      Yeah its not a job for everyone but it is his right, it's highly unlikely the lawyer would get him off, but it's for a fair trial.
      I don't think people should demonize these defense lawyers either, their jobs are difficult enough as is.

      The only sad thing here is the fact this man absolutely destroyed a little girl merely to satisfy himself sexually.

    Can't quite understand how any family member he has would want anything to do with him after what he did. I love my dad to pieces and had a great childhood but if he did something like that to a child that would be the end. It sickens me.

    It makes my blood boil that they’re trying to say he’s at risk for being raped and murdered in prison. I would applaud a lifelong monthly payment to whichever inmate gave this bastard exactly what he gave to Cherish. He is disgusting. If a grown ass man is terrified to be a victim of other grown ass men, imagine how that tiny, fragile, precious, innocent little baby felt while this man did everything possible to destroy everything she was. He deserves general population for life. The death penalty is too easy for him. 🤬🤬🤬🤬🤬

    I’m about an hour and ten minutes in, and I’m confused about why we are talking about how Donald didn’t have friends in school. Are we supposed to feel sorry for him that he didn’t have friends- that this in way provides an excuse for him to have become a murderer? Sorry, no. It doesn’t work that way. Once you reach the age of adulthood, you alone are responsible for the choices you make and the things you do. That’s part of being an adult.

      Later you hear if the judge accepts his mitigating or impacting circs (which is his childhood, and what he considers to be environmental factors) and it’s not considered to the courts to be reasonable reasons for his crimes and as such there’s no reducing or exemption from further prosecution.

I watched the man who left his son in a car to die, the couple who pampered one baby while letting the other to die a very painful death. The girl who killed her on and off BF. Jodi Arias. There is the sheriff named Will Lewis. I think . I'm sorry I can not remember better. Oh, The police officer who killed her ex's wife . Stephenie Lazarus. I almost forgot Chris Watts.

    I had to fast forward the um... um... lady with the family pictures. If I heard her say um one more time! I know this is all done by the defense to show he is human to avoid the death penalty but I don't want to hear it. I DON'T care! Set him loose in prison and let his prison peers exact justice for Cherish. He will then, beg for the death sentence.

      Lol. These uhms are nothing 😂 I saw a trial where the defense attorney said: "aaand uhm" + "uhm" so much that I started to count them. I got distracted ok? And I counted on it. The result. "Uhm" was said every two seconds.
      I don't remember exactly how long time I counted the average on tho. And I unfortunately don't remember which trial to link to, if a masochist were to be curious.

    Bottom line is that if a person, regardless of how crazy they are, commits a horrible crime and then covers it up in order to keep that act secret, they know enough to know it’s wrong and should face societies consequences to the fullest extent of the law.

    As I get to the end of these videos, I cannot stop thinking about how painful and terrifying the last few hours of that beautiful sweet girls life was. How dare him rob that baby of the rest of her life. The fact that we have to look at photos of this monster as a child growing up when he took that away from Cherish enrages me. Zero sympathy. None.

      Everyone has a right to a defense and everyone has a right to present mitigating factors. If these monsters didn't have that right, neither would innocent and wrongly accused people. The justice system can't lower to the level of murderers and just hang them without a trial. And also, many many people in this world are passionate about abolishing the death penalty. Thats why they dedicate their careers to prevent as many people as possible from getting the death penalty. Stop demonizing lawyers and experts who work for defendants. It doesn't matter what he did, when 8t comes to the right to represent a defense. We as a society would crumble if we just gave into our vengeful rage and wouldn't provide everyone the same rights.

    So to learn about the defendant's background, the specialist interviewed a father with alzheimers & a half sister who he had never met & who had never met him.🤔 Well that's time well spent on the taxpayers dollar, right there!

      I haven't seen the alzheimers yet but during my brothers divorce his father-in-law was going to testify, I wrote a lot about each person testifying. The father-in-law had been diagnosed with dementia, onset of dementia, he was immediately excused.

      Let’s be honest, they didn’t really defend him, they knew he was going down and so they did their job and no more.
      I am beginning to understand now about how lawyers can take these cases on, sometimes their man is going down whether they get the best defence in the world or not, and in this case, then this is one of these times due to overwhelming evidence, DNA, eyewitness and so on and so on, plus Smith didn’t even ask them to put forward a defence, when it came down to it then I think even he knew there was no defence except his sick violent lust for little girls.

While that could be the case for something in which there isn't enough evidence, that so obviously isn't the case here, they are merely doing their jobs and making sure his rights aren't being infringed on. The standard for this process is important because if it wasn't this way, it would be an absolute nightmare for society.

    Most people on the street already know that other inmates would consider him a target due to his offense. I don't know why the defense is even bringing this up; it seems almost an argument in favor of the death penalty. He has already been judged competent, so he is not going to a psychiatric institution. So it's either life in prison with protective custody (or gen pop, which would be a quicker end) or it's death row. No other options.

      He said to his mom on the phone that if he can't get off with a mental incompetence defense then he wanted the death penalty so he'd die painlessly bc if he gets life the other prisoners will kill him. He said he won't know which day it's coming & it would be very painful, so he'd rather have the death penalty. They're trying to get him protective custody instead.

      Seems like it wasn't much of a deterrent.     The female defense attorney comes across unprofessional to me. She seems like she gets upset only because she wants to win. Like it's all about her. I find that disturbing. Other defense attorneys that defend a-holes like this are very professional and less emotional than she is. Just watch her demeanor and compare it to the female prosecutor. I would expect that type of defense from an attorney if there was some sort of doubt involved in the case...not in this case. I hope it's because she's passionately against the death penalty, and not because she's narcissistic.

      C Dog I’ve been pretty damn angry and disgusted by her myself. She objected during prosecutions opening - almost unheard of - because the prosecutor repeated the words - a parent’s worst nightmare - twice. She straight up blamed the mom for the rape and murder of her daughter and she treated pretty much all of the prosecution witnesses with hostility - people who JUST saw him do this or that. But I’ve seen that in many cases whether guilt is beyond all shadow of a doubt or not. I’ve also seen defense attorney’s force the state to prove their case without resorting to victim blaming/bashing or hostility - I can’t think of an instance where guilt wasn’t absolute..but still. Too many do this and we, the public, tolerate it. It’s gross. I could only come up with the exact same conclusion you did - passionately against the death penalty? Idk..sometimes she just looks like an attorney that’s angry af she even has to be there so..it’s ethically wrong to me though...what she and others have done to victims.

      Defense attys have a legal obligation to give the defendant as strong a defense as they can, for alot of reasons including making sure there is no chance of a mistrial. These attys were appointed by the court, they don't have a choice about representing him. They asked to be removed from his case but the judge denied their request. So they're stuck with the job. In light of that it makes sense she would be unhappy to even be there.

    Why is there a trial if he is admitting his guilt. The psychology specialist female is driving me nuts! She said she interviewed or TRIED TO interview 50 people - seems like she interviewed 2 or 3 people. She gave lots of "reasons" for those who were unavailable - old, dead, altzheimers, moved away etc., but she didn't tell us simply had NOTHING good to say about this cretin she endearingly likes to refer to as Tom!🤬🤬🤬🤬.
    I wish Judge Judy was there as she would have told her "Don't tell me what his mother said! That's hearsay!" 🤣🤣

    Hi's son's testimony was so weird and out of place. He'd say his father wasn't around and that pushed him towards drugs and a minute later he'd praise him for doing "unhuman stuff" or something...like, what? A truly wierd family. I'd sugest the police to keep an eye on his son as well. The state should've asked him if he's seen what his monster father done to that girl.
    His son is as DERANGED as he is. No doubt in my mind he will turn out a criminal as well soon enough!

    I love how the death sentence "mitigator" simply said, yes, I'm part of the defense, when the prosecutor was trying to create suspicion around her testimony under oath.
    then, it made me uncomfortable that she kept using his first name when referring to Mr.Smith, saying, "Donal...uh, excuse me, I'm sorry, Mr.Smith..."
    it seemed intentional, like trying to humanize him

    It’s sickening that how he may be treated by other inmates is even a discussion. The sentence doesn’t have anything at all about how the prison intake decides where he should serve his time in the prison he goes to.
