hesitant to carry in my car unless I'm going to a bad part of town for some reason. Don't want trouble with the police.

    I mounted a cheap holster to the side of my center console, pistol comes off of me and then rides in that holster while traveling then before I get out just pull from that holster and go into the one on my belt, easy

      21 to buy from an FFL dealer.
      Private sales are not affected.

      It no longer has to be hidden in your vehicle. I carry on my right side with my shirt tucked behind it where it can't really be seen, and then I move the holster around to conceal it when I get out.
      DO NOT leave a weapon in plain view an unoccupied vehicle. That goes without saying though

    In the county I live in, if you are carrying a gun in your car and you commit another crime, such as DWI, Racing on Highway, Reckless Driving, etc., they will also charge you with unlawful carrying a weapon. In the majority of cases I've seen, they will dismiss the UCW if you forfeit the weapon.

      In Texas, that is all across the board. But just as in your county, the way D.A.s offices handle the case is up to their discretion, such as dropping charges if someone forfeits their firearm.

      WRONG! over half the states were “open” carry, then Arizona became one of four (incl. Alaska, Wyoming, and Vermont) to be Constitutional Carry…. Texas finally caught up but has these weird limits so cops can try and screw you over on technicalities….

    So what if you’re 20 years old with a clean record, but without a license to carry? Can I legally carry a pistol in my vehicle? And if so, it has to be out of plain sight? Just clearing it up as I was still a little confused after watching the video a few times. Thank you in advance. ❤️

      Your can carry without a license in your vehicle. And correct, if you are under 21 and no license the pistol has to be out of plain sight.

      @@geovanny206 the legal way to own a handgun under 21 and at least 18 in texas is buying it from another texas resident who is legally allowed to buy a pistol , they can can sell you the pistol they already own. you cannot buy a pistol from an FFL which is the people at gunshops and academt walmart etc its gotta be another normal texas resident. from there u can have a bill of sale just write ur signatures and contact info and the amount paid for the gun and each keep a copy and ur all set

    My holster is nose down wedged in the crack between the passenger seat and console most of the time. If there is a passenger in the vehicle it's on the drivers side.

    Great.
    In California it is Ridiculous.
    Handgun in a locked container of some sort, empty and ammo in the passenger compartment or reverse.
    Unless laws have changed that has been the transportation regulation for decades.
    Uniformed Exposed Security can carry loaded to and from the job site only with No stops in between.
    For non licensed civilians it's a misnomer to carry. There is still the Castle and Stand Your Ground laws.
    There is a reason criminals feel safer in California.

      There is many 2A people there that are current and retired law enforcement and Security Services.
      I believe Newsom is trying to eliminate the carry licenses there.
      There are few, even Assistant District Attorneys have a hard time getting carry licenses in the big cities.

    Watching TV I have noticed a lot of cops ask if you are carrying? When someone says yes, they use it as an excuse to remove them from the vehicle and then search the vehicle. In Texas, 1. does a constitutional carry have to give notice to an officer that they are carrying? 2. If not suspected of a crime and a cop asks the question, are you required to truthfully answer? 3. Can you ask or demand that you are suspected of a crime before answering any questions not related to your DL and insurance?

      Under case law Pennsylvania V. Mimms and Maryland V. Wilson, police do not need an excuse to have you step out of your vehicle as long as they have you on a legal traffic stop.
      When detained even for a traffic stop, an officer can pat you down for weapons.
      You don't need to answer any questions other than providing your identifying info. If lawfully detained.
      Randomly being asked to ID by an officer, you do not need to answer.
      But if you are suspected of a crime or believed to be a witness to a crime, then you do need to provide identifying info.
      If you are under arrest, lawfully detained, or believed to be a witness to a crime and you provide false identifying info, you will be charged with Failure to ID TPC 38.02.
      You do not need to tell him that you are carrying, but I do. The stops have gone smoothly and no citations. All my citations have been before I started carrying.
      The decision is yours.

      @@PrimalDefenseCo I graduated from a Tx police academy in 1988 and received my TCLEOSE certification after passing the state exam. I also completed two 6 month interns with police departments, one of which was Dallas PD., but got sidetracked into the Marine Corps and an injury left me paralyzed while waiting on an academy date for a federal agency. Your response was very good and detailed. I will never have any problems in the event I’m pulled over by the police. I’m no longer an expert on police procedures and the latest laws, especially when it comes to carrying a weapon. I do hate seeing video of police crossing the line of violating civil liberties in the name of officer safety which is sometimes an excuse to go on a fishing expedition. I would of been extremely guilty of this had I went to work as an officer because that is what I was taught. I didn’t reread my original reply but I believe it was about officers in states other than Texas over reacting to drivers who admit to legally carrying a weapon and then being removed from their vehicle and having everything searched. Essentially being treated like someone suspected of a crime when there was no such suspicion and the only thing that lead to being removed from the vehicle followed by the gun being secured and the entire vehicle being searched was a statement of having a gun in the vehicle. I can’t imagine that is ok or legal in any state. I’m looking forward to an overzealous officer using “his safety” as an excuse to pull me out of the vehicle and separate me from my weapon. Driving from a wheelchair and it being impossible to exit my truck on the side of the road in most situations, will put any overzealous officer in a conundrum.

      I do my best to educate the public in what their rights are. And I also educate Law enforcement on what the public's rights are. After all they are a member of the public themselves.

      No sir. Only exception to state law is when you are bringing it home after purchase. It is still against federal law.

      As long as it's a class C Traffic citation, you are ok. If you get a class B, you will likely be arrested and possibly charged with Unlawful Carry

    LTC holder, when I'm in the car driving, I have a holster strapped to the bottom of the steering column to keep my firearm. Easy access, in a holster, and LTC in pocket.

    Why not just keep the firearm concealed on yourself at all times? Sitting down in a vehicle changes nothing. I still have fast easy access to my firearm.

    Is mandatory in Texas have a holster if the gun is in your body. Beginning September 1, 2021, HB1927 made it legal in Texas for most people 21 or over to carry a handgun in a holster without a permit both openly and/or concealed.

      It is required to be in a holster if carried openly.
      Regardless, I strongly suggest a person uses a good holster.

    Hey I have a question, I’m 18 looking to get my first handgun. At this point in time I do not have an LTC however I am looking to get one in the near future. From my understanding I am able to carry in a vehicle or vehicle under my control as long as it’s concealed, before I get my LTC, is that correct? I have a clean record as well.

      @@bvierville1 there isn't a legal definition for holster in the lawbook. But there is a common definition. In my opinion, a magnet does meet the definition.
      I personally would not care. But depending on the jurisdiction you are in, the political climate, the officers bias, you may or may not run into a problem.

      It does prohibit them from carrying in public for 5 years if it was a criminal mischief involving a firearm.

    Hello Texan here. i had a situation today where an angry road raging driver followed me and stopped behind me at a red light (where i couldnt drive away) and got out of the vehicle before approaching the driver side window and punching it in a threatening manor (although he didnt break my window). I waited for the light to turn green and quickly drove off. Do i have the right to use a firearm in self defense from my vehicle in this situation? Of course I don’t want to shoot somebody unless absolutely necessary but today it seemed like I was trapped in a bad situation. Many thanks.

    Great info….what about these gun mounts that go under the driver side dash, like where your feet go? It’s out of “plain view” but had a cop say it was in “plain view”. Or is it one of those Officer discretion deals?

      Officers will use their discretion as to what is visible. But if it's not in plain sight, it is not in plain sight even if they say it is. Unfortunately if you get in trouble, you will need an attorney to straighten that out for you.

    Now your getting somewhere 🤝🏻 so if you had your record expunged that means you pass a background check ?
    Also I did a Hazmat background check so TSA can decide if I qualify for a Hazmat endorsement on my CDL.

      If you have had the record expunged, it should be as if the charges never existed.
