***A lot of people have been asking me about dash cams and yes I did forget to mention that in the video. Dash cams are a great way to have evidence in the event of an accident and many other things as well. I get dozens of dash cams every year to try out and this is my recommendation for a dash cam, it's not cheap but it's by far the best with the most features and easiest to use, if you want to the best get this, if not there's tons of other dash cams out there just look around:

Scotty, a dash cam in the car is great help also. A friend of mine had a lady backed into him in a parking lot. When the lady got off her car she started screaming to him: “you hit my car!”. My friend had a dash cam in the car but did not tell the lady. He just kept denying her claim. After the cops arrived he showed them the footage and the lady’s expression of shame and surprise in her face was hilarious.

I was in a car accident a while ago, immediately after I was so pumped up with adrenaline that I felt fine, didn't hurt anywhere. So I told the paramedics I was fine, it was a big mistake. Woke up the next day to realize my neck, shoulder, and lower back all had pulled muscles. Could barely walk for 2 weeks. Adrenaline is crazy how it can mask an injury

Yeah plus the police reports can be biased. My mom was in an accident a few months ago and even though the other driver was 100% at fault the cops tried to blame it on my mom b/c the other driver (supposedly) was responding to ambulance sirens behind her when she ran the red light. This despite that Texas law clearly states that you should move for emergency vehicles but you MUST do so safely as the onus is still on you to make sure you don't hit somebody. In short, police are not legal experts.

I was once stopped at a red light. The car next to me was anticipating the light turning green, and went before the light had turned green. Coming across at high speed was another car trying to beat the red light on their side. Fortunately, the first car was able to hit the brakes and avoided an accident. The light turned green soon enough. I think both of them were at fault, both running the red light.
Another tip, get a reliable dash cam (front and rear). Even if you don't get into an accident, you could capture something interesting.

From an adjusters point of view (difference between an adjuster and an a agent, an agent sells you a policy, a adjuster decides fault on a accident)
    1. Take pics of the accident scene-lots of pics, send more then you think you could use, everything including but not limited to;
    1a. Both cars damages
1b. The other person (in case the try to claim they weren't at the seance of the accident)
1c. The area where the accident happened (if you can do it from a safe distance
    2. Canvas the area where you had accident find witness (despite what he says these are very important, make sure you have at least phone number and name. These are VERY important to claims were its word v word.)
    3. Talk to your insurance right away and corporate with them.
    4. If you are injured, go get checked out. Tell the insurance adjuster, make sure they here it in your statement, so insurance companies are shady.
    5. Make a police report at the scene accident if you can (some areas don't let you make one unless someone is injured)
    6. Don't admit fault, in most cases, if you think you are at fault you probably are, but please don't tie the adjusters hands, If you admit fault its a lot harder to argue it might be comp neg
    7. Ask. Ask. Ask. Ask questions about your coverage. Ask questions how the claims process works. Ask questions about determining liability. Ask questions about benefits for filling with the other insurance company ((if you are in a rear end, or in a parked car) in all other instances it might take a while to determine liability.)
    8. Be patient. Liability isn't finalized over night.

Oh my God he is 100% absolutely correct about the tow truck drivers! Never never never let the tow truck driver that shows up at the scene take your car. First call your insurance company or AAA and let them recommend someone. I've had customers who we're so Shake It Up they didn't realize that they signed for a $500 tow fee which is legal in my state.

      What state?

  • @BigHeadClan
    @BigHeadClan 5 років тому +6

It's by law here in Canada so not all of this is applicable to us but here your car must be insured and registered and anything that you suspect is over $2000 in repairs requires a police report to be submitted. If the other party leaves an accident and refuses to submit a report it can be considered a hit-run.
All solid points though, another two points I find very helpful can be found below.
    1. Holding off submitting an accident report for a day or so to the Insurance agency do not report immediately after the accident. Before you do submit the report make sure you write out what happened once you get a chance then wait a few hours or a day and read it back to yourself before you report it to the Insurance company.
Many people (myself included) have been placed at fault in an accident because they weren't clear enough when they reported the accident.
    2. If you have a dash-cam bring that evidence forward only if it's required, like the other driver is lying or the situation wasn't very clear. They are a wonderful tool but often only show a narrow view of the situation right before the accident and can sometimes end up with other charges being laid against you.

Great Video Scotty. I agreed that Uninsured motorist is very important, just 2 weeks ago i was hit by uninsured motorist. Lucky I had uninsured property damage on my policy so my insurance cover my car damages. I only had to pay 200$(deductible) out of 5400$ repair cost that were done to my car. This can happen to anyone so it's very important to have uninsured motorist/ uninsured property damages on your policy.

Been driving for 25 years. Never had an accident, never been around one, never seen one. Been there right after it happened. You can influence other drivers to acknowledge you by doing a few simple things like:
using turn signals before you turn, slowly merging into lanes
    avoid driving on blind spots
    Using hazards in dangerous zones
Avoid driving next to clusters of other cars.
Slowing down to normal speed limits
    Let others pass you
Always know where others are and keep a good distance
    Never rush when driving
    Respect others
Make sure your car breaks, tires, lights, is operational.
Avoid rush hour traffic if you can leave early or 2 hours later than 5 pm or 8-9 am.
Avoid driving in the rain, heavy snow etc.
I hope I can safe a life. I took a defensive driving course and it was useless.

Take your phone and all your paperwork, minus your registration and tell the other driver you need their paper work, drivers license, insurance card and whatever else your state requires, take pictures of the other persons papers, all of them. The cop will see your registration. Take pictures of everything including the cop and his/her car and license plate. Make sure you have an ambulance for yourself and all passengers in your vehicle. Go to the ER and be checked out and have them call your doctor and inform them of your accident and their conclusions. You are only interested in you and yours well being, the other individual is on their own.

1:30 speaking of cops writing accident reports:
    (1) keep in mind that there are usually 2 sections to an accident report. If an accident is considered "no fault" (or the cops can't tell who is obviously at fault), whoever is in the first section is considered AT FAULT.
I had an accident where I was dead stopped on a left turn lane at the end of a row of cars (for those in Louisville, on Florence between Southern Parkway and 3rd Street. Florence is maybe a block long, and it's the entrance ramp to I-264 west). The guy who hit me (a plumber in an older style van) was trying to beat the yellow left turn light, and his rear bumper hooked onto my front passenger bumper. He wound up tearing the front nose off of my 2001 Toyota Celica.
He was acting like he _wanted_ to "hit and run", but my bumper was stuck in his and I'm guessing he realized he would have looked pretty stupid speeding down the road with my entire nose stuck to his rear. The cops showed up while I was trying to get the driver's side bumper part unscrewed (so I could take the whole piece off and put it into my trunk) and took the report. EVEN THOUGH I WAS DEAD STOPPED they put me in the first section. When I called Alstate (the insurance of the plumber) to get a case opened, he said the cops put "no fault" and I was the first slot on the report, so he wasn't going to pay me a dime.
    (2) get a camera - know where your "video" and "photo" buttons are - *FILM EVERYTHING.* Get the license plate number, VIN number (which is usually under their front windshield on the dash or on the driver's side window) and EVERYTHING regarding the impact zones. LEAVE NOTHING TO CHANCE.
Remember: *You can never have too much information.*

You are so right about your advice here, Scotty. Decades ago, when I was young married woman, my husband and I got into an accident on a snowy icy road in rural Oklahoma. Unfortunately, about four other vehicles piled up along with us and we all slid into a snowbank ditch. We helped each other out of the snow, and as one guy got his car out of the snowbank, he just took off. He had run into our car, and dented up the side and rear of it pretty badly. Because I had the foresight to write down his first name and license plate, We were able to file a hit and run along with the description of him and his car. The man ended up having to pay for our repairs as well as the court costs and the fines. So always write down or take pictures of everything at every scene of accident if you are able to do so.

Always take VIDEOS. Still pictures can be derived from the video if needed.
First thing to video is the other driver, any passengers and any witnesses. Then, or at the same time, video both vehicles from all angles.
It's been four months since I was rear-ended and my left foot is still giving pain, is swollen even though the X-rays didn't show any breaks. I'm having headaches in the back of my head where the head restraint bashed my head, causing me to black out and have blurred vision. My lower sides are still tender from where the seat bolsters slugged me as the seat was breaking.
So don't be quick to say that you're OK.
Oh, BTW, SURPRISE! SURPRISE!! the SUV was UNINSURED. My uninsured motorist insurance is paying what my other coverage doesn't cover.
I told the tow operator to take the car to my house and gave the address. He took it to his tow-in lot anyway. I couldn't do anything as I was being loaded into the ambulance.
As it turned out it didn't matter as the my insurance company totaled the car and bought it.
Just in time, too, as it was due for a timing belt and other services and repairs.

Hey Scotty, I don't always agree with everything you say - but I do with this video. Awesome advice!
When I was 19 years old (many years ago) being naive after an accident that another driver caused cost me a fortune. I was driving along at the speed limit when a brand new 7-series BMW (top of the line BMW in 1984/1985) came careening out of a bar parking lot and smashed hard into my right front fender, spinning my car around. The hit was so hard it broke my upper control arm, bent the frame (1979 Dodge Diplomat) and both cars were ultimately written off (although I ended up driving mine for the next 7 years as a wreck).
I got out and asked the driver if he was ok but he didn't answer and literally ran as fast as he could straight into the bar he came out of. I could smell alcohol on him too as he ran past me. Almost an hour later the Police finally showed up and the other driver was still in the bar so the cop didn't talk to me and went into the bar and got the guy and took his report. I was told to wait with my car. To my surprize numerous other people were going into the police car and coming back out and nieve me had no idea what was going on for over an hour. Eventually to my surprize an ambulance arrived, the other driver got into it and it left. The cop then asked me to come to his car and told all the other people he'd been talking to they could leave.
To my absolute shock the police officer told me I was being charged with a severe case of dangerous driving causing bodily harm, charged with speeding, charged with an unsafe lane change 1/2 a mile up the road and was immediately losing my drivers license and might be going to jail. I couldn't believe what I was hearing and had naively assumed this was a clear case of the other driver being at fault. I tried to explain what had happened but he said he had interviewed 11 people, many of whom had "witnessed me racing down the street and driving recklessly several blocks away, including cutting one driver off, and there was no way he was going to believe a teenager over all of these 'respectable' adults". They had completely rewritten the facts and even had the other car driving down the road and me losing control and spinning before hitting his car. I tried to point I could smell alcohol on the other driver but the officer stated the other driver started drinking only after I hit his car and he had apparently gone into the bar in severe pain and started drinking due to the trauma he experienced. He also pointed out that the other car involved was one of the most expensive cars available in North America and told me that I had written it of and it was going to cost a fortune to replace. I was taken to the police station for booking and my car was towed to an impound yard. I was going to have to pay a minimum of $1200 in fines (in 1984) plus go to court for the dangerous driving causing bodily harm charge which could even result in jail time for me.
I pleaded not guilty to all charges which enabled me to get my driver's license back until the court case. Realizing the severity I hired a lawyer who subpoenaed all 11 witnesses. It turned out that every single one of them had provided a false name and false address so the only one successfully subpoenaed was the other driver. At the trial not only did no witnesses show up, but the other driver didn't show up nor did the police officer show up. The judge threw out all charges against me, reinstated my license fully and declared the accident unsettled and in need of the police to investigate to decide who was at fault. I don't believe the police ever did re-investigate and the police report was never updated, but at least I was no longer legally considered the at fault driver (or so I thought).
After the trial my insurance company decided to sue the other driver and his insurance company to recoup the almost $1 million dollars they had already paid in compensation for the other driver's vehicle damage and compensation for his supposed injuries (he had a doctor report showing he had a back injury, neck injury as well as possible internal injuries). I was even asked to travel 200 miles away to meet with the insurance company lawyers in preparation for the lawsuit. I did that and it looked like they were in an excellent position to get their money back which would also mean I'd have no payment claims against my insurance policy.
Unfortunately for me about 4 months later the two insurance companies settled out of court for an unspecified amount and I was sent a letter stating I would not be required to go to court. Worse than that, this resulted in an "on paper" payment of almost $1 million staying on my insurance policy even though they settled for some unknown amount and per the judge in my trial, the accident was no longer considered as being my fault.
As a result my insurance increased from approximately $300 per year to $3600 per year and when I tried to switch insurance companies I discovered there was a registered at fault insurance claim of $1 million still on my record and the only insurance I could find was over $5000 per year. I went back to the same lawyer who I used for the charges against me and he tried to get the insurance company to do the right thing and remove the at fault payment registration. Eventually he even wrote them a letter threatening to sue them (my own insurance company) but they still did nothing. Ultimately he told me it was going to cost well over the $3600 for 5 years to successfully sue the insurance company so I ended up paying the high insurance premium in addition to about $2500 in total legal fees for everything.
Back then there were no cell phone cameras, no street cameras, etc. but had I known what was going on I would have been wise to talk to people standing around and to try to get some witnesses. Today, as Scotty said, take lots of pictures. The skid marks and vehicle positions in my case would have made it clear that the other driver's story was a lie but the police didn't even take any pictures of the scene themselves; only pictures of the vehicle damage. I think if this happened today I'd also follow the other driver into the bar and take pictures of him attempting to talk to people in the bar, plus insist he come outside and wait for the police. I also don't know for certain but when a "witness" makes a police statement/report, I wonder if today the police would actually check to make sure they were real people (real names and addresses) instead of fake names and addresses like in my situation.
If the driver of a car that just caused an accident with you suddenly takes off to talk to other people, don't be naive like I was. He/She is trying to get false witnesses arranged and you need to do whatever you reasonably can to stop this from happening. In my case they had about 45 minutes to all get their story straight before the police arrived but had I stopped this they wouldn't have been able to present a consistent story.
If you made it through reading all of this - has this sort of thing happened to you? Did it end up costing you huge amounts of money like it did me (about $20,000 in total and that was in the 1980's)?

And after my last accident, with all the lies from the other party, I NOW HAVE DRIVING CAMERAS! I have one in front, one in back recording 100 percent of when I drive. Cost me $600 installed, but some day it will pay for itself! I just had a close call after installation of cameras. I was going straight with green light ahead, guy at red light in intersection pulled out, crossed 2 lanes in front of me almost side swipped my new Toyota Highlander. I had to take a severe turn, narrowly missing him. They have no chance in court now!! It has my speed and GPS on it too. I'm ready for you crazy drivers!!!!
FYI, two weeks after my accident, I was found to have a anurism in my heart aorta, coincidence???

Definitely sucks if you're in a wreck and you're a teenager. I got T-boned by some old hag who was very dramatic about the whole thing. I remained calm and described how the old lady didn't do her stop, yet did not believe me and now I have to go to court over something that wasn't my fault! The worst part about all of that was that the Police were around the corner when this happened and prevented me from obtaining evidence, you would think they would be near enough to see this.

Also, should you move the damaged vehicles at all - or wait? If assistance or first aid is required - what should you do?

You are a star, Scotty. Absolutely right on, bingo! Just had my first crash a month ago--first ever for me, with decades on the road (she did an illegal u-turn against green-lighted oncoming traffic, w/blind spot). Even my cat-like reflexes couldn't save me/us from this one.
I was anything but prepared. But a witness appeared in a heartbeat, said she saw everything, it wasn't my fault, nothing i could do-- and she had it on video! "God bless you!" i said. She typed her info into my phone. Then she took pictures with HER phone (pictures by the witness, that's pretty good, huh?). She must've called 911 too. Everything unfolded. I was in shock, but not obviously so. Police came. Firetruck came. Police called EMS to come after firetruck left bc there was a 4 year old in her car, a "CYA", he said.
It's funny, they ask, "Are you alright?" I had to say "I don't know, i think so." Intuitively, i knew not to say yes. Turns out i was alright, thankfully. But my sweet creampuff 2007 Impreza with only 94K was totaled. In the end (31 days out, today) all turned out okay, though it took a full month. I am grateful.
I don't want to experience another, but just to be on the safe side, i am going to make a little card for the glove box of my beautiful new(er) Deep Cherry Impreza Premium--point by point from your video. Funny, it was the EMS guy, last guy to the scene, who said "do you have her Insurance info?" I didn't. Because Police suggested taking pictures (of her license, of her plate). So the last thing i got before everyone left the scene was the name of her insurance company (duh!). First call when I got home was to my Insurer. The second was to hers. Put the whole claim through hers (thus maintaining my perfect driving record and top discounts for same), since i had zero fault (and a rock-star witness).
No one can be expected to be thinking clearly after a crash. So your EXCELLENT advice to be prepared in these ways is priceless. Thank you. You're an angel from heaven :) - bless you.

@@burritos1000 One would think at first but the greater weight forces the impact to remain at the bottom point....so heavy there is no rebound therefore maximum possible force is applied. Were the "sled" as light as a feather or made of plastic, there would be some rebound effect from the sled absorbing some of the impact force but as is, all the force (virtually 99%+ ) is impacted on the body (subject). Note the sled is made such that the sled is moving down hill and not level decreasing to virtual zero any rebound effect which stops the sled from absorbing any of the shock thus maximum transfer of force to the person in the sled. Also note this is not a real world scenario as the crumpling car would absorb a great deal of the g forces. I could be wrong but you'll have to prove it. : )

If people stop tailgating other cars too close then they would be less chance of rear ending them and less insurance claims happening because alot of cars these days on the roads are seem to be following too close

    • @algrayson8965
      @algrayson8965 5 років тому +4

Martin, almost all drivers follow too closely. Few realize just how far the safe distance is. Two seconds is the absolute minimum on a dry, clean, straight and level asphalt or concrete pavement. Two seconds at 60 mph is 176', nine "car lengths" of almost 20'. It takes the ordinary driver about a second and a half to see, process, react, lift the foot from the go pedal, move it to the brake pedal and begin to apply the brakes. One and one half seconds at 60 mph is 132', three-fourths of the minimum following distance. And the first thing seen was the leading car's brake lights, meaning that its power was off and its brakes were already being applied.

Believe everyone here who says to get a dashcam. Yeah, pictures are great, but pictures when the accident actually happens are gold, even if the action happens off screen. For example, someone rear ends you, they're going to say you swerved in front of them and then slammed on the brakes. Even though you don't capture the accident on a front-facing camera, what it does capture will prove your innocence. A dash cam will capture things like your light being green when you go through the intersection. Finally, the dashcam captures audio as well. You can record information just by saying it. If a driver is acting erratically, I'll speak their car type and license number so that the microphone captures that info. When you're driving, you won't have the presence of mind to try to mess with your phone and get an app started to record information. An HD-quality dashcam and a good size memory card can be had for well under $100, or you can get a mount for your phone and use that. I prefer a cheap dashcam as it's starts working as soon as I start the car and I don't have to think about it and i don't have to hide it every time I leave the car. And if it gets stolen, not a big deal. Or, your old phone can be used. Even if it is out of service as a phone, it will work great as a dashcam.

Just a note regarding using an old phone - i would not recommend that method, as usually it would be mounted on the windshield, and phones are on batteries, not capacitors. On a sunny day the battery may overheat and explode, causing fire. Side note: I got myself a ~120$ front dashcam, but if I were to make a decision again, I'd choose 2 X 50$ dashcams, one for front, other for rear.

As a chiropractor who treats many auto accidents patients, I say your advice is spot on. I also recommend buying a dash camera. The at fault car may have a few passengers to dispute liability while the camera does't lie. Also make sure you carry medical insurance on your auto policy if you don't live in one of the few no-fault states. Often times health insurance has to be reimbursed if you get a settlement. Medicare and all federal plans for sure has to be reimbursed.

I even got their phone number and plate but guess what, they changed their number after the fact to avoid. Good thing at the time I had a front and rear dashcam from Blackvue. The whole situation was cleaned up as I had insurance check the car for damages cosmetically. I know the whole just about bumpers being damaged. Though looking under the car and in front of the true bumper looked pretty ok. I own a 2003 honda accord ex rather a pretty good vehicle and I take rather good care. The dashcams do save lives as they also prevent insurance fraud.
