If a surgeon makes a critical decision that he was not trained to make and lead to someone dying should he continue to do surgeries? No nor would the public be comfortable allowing him to continue doing surgeries. People fail to realize certain jobs do not have room for mistakes.

That's why some jobs have strict protocol, including calling a supervisor to the scene or making sure the interaction is recorded. @nate Just like a surgeon or a judge, mistakes can't be made to tip the scales of an already low chance of freedom or death. Just like the surgeon's job not done right due to negligence or life in jail for a crime you did not commit, due to an unfair jury selection or inadmissible evidence being presented. There has to be checks and balances for criminal decisions not just stereotypical criminal decisions. An examples needs to made out of them, as a deterrent for bad actors that will purposly do evil but claim it was an accident(we all know someone like this, that's takes advantageof situations or will sell out a stranger to save their own) just like the criminal it is almost criminal to know how your job could take a life by not following procedures & make the decision not to follow those procedures or conduct. Guidelines that were established to guarantee the prevention of mistakes. So if it is not a mistake, it is a choice You made the choice to risk people's lives, every crime is a choice except hostage situations.
