That would have been the smart play in his case. It seems the case hinged on whether the fatal shot he fired was intentional or accidental. If it was found to be accidental homicide then the sentence could have been more like 10 years. Maybe the prosecution was not interested in a deal because the evidence against him looked so bad they were confident in going all the way for the intentional murder conviction. Or maybe they offered a deal and he refused, choosing to go all or nothing, and now he's done. I've heard it said that if they do offer a deal and you don't take it then they will go for maximum sentence on conviction, to set an example for the next defendant who might not want to take a plea deal.
If you're that scared, you don't go outside, you talk from inside the door and you ask what the person wants. If you fire a warning shot, you do it from the doorway as protection from returning fire. Shotguns aren't accurate over a long distance, it would be extremely unlucky to hit a person down the driveway by stumbling; you would have to aim. This varies with the gun and other variables. From Shooting Illustrated: "accuracy beyond 50 yards is poor".
As a gun owner and 2nd amendment supporter, I've always believed that guns don't kill people. People do. And unfortunately, this is another irresponsible gun owner. Why did he not take a plea deal?
That would have been the smart play in his case. It seems the case hinged on whether the fatal shot he fired was intentional or accidental. If it was found to be accidental homicide then the sentence could have been more like 10 years. Maybe the prosecution was not interested in a deal because the evidence against him looked so bad they were confident in going all the way for the intentional murder conviction. Or maybe they offered a deal and he refused, choosing to go all or nothing, and now he's done. I've heard it said that if they do offer a deal and you don't take it then they will go for maximum sentence on conviction, to set an example for the next defendant who might not want to take a plea deal.
If you're that scared, you don't go outside, you talk from inside the door and you ask what the person wants. If you fire a warning shot, you do it from the doorway as protection from returning fire.
Shotguns aren't accurate over a long distance, it would be extremely unlucky to hit a person down the driveway by stumbling; you would have to aim. This varies with the gun and other variables.

As a gun owner and 2nd amendment supporter, I've always believed that guns don't kill people. People do. And unfortunately, this is another irresponsible gun owner. No sign of a threat to bodily harm let alone his life. He fired a warning shot which almost always proves he was not in life threatening danger. That's an aggressive tactic and not a good look in court. You don't bring a gun to a fist fight... and you certainly don't bring a shotgun to a "non-combative" scenario.
