Well, obstructing justice just makes things a lot worse. There are cases in which the willful commission of a crime is the core problem, but "possession of classified materials" is something that is EXTREMELY common at the higher levels of government, and if everyone who did it got arrested and had the book thrown at them then nothing would ever get done, for either party. The standard tends to be that so long as the documents aren't _too_ serious, and so long as it could reasonably be considered an accident that they ended up in the wrong place, then it's ok.

The entity that released the classified documents should have made an attempt to retrieve the documents from whoever took possession of them. It is nonsense to wait for someone who left office to keep them because they forgot to give them back or lost track of their whereabouts. Well, obstructing justice just makes things a lot worse. There are cases in which the willful commission of a crime is the core problem, but "possession of classified materials" is something that is EXTREMELY common at the higher levels of government, and if everyone who did it got arrested and had the book thrown at them then nothing would ever get done, for either party. The standard tends to be that so long as the documents aren't _too_ serious, and so long as it could reasonably be considered an accident that they ended up in the wrong place, then it's ok.

The entity that released the classified documents should have made an attempt to retrieve the documents from whoever took possession of them. It is nonsense to wait for someone who left office to keep them because they forgot to give them back or lost track of their whereabouts. The FBI should make an effort to retrieve the documents at the appropriate time and not wait until it is too late. It is clearly sheer negligence that as a result of all parties involved, classified documents are not retrieved and accounted for.

Even IF trump declassified the documents (Which to be clear: He did not. But lets for arguments sake say he DID), that doesnt give him the right to *keep* the documents. Those documents are property of the US government.
So it appears that the main difference is obstruction? Trump's entire defense seems to be predicated on interpretation of the "Presidential Records Act." Granted, I haven't read the "Senatorial Records Act" yet though... so maybe that completely exonerates Joe Biden. But that could be a difference as well.
