      They just need to make a case with admissible evidence. That's all.

    It doesn't matter whether the Prosecution thinks any evidence is relevant to the Defense's case.... or is or is not exculpatory. That's a decision the Defense has a right to make themselves. Hand over the evidence and quit playing games!

      @@tThisNThatthis defense lawyer has shown bias as well as she should have recused herself since she was the lawyer for a couple of the parents for two of these victims. She is just trying to stall the case. She has been given all the evidence. She just won’t listen to the judge or anyone else. Previous hearings have proven this defense attorney has been trying to undermine the prosecution and the trial itself.

      In the Lori Vallow trial, the judge removed the death penalty bc prosecutors failed to discover details asked for by the defense. They must hand over what they need to asap. Ducks in a row already.

      They tore it down because four college kids were brutally ******** there (censorship). That’s not a structure that could be resold or a place people would want to rent again. More than anything, I think they were worried about people trying to break into the house because sites like that become a spectacle.

    The families need to show up at court and demand that the prosecution release all the evidence they used in the PCA to arrest Brian. Someone other than Ann needs to put pressure on this court to get it together already.

      The PCA was written by a cop not the Prosecution. Prosecution do not have to answer for what cops write or say or do. The PCA was written in the infant stages of the case and does not lay out the entire trial. Prosecution have their own evidence to present other than a PCA.

      In the Lori Vallow trial, the prosecutor's delay in handing over discovery resulted in the death penalty being taken away by the Judge. Why can't prosecutors hand over discovery on time? This seems to be a regular problem. What is with the prosecution??? Do your job already

      @@Pllm30the Prosecutor is responsible for seeking an indictment based on the evidence presented in the PCA. This prosecution team sought a secret grand jury indictment whilst clearly NOT HAVING the evidence the judge that issued the arrest warrant relied upon.
      Sloppy and devious behaviour by the State. The State are a collective: police, the justice system, judges, prosecutors and defence.
      The only State player that’s following due process is the Defence.
      Enough of the manipulative shaming of anyone that speaks on what is so wrong with this prosecution. We are all thinking about the student victims and their families but justice requires the judge to end the delays and start sanctions against the prosecution.
      Any evidence listed in the PCA and or the other 200 plus warrants that the prosecution says they don’t have? Last motion to compel. Then take the DP off the table and start ruling on suppression requests. The games will end and if this is the guy the agencies will have to start behaving like professionals.
      It’s disturbing to watch how much indifference the Prosecution, police, FBI and News channels are showing when told of the lack of evidence forthcoming. It’s a DP case.

      Agree. I've had burgers, and home invasions. I did all I could to save my family by calling police.
      Self preservation also kicks in. Most try to get out of the house or call police or defend themself.

      This was a house that had ppl coming and going at all hours of the night. Its not like unfamiliar people walking out at night was an irregular event. If it was my house sure, not a college dorm hang out that was getting food delivered that night at 4am lol

      From what Payne said on the stand there, they 'relied on' surviving roommates interviews, roommates phone analysis..that's foolish for a start!! Something changed with Bethany's interview for certain!! She originally got home at 1am and was out 'separately in the community'. Then in the PCA she's suddenly at the Sigma Chi party and sees X and E there until 1.45am!! This case is full of stinking rats! It smells very bad to me!

Then the assailant carries it to the crime scene with gloves on. Too easily carried. I'm not even believing they had a large enough sample to get a proper profile.

      Because the Defence are trying to craft an Alibi based around the evidence but that goes against the Idaho states laws on the matter. The prosecution has stated that they’ll pass on the data once the defence provide the full alibi, something they’re still refusing to do.
      If he’s innocent then the alibi should be sound regardless of the data the prosecution have. The fact they need to see this data before giving and alibi is highly suspect.

      I doubt it.
      Police didn't just pick out the suspect's name from a basket, they followed evidence.
      The fact that the suspect has no alibi and he was out near the murder location around the hours of the crime is an example of why he is the main suspect.
      All you need is common sense to see the 'possibility' that he might truly be the culprit.
      There would not have been a grand jury indictment if there was no evidence linking the suspect to the murder location.

      Why isn’t BK able to give his exact location during the time his phone was turned off. It should be very easy. Can’t say I blame the defense but they are crafting an alibi based off of the CAST data. If he’s innocent, why not just give the notice of alibi? Produce your witnesses. Tell us where you were from 3:30-4:50am. The problem is as soon as he says he was at X and the data suggests otherwise, he’s cooked.

      @@SizzleMan23 BK's alibi is that he was "SIMPLY DRIVING AROUND' in the timeframe the murders occurred.
      In the court of public opinion, his alibi is clearly that of someone who probably killed those kids.
      The state just has to do the hard job of proving it.

      @LadyGenerationX Yeah I think he's involved on some level. But I don't think it's just him alone. And I do think there's some corruption involved. So many red flags from the 8 hour delay calling 911, to demolishing the crime scene, to withholding evidence etc.
      But that's just my armchair detective opinion watching all the way from Australia.

      The FBI cannot be compelled to comply with a subpoena and it’s obvious they want anything to do with this case. The Agency has a duty to protect their confidential sources, agents, and methods from public disclosure.

      They seem to have dropped out of this case immediately after Mr. Kohberger was arrested. Not cooperating anymore, not having their expert (and alleged team leader) testify for the grand jury indictment, and not turning over their documents makes it seem like they want nothing to do with this anymore. I don't think they'll respond to this at all.

      Troubling, isn't it? LE just sort of made it all up. Brett Payne's cherry picking of data, no footage of Bryan's car.... fantasized two possible "escape routes." Can't find the evidence or forgot they had it. I'm appalled at MPD's "investigative practices."

    This case is about the murder of 4 people. It is not about a car and the knife sheath is not the murder weapon. Think back to the beginning as in the first reports about this. Rumors of someone passed out and rumors of someone being shot. This was before police response. After a short lockdown, police claim they have no suspect or person(s) of interest, but they were confident in saying there is no threat to the public. This means something very significant. If this case is to be such a slam dunk for the prosecution, why seal so much info starting with WHO placed the 911 call?

    Given the new developments, anyone claiming that the defense is stalling and filing redundant motions should no longer feign concern for justice for the victims and their families. This case will not go to court until the prosecutor has fulfilled his obligations. What does not exist or was eaten by a dog is worthless because it cannot be used in court.

    The fact that the prosecution keeps saying a vehicle instead of Bryan's vehicle should be alarming!! Part of their arrest warrant claims its his vehicle but everyime they are on the stand they are careful to say a vehicle...if I was sitting I jail because of "a vehicle" I'd be upset...I'm saying he is innocent its just very shady to me

      @@bud-9668there’s no evidence that he turned his cell phone off, only that his cell didn’t have service during that time frame. It’s been stated that it was a rural area and it’s possible his phone didn’t have service. This would make sense if his alibi is correct in that he was driving around in a rural area known to not have service. Bottom line, this is a capital murder case. Every piece of evidence needs to be turned over. It’s clear the prosecution has theorized what they believe or want to be the truth and has tried to pin him for these murders. If it was your family member you would want the investigation to be done right and you would want a defense attorney who would work their butt off for you.

      @@jackierobinson6547 I don't disagree with much of what you said. That doesn't change how I feel about what I've read and seen so far. I'm willing to bet, this was/is the first and only time his phone "lost service". But that's because of many puzzle pieces and not just a cell phone being turned off or put into airplane mode, or a knife sheath, or video tracking, or cell tower triangulation, or his unverifiable alibi, or any other information by itself. Trial is where we'll learn more. And in all fairness, he does deserve the presumption of innocence, until proven guilty. But failing to recognize the weight of the evidence that we already know about would be foolish in my opinion.

Some of the evidence was ordered by the judge to be given in July 2023 and some more evidence was ordered to be given by the end of March. None of those items have been given to Ms. Taylor yet. The judge certainly thinks those things exist because the prosecution relied on them as part of their evidence.

    Those Kohberger cellphone records are not from his phone, they are from the AT&T cellphone tower archives, as aquired by the FBI, and later, from Verizon and T-Mobil as well. That data simply indicated that someone could heve been in either Moscow or could have been in Pullman, and the phone would have pinged the AT&T tower in Moscow, regardless of which city the person was in. So, Brett Payne created the fiction that this person drove between the two cities.
    Sy Ray's testimony is that there is no cellphone data indicating a journey between Pullman and Moscow, or vice-versa.
    The map you show at 3:17, is only a map of Sand Road, which runs between Moscow and Pullman. Brett Payne speculated that perhaps one car seen on a video could have been the Perpetraitor. He then speculated that the car could have driven to Sand Road, and could have driven to Pullman. It was not drawn from any cellphone data. "To develop that path". Payne was very, very greatly exaggerating when he suggested that it was.
    The prosecution has repeatedly claimed that the FBI has the evidence requested by the defense. Judge Judge ruled that the FBI data is part of the DA's office evidence, therefore, the DA's office must produce it for the court, to be turned over to the defense. They have not.
    I am very tired of seeing old video of Kohberger in an orange outfit.

      I agree... The real problem is the feds used AI software to find the suspect, then tried to make the case after the fact, based on the data that was fed to the AI. Which in no way was proof of guilt... just who was the most likely suspects based on all the data they could feed it.

      They have no clue of his phone was off! Thats why in the pca he mentioned multiple reasons his phone was not on the tower dump!! One BIG reason could be that he wasn’t on that tower- he was in Washington - near that park- completely different tower!!! They did NOT pull those records

      Yeah because evidence has been handed to pros and they wont turn it over to defense, but why not if they have the evidence they need to prove it was BK and only BK then handing evidence to defense should not be a issue. And the Judge isnt making them hand it over by a desinated time frame.

    They found multiple GPS routes of Kohberger showing he was around the house. Then don’t forget the dna blood on the sheath that matched Kohberberger’s blood.

      All of the hearings are being livestreamed on JJ's YT channel. The hearings are well worth watching as with any case, not only is there much more information, in many ways they are more important than the trial. :)

    It seems like the defence is trying more to find a technicality in obtaining the search warrant that offered the information showing a correlation to his whereabouts and quilt more than proving his innocence

      They don't have to prove his innocence. The duty of proof is on the prosecution. They have to prove the prosecution is wrong and to do that they need all the information handed over

      They are doing no such thing, since prosecution won’t hand over ALL of discovery, they need to find another way to expose how LE came to their conclusions, and what it seems to me, is they’re still dancing around the issue, but Payne did say they did not see BCK’s car on any footage!
