    @Oscar: Last year in 2023 Oct visa bulletin, there was only 1 month forward movement for date of filing (Dec 2022 to Jan 2023) and 1 week forward for action date (1 July 2022 to 8 July 2022). Not a good jump as you mentioned in the video for date of filing in Oct 2023. Now, we have 4 and 1/2 months forward movement for filing date in Oct 2024. This is indeed a very good news in this climate.

      Last year was almost identical, because even if Table B did not move...one could not use Table B in September 2023 and they could in October. Which esentially made the jump 5 months total for AOS applicants. The end result is, like I said in the video, incredibly similar to this year´s (with the difference that the absolute wait times are worse now)

      @@edwardt2417 No, the FAD moved from July1 2022 to March 15, 2023, between Oct 2023 and Oct 2023. That is about 8-9 months forward progress.

    People doing consular processing got shafted again. Expect growing backlogs in the visa queues. Some already say that USCIS will make EB2 ROW Table A catch up to Table B by 30 September 2025 which is a 5 month movement in a 12 month period. Forget about it...

      Its frustrating applying for consular process and it doesnt move a single day in new fiscal year. Does It mean consular process is not worth it? Are these table B folks living in US without working until they become current? Of course not

      No. People in consular processing are not shafted. The Filing Date (FD) and Final Action Date (FAD) work the same way for both people doing Adjustment of Status (AOS) and those doing consular processing. These two set of categories will not be invited for interview or visa available for issuance to them unless their Priority Date (PD) is earlier than the FAD. For people doing consular processing, the National Visa Center (NVC) will reach out to the people doing consular processing to start the filing process very close or after their PD is earlier than the FD and at the end they will be documentarily qualified/ready/complete. However, the relevant US embassy or consular post will not invite them for interview or issue issue them the visa until their PD is earlier than the FAD. For people doing AOS, even if USCIS allowed them to use FD (which USCIS usually do between Oct-March of a fiscal year) to submit their AOS, the USCIS will not invite them for interview (which can be waived) or issue them the visa until their PD is earlier than the FAD. In sum, the end product of both AOS and people doing consular proceess is the same because FAD is the most important date for their interview and issuance of visa.

My priority date is July 7, which is before August and according to the B section we can now file for the adjustment of status? Is that correct? can we file now?     Oscar, thank you for the detailed analysis of the October visa bulletin. You clarified the importance of the filing dates for the filers who chose I-485 as the step following I-140 approval. How about those who chose IVP processing, what does having a priority date earlier than the filing date mean for them?

      They also monitor demand, what's in line. They must have reasons to be cautious...but they could rectify later

      Consular processing depends on the instruction you get from NVC, it's not like AOS where you have to file a package. Just follow the instructions you get from them

    Thanks a lot for your videos! If someone’s priority date is current for filing but not for final action, are there any added benefits to filing the I-485 now? Or would it make no difference if one files now versus waiting until the final action date becomes current?

      It's best to file ASAP because you don't know if dates will retrogress in the future. The sooner you apply, the sooner they start processing it, so when a visa number is available they may schedule your interview / give the green card. Plus, you are eligible to file for EAD and travel doc.

      Table A marks the earliest possible end for any applicant , it's when the visa number is available. Table B is mostly relevant to adjustment of status applicants during certain months because it allows them file their I-485 petition

    Hi Oscar, my priority date for EB-2 is May 07, 2024. However my visa expires in June 2026 (21 months from now) I may potentially extend for 8 more months for the time I stood outside US, totaling 29 months.
    Do you think I’ll have enough time to file before my working visa expires? Without considering the extension, so 21 months from now? I know it’s difficult to predict, but I just want to think in a plan B if the priority date May 7, 2024 doesn’t become current by my visa expiration June 2026.
    Plan B would be to re-apply and try to classify for an EB-1. But that would be very costly to have another application. 😢

      I don't give out individualized advice. In general if you are in an H visa, and your I-140 is approved, you can extend your visa indefinitely and would not be subject to the 6-year limit. Please consult a lawyer if you need help.

    Hi Oscar, I am confused about my I-485 filing date. My I-140 EB-2 priority date is June 9, 2023. In the visa bulletin of October 2024,
    A. FINAL ACTION DATES FOR EMPLOYMENT-BASED PREFERENCE CASES is 15 MAR 23 and
    B. DATES FOR FILING OF EMPLOYMENT-BASED VISA APPLICATIONS is 22 MAR 23.
    Which table should I follow A or B to file I-485?

    Demand from the backlog is already high enough to prevent any hope for forward movement. The USCIS could have at least given a plain-English explanation as to why they decided not to move the EB2 FAD.

      Table A is what marks the end of the process for everyone. Table B is more relevant for Adjustment of Status since NVC does not always enforce its use for sending documents

My question now is since we are using table B , if the date move to like August 30th next month . Does that mean we should be expecting an interview date if there is no back logs in our prefare chancellors office??

      Yes, if there is no internal backlog of course. There is always some level of wait time in embassies.

      Thanks! I have not personally seen an I-485 denial. It could happen if there is fraud or misrepresentation detected, for example...or lack of status

    Thank you so much Oscar. I am currently in the US, and my status is OPT STEM. I have an EAD card. My priority date for the EB-2 is April 16, 2023. Does this mean I can apply? Do you advise me to apply? Why? From what I understood, there are no green cards available yet, and only the EAD is what they will give me, which I already have.

      As long as your PD is earlier than the date shown in the appropriate table, you can apply. It makes sense to put in your application as soon as possible, so the adjustment of status starts getting processed. You won't get a green card until Table A allows them to issue one, but once you submit, you can just pay attention to biometrics and other than that, forget about it.

      I-140 adjudication times are independent of the visa bulletin. The median processing time for I-140 has increased to 7 months, but it may be longer for categories such as NIW or EB1A egov.uscis.gov/processing-times/historic-pt

    Hi Oscar, really great information. My PD date is 12 Dec 2012 India EB2. The Table B shows Jan2013. Does that mean I can only file I-485 but I am not getting GC as it’s not yet current in the Table A- final action date. Hope you reply. Thank you !!

    Hi Oscar, my PD is 01AUG23, and as per October 2024 Bulletin, my respective Date of Filing is also 01AUG23. The bulletin states that the PD should be EARLIER than the listed date. Does that mean, I still can't file I-485? (as both dates are same, my PD is not earlier).

    What if you filed for EB-2 NIW from the United Kingdom? It does not show United Kingdom, only India, China and Phillipeans?

      It is not where you apply from that matters, but your country of birth. People born in India, China, Mexico, and Phillipines have longer wait times because of the volume of people born in those countries that have applied. if you were born in the UK, you fall into the first column "All Chargeability Areas Except Those Listed".

      It doesn't. Both advance equally, because Table A is what matters when it comes to the visa number. And why should it be otherwise?

      @@OscarsGreenCard Adjustment of Status is for people that already are in the U.S. Everybody knows that most people uses student or tourism VISAS just to apply for an adjustment. That's why, in my opinion, it shouldn't advance faster

      @@raitojv99 Not really, at least not in my many many years of experience living in the US. The primary reason people were on a visa was not "to apply for adjustment". Even if it was, I don't get the point about why it should be slower. It should be, as it is, equal.

    If my form i 140 was approved but my date is later, will I have to wait? How long? How long is the eb2 taking, more or less, for the entire process?
    For example, the date is March 22, 2023, I will apply in March 2025

      It depends. You need to follow the bulletin because it does not always move in the same ways, depends on demand.

      They say it each individual months, we don't know for sure until they say it. Usually towards the start of the fiscal year they let you do that as I said in the video

    Hi Oscar. Can you explain the difference between table A and table B? I’m applying from outside the US and will need consular processing once my i140 is approved. Which table would apply to me?
    My priority date is July2024.

      Table A is what dictates when the consulate may call you for an interview (keep in mind they also have internal backlogs, so being current on Table A does not guarantee you will be called immediately)

      You can if you are current (during October). But you must apply for I-485 too if you want to apply for EAD

    Hello Oscar, many thanks for your great work. I started watching your videos about two months ago (August 2024) and I can attest to the simplicity in your communication breaking down complex matters relating to EB1(A) &EB2-NIW self-petition employment-based green card. I just compared your analysis of both October 2023 and October 2024 bulletin at: ua-cam.com/video/DMsYFelRJTIf/v-deo.htmlor EB2, for the Rest of the World (ROW) and I noticed the following major changes: First, as at 30 September 2023, the Filing Date ended at 1 December 2022 for the outgoing fiscal year 2023 for the EB2 category (ROW). The Filing Date opened on 1 October 2023 for the 2024 fiscal year at 1 January 2023. Hence, there is a one-month forward movement from 1 December 2022 to 1 January 2023 for the Filing Date at the beginning of the 2024 fiscal year. Secondly, the Filing Date for the 2024 fiscal year as at 30 September 2024 stopped at 22 March 2023. Therefore, what we witnessed throughout the fiscal year 2024 (1 Oct 2023 to 30 Sept 2024), is the movement of the Filing Date from 1 January 2023 to 22 March 2023. This forward movement was just two months and 22 days. In sum, the Filing Date for the 2024 fiscal year moved from 1 December 2022 to 22 March 2023 (that is, three months 22 days). Thirdly, the Filing Date opened on1 October 2024 at 1 August 2023 for the 2025 fiscal year (1st Oct 2024 to 30 Sept 2025). This is a great news of 5 months 8 days forward movement. This change already surpassed the movement achieved all through 2024 fiscal year. Any more forward movement for the rest of this 2025 fiscal year for the ROW will be a bullish and a bonus movement. This additional projection will depend on whether they are more than 140,000 visas available for employment-based and drop in demand, (which is not the case because demand is at its highest peak from 4,000 per year pre 2022 to over 12,000 per year in 2023 category. We expect both USCIS and Department of State (DOS) to provide more information on this point. Fourthly, the Final Action Date stood at 1 July 2022 for the year ended 30 September 2023(2023 fiscal year) and opened with the same date of 1 July 2022 on 1 October 2023. Thus, no backward or forward movement for these reporting dates. Fifthly, the Final Action Date as at 30 September 2024 for the ROW stood at 15 March 2023. Thus, Final Action Date moved for a period of 9 months 15 days from 1 July 2022 to 15 March 203 for the 2024 (1st October 2023 to 30 Sept 2024) fiscal year. A big movement I must say. As at 30 Sept 2023, the Filing Date stopped at 1 December 2022, while the Final Action for the same period ended at 01 July 2022. This a 6-month gap between the Filing Date and Final Action at the end of 2023 fiscal year (which ended on 30 September 2023). For the 2024 fiscal year which ended on 30 September 204, the Filing Date stopped at 22 March 2023, while the Final Action Date stopped om 15 March 204. This is simply a little gap of just 8 days. This is a great news when dealing with the confusion that usually confront the issue of Priority Date, Filing Date and Final Action Date. We hope that the 2025 fiscal year which started on 1 Oct 2024 can achieve a 9-month forward movement for both Filing Date (which opened at 1 August 2023) and Final Action Date (which opened at 15 March 2023). Lastly, it seems that the forward movement for both Filing Dates and Final Action Dates were slowed down so as to ensure that we do not find ourselves in a retrogression territory. Also, what we have witnessed in the last two years (Sept 2023 and Sept 2024) is for the EB2 visa to be used up and become Unavailable. What is clear from the visa bulletins is that most back log from 2021 to early part of 2023 (March 2023) were being cleared for the ROW during 2024 fiscal year (1st Oct 2023 to 30 Sept 2024). The projection will be for the back log for 2023 (15 March to 31 Dec 2023) to be cleared using the visas available for the 2025 fiscal year. Hopefully, this can be achieved. For those who filed their Form I -140 in 2024, they just got to be patience and stay on the waiting list. It will surely get to their turn.
