She should dismiss the case fir two reasons. It's not unique. Every President has retained documents. Even Pence had documents. And of course Jotato as Senator and VP wasn't supposed to have documents and wasn't charged.
The second huge problem is Trump was given permission by the FBI to retain the documents that they later came back and seized. They visited Mar a Lago dug through his records, took some, and allowed him to retain the rest. They advised him to put another lock on the door where they were stored, which he complied with.
