I am an attorney and I can 100% vouch for what the judge is saying. An insurance company will never pay out initially because they are banking on you not following through; getting intimidated; or they will claim contributory negligence like here. What you have to remember is an adjuster is not a judge. Dare I say many of them don't have a solid grasp of the law. A claims adjuster only works to settle the claim at the least amount of expense to the insurer. Demand all of your expenses / damages in a formal letter or better yet hire attorney to present a settlement demand package and if the adjuster denies the claim, be prepared to file a lawsuit. The judge is 100% correct in that most insurers will pay and settle before they will actually litigate the case. Especially in cases like this where culpability is clear . Don't be intimidated by filing a court claim or paying a filing fee. In Most states, you can recoup those expenses too, if you win. Never be afraid to stand up for your rights!!!! They can tell if you are intimidated and if they think they can take advantage of you that is exactly what they will do!!!

PSA: If you are in an accident (in CA) and are having problems with the other persons car insurance you can get in touch with The Department of Insurance and they will help get the ball rolling and make sure the insurance is doing what they’re supposed to do by law.

The insurance was not giving me any information. Just telling me they were not taking liability or going to fix my car. They were just trying to get out of paying. Since I only had liability my insurance couldn’t/ wouldn’t help me and told me to file a claim with the Department of Insurance. I found out thru Dept of Insurance that her insurance company was not following legal responsibilities and duties to me as a claimant. The ball started rolling after I involved Dept of Insurance and they finally took responsibility for the accident and fixed my car.

The reason the plaintiffs sued the defendant was because the drunk driver's insurance company only offered to pay half on the grounds of 50/50 liability. Normally, the insurance company could get away with it because without any independent witnesses to testify who was at fault, it's almost impossible to determine liability when both parties had a stop sign. However, in this case, because the other driver was intoxicated, it's easy to presume he was at fault, and ultimately, the insurance company should accept their driver was at fault. Without having enough knowledge of how insurance companies work, the plaintiffs believed what the adjuster said about seeking the other half from the defendant. The first time I had to battle it out with a car insurance company, I was ignorant about my rights and blindly accepted what they said and offered. So, I don't blame the plaintiffs' attempt to recoup their losses. They just need to follow the judge's advice and aggressively pursue the drunk driver's insurance company.
I don't know if you've ever been falsely accused of doing something but "presumed to be at fault" is exactly what's wrong with the world today and is totally contradictory to how the justice system is supposed to work. "Presumed innocent until proven guilty" isn't adhered to enough and a lot of people that have gone to prison and were later released because they were originally presumed guilty without proof. Not saying they didn't cause the accident but no one should be presumed to be guilty without proof. This case didn't even have circumstantial evidence to back it up.

The defendant was in shock.. She didn't file charges because she was driving on suspended license. She has some difficulties. Probably financial why she missed a car payment . Plaintiffs reported and got hold of the drunk drivers insurance, but the insurance was only willing to cover 50% of the damage because it was the defendant who also hit their car and damaged it. The plaintiffs took that offer and are now suing the defendant for the other 50%.
Personally I think they should be suing the drunk drive and leave this woman alone because she was a victim too and where else would her car have gone? But they probably knew they wouldn’t get much money from a man in jail who’s probably already having other fines and fees to be paying for.
Adjuster's work for he insurance company and they are never going to give you what you should unless you threaten suing. Except, my son had a wreck and the car I figured was worth about $7,000 and I thought they will probably offer $5,000 and I was full of fact finding and prepared to fire back. They called me and said, "We'll offer you $11,000 if you take it" I couldn't say "ok" fast enough. LOL
Is the defendant and the drunk driver jointly and severally liable in this matter? I'm reasonably doubtful. But the defendant driving on a suspendend license complicates the delivery of justice.

In Australia, both the drunk guy's insurance and the defendant's insurance would disclaim. Our insurance policies contain clauses that if you are operating the vehicle illegally (drunk or without a valid licence) they will not pay out.

Here in Ontario, regardless of any DUI's , if you hit another car due to someone else hitting your car, you're at fault. Once you pay that , you can then turn around and sue the other person for your damages and the other person's.
Im confused. There's usually an ambulance chaser in the area waiting to represent a car accident. Why didn't her family tell them this. Me and my daughter got hit sitting at a red light last year. It was 2 other cars in front of us. She had a lawyer. But she doesn't owe the guy in front of us.

I was witness to an accident with a drunk driver ware he hit 3 parked cars and went airborne across 3 lanes of traffic at 11:30 am. He then got out of his car, took off his flip flops and walked away. We did get him but are still weighting to go to court. It was Oct. 27 2023. And this is Dec 2024.

This lady hit me once and her insurance said they would only pay half cuz she said my headlights were off, which was a lie and even if they were off how tf she didnt see a whole car directly next to her?? Smh luckily my insurance fought it and got them to pay the whole thing.

The DUI report saying "odor of alcohol" could get that DUI thrown out. Alcohol has no odor. It should read "odor of an alcoholic beverage".

Drunk driver hit myself and caused a five car accident. My son, myself and all other cars received 10k plus and cars completely repaired
