The PCA was written by a cop not the Prosecution. Prosecution do not have to answer for what cops write or say or do. The PCA was written in the infant stages of the case and does not lay out the entire trial. Prosecution have their own evidence to present other than a PCA.

From what Payne said on the stand there, they 'relied on' surviving roommates interviews, roommates phone analysis..that's foolish for a start!! Something changed with Bethany's interview for certain!! She originally got home at 1am and was out 'separately in the community'. Then in the PCA she's suddenly at the Sigma Chi party and sees X and E there until 1.45am!! This case is full of stinking rats! It smells very bad to me!

Because the Defence are trying to craft an Alibi based around the evidence but that goes against the Idaho states laws on the matter. The prosecution has stated that they’ll pass on the data once the defence provide the full alibi, something they’re still refusing to do. If he’s innocent then the alibi should be sound regardless of the data the prosecution have. The fact they need to see this data before giving and alibi is highly suspect.
I doubt it. Police didn't just pick out the suspect's name from a basket, they followed evidence. The fact that the suspect has no alibi and he was out near the murder location around the hours of the crime is an example of why he is the main suspect. All you need is common sense to see the 'possibility' that he might truly be the culprit. There would not have been a grand jury indictment if there was no evidence linking the suspect to the murder location.
Why isn’t BK able to give his exact location during the time his phone was turned off. It should be very easy. Can’t say I blame the defense but they are crafting an alibi based off of the CAST data. If he’s innocent, why not just give the notice of alibi? Produce your witnesses. Tell us where you were from 3:30-4:50am. The problem is as soon as he says he was at X and the data suggests otherwise, he’s cooked.

The FBI cannot be compelled to comply with a subpoena and it’s obvious they want anything to do with this case. The Agency has a duty to protect their confidential sources, agents, and methods from public disclosure.

This case is about the murder of 4 people. It is not about a car and the knife sheath is not the murder weapon. Think back to the beginning as in the first reports about this. Rumors of someone passed out and rumors of someone being shot. This was before police response. After a short lockdown, police claim they have no suspect or person(s) of interest, but they were confident in saying there is no threat to the public. This means something very significant. If this case is to be such a slam dunk for the prosecution, why seal so much info starting with WHO placed the 911 call?

It’s been stated that it was a rural area and it’s possible his phone didn’t have service. This would make sense if his alibi is correct in that he was driving around in a rural area known to not have service. Bottom line, this is a capital murder case. Every piece of evidence needs to be turned over. It’s clear the prosecution has theorized what they believe or want to be the truth and has tried to pin him for these murders. If it was your family member you would want the investigation to be done right and you would want a defense attorney who would work their butt off for you.

I'm willing to bet, this was/is the first and only time his phone "lost service". But that's because of many puzzle pieces and not just a cell phone being turned off or put into airplane mode, or a knife sheath, or video tracking, or cell tower triangulation, or his unverifiable alibi, or any other information by itself. Trial is where we'll learn more. And in all fairness, he does deserve the presumption of innocence, until proven guilty. But failing to recognize the weight of the evidence that we already know about would be foolish in my opinion.

Those Kohberger cellphone records are not from his phone, they are from the AT&T cellphone tower archives, as aquired by the FBI, and later, from Verizon and T-Mobil as well. That data simply indicated that someone could heve been in either Moscow or could have been in Pullman, and the phone would have pinged the AT&T tower in Moscow, regardless of which city the person was in. So, Brett Payne created the fiction that this person drove between the two cities. Sy Ray's testimony is that there is no cellphone data indicating a journey between Pullman and Moscow, or vice-versa. The map you show at 3:17, is only a map of Sand Road, which runs between Moscow and Pullman. Brett Payne speculated that perhaps one car seen on a video could have been the Perpetraitor. He then speculated that the car could have driven to Sand Road, and could have driven to Pullman. It was not drawn from any cellphone data. "To develop that path". Payne was very, very greatly exaggerating when he suggested that it was. The prosecution has repeatedly claimed that the FBI has the evidence requested by the defense. Judge Judge ruled that the FBI data is part of the DA's office evidence, therefore, the DA's office must produce it for the court, to be turned over to the defense. They have not. I am very tired of seeing old video of Kohberger in an orange outfit.

I agree... The real problem is the feds used AI software to find the suspect, then tried to make the case after the fact, based on the data that was fed to the AI. Which in no way was proof of guilt... just who was the most likely suspects based on all the data they could feed it. Hard to say when they seemingly zeroed on Mr. Kohberger early on. They haven't released information about why or how the other men who left the samples of "unidentified DNA" at the scene were cleared or eliminated as suspects.

It’s disturbing to watch how much indifference the Prosecution, police, FBI and News channels are showing when told of the lack of evidence forthcoming. It’s a DP case.

Because the Defence are trying to craft an Alibi based around the evidence but that goes against the Idaho states laws on the matter. The prosecution has stated that they’ll pass on the data once the defence provide the full alibi, something they’re still refusing to do.
If he’s innocent then the alibi should be sound regardless of the data the prosecution have. The fact they need to see this data before giving and alibi is highly suspect.

The fact that the suspect has no alibi and he was out near the murder location around the hours of the crime is an example of why he is the main suspect.

Why isn’t BK able to give his exact location during the time his phone was turned off. It should be very easy. Can’t say I blame the defense but they are crafting an alibi based off of the CAST data. If he’s innocent, why not just give the notice of alibi? Produce your witnesses. Tell us where you were from 3:30-4:50am. The problem is as soon as he says he was at X and the data suggests otherwise, he’s cooked.

Rumors of someone passed out and rumors of someone being shot. This was before police response. After a short lockdown, police claim they have no suspect or person(s) of interest, but they were confident in saying there is no threat to the public. This means something very significant. If this case is to be such a slam dunk for the prosecution, why seal so much info starting with WHO placed the 911 call?

This would make sense if his alibi is correct in that he was driving around in a rural area known to not have service. Bottom line, this is a capital murder case. Every piece of evidence needs to be turned over. It’s clear the prosecution has theorized what they believe or want to be the truth and has tried to pin him for these murders. If it was your family member you would want the investigation to be done right and you would want a defense attorney who would work their butt off for you.

I'm willing to bet, this was/is the first and only time his phone "lost service". But that's because of many puzzle pieces and not just a cell phone being turned off or put into airplane mode, or a knife sheath, or video tracking, or cell tower triangulation, or his unverifiable alibi, or any other information by itself. Trial is where we'll learn more. And in all fairness, he does deserve the presumption of innocence, until proven guilty. Those Kohberger cellphone records are not from his phone, they are from the AT&T cellphone tower archives, as aquired by the FBI, and later, from Verizon and T-Mobil as well. That data simply indicated that someone could heve been in either Moscow or could have been in Pullman, and the phone would have pinged the AT&T tower in Moscow, regardless of which city the person was in. So, Brett Payne created the fiction that this person drove between the two cities.
Sy Ray's testimony is that there is no cellphone data indicating a journey between Pullman and Moscow, or vice-versa.
The map you show at 3:17, is only a map of Sand Road, which runs between Moscow and Pullman. Brett Payne speculated that perhaps one car seen on a video could have been the Perpetraitor. He then speculated that the car could have driven to Sand Road, and could have driven to Pullman. It was not drawn from any cellphone data. "To develop that path". Payne was very, very greatly exaggerating when he suggested that it was.
The prosecution has repeatedly claimed that the FBI has the evidence requested by the defense. Judge Judge ruled that the FBI data is part of the DA's office evidence, therefore, the DA's office must produce it for the court, to be turned over to the defense. They have not.

It's only tranfer DNA, very unstable and not reliable. Furthermore it's on a movable object, not on a wall or carpet or bed.

They don't have to prove his innocence. The duty of proof is on the prosecution. They have to prove the prosecution is wrong and to do that they need all the information handed over
