Nah, HOA's work for some people, I love mine. I don't have to worry about sh*t (lawn care, tree trimming, paving, etc etc) and the neighborhood always looks nice. We don't have 'that house' on the block.

I can imagine the neighborhoods without them, have low property values and have at least one if not multiple residence whose property has deteriorated into a monstrosity of an eye sore.

Unfortunately this is a you problem. If you live in an HOA house, there is literally nothing you can do without getting permission. And the father is correct…if he DID go about getting the permits and permission to build that treehouse, it would have NEVER been built. It’s a big beautiful treehouse, but its beauty is why he would never have gotten away with it. For the sake of the daughter, just move to a house without HOA, and say goodbye to the folks who make you become a prisoner of your own home.

My HOA fee is 40$ a quarter . Literally nothing to make sure that my neighbors houses are clean and up to standard. Maintenance will always cost money. However, I would not want a house with zero HOA. I’ve been to neighborhoods like that. You have some disrespectful people.

What does the HOA actually do for the Home owners? I never hear good stories about them it's always about an owner being upset about what they can not do with their own property or about being them in a disaster zone and getting no disaster relief coming in to help from the city or town because you live in a HOA. like in flordia when they had that hurricane an HOA refused to have dumpsters line the streets that the town offered to send in so people could gut out the damaged items and dry wall from flooded homes so all that stuff sat out along the street for who knows how long until each person could have it removed on their own and these people were mainly seniors.

@Amy. Let’s say you were a neighbor of this person who built the treehouse without any permission and now your mountain or ocean view is blocked. Let’s say a neighbor’s dog is crapping on your lawn and neighbor not picking up. Let’s say a neighbor keeps parking his camper if front of your house and not theirs. There are many other situations where you can go to the HOA for resolution. There are indeed drawbacks. If people don’t like it then don’t live in one. I feel a lot safer and have more piece of mind living in a HOA than when I didn’t. Way less soliciting and way less crime. Neighbors are way more courteous and friendly too.

All we got with ours was certain rules for a select few, board members that didn’t have to abide by rules, harassment when others chose to do what the select few could do. You don't hear about the hundreds of thousands of HOA's that don't have issues, only the couple that do. What you don't realize is that the people whining about them all knew they were buying into a HOA property or voted to form the HOA. Nobody had one suddenly appear one day and say "btw, you're part of our HOA now."

What you may not realize is you are going to buy a house in your lifetime. Either for yourself or for somebody else, if you choose to be a renter. And when you are 65 you won’t be able to retire because you will still have monthly housing costs.
I watched a documentary where this older guy was forcibly ousted as owner from his several properties being legally labeled “unfit” to care for himself or his properties and placed in a senior care facility. He was duped by a housing attorney to sign some sketchy document that set it all in motion. He was sharp as a tack though. He had no surviving spouse or children of his own which made it easier for the city to seize his properties. They tore most of them down and built swanky townhomes and he was suing. Don’t think he won. So yeah, it is a scam.

It's either your property your way or live in an HOA community and know that your property isn't your own. Can't have both. Everyone knows when you live in an HOA, you have to get permission for any changes/additions to your yard. Especially something like this...come on. I think the guy went to great lengths to make it sooo nice, that he thought that AFTER it was built, that it was going to be so nice that the HOA would go ahead and approve it. Wrong. They don't care HOW extraordinary it is. I'm not in favor of HOA's either, but rules are rules and if you know you shouldn't do this from the beginning, then you shouldn't build it. (I feel sorry for the little girl, that her father built her something that he probably knew was wrong from the start, now they might have to get rid of it.) Sorry. HOAs are soooo ridiculous! When I bought a house after renting in HOA neighborhoods I made SURE to buy where no HOA has or can EVER have any authority.
The homeowner may have recourse under a principle of mitigation of damages, but first I must share that although I have taught real estate law, I am not an attorney and by my code of ethics I advise all parties to seek legal counsel, and only offer an opinion. If this enhances the value of the property, which it seemingly would, while it is not anything that would be visually disturbing, and likely not visible from the front, the homeowner could file litigation based upon the principle of mitigation of damages, that this structure isn't damaging the property value, but enhancing it. However, the homeowner wouldn't want to risk legal fees against an HOA, which is why this litigation, to merely allow the tree house to stand might be filed in Small Claims court, for which to my understanding (but please verify) that a losing party is not charged with attorneys fees. The HOA has to give reasonable approval, for which Mr. Philips might take a look at other backyards and see if there are any other structures that have been approved, even storage sheds something comparable or not as nice in appearance as his tree house. If so, that would bolster his case as he could potentially state of discriminatory treatment. If not, he might send the association a demand letter to approve the tree house as he is not detracting from property value, and this isn't visible from the front (check the CC&R's), and in fact improves the value and looks nicer. A consultation with an attorney would always be recommended, but with my 31 years in real estate and having read through many dozens of association CC&R's, the association shouldn't be rejecting what common sense would indicate would be an improvement to the property. It isn't like he painted the exterior of his house a really loud purple or red, or that he has some offensive sign up, for which he could take things to small claims court to avoid legal fees if he lost.

Insurance problems is the most likely problem. Or a neighbor whose windows view is now blocked. That or anyone can complain and since it’s in plain sight, be fined accordingly very easily and it will be the HOA that pays the fine.
I’m looking to buy a house and every neighborhood without HOA looks like a dumpster with trash, junk cars and aggressive dogs. Neighborhoods with HOA look clean and safe. I initially thought no HOA is the way to go but after seeing both, I’d almost prefer HOA. I’m still torn but with no HOA other people trash the street.
That sucks. That isn't a problem where I live, you just avoid the north end. I'll never live in an HOA because I'd like to have children someday, and I want them to be able to be creative and have fun in their own yard. But everyone has a different situation and needs different solutions. I've no problem with folks who do live in HOAs, but I'd never do it.
I truly revile the power HOA's are given by the community. Trash, Storage, Maintenance, and Landscaping are the only things the HOA should be responsible for. The idea they have any say as to what you build, decorate, remove is non of their damned business. But keep it clean, trimmed, and not falling apart, that's it.
So I am on the board of my community's little ~20 unit HOA. The members pay about $300 per month in dues; that covers all of our landscaping throughout the year, snow removal (including roads, driveways, and sidewalks), sealing of roads/driveways, superficial building maintenance every few years and other a variety of other perks and community investments. I admit the dues are expensive but one of my main goals recently has been and still is cutting them. My biggest gripe is that we all invest in our community but too few in the community seem to give a shit about the way things are managed. Show up to meetings and make your voice heard if you have something to say. Some residents let their dogs crap around the grounds and leave it for the HOA. Some residents leave trash bags on the ground instead of in proper trash cans. HOAs can be beneficial when the community comes together to create and maintain them. Our board is small and all voluntary... and we end up dealing with more crap than we should, simply because some tenants just don't seem to care.
It's sad...however you know as a homeowner about HOA restrictions. So this can not be a surprise and it's a bigger issue if they live in a gated community with strict standards are forced as it should be to keep neighborhoods looking nice and manicured not an eye sore . Though it is a nice tree house

This is a beautiful structure but HoA is in place for a reason. Just think of his neighbor wanted to build a massive bug hideous structure on their property. Anything that can make the property value go down for surrounding neighbors is going to be a problem. It obstructs views. There are many other situations where you can go to the HOA for resolution.
There are indeed drawbacks. If people don’t like it then don’t live in one.
I feel a lot safer and have more piece of mind living in a HOA than when I didn’t.
Way less soliciting and way less crime. Neighbors are way more courteous and friendly too.

All we got with ours was certain rules for a select few, board members that didn’t have to abide by rules, harassment when others chose to do what the select few could do. It was a complete nightmare. People are out of their minds to live in such a place
You don't hear about the hundreds of thousands of HOA's that don't have issues, only the couple that do. What you don't realize is that the people whining about them all knew they were buying into a HOA property or voted to form the HOA. Nobody had one suddenly appear one day and say "btw, you're part of our HOA now."

What you may not realize is you are going to buy a house in your lifetime. Either for yourself or for somebody else, if you choose to be a renter. And when you are 65 you won’t be able to retire because you will still have monthly housing costs.

I watched a documentary where this older guy was forcibly ousted as owner from his several properties being legally labeled “unfit” to care for himself or his properties and placed in a senior care facility. He was duped by a housing attorney to sign some sketchy document that set it all in motion.
He was sharp as a tack though. He had no surviving spouse or children of his own which made it easier for the city to seize his properties. They tore most of them down and built swanky townhomes and he was suing. Don’t think he won. So yeah, it is a scam.
Kudos to you sir for admitting that you went about it the wrong way. Unfortunately, you can't do whatever you want with your own property when you live in an HOA. It's either your property your way or live in an HOA community and know that your property isn't your own. Can't have both. Too bad because it looks like you put both an enormous amount of time and money into your project. It also looks like your daughter thoroughly enjoys it as well.

Everyone knows when you live in an HOA, you have to get permission for any changes/additions to your yard. Especially something like this...come on. I think the guy went to great lengths to make it sooo nice, that he thought that AFTER it was built, that it was going to be so nice that the HOA would go ahead and approve it. Wrong. They don't care HOW extraordinary it is. I'm not in favor of HOA's either, but rules are rules and if you know you shouldn't do this from the beginning, then you shouldn't build it. (I feel sorry for the little girl, that her father built her something that he probably knew was wrong from the start, now they might have to get rid of it.) Sorry. I painted my front door and then a notice went out to all of us from the HOA saying we need to ask permission if the color is appropriate before we paint anything on our house.😒

HOAs are soooo ridiculous! When I bought a house after renting in HOA neighborhoods I made SURE to buy where no HOA has or can EVER have any authority.

The homeowner may have recourse under a principle of mitigation of damages, but first I must share that although I have taught real estate law, I am not an attorney and by my code of ethics I advise all parties to seek legal counsel, and only offer an opinion. If this enhances the value of the property, which it seemingly would, while it is not anything that would be visually disturbing, and likely not visible from the front, the homeowner could file litigation based upon the principle of mitigation of damages, that this structure isn't damaging the property value, but enhancing it.
However, the homeowner wouldn't want to risk legal fees against an HOA, which is why this litigation, to merely allow the tree house to stand might be filed in Small Claims court, for which to my understanding (but please verify) that a losing party is not charged with attorneys fees.
The HOA has to give reasonable approval, for which Mr. Philips might take a look at other backyards and see if there are any other structures that have been approved, even storage sheds something comparable or not as nice in appearance as his tree house. If so, that would bolster his case as he could potentially state of discriminatory treatment. If not, he might send the association a demand letter to approve the tree house as he is not detracting from property value, and this isn't visible from the front (check the CC&R's), and in fact improves the value and looks nicer.
A consultation with an attorney would always be recommended, but with my 31 years in real estate and having read through many dozens of association CC&R's, the association shouldn't be rejecting what common sense would indicate would be an improvement to the property. It isn't like he painted the exterior of his house a really loud purple or red, or that he has some offensive sign up, for which he could take things to small claims court to avoid legal fees if he lost.

Insurance problems is the most likely problem. Or a neighbor whose windows view is now blocked. That or anyone can complain and since it’s in plain sight, be fined accordingly very easily and it will be the HOA that pays the fine.

I’m looking to buy a house and every neighborhood without HOA looks like a dumpster with trash, junk cars and aggressive dogs. Neighborhoods with HOA look clean and safe. I initially thought no HOA is the way to go but after seeing both, I’d almost prefer HOA. I’m still torn but with no HOA other people trash the street.

That sucks. That isn't a problem where I live, you just avoid the north end. I'll never live in an HOA because I'd like to have children someday, and I want them to be able to be creative and have fun in their own yard. But everyone has a different situation and needs different solutions. I've no problem with folks who do live in HOAs, but I'd never do it.

I truly revile the power HOA's are given by the community. Trash, Storage, Maintenance, and Landscaping are the only things the HOA should be responsible for. The idea they have any say as to what you build, decorate, remove is non of their damned business. But keep it clean, trimmed, and not falling apart, that's it.
So I am on the board of my community's little ~20 unit HOA. The members pay about $300 per month in dues; that covers all of our landscaping throughout the year, snow removal (including roads, driveways, and sidewalks), sealing of roads/driveways, superficial building maintenance every few years and other a variety of other perks and community investments.
I admit the dues are expensive but one of my main goals recently has been and still is cutting them. My biggest gripe is that we all invest in our community but too few in the community seem to give a shit about the way things are managed. Show up to meetings and make your voice heard if you have something to say. Some residents let their dogs crap around the grounds and leave it for the HOA. Some residents leave trash bags on the ground instead of in proper trash cans.
HOAs can be beneficial when the community comes together to create and maintain them. Our board is small and all voluntary... and we end up dealing with more crap than we should, simply because some tenants just don't seem to care.

I work in an industry that fights HOA’s everyday. The HOA Boards are just ridiculous! Don’t blame the Management Company, it is the Board Members that have an issue.
It’s beautiful and well made, HOA should try to work with the family and see if simple modifications might work for everybody. But yes, permission required.

They live on a quarter acre lot with a 5,800 sq ft mansion and a full size pool inside a golf course. There's barely any room left for such a large structure and he knew full well it would be denied, but he built it anyway. Now he's using the father/daughter angle to get away with it. Why are they having the interview on a busy road miles away from their house instead of by their gated golf course luxury house?

That's a whole HOUSE elevated higher than 4', HOA or not most counties would require a permit for this sort of thing. This is not a "father-dauther project", this is a guest house.

Sorry, no sympathy for the homeowner, because as he said himself, "I should have... " However, plenty of empathy for his daughter, Claire. Considering the amount of extra money this guy must have to start with, I'm sure that a ground level kids play room would still be very nice and work just fine. FYI: I am also in an HOA, knew this before I moved in, including "The Rules." Sometimes, they work against me, upkeep/money wise/use of property wise, but overall it's kept 25-30 y/o houses and common areas looking like new.

This is a beautiful structure but HoA is in place for a reason. Just think of his neighbor wanted to build a massive bug hideous structure on their property. Anything that can make the property value go down for surrounding neighbors is going to be a problem. It obstructs views. I’m wondering why the dad went through with building it knowing it probably wouldn’t be allowed. There’s no exceptions to HOA rules.
That's what happens when you join a HOA community when you sign then you agree to let someone else tell you what you can and can't do with your own home and can actually kick you out of your home it's ridiculous why anyone even wants to be a part of these.
