Thank you for your information! My question is does this new CSPA policy apply for children outside the U.S too? Or only if they are in the U.S already?

Yes, for some applicants. If you could file an adjustment of status using the Dates for Filing Chart, you can use the Dates for Filing Chart for CSPA calculations.
Our case is F4 category and we need immediate help. one derivative age 29 now (his Visa was denied because of age out at interview time ....but we think they didn't calculated the age correctly according to new law. when our Filing Date was current and we received the letter to submit fee and DS260 form in 2020 He was about 20 years old according to CSPA age. Will his age will freeze on DQ date which is in 2020? Please respond!

Hi sir my case is F1 category. I am an unmarried daughter with two kids. My mom is a us citizen My priority date is October 13 2015. One of my kid was 15 and the other was 17 at the time our paper file. We were documentary qualified in 2021. I went for my interview on August 15 2024. I was told by the immigration officer that she saw our case was pending for a long time but unfortunately my kids aged out. Please advise me what to do next.

Question is when to do this late filling.... Should we wait for the DFF chart to reach parents' priority date to make this filing?.. Or can we file right away ( since the original DFF date when the parents and the other younger siblings filed their 485 is what is relevant to calculate CSPA age of the now aged out child)? Will mailroom accept 485 petition without the date being current per latest visa bulletin chart (chart USCIS determine for the month for filing purpose)
