What happens if you choose the "wrong" option when asked about who you picked as councilor?
As far as I remember, saving ME1 does not transfer the choice of the councilor and thus this dialog rules saving
That part of the conversation only plays out if you didn't pick either candidate in ME1, so this is just another way to choose a councilor for people who didn't play ME1 or chose not to make that decision in ME1.
