- On the night of January 26, 2023, while patrolling northbound on Unser Blvd., the officer spotted an erratically parked Audi SUV disrupting traffic flow. Upon closer inspection, the officer noticed a man, later identified as Richard Hernandez, slumped over the center console.
Upon interaction, the driver appeared disoriented and belligerent and struggled to produce his driver's license, instead handing over multiple credit cards. The officer reported signs of intoxication, such as the smell of alcohol, slurred speech, watery eyes, and a bottle of vodka on the passenger side floorboard.
As the situation escalated, with Richard becoming increasingly aggressive and repeatedly exiting the vehicle, backup was requested. Richard also challenged the officer to arrest him on multiple occasions.
Despite an injury to his Achilles tendon, Richard agreed to participate in a field sobriety test but displayed signs of severe impairment. His resistance continued throughout the process, but he was eventually arrested and taken into custody. Upon arrival at the station, Richard refused to submit to chemical testing, even after being warned about the consequences under the New Mexico Implied Consent Advisory.
Richard was charged with Aggravated Driving While Under The Influence, Open Container (1st Offense), and Stopped Vehicles Not To Interfere With Traffic.

Do you believe that the penalties for repeat DWI offenders are strict enough? Why or why not? (This was Richard's 3rd DUI)
I definitely think drunk drivers get way more chances than they should! I’m very proud to say I’ve never driven drunk Now not to say I haven’t been drunk out somewhere! My husband and I always made sure one of us stopped drinking or didn’t drink anything if the other one was. Plus my dad whiles a good dad was an alcoholic who did drive so that helped with my decisions also
We are all here learning to be better humans, so we are going to make mistakes. Penalties are helpful, but in the end, the person has to decide who they want to be.
Not sure how strict Texas is with DWI. Here in NM there people who have 20. DWI is a major problem in NM. Alot deaths and the offender gets like 3 to 4 years. Very weak law in NM.
No they are not! They wait till the drunk kills somebody!!
No they aren’t strict enough. There are people in New Mexico with more than 7 DWIs that have never gotten jail or prison time but maybe some probation and community service and even get another DWI while on probation and still get a little slap on the wrist. We aren’t strict enough on alcohol offenders in our court systems unless someone dies. We should be trying to prevent those deaths with ignition locks or something. I prefer prison.

This thing should never be around children. I’ve lived in the woods with no neighbors for about 35 years but I want to move so we can be close to stores and restaurants and move into a much smaller house but after watching these videos I’m scared I might end up living next to a psycho.

@@syedhasanmohiuddin827 It was on WTF on Reddit the other day I believe. Cops called on an elderly guy, whom a grocery thought he stole a cake. Cops showed up, no cake to be found, and they start arresting the guy. So his wife steps back and starts recording the wrongful arrest, cops say to stop recording, she does not, so they tackle the shit out of this old lady and pin her down as she tries to resist being assaulted and attacked. Lucky others were also recording the confrontation. Last I heard there is an open case for the jobs of the cops involved. Hopefully this one turns out to be a win against the force.

I know. I’m too disciplined to drink from being pissed. Never drank and drive at all; I knew better still know better: And I still get pissed every now and then, even extremely pissed.
I live in South Carolina and at the tender adult age of 22, I was arrested for DUI after putting my car in a ditch full of water. That arrest cost me my drivers license for 3 years plus I had to take an 18 hours of safe driving course and I was mandated to carry SR-22 Insurance for 3 years once I got my license back. I found the penalties to be quite excessive, that is until I became a professional firefighter for a medium size city on the east coast, of which I spent the next 30+ years before retiring. During that time, I literally answered 100's of accident/auto wreck calls, almost all with injuries and far too many of those calls having one or more people killed in the accident. I quickly grew to understand why the penalty for DUI was and still is harsh in my state and I now support it as being harsh, inasmuch, as it does make an offender think before making that mistake a second time. I know, because it made me think and I never have repeated that offense ever again.
Sometimes a tough lesson takes hold.

Yeah I've met people like Richard, Richard is his own worst enemy. And I genuinely wouldn't even be sure that his wife did actually cheat on him. Those sorts of super aggressive, paranoid delusional types will come up with some wild nonsense that literally everybody other than them knows is nonsense and yet still act like God himself came down and showed him it was true.

He was charged with aggravated DUI because he probably refused to take the breath test once at the station. I've seen enough of these New Mexico DUI arrests to know if you refuse a breath test at the station, they will charge you with aggravated DUI.
Can also get aggravated dui by having multiple past duis, judging by his insistence that hes the one in the right i dont think this is his first time

The courts seem to think people who've been arrested and convicted of DWI are OK to be back behind the wheel, like "They've learned their lesson, they won't do it again" Most of these repeat offenders have a drinking problem and will continue to drive, regardless of the consequences or if they have their license revoked or not. They need to be put in mandatory detox and have stricter penalties for repeat offenses
The courts know that sooner or later they will have to sentence one of their own, and they want the leniency option.

I'm not sure I believe him though after the cops found two empty bottles in his car, especially since he said that he had one drink. He didn't mention that one drink was two bottles.

He fled. Starting a high speed chase with a drunk driver is incredibly dangerous to the public. She probably radioed and that's why this cop was on the look out. He was apprehended because he had stopped fleeing and was pulled over.

I suffered a severe TBI 5 years ago and am still severely suffering to this day but there's a whole world of difference between TBI and completely drunk so lock him up and keep everyone else on the roads safe.
