This is one of many reasons why you NEVER take payments for a car. When asked if I take payments, I tell them, "Yes. One" They can either come back when they have the money and if I still have it I will sell it to them or they walk. You are asking for trouble when you do deals like this.
That's debatable because you could do payments and just make sure you have a contract for how much the payments are when in the month of payment is due and how many payments they have to miss before you take back your car.. I know you have to do is make sure they sign and you sign then your Gucci

A cashiers check is as safe as cash because you either buy them with the amount written on the cashiers check or the bank will pull the money out of your account and hold it until the cashiers check is deposited by the other party (just like they do with payroll checks) - unlike a personal check that doesn’t need cash backing it when written, a cashiers check CANNOT be issued without funds backing it in the moment the bank writes it. It is guaranteed money. Cashier’s checks are also safer than cash for the payor because there is now proof of payment in the event that neither party has that “crayon and roll of toilet paper” handy to write out a receipt.

i dealt with this similar thing once. i bought a car on payments and before i could get off work on the day the final payment was due the former owner came and stole it. i called the cops we went to his house. i offered him the money with the police as a witness he refused.. the cops took the keys and said drive home your car..if you offer payment with a witness and it is refused it's as good as a payment..consumer protection laws..the same rules apply to all stores ,banks ,private deals,hot dog vendors,collection agencies,etc..he seems to have defaulted on the contract first though.
