What Congress doesn't want to realize is that Truckers are affected up to 5 years regarding insurance companies. When it can't be proven they were under the effect of THC when they tested positive.
They're calling people who sweep up the street on foot "safety sensitive" out here now, the reclassifications are ridiculous.

Im in the same boat captain. I’ve been in the wheelhouse for fourteen years now and it’s sure be nice to be able to enjoy myself on my time off. It’s silly that I live in a state ( soon to be one of a minority ) that has recreational use, and now all my friends can smoke at my bbq totally worry free and I cannot. I don’t want it on the boat, but my home is my business and I should have the same freedoms as everyone else.

Me included. I've been home testing I ate an edible like 34 days ago and home test will barely show a red line. But am I under the influence at this moment no.

Caffeine falls under the definition of intoxicant. So does nicotine. Following this logic people who smoke cigarettes or drink coffee shouldn't operate heavy machinery.
Nicotine is typically considered a stimulant not an intoxicant. Caffeine is only intoxicating in rare instances "Caffeinism". Even this state is not considered as inebriated as being under the influence of alcohol or the 5 drugs typically tested for.

THC should not be tested at all as you can’t test a driver to see if they were “under the influence” of their phone
Distracted driving is the cause of so many accidents, just people that should be paying attention to the road.
THC should not be tested, if the DOT still does at least make it a mouth swab or raise the cutoff level

you are mistaken sir... the initial dot test is at 50ng... if its positive over 50 ng they do the second test at 15ng to confirm...so if your at 20ng you will actually pass because you would be under the 50ng threshold on the initial test ...your welcome!@@jasonb.3874

Prescription drugs are tested in DOT drug tests, why wouldn't Prescription MJ not be tested as well?? I highly doubt the DOT will ever quit testing for something they can make money off of..

So I take adderall and it's schedule 2. As long as I provide a current prescription I pass the dot drug screen. My question is, once the fda approves thc for treatment and I get a prescription(not a med card) will I pass the same way I do with adderall?
Should have something to test for that day just like alcohol. I work Monday through Friday so my weekends are valuable to me to relax because I have a high stress job. I just want to relax on my weekends. I choose THC over alcohol . I have severe DJD and it helps with my pain. Looking for help
Once it’s rescheduled… can’t FMCSA employed people just get a medical card and a clearance letter? It’s the same thing as being on any other medication.

I work in an oil refinery and we are under the same DOT regulations. My employer only does hair follicle testing. 😢 I dont even know if this is legal... maybe it is in California 🤷🏽♂️. I highly doubt that they will ever change this...

I'll tell you something else: I think they, whoever THEY are, should consult the people that made it possible for the UFC's fighters to use the plant just as long as they don't come to the big event high.
A fighter you may know, Nick Diaz was banned by the comissions for testing positive for weed. They basically rendered his career over because the guy wanted to relax how he chose to relax. Actually, I'm sure he would train high. Hey, and maybe some guys smoked before their fights. But I doubt it enhanced their performances the way steroids would. If there was a rule that fit us pothead's sensibilities, I'm sure anyone of us could abstain during the times you're supposed to be working. Hell, I enjoy it more after a long day of hard work...
But as we all know, THC stays in your system for longer than most substances. So finally, some reasonable people devised a way to detect if one was under the influence DURING the times they were on the clock. Then USADA made it possible, ruling that if a urine sample was over 50 nanograms per milliliter, it was positive.
That freed the fighters who wanted to use on their time. Sucked that Nick had to be the catalyst for change, but I think maybe his sacrifice lead to this current development in the workplace.
It's also highly likely that the tax revenue created by the cannabis industry weighs in heavily. Either way, 🤞

What if you have a prescription? When they make it a Schedule 3 drug, getting a prescription for it is possible, right? What if you have a prescription for THC and pop positive for it on a drug test? They need to refine their test to be able to tell if someone used it last night, or if they're "high at work".

Its my understanding the swab will be more akin to the breathalyzer testing for if your under the immediate influence thereof. NOT checking your habits in the past month.

Specifically in my case the FAA controls what can and can’t do when I’m not on the job and I’m sick of it I would NEVER got to work under the influence but if I smoke a joint on an off day I’m the worst of the worst Smfh

Once it becomes a schedule 3 substance, it will no longer be considered an illicit drug. Wouldn't that mean if you have a prescription, it would be treated the same as, maybe an anti-anxiety or anti-depressant prescription drug?
I would assume after reclassification there will have to be some sort of lawsuit because someone had thc in their system and gets fired and or loses their cdl even though you can take Tylenol with codine obviously not while working but to ruin someone’s career over something that’s now legal is bullsnuff FMCSA definitely needs to ease up on pot but come up with a test that can pin point usages down to a two or 3 hour window
You can get a prescription for Adderall and Vyvanse but will still be fired if you test positive for either because they're an amphetamine
@swish3814 if you have a prescription for adderall you won't be fired. There's some hoops you have to jump through to be cleared to take it, but with a valid prescription they can't fire you.
Canada drivers can smoke there's swab test which tells u if u smoked within 6 hours or so. I quit long ago I don't even like this new potent medical pot lol

7 panel tests for 7 different drugs and 5 panel tests for 5 different drugs. My DOT tests have ALL been 5 panel

Why should you even be tested for this drug marijuana if you have a prescription for it even if it’s on the classification of drugs. I have a prescription for benzodiazepine. They remove it from the test when they find out I have a prescription shouldn’t the same hold true for medical marijuana that is prescribed by my doctor

They will always use UA, the point of drug test are to catch you. Companies do not give a flip that saliva testing only goes back a couple days. Meaning they will always use UA, because it shows the bigger picture. Unfortunately
and they will eventually end up with empty seats. recently more the half the trucking companies want this to change, it negatively effects retention with drivers that are otherwise sober at work and completely safe.
They don't test for THC now. The urine test is for a metabolite not THC. The question is will FMCSA start testing for THC

So I haven’t used any form of THC in over 60 days, took a pre employment dot drug test and failed, literally just got my CDL, before I can even start the job this happen. I feel that’s not fair what can I do to have this removed from the clearinghouse, I know it’s gonna be an issue for get getting a job after.

One question i smoked thc a month ago im not even a light user cause i done it like once every 6 months, i want to apply to a company that does a hair follicle test should i be fine is been a month and it was only like 3 pulls not even a whole piece
my advice, if you want to consume any THC what so ever, stay far away from a company that test hair follicle. it will be their fault they literally have no drivers in the future. it an obnoxious violation of privacy.
I wouldn’t worry about it. Hair follicle tests are very bad at detecting single use over a long period of time. If you smoke more often than once every 3-6 months you wanna wait a month and shave your entire body and then wait another month and do that again then grow a testable amount of hair. Lol

i know drivers that get drunk every night..... and i mean drunk out of their minds, they get in the truck the next morning..... still drunk and hung over. no one seems to care they are the real danger, the current structure encourages being a drunk over even modest THC consumption.

Talked to a lot of drivers about this and the answer is no you most likely won't .. unless randomly picked from the government which is not likely.. most companies do a dot drug test and that alone is used by the state to regulate driver drug usage
If you're not working a safety sensitive job, you will not be drug tested despite having a CDL. The onus of testing falls on your job if employed or a consortium if you possess your own authority.

The correct answer is yes. As long as you hold a current medical card, you are in the clearinghouse pool to be picked at random. Your chances are low, but still there's a chance. That's what my fmcsa auditor told me.

No. Only return to duty and follow ups are observed. Randoms could be observed if the collector believes the donor is doing something to try and cheat the test or if the initial collection is out of temperature range of 90-100 degrees.

Yes the dot will always test for thc these companies make too much money from kickbacks from labs and frankly it's a control thing. As long as they can be in peoples business they'll fight any deregulation. Like Swift had a big lawsuit because they were viewing truckers in their cabs when they were off duty and sharing it around the office. I believe they even posted it online. These companies are super controlling and anything that would reliquish any of that control would be considered horrible by company standards. I can't tell you how many times I've seen then butcher peoples hair with those hair samples. think cutting hair from the middle of their head and leaving big holes in very visable places. instead of the base of the neck like they're supposed to do.
