      I see the opposite, he was taking advantage of the defendant and I bet the defendant was offering sexual favors. He thought he would come back after rehab, but ended up being upset he chose to live with his GF instead. He then “visited” this guy to make him feel better, but he ultimately got upset and used this as the last resort, “if you don’t come back, I’m suing you.”

    I completely understand what this guy is going through… I lost my dad and I rapidly hit rock bottom. I went to rehab moved away. I’ve been sober 7 yrs in May ❤

      Most addicts are selfish. Selfish people tend to still be selfish in early recovery. It often takes a while to get on track.

      ​@@wezzman1 - There's no problem in being kind. There is a problem in letting somebody take advantage of you though, and that is what happens too often in today's society. This so-called kid is one of those people. He knew he didn't have any money for rent, which is why he took all the sentimental things and put them in his girlfriend's house. If the landlord was smarter, he would have clued into that. I remember thinking when he said it, what's the point of him moving things to his girlfriend's house if he plans on giving you rent, and that's supposed to remain his place? Clearly, this nice guy, isn't the brightest of people.

      The "kid" is a man-child adult that needs to grow the hell up. I've lost both my parents my stepfather, my only grandparent, my house burnt down, not to mention my health, my brother had a severe stroke (and he was supposed to be my Kidney donor), and much much more. There is no excuse for his behaviour. It's just 100% selfish and inconsiderate.

    Someone needs to explain to this young man, that recovery entails owning up to your responsibilities and trying to rectify the wrongs you have done. He seems to be missing that part of recovery.

      ​@Alyssa Hamlett HI. Were never fully "Recovered". Once In recovery always in recovery. It's an everyday choice to stay sober, but you can be sober and in recovery simultaneously. You can see, ownership/responsibility hasn't fully clicked with him so I'd say yea. He's still recovering 🙃

      Only way it's difficult to admit when your wrong is when your prideful, stubborn, and selfish! These are qualities that we teach our children you know right from wrong. That stands for adults as-well! It's called ACCOUNTABILITY!

      Not for a reasonable adult. I mean, look, I get it. If I lost my mother my entire life would fall apart but life goes on and you have things to take care of. This man was beyond patient, sympathetic and generous. You can't expect the world to stop just because yours has.

    My heart goes out to the defendant. But unfortunately being a sympathetic case doesn’t negate personal accountability. He need to get his shiz together big time.

    Grief really takes a toll on you. Hearing his story pulls at my heart. I would have cleaned up the mess and given him his mother's furniture back. Sometimes being a good human cost us.

      Grief doesn't give an excuse to drive multiple times while drunk. Paying for his irresponsibility is merely saying it's okay to endanger others. Stuff is just stuff. He's lucky he didn't kill someone.

      @@projectionv.accountability1010 well usually if he got the 2nd dui, his bond should of been revoked the bail for the first DUI. Who ever the judge is, was an idiot. Cause he also got rebonded out and got a 3rd DUI.

    Rehab is NOT a “get out of jail free” card. Recovery requires the addict to live up to their responsibilities.
    This kid has a lot of nerve turning around to sue the plaintiff. He really thinks the world owes him something. I can almost guarantee his recovery ended up being a failure. He learned nothing.

      Yes, that's true, but on the other hand, the process is NOT the same for everyone in recovery. It's obvious that the defendant is suffering from some cognitive/memory issues, most likely caused by substance abuse.

    Xanax addiction is no joke. That drug did more damage than all the other ones I tried combined. So glad to be free from it and hope he also gets free.

    The defendant is still in the mindset that he is a victim of his addiction and can use it as some sort of shield for telling the truth and owning his problems.
    The whole " not arguing with you" to the judge is his way of trying to force the judge to not make him face his responsibility through questioning him

    My brothers and I lost our mom very suddenly, so sudden she was on emergent hospice for only 2 days before passing. I took advantage of the free year of grief counseling provided by the hospice company, my brothers did not. The difference between grief reaction varies between people, but with one of my brother's alcoholism tendencies, he relapsed and made poor decisions (again) due to the influence of alcohol. Particularly relating to not taking responsibility. I was able to curb how much alcohol I found myself drinking because I got the mental health care and developed better coping skills. I kept encouraging my brothers to do the counseling but they didn't want to. Can't force that sort of thing.
    Sadly, mental health care, and grief counseling, is not accessible to everyone. It should be. Maybe the defendant would've avoided DUIs and losing his license, etc, if he had access (and accepted) therapy after his mom died.

      My deepest empathy!. My mom passed in 4wks and 2 of those were in hospitsl at the top of covid. I was 42yrs old and it turned me into a child.. just broken and helpless. Thank God I didnt turn to drugs or drink but I do understand how others could. I was in so much grief, my soul hurt. So I hear your words and understand your grief 💔

      Mental health care and grief counseling is available to those who want it. Some chose not to for personal reasons. You cannot force them to get help when they do not want it.

    In North Carolina where I am we have to sue in the county where the defendant resides for small claims. I too feel that it should be where the offense occurred as my small business is stationary in one county; however, that’s not what our law requires.

      Exactly - EVERYONE deals with loss. If everyone just shirked life's responsibilities because a relative died, life would not go on anywhere. You still have to go to work, pay your bills, bathe, eat and sleep, and manage your responsibilities. Death is part of life.

      @@shirleywiese5230 if he got all 3 that close together and can get a halfway decent attorney, the judge may drop it to two just so he doesn't get a felony. I've never gotten a dwi but know of people who have gotten 3 in lest than 2 months and were only charged with 2. You are correct and he most likely will get jail time and thousands in fines but judges sometimes will only charge them for two. That also depends on his record and if he had any dwi's previously to those.

    I'm glad people are empathetic in the comments. But he's clearly got no empathy for others. His callous responses to his "multiple" DWI's, his response to the judge of "you can ask me a million times but I'm gonna keep saying the same thing", his blaming "them" for "specifically not wanting to sue him" even though he filed a counterclaim, his making excuses for every turn... that's someone who needs to grow up any take responsibility. Empathy sometimes involves a dose of being kicked in the *ss. He's lucky he didn't kill someone.

      agreed, i’m sympathetic to his struggles but his lack of accountability and nonchalant attitude towards not only inconveniencing the plaintiff despite him being very understanding, his attitude towards JM & risking people’s lives while driving under the influence multiple times. grieving is not an excuse to potentially kill others.

    Idk I find it cute when she finds enjoyment in his stories. Milian is the only judge I watch cause she seems the most fair and I learn from her and the humor is enjoyable. But her time spent with his husband does make her seem more ....awesome as a human

    Unpopular opinion: I think they’re both idiots. The plaintiff could have said something immediately protecting himself and his property. He also could have put his stuff in storage right away and then charged for that. THEN he could have mitigated his losses by getting a new tenant.
    The defendant seems to think his addiction is an excuse for poor behavior and taking advantage of a very nice and incredibly naive person. I hope he stays sober and gets a clue.

    All the comments below praising the Plaintiff- NO! He's a pushover. There is a point where you can be a good person and help someone in need- then there comes a point where you're just being walked all over and have no spine to stand up for yourself and that is where I believe the Plaintiff is. As for the Defendant- he's clueless how the real world works and that's sad.

    JM, to file in small claims you DO have to file in the county they reside in. So her saying 'no you don't' is a lie. I physically had to travel to LA from TX to file on a debt a former friend failed to pay me back on. I could not do it in my town where I live, because evidently the incident did not take place in my town, it took place in his town.

    Why is she giving plaintiff such a hard time. He seems super credible and the other guy was zoomed out of his mind to even know what was going on. Grief is not an excuse to avoid accountability.

      Because the burden is on the plaintiff to prove his claims. In civil court it's a preponderance of the evidence which is less strict than a criminal case. Also she can't award amounts without evidence to support that amount so she's probably frustrated because she believes him but has very little basis for amounts.

    I can empathize with the defendant losing his mother. However, he’s not taking any accountability for his behavior & he expects his landlord to bare his burdens. He appears to be possibly still using based on his responses & behavior

      I’m from Texas and your 3rd DWI is a third-degree felony and up to 10 years in prison. Hence the saying: “Don’t Mess with Texas”

    i respect the plaintiff for being a nice person, he could’ve easily thrown his stuff out but chose not too. i also really respect the plaintiff for being so honest, it shows he’s truly trying to recover. praying for him, i hope he is able to fully grieve and continue his journey to sobriety.

    Unbelievable how patient Judge Milian was with the defendant and rather harsh towards the plaintiff. I think this young man is extremely selfish and used to manipulating people...all those excuses, there's always a death of a relative involved too (drug/alcohol related too?). She should've yelled at this punk!

    The defendant has an excuse for all his woes, but his mother dying has nothing to do with his alcoholism, he needs to accept responsibility for everything he has done before he can start to heal. He says he can't remember much from back then, but then denies backing the Uhaul into the fence, but then repeats he can't remember much from back then...

      Now that I watched the episode I actually have a better understanding of what's going on the plaintiff made it very clear that he was on alcohol and Xanax two substances that will make you remember the least amount of things especially Xanax it will literally clear your brain from the day before you will not remember anything it'll come back to him after you put down drugs there's 12 to 18 months of post-acute withdrawal symptoms meaning the mental symptoms after that time he'll be much better if he stays sober

      I’m starting to dislike her. The poor defendant lost his mother and judge Milan was scolding him. I didn’t like it at all. I’m glad someone else see what I saw during watching the case. I feel so bad for him.
      Because he was behind on rent and there was no need to be that cruel.

    Ahhhh.....the good old days! When tickets were affordable - even over here in Europe. I was shocked when I went online to check out a recent concert. Decided against it. I think the last concert I saw (and maybe I just don't remember and that followed...?) was when I was in the US in the mid-80's and saw The Who in Boston. If they didn't have jumbotrons set up, it coulda been just about anybody on stage jumping around --- I couldn't see them from up in the cheap seats.

      There is a brand new study that says when parents or anyone else say things like, grow up, man up, wake up, or woman up, that’ll make anyone feel more depressed, anxious, fearful, shameful, resentful, scared you name it. I personally don’t believe in tough love because I find it to be too harsh and cruel and I’ve seen people especially litigants feeling demeaned, demoralized, voiceless and powerless. Calling somebody a crybaby isn’t nice at all. That’s bullying and harassment. The poor defendant is going through a lot and he doesn’t need your toxicity in his life. Please cut some slack on him. Have a good 1.

    The plaintiff is WAY too nice and the defendant is nasty, irresponsible, clueless and probably blacked out due to all of his drinking....so he's vigorously denying things he just can't remember. What a mess. Goes to show no matter how accommodating and empathetic you are, you can't fix a dysfunctional disaster of an individual who accepts zero accountability for his f-ups.
