I heard a thing from someone saying that there is a bill about to be passed or Atleast in discussion about children under a h-4 can get an authorization to work as long as they stayed in the U.S. for at least 8 consecutive years, is that true? What if my child has spent most of his life in the U.S.?

Good day, I just want to express my concern about my son, who is over 21 years old and is an autistic child. He is dependent on us, and our entry to the US is an EB3 visa as a family. However, our son is not included in the application, as my agency told me, and my question is, in what way may we be able to get him to the USA with a legal visa? I hope that you will enlighten me. Thank you.

Your son will probably need to be sponsored for an Immigrant Visa when you receive your own green card. Did your lawyer council you on this plan?

Probably not. We would have to see if you are qualified under CSPA.

@kaushik Yt My son is in the same category. We are in CA. He did his schooling from 7 th grade here and is in 10th grade now. I have an i140 and I don't think I will get a green card before he is joining college. So what would be the best for him. H4 or F1. Heard H4 visa students aren't eligible for internships in college. I can't use the instate tuition in F1. Bit worried now.

@@karthika8610 You are correct on your knowledge - the H-4 cannot do a paid internship. it is really frustrating!

Hi, I'm on H1 and My daughter (H4) is in 8th grade right now. When she turns 21, she will be in 4th year in college. Can she continue to stay in H4 until 3rd year in college, convert to F1, and study 4th year on F1? Can you please shed some light on this? BTW, my GC is in progress, and not sure we will get it before her 4th year of college.

You are clearly safe until you turn 21. But it is good to have a backup plan, such as an F-1 student visa, just in case. Also look into the Child Status Protection Act.

Then they may need to sponsored by you when you get your own permanent residence. This is a complicated problem, you are welcome to reach out for a consultation. 404-325-5858 or info@tdlaw.us.
