The problem lies in the selection or shortlisting the builder for redevelopment. In most of the cases the society committee selects the builder with Good or Big Brand Name alongwith security deposit and funds to develop. So after the builder receives all the power and rights to execute the funds disappear or diverted to other projects or work and in this way the project gets stuck. Genuine builder or developer will try or give his best to complete the project whereas the so called big branded builder will try to delay or show incompetence. So the society committee alongwith the member's consent should not go by what is shown but how builder will make things will happen and the duration.

People having 2 3 Cr have become builders , in every second building agents are living.
Now onus on government to strengthen law and governance process.
As a start government should make law on selling underconstruction flats .Separate law needs to be enacted. Also it should put ban on selling such flats which never exists

rehab component people are 2nd class citizens and their structure is aswell. I have seen this. new people will push down old ones with increasing maintenance charges and they will make you feel second class. old tenents may but in most cases may not have money to pay 3-8x maintenance for new building which is saddest part. our income does not rise as inflation. 😢

Some People danching and tempting for home at upper floor are highly responsible for getting high rise tower built and raise in maintenance min by 10 to 15 fold and many old residents staying with monthly maintenance 700 to 1200 get dragged...into unaffordable expensive living in old age
There are few who get happy for amenities but they are actually to sell additional flats and buyers can pay that with ease but old residents feel heat of that burden..also compulsion to pay even if old age people has no ability to use it.its like use by few by forcing all others to pay money.
There must be strict rules from RERA that those who can't afford and want To leave due to majority for HIGH RISE STRUCTURE with amenities, they must get 175% to rate of selling additional carpet area to old members in DA as compensation from developer for compelling to leave residence spot where they are living since last many years.
Otherwise it's harassment for seniors who get pushed for expensive living when that's time, they need handful balance money for their health.
PPlease write it to supreme court to stop such compulsory punishment against support for protecting life of others in building.

Redevelopment of Cooperative Housing Societies: Challenges and Problems Faced by Opposing Members
    Introduction:
Redevelopment of cooperative housing societies, especially in middle-class areas, often promises better living conditions and extra space. However, this process can be fraught with difficulties, leaving many members displaced and powerless. This narrative explores the issues and challenges that arise during the redevelopment of cooperative housing societies, particularly focusing on the problems faced by members who oppose the redevelopment process.
1: Legal Complications and Loss of Control
The redevelopment of cooperative housing societies is legally complex and often built on shaky foundations. While the law technically allows societies to enter into redevelopment agreements, it does not provide adequate protection for individual members. The following issues are commonly observed:
    1. **Legal Fiction**: The legal basis for redevelopment is often a "legal fiction," where the cooperative society is considered the owner of the property. However, individual members do not have real ownership, leaving them without recourse in civil or criminal courts.
    2. **Builder’s Control**: Once the redevelopment agreement is signed, the builder gains significant control over the property. The cooperative department cannot intervene until the redevelopment is complete and a new society is formed, leaving the original members vulnerable.
    3. **Powerlessness of Members**: The managing committee, which is responsible for selecting the builder and ensuring transparency, often sides with the builder. This leaves individual members powerless to challenge the redevelopment process or hold the builder accountable.
2: Social Dynamics and Marginalization of Opposing Members
The social dynamics within the cooperative society change significantly during redevelopment, often marginalizing those who oppose the process:
    1. **Builder as an Ally**: The builder is often seen as a benefactor by the cooperative society, promising to construct new, improved housing. Members who raise concerns are viewed as obstacles and are marginalized.
    2. **Lack of Legal Standing**: Opposing members cannot take legal action against the builder, as the courts do not recognize their individual standing. The redevelopment agreement is signed by the managing committee, not by individual members.
    3. **Difficulty in Change**: To challenge the builder or the redevelopment process, members must obtain a 51% majority to change the managing committee-a challenging and time-consuming process.
    4. **Displacement and Disinterest**: During redevelopment, members are often scattered across different locations, weakening their involvement in society activities. Office bearers may also lose interest in addressing members' concerns, especially when the redevelopment process starts.
    5. **Loss of Documents**: As buildings deteriorate, important documents and records are often lost, making it difficult for members to take legal action against the builder. The builder, who controls the original documents, further complicates the situation.
    3: Inequality and Marginalization Post-Redevelopment
The post-redevelopment phase often sees a growing divide between the original members and new buyers:
    1. **Lower Quality for Original Members**: Rehabilitation members, who initially granted development rights to the builder, often find themselves in lower-quality housing compared to new buyers. Their housing is usually in a separate wing or building that is visually and qualitatively inferior.
    2. **Class Divide**: A noticeable class divide emerges between the rehabilitation members and the new buyers, who paid for their flats. Rehabilitation members are treated as second-class citizens within their own society.
    3. **Dissolution of the Old Society**: With the increase in the number of flats, the old cooperative society is effectively dissolved. The new managing committee is likely to consist entirely of new members, with little to no representation from the original society.
    4. **Marginalization of Original Members**: The formation of a new cooperative society leaves rehabilitation members feeling marginalized and deprived of their rightful place, as the society they once knew ceases to exist.
    Conclusion:
The redevelopment of cooperative housing societies, while promising on the surface, can lead to significant challenges and issues for individual members, especially those who oppose the process. From legal complications and loss of control to social marginalization and inequality, the process can be fraught with difficulties that leave members feeling powerless and marginalized.

Based on this video, here are key questions that members of a society undergoing redevelopment should ask the management committee and the builder:
    ### Questions to the Management Committee
    1. **Legal and Ownership Clarifications**:
    - How is the legal ownership of the property defined during and after redevelopment?
    - What legal protections are in place for individual members if issues arise with the builder?
    2. **Transparency and Accountability**:
    - What criteria were used to select this particular builder for redevelopment?
    - How will the management committee ensure transparency throughout the redevelopment process?
    - What steps will be taken to ensure that the builder fulfills all promises made to the society?
    - How will the committee address concerns or objections from members regarding the redevelopment process?
    3. **Member Involvement and Rights**:
    - How can members actively participate in decisions related to redevelopment?
    - What is the process for removing or changing the managing committee if a majority of members disagree with its decisions?
    - How will the management committee ensure that all important documents and records are securely maintained during the redevelopment?
    4. **Contingency Planning**:
    - What contingency plans are in place if the builder fails to complete the project on time?
    - What measures will be taken to support members who are displaced during the redevelopment process?
    ### Questions to the Builder
    1. **Construction Quality and Housing Standards**:
    - How will you ensure that the quality of construction for rehabilitation members is equal to that of new buyers?
    - What guarantees do you offer regarding the quality and durability of the materials used in the redevelopment?
    - Will rehabilitation members be housed in the same building as new buyers, or will there be separate wings? If separate, why?
    2. **Project Timeline and Commitments**:
    - What is the timeline for completing the redevelopment, and what penalties are in place if deadlines are missed?
    - How will you ensure that the redevelopment process does not exceed the agreed timeline?
    - What compensation or alternative arrangements will you provide if members cannot move back into their homes on time?
    3. **Legal and Financial Security**:
    - What legal assurances can you provide to protect the interests of the individual members during the redevelopment?
    - How will you ensure that all original documents related to the property are returned to the society after redevelopment?
    4. **Post-Redevelopment Integration**:
    - How will you facilitate the integration of rehabilitation members with new buyers in the newly formed cooperative society?
    - What steps will you take to prevent a class divide between rehabilitation members and new buyers after redevelopment?
These questions will help society members clarify critical aspects of the redevelopment process, ensuring that their rights and interests are protected throughout.
