- The plaintiff says the defendant sideswiped his car while he was parking. He claims the defendant tried to flee, but then a cop stopped him. The plaintiff says the defendant’s insurance adjustor determined his car was totaled, so he’s suing for car damages, storage fees, and a rental car. The defendant argues the plaintiff backed into his car. He says the plaintiff doesn’t have a license, registration, or insurance.

I agree with the decision. In the criminal court case plaintiff should pay the defendant $2900 pain and suffering. LEO had witness testimony/video to arrest him. He's toast.

Yeah but the plaintiff was arrested so LEO must have had witness statement and/or video. Now it goes to criminal court and restitution to the victim. If the plaintiff doesn't have a record then downgrade it to a misdemeanor but he must pay the victim $2900 (same amount as he got for his goddam car). Ironic justice eh?@@georgebenevides

I don't trust either of these litigants. The defendant claimed the accident didn't cause any damage to the plaintiff's car even though the evidence shows otherwise. He doesn't actually come out and say the plaintiff had another accident and is trying to scam him, though, it's just, "Trust me, Your Honor. Don't believe your lying eyes."
The plaintiff tried to slip in a DUI accusation but had to fall back on "The cops didn't ticket him because they felt sorry for him."
That's what I was thinking. It could have come from a different accident but he didn't say that. Glad he's more stupid than dishonest. Both are scummy people.
The judge's look right after she signed off with, "But good luck with your criminal case," says what she thinks about that (4:40).
For the upcoming criminal case:
1. Plaintiff needs to receive car rental and storage- dock that off defendant's tab.
2. Judge needs to take into consideration the fact the defendant fled and tried to evade the accident.
This is definitely a time a copy of this tape needs to to be shown to the criminal court judge to show how the defendant is.
He should get a rental while he is waiting for the adjuster to make a decision

I agree. The attack did happen and the plaintiff is in serious trouble. If there's store witness testimony and/or video then he's toast. Depending on his record he may serve time and obviously pay restitution (hospital bill, pain and suffering). If I'm the criminal court Judge I'd make it $2,900 the exact amount he got for his car as a message he'll remember.
If the plaintive is telling the truth about the assult charges, I'd go looking for any cctv footage from in store and out.

I think the plaintiff is a straight-up liar. But I think the defendant is delusional. He thinks he’s telling the truth but isn’t seeing reality correctly.

There are a few points i want to highlight about this case and hopefully the more educated people on the law can weigh in:
1. Why didn't the judge ask for proof of registration and insurance from both parties? If the plaintiff did not have insurance, wouldn't his right now become a wrong?
2. Could it be the defendant was telling the truth and the vehicle had sustained the damage before the incident? What if the damage doesn't line up?
3. What was the color of the defendant's car? Was that the same color on the plaintiff's vehicle? The reason i ask this question is because the defendant was trying to speak and the Judge cut him off like she normally does with everyone. The defendant did not articulate his case properly.

The plaintive said in his testimony that his door would not open before the accident. So it is my guess that the car was damaged before the accident. I think the plaintiff is lying and should get absolutely zero

If the car has been totaled they are not going to pay storage fees. The plaintiffs story didn't match up with the photos of the damages.
From now on, if someone asks you what happened, start by saying "3 or 7 days later" and act like it's normal. Apparently people can just say whatever now and it's perfectly fine to have words mean nothing.

I think both are a little off but I think the plaintiff is a liar. The defendant didn't present his case well either. I think the damages on the defendants car should've been shown as well. Who knows if those damages were already on the plantiffs vehicle. Also it was mentioned the plaintiff was driving without a license and insurance on that car but it wasn't brought up in the case. Although it wouldn't probably matter it can speak to the plantiffs character and thought process. I think the plantiff was looking for a way to get a new car and is lowkey scamming. The defendant seems very unsure of what really happened which is weird but his downfall was leaving that scene. initially.

I am sure everyone watching/listening to this case was more intrigued by how the defendant sounded like Mike Tyson rather than the actual case, as was I. LOL The defendant is 100% guilty regarding the car accident & the plaintiff is 100% guilty of assaulting the defendant in a separate incident. Bout #2 is going to go to the defendant when his case finally goes to both criminal & civil court & so the plaintiff's adulation in winning his civil suit today is going to be short-lived.
