    I had a criminal justice professor in college. Regarding interrogations if we were ever arrested, he told us point blank that it doesn’t matter how innocent we think we are, the only thing you should say to the police is lawyer.

      @@K.I.A22 That is not so much a concern tho it does happen occasionally. It is mostly about the police having all the leverage and you being entirely alone and out of you element. A more poinent concern here with the FBI is lying to federal agents is a crime on its own. So if you do or say the wrong thing ,which you will, as they are trained and very good at spotting inconsistencies they can arrest you. It is easier to never lie or give a inconsistent answer than attempt to sweep it up after the fact. Kinda like a vase once its broken it'll never be the same.

      @@K.I.A22 it’s not necessarily about “framing” you persay, but the thing is YOU know you’re innocent but they don’t know that (that’s why they’re presumably arresting you), so things that you say could make you sound guilty inadvertently. And if you’re suspected of a crime (even though YOU know you’re innocent) they’re going to listen to every little word you say to look for hints of guilt that you might not even realize you’re giving. Sometimes they’ll try to make it seem like well if you’re innocent then just talk to us in order to make you feel like calling a lawyer is some admission of guilt but it’s not and can’t be used against you as it’s a constitutional right. Kind of like how the prosecution couldn’t use Rittenhouse’s silence against him as evidence of guilt because that’s your constitutional right

    56:00 I am an attorney and spent my first couple years in practice doing criminal defense work. I assure you, if he had reached out to an attorney before this interrogation there is NO WAY his legal counsel would even be allowing this conversation to happen. Even a sleazy, lazy ambulance chasing kinda lawyer is smart enough to make sure this kid didn't spend a minute alone with 2 FBI agents in an interrogation... Also, you are asking if you have to testify against yourself in a deposition. The answer is no, you may refrain from any questions that may tend to incriminate you. But more importantly, This is an interrogation which is something ENTIRELY DIFFERENT than a deposition. If you are deposed you must show up and must answer questions, you simply have the right to refuse to answer questions that would tend to incriminate. This kid is under NO OBLIGATION to even be in the same room with these 2 agents, much less allow them ask him questions, much less answer every question they ask.

      In America, most people have no clue what their rights are. They are raised in a culture where if you want to know what your rights are, you must be guilty of something or why else would you want to know? Or if you did nothing wrong, then you have nothing to worry about if you tell the truth.
      truth = good, cooperate = good, noncompliance to authority= bad.
      Also, rights are never really taught in school especially when it comes to stuff like this. Generally speaking Americans who are not lawyers or police learn about this stuff from “Hollywood” which is a horrible source as that focus is on entertainment rather than education.

      If you never been in trouble with LE before, it's a really serious and scary event. All your worst fears about spending time in prison are starting to come true. In the back of your brain, you think, well maybe there's some way out of this, I could be home right now. You're in a scary place and they know very scary secrets about you, you just want some sort of comfort or safe space. LE will do everything in their power to slow down lawyers as long as possible. You can be faced with a night or two in jail. And if you remain silent, you will be bombarded with provocation and accusations. If you're allegedly part of a conspiracy, they'll suggest you're fully responsible. You start to give them small details, you try not to reveal much and then they hit you with it. They know more than you think. They know everything and, now, if I come clean, I'll feel better. You may have the right to remain silent but they will lean on you with all their might. It's very hard to resist.

    Why do people talk to cops like this? Either the cops have enough to charge you and just want a confession, or they are needing details to make their case more robust. Either way it should be "just lock me up, I have nothing to say."

      I already responded to another comment about this but you probably have never been in one of these rooms before facing these accusations. It is very terrifying being there. It's hard to sit in that room and not feel immense dread. You want a way to just end it, it's torture and you think, "maybe I could talk my way out of this." Most people think that as soon as you ask for a lawyer, a lawyer just walks through the door. It takes a long time sometimes. It's very hard not to break under that pressure.

      @@TheButcherClan just for context, I was hit with 10 counts of possession with intent to sell and they were promising me the world in exchange for cooperation. It ended with me saying "if you can make this go away and are so worried about me ruining my lufe then just do it...just let me go" to which they responded "you know we cant do that"to which I responded "you know I cant do what youre asking."
      In the end I got off with 4 years felony probation and changed my life. completely.

    Destiny keeps calling this 38 year old man a kid, and it's easy to see why. I'm 40 myself, two years older, but listening to this guy talk, I'd say he's in his low 20's. Not because of his voice, but because he comes off as naive and not very bright, and sounding as bereft of life experience as I'd expect someone in their low 20s to be.

    I feel like some people like to say that the word insurrectionost is too strong of a word to describe the people that were there but how can what happened on January 6th not be considered an insurrection? It was a violent uprising against the government and its clear that these people were trying to prevent the ratification whether or not they realized it in the moment. For what other reason would you be thinking that you were going to be in the capital building for a couple of days?

      It's not that it's too strong of a word, it's that it doesn't apply here. If the federal prosecutors thought these guys met the legal definition of an insurrection, they would have charged them with that. They didn't because they know better. Legal definitions are often more nuanced and have more qualifiers than dictionary definitions. You would have to prove more than these guys were engaged in "a violent uprising against the government" to get them on insurrection. Organization, attempts to seize or take power, etc.

    So, I am a former writer for the JCS channel (there's a bunch of us, I'm not special) and one of the more interesting aspects of this interview is them leaving out the rapport building phase upon release. They must have pared down a large portion of the interview, because we are almost immediately thrust into the confrontation portion- Destiny mentions the dichotomy but we did not see the shift (orchestrated long prior to the interview typically). Missing context clues can be a deliberate deflection, and his incentive (the subject) to lie could be pretty large. Yeah, idk this is an interesting one.

      Also, people in the comments will inevitably ask why the subject did not lawyer up prior to this. There is a prevailing and very intentional stigma around "only the guilty" lawyering up obviously. Still, I am astounded that the admissions come this freely and with almost no prodding or very little pressure. Could indicate 1 of 2 things, a subject that is resigned in their guilt, or a subject that is operating under delusional thinking: I did this, but it was right because of A, B, and C.
