This looks like it was nearly ready to be released and someone suddenly decided that a full back piece would add just the right touch, but wasn't going to bother with a whole new photo shoot when a graphics guy and $50 would do it 🤷♀️.
But even that, the person should’ve just hand designed a tattoo to photoshop onto it haha. Lazy ass photoshopper. It takes like 40 minutes to just design a design in illustrator and then photoshop it onto a back and make it look like a tattoo with tattoo details.

This case is wild! Technically, I think it's the photographer of the original back tattoo photo that is more cleary protected by copyright laws already in place, not the tattoo artist, not the person wearing it. But the guy wearing the back tattoo could have sued for the useage of his likeliness, his image, as it is really easy to link him to the album cover. People who know him could have thought that he actually modeled for the album cover, and so that could be use in court as defamation.

I think it's weird the tattoo artists think they can still own the art they've put on someone's skin. As an artist familiar with copyright law, it confuses me how a person's likeness that is usually owned exclusively by them can be sucessfully copyright claimed by a tattoo artist. Once your art is on another person's skin, it's become a part of their personal likeness. We can't stop people from being photographed just because we added art to their skin... this level of entitlement just seems completely unethical and bizarre in the context of other copyright laws.
As a designer, I´m deeply offended that cardi is paying ONLY 50 bucks for a cover... she just fucked this graphic designers career for 50 miserable dollars, he´ll always be known as the guy who got cardi sued for "lazy work" but if she just would have payed him right... he could have dedicated the time needed to redraw and change the tattoo and this whole drama could have been avoided

I definitely would be affected and likely worried about my teaching job, and my reputation as a whole, even if EVERYONE(almost) knew I did NOT do THAT type of modelling and that it’s NOT ME! UNPOPULAR OPINION Here's some food for thought.. Cardi paid a graphic designer (yes a low amount but he accepted it) to create her unique cover. Did she tell him to photoshop the image? Maybe she had no idea. Personally I think the graphic designer should he getting sued. If Cardi didn't know that he stole a tattoo it's hard to blame her. If she did know then she should also be sued. Either way the graphic designer knew exactly what he was doing when he stole Kevin's tattoo. Another thing to consider is what exactly is Kevin's claim to the tattoo? He should get money for damages for sure but does he "own" the tattoo or should his tattoo artist be the one to sue Cardi for copyright.
Once you pay for a tattoo, if it is custom, I believe you own that piece of art and everything that goes with it. They did nothing to transform it or make it different. He should win hands down.

Initially, I thought about this, but for $50 he could be a student or just starting out, and in that case as his employer, I feel like it still sort of falls on her. I read more about where he got the '1.5 mil' number from too and it was based on album sales, so it says that she finically benefited the most from his likeliness being on the album cover (more so than the $50 designer did) but I don't now!
I used to be (still kinda am) a huge fan of Twenty One Pilots. In high school, before I was tattood, I remember googling all of Tyler Joseph’s and Josh Dun’s tattoos (look them up, they’re great). It’s actually a big part of TØP fan culture. Fans redraw the tattoos in fan art, put it on merch, get their own real tattoos that are similar. At the time, I joined in with the fan art. Although, I thought it was strange to buy a hoodie with Tyler’s exact tattoos on it. But since watching all your videos, and then getting tattoos myself, I realized that they are so personal and belong to the person wearing them.
This is extremely interesting to me as a photoshopper. But, seems lazy that the photoshopper didn’t design a tattoo by hand to put on a guy. THAT would’ve been interesting. They could’ve photoshopped the title onto his back like a tattoo. I could actually do that for them and completely fix this lawsuit hahaha.

I think you could make a pretty strong legal case that a unique tattoo is a part of that person's likeness, and that by using the tattoo they're infringing on copyright by stealing the likeness of the tattoo wearer

I would be slightly HORRIFIED TO be Photoshopped (my likeness due to a generic looking back or rib cage or what have you, insert body part with easy ability to mask whom it is....displayed on an Album cover, Billboard, on TV, in a Movie, and the like, and said “model” was performing something that would possibly “tarnish” my reputation, IF I had a circle of ppl in my life large enough that they would see it and recognize EASILY that that was Me/MY TATTOO, etc, I truly would be VERY UPSET. Honestly, I don’t know what my first move would be? Now so far, none of my tattoos, to my knowledge have been shared or put into an album of work and on the internet. Especially on an easy , comes up first in a search due to subject etc, so for me it’s not an issue currently. But if I was Kevin, I’d be upset, I am just not certain what I’d have the you know what’s to do about it. Depends on how much the perceived image would affect my life, my possible perceived reputation, for example say I was a doctor or a teacher, and I lived in the area these people were(LA, New York, etc)
And I also modeled on the side. Would I be bothered if MY Tattoo were put in a magazine that was totally cool, no life consequences if there’s no face but the assumption was it’s ME. What would I do? But let’s say it was in a Sex centred publication, etc, how would I feel? What if a parent who didn’t really like me and I happened to be her kids teacher that year and she saw my back or rib cage tattoo that summer at a neighborhood pool party and indeed thought it was I , in said publication. Then she thought she could make trouble for me by spreading a huge rumour to make me look racy and possibly an immoral Character who questionably would maybe NOT be an appropriate person to be a kindergarten teacher?
I hope in my disabled brain today, in all my “wordy” ways here, that my points are clear?
I definitely would be affected and likely worried about my teaching job, and my reputation as a whole, even if EVERYONE(almost) knew I did NOT do THAT type of modelling and that it’s NOT ME!
Who cares at that point? Some of them certainly would believe me, but what about the ones who barely know me, and only on a very surface level?
Yeah, it’s definitely a thing to think about. It’s kind of like the internet being forever. How did Kevin’s tattoo get on here in the first place(100%NOT BLAMING OR SHAMING KEVIN) or his artist. But where do we draw the ownership line, and/or the privacy/fair use/etc lines?
Yikes, so glad I didn’t go to law school! Lol I’m much too emotional and all over the place to be deciding these things for others. I try my best to foresee from prior life experience, in order to protect myself and my family and teach my kids what I can while they can still hear me lol and after that, I have to breathe and know I have control over what I DO and that’s it.
Love that I found your channel again, as the algorithm is so mean lol that I sometimes go months without notifs regarding new vids by my most favorite creators on UA-cam. And if I have 100, due to the arts I adore, and the other 7 things that interest me, AND having biological memory issues, it sucks. But anyhow I’ll let that go for now. If you do read this, I also want to thank you for very well educating this person whom is not quite twice your age but close enough lol about Tattoos and reminding me of my love of art and our ability to have happiness due to creating our own art and displaying it on ourselves. It’s a bit like wearing make up, as far as it changes your feelings of how you look and wish to look and feel, whereas tattoos are just a much more committed form of that, without the easy ability to take soap&water and remove a mistake or a look that may be too bold in some situations(even if you have a love for bold tattoos but feel inside YOURSELF that your career etc may not be the best place to be displaying certain art pieces, we can put those special works in places which are easily covered at work but we still know that they are there and we can see them at 5 pm etc.

Here's some food for thought.. Cardi paid a graphic designer (yes a low amount but he accepted it) to create her unique cover. Did she tell him to photoshop the image? Maybe she had no idea. Personally I think the graphic designer should he getting sued. If Cardi didn't know that he stole a tattoo it's hard to blame her. If she did know then she should also be sued. Either way the graphic designer knew exactly what he was doing when he stole Kevin's tattoo. Another thing to consider is what exactly is Kevin's claim to the tattoo? He should get money for damages for sure but does he "own" the tattoo or should his tattoo artist be the one to sue Cardi for copyright.

Once you pay for a tattoo, if it is custom, I believe you own that piece of art and everything that goes with it. They did nothing to transform it or make it different. He should win hands down.

Initially, I thought about this, but for $50 he could be a student or just starting out, and in that case as his employer, I feel like it still sort of falls on her. I read more about where he got the '1.5 mil' number from too and it was based on album sales, so it says that she finically benefited the most from his likeliness being on the album cover (more so than the $50 designer did) but I don't now!
Its still on her to double check her shit. Shes tech the employeer. What her employees do reflects on her.

I used to be (still kinda am) a huge fan of Twenty One Pilots. In high school, before I was tattood, I remember googling all of Tyler Joseph’s and Josh Dun’s tattoos (look them up, they’re great). It’s actually a big part of TØP fan culture. Fans redraw the tattoos in fan art, put it on merch, get their own real tattoos that are similar. At the time, I joined in with the fan art. Although, I thought it was strange to buy a hoodie with Tyler’s exact tattoos on it. But since watching all your videos, and then getting tattoos myself, I realized that they are so personal and belong to the person wearing them.
This is extremely interesting to me as a photoshopper. But, seems lazy that the photoshopper didn’t design a tattoo by hand to put on a guy. THAT would’ve been interesting. They could’ve photoshopped the title onto his back like a tattoo. I could actually do that for them and completely fix this lawsuit hahaha.
Cardi B has how much money and she paid some guy $50 to make her album cover?? Now she's getting sued. Hm. Maybe invest in the first place in someone who doesn't do shady stuff like Google "back tattoo" and copy n paste...

I agree with everything you've said in this video and I know this isn't the point but I also feel like its ridiculous that the graphic designer only got paid $50 for the album cover. He should've known better than to just Google a back tattoo and throw it in there so there's no real excuse there but like they probably could've avoided this mess by paying a graphic designer more, someone who's more expensive bc they know their worth and probably know a little more about whats appropriate to put on album art. I dont know whats standard in the industry for an album cover for someone like cardi b but I have to believe its more than $50

I think you could make a pretty strong legal case that a unique tattoo is a part of that person's likeness, and that by using the tattoo they're infringing on copyright by stealing the likeness of the tattoo wearer

Yeah I have a very large and unique thigh tattoo. If anyone photoshopped my thigh tattoo on someone else I would be shocked. It’s my leg and my artist’s art, so I’d expect to be paid.
