- Microsoft & Xbox vs FTC trial Day 2 was a huge WIN for Xbox. Phil Spencer took the stand and embarrassed the FTC in regards to Call of Duty and the Xbox Activision Blizzard Deal and explained why Xbox bought Bethesda after PlayStation was rumored to be buying Starfield exclusivity.

Something tells me if Sony bought Activision the FTC wouldn’t give a shit.
If Sony bought Activision, that could've legitimately harmed competition as you damn well know Sony would make CoD a PS5 exclusive in a heartbeat, potentially permanently damaging Xbox's chances of survival in the console market. But you're right, the FTC and the CMA wouldn't give two shits if Sony - the market leader - acquired ABK, even if it resulted in the death of Xbox. Why? Because cloud gaming, of course.

The fact that a lot of people knew Sony was dirty, and people always said that wasn't true. This is the clearest case of evidence that has came out just how dirty Playstation is. They DO keep games off of xbox. Therefore it's proof that FF7 remake will also never come out on xbox because these deals. Glad Microsoft gave them the definition of eff around and find out. They went from trying to get starfield to losing Bethesda. And they tried making cod exclusive to Playstation only. And Jim crying lying Ryan tried to say things to make xbox look bad. Yeah, it's hard to argue against that the FTC is more worried about Sony than the consumer. I get having Phil swear under oath to keep the games on PS as long as Sony does their part too, but to ask for more is just protecting Sony, not consumers.

The FTC will lose their case simply because they never had a case to begin with. I wouldn’t be surprised if Sony’s dollars are lining their pockets. Sony themselves put the final stamp on this deal when Jim Ryan said PlayStation would thrive and survive even if the deal goes through.
What's so said is that their attorneys were thrown into this with no substance, and the sense of shame is haunting them. Most intelligent attorneys would have declined to even pick up the case

To be fair though Fable looked like woke trash and I was so excited for the new installment. I switched from PS4 to the Series S this gen and I am satisfied especially with the value GP offers us but MS needs to stop with their pride shit!

To use a sports analogy a while ago there was a football match (soccer for you non-British) between England's women and Lativa's. The final score was England 20 - Latvia 0. In these first 2 days of the trial Microsoft has been England in my analogy and the FTC has been Latvia, thats how badly the FTC has been embarrassed and just to clarify normally football (soccer) matches are NOWHERE near this one-sided, they are normally well within single figure margin of victories.

Definitely not a bad choice,I’ve had my PS5 for 2 years now and i love playing on it when i do,As a xbox fan mainly it’s a good console for some exclusives here and there,Only because spiderman,Gow and so on i play,Xbox is my main console for indie titles and upcoming titles like starfield and so on,I think ps however won’t be the same,Xbox has so many studios and if they buy Activision it’s kind of done for Sony’s competition….

My issue is that buying a whole publisher is not the same as buying exclusivity. With exclusivity at somepoint after Sony has had their fill, games might be released on other platforms. Whereas buying a complete publisher is just taking stuff away in hopes of starving the competition.
By the time the widow of popularity has closed to a mainstream audience, there is little difference the sales are diminished and the developer is hurt as well.
At least full exclusivety gets the funding and game pass makes more people ready to try it.

The House Oversight Committee has opened an investigation into the FTC (specifically Khan). Although spearheaded by several Republicans there are Democrats that seem keenly involved. At the very least the FTC shouldn't get the increase (hundreds of millions) in additional funding Khan is asking for.
I said this after both days, I believe the FTC lawyers are throwing the case. They aren't bad lawyers. So, you must wonder why they fall into so many obvious mistakes. I know they were given a lousy hand to begin with, but they keep asking questions they don't already know the answer to. You never ask a question you don't know the answer. Ther FTC questions often (even with their own witnesses) lead to proving Microsoft's case not the FTC's.
Remember Khan is not well liked at FTC. There has been a rampant exit of staff these past few years. From my understanding most of the staff did not want this case to go to court. They knew it did not meet any legal threshold to be blocked. Yet, she wants to transform the FTC into something different. She runs teh FTC like her personal fiefdom and does not listen to anybody, she just does what she wants.

Congress did call for an investigation of Sony and the Japanese government. I’m guessing it went nowhere cuz Japan approved the deal immediately after that
Unlikely but elected representatives will question them for years weather they are doing what's in the best interest for America consumers and competition in American markets.
This practice has been going on so long. When EA and Gta was only was PlayStation 1 and 2 exclusive. At that time sega and Nintendo was in the console arena. Nintendo tried with madden 64 but sega went a different route with visual conscepts and made nfl 2k and nba2k.

If the judge didn't cut-off the FTC lawyer on CoD on Sony's cloud, a great "answer" would be something like "there are financial details that would need to be negotiated with Sony, do you have an offer that you want to propose on Sony's behalf?"

I believe they are not ignorant or stupid to be honest but looking for something. Whether they find what they are looking for or setting something up for next week who knows. Court cases and listening to attorneys is always crazy to be honest. I am happy though we should know something next week on whether it will be allowed to continue and the fight continues.

The whole treason angle is interesting. I mean America is arguing that an American company should give assurance that they look after a Japanese company, one that is the market leader at that. The judge was wrong to ask Spencer to say that CoD would remain on PS.
They should just release Call of Duty games with different names.

Its the fact that it was the FTC that brought up the “console wars” and Phil had steer the conversation from a made up twitter argument to actual revenue numbers and market share.
The FTC isn’t arguing against Microsoft buying ABK, they’re arguing against Xbox having exclusives period and with about as much sophistication as your average twitter console warrior. If anything I feel sorry for PS only users who actually thought the FTC was gonna bring some heat or anyone against the acquisition for that matter. Makes for great entertainment though.

I think Microsoft is putting on a very strong case against the FTC. It was interesting to hear some of the things actually coming out during the testimony. We have heard things like Xbox not hitting targets before but never really to this level and just how much trouble they were in at some levels. Eye opening to be sure. I am not sure acquiring ABK will fix all those issues but it could help especially in the mobile space. I keep hearing people say this is about CoD but I am more convinced than ever this deal is about the mobile space. Microsoft themselves acknowledged the importance of mobile during the testimony to their business goals and success. In fact, I believe if I heard correctly they couldn't be successful without it.
Look no matter what your feelings on the case it is important we have strong competition for any market. I personally enjoy Xbox as much as PS and the other way around. I want both companies to be strong. It is diffidently better for the consumer and gaming. Now this deal if passed will not make Xbox magically number one in the console space. Microsoft has already stated theirselves they have lost the console market. What the deal does however is make Xbox a stronger competitor in gaming which is what every market should have to be healthy, competition.
I hope they make the Quake remake exclusive too and any Wolfenstien game who cares if it was a previously multiplatform release. It’s time to play Sony's game but with more money at hand.

The deal just makes sense. It’s better for the gaming industry (which generates more than the movie industry now… and in which it costs more to produce a triple A game than film of equal standing), it’s better for gamers, and it does more to protect gaming companies than preventing the deal would. Seems easy to green light to me.
As a tx payer this is just crazy we are fighting a American company buying another American company to fight a Japan company ran by a Uk division
I Disagree what you said about Final Fantasy XVI, Square-Enix offered Final Fantasy XVI 2 Microsoft but Microsoft wouldn't pay the cash for it, Yoshi P openly said that, Microsoft Lost Final Fantasy XVI because they wouldint pay the money for it
