I’m battling my custodian of my UTMA account for access since I’m passed the age of majority and I was told by the clerk that the probate court is limited in its capacity. They refused to do my motion for summary judgment. I’m trying to get my case transferred to Civil court but the clerk isn’t returning my calls. They said they’d call back on Thursday and never did. I called and left a message. I also just placed a motion to transfer. I’m appalled how slow the probate courts are. I’ve been going in this a year so far. I heard it takes years. It shouldn’t be like this to get justice from an abusive custodian!

In my case my half brother, i believe and have evidence to show, made a fraudulent will, colluded with a solicitor and accountant in it, concealed valid wills in England and Spain, concealed bank accounts and investments, ordered false adjudications, committed share fraud, violated and perjured a court order. I beleive that the court and police colluded with them to let them off. My half brother said to me once 'everyone's got a price'. It certainly seems that way. There are so few people with honour. I want to have the “ probable cause” clause mandatory in every state to protect beneficiaries from unsavory trustees and be sure their no contest wills are ignored when there's probably cause. I also want to bring a pkea in the Federal courts to demand that in every State there is a mandatory video and or audio recordings of every change amendment or codicils..anything like that and it to be mandatory the person audibly and coherently give a brief explanation of what they are signing. I just found out that my sisters lawyer allowed a witness to a will change who is also a beneficiary so cant wait to see how this unfolds. Sorry for rambling lol. I accidentally located a warranty deed with vendors lean than says I was the grantor of the home as a minor with no guardian (false). The executrix sold the property to her children for $10, who happen to be the current owners. We (my mother and myself) were never informed of this. Its been a long time and I only discovered this yesterday while searching the database for a DBA. Is there a remedy in Tx available? I read that if I bring a claim within one year of learning about it no matter what the time frame is. Any guidance would be appreciated. The deed transfer was in 1993.

If an attorney and the executrix knowingly filed fraudulent documents of material misrepresentation in court, lied and mislead the heirs, court and judge on the sale of a real estate asset of the estate, didn’t follow the judge’s order confirming the sale, then took a higher court ruling and altered and manipulated it to again, mislead the judge, court and heirs this time to take money from another case!

What about learning that you and your siblings would receive so much a month and you need a lump some now? If we all live another 20 yrs. we would only receive less than half. The remainder goes to a local college upon our death.
