    I heard someone say that the attorneys for Mr. Smith were scumbags for even representing him. Don't you know that in our legal system everyone has the right to have an attorney, free of charge if necessary, to represent him or her? Well, that's how the ball game is set up. A defense attorney that's doing free work for the courts is forced to present as strong of a case for their "client" as is possible. If they don't, the jury's decision could be reversed. Nobody would want to represent a child murder and rape charge, but that's the way our system works.

      I feel sorry for those having to defend such a monster as Smith, but yes it is the law, and the attorneys have to look to be doing the best job they can, but underneath it all i should imagine they to will breath a sigh of relief when this guy get's the death penalty, as it is the only thing that can be given to make sure this vile individual never ever gets back out on those streets again.

    If he was so out of it on drugs how did he manage to talk this woman into trusting him and believing he was going to help her? What a load of BS he was controlled and articulate. He was cunning enough to go through all his rigmarole with the ultimate goal of walking off with and abusing and murdering a child.

    This self-loathing on this Birdman's face makes me so mad. He has not shown an ounce of remorse for cherish but when his relationships and life is discussed he looks like he felt so sorry for himself. What a piece of trash

    The mother appeared slow minded. No awareness of evil.... it appeared she fed her kids well and did not treat them poorly yet she failed to realize danger. Listening to her speak brings to mind the innocent special needs ( slow)
    That is why she didn't need her kids. 😢
    In my opinion 🤔.

      I agree. I think she meant well and did her best. The kids didn't seem to fear her and seemed happy and cared for. Maybe she needed more help and support instead of judgement imo

    Why do so many commenters not understand that ANY POSSIBLE MITIGATING FACTORS must be professionally discussed in court.
    It is not excusing him, that’s up to the jury and the judge who MUST BE FULLY INFORMED of all the FACTS even if they don’t like them.

      It has to be done, everything has to be brought into the open otherwise he could use that evidence down the road, maybe even to get a retrial or get him off by saying important evidence was kept out of the court proceedings

    Who is interested in what drugs that monster has used. Many people use drugs but don't become despicable abominations such as that lowlife. Good grief they get more care and attention than good honest citizens who have to work for their keep. It's sickening that the taxpayers have to pay for all this medical research into his past as well as for the expert testimonies.

    Another repeat offender just let out if jail to continue the pattern. Our justice system is so incredibly flawed to allow to this happen time and time again in case after case. It sure didn’t prevent this from happening to Cherish when he should have been in jail “with the key thrown away” long ago. My heart breaks for this little girl that should never have had the chance to meet this man

    Straight to general population should be an option for the jury. This monster wanted the death penalty for an isolation cell then appeals in Dec 2020, which for death penalty cases will take another 10 yrs. All on the tax payer dime.

      There was a custody recommendation by the Florida authorities. They recommended that Cherish should live with her father. Their recommendation wasn't granted. You know the rest.

    The pharmacologist has been summoned as an EXPERT witness to ANSWER questions by the prosecution and defence.
    The defence probably wanted him as a way of gaining leniency through mental deficit/drug addiction and not receiving the appropriate support.
    He answered those questions in a way that the lay person (the jury) would fully understand how the use of these medications and recreational drugs would affect a person psychologically.
    This way the jury can be fully INFORMED when making their decision without any reasonable doubt as to MITIGATING factors.

      She did not know that they left the Walmart it was her understanding that they went to the McDonald's inside the store or maybe it was Subway and after they walked off that's what the mother assumed

      I suppose all the horrible trials she has to preside over would make her very depressed if she allowed them to. It's probably her way of protecting her own mental health. I've seen a lot of cheerful judges in murder trials

    Some of these lawyers are doing a poor job and sound rather unprepared. This guy is where he belongs , I would not want to meet him on the street at any time of my life especially when I’m a parent .
