I'm truly surprised JM was so easy on the defendant for not having documentation of the tow. They have a responsibility to document everything(damages noted before tow, etc) to cover themselves in these events. It's awfully suspicious this defendant didn't keep any paperwork, especially considering the plaintiff contacted him regarding the damage the very same day. He had to know this could end up in court. Very suspicious.
Because it’s on the Plaintiff to prove it happened his way, once the Plaintiff does then it’s on the Defendant to prove it didn’t happen that way or prove that even if it did happen that way the Plaintiff waived away the right to blame them for it, except for gross negligence or they rigged it to temporarily hide it.
they were probably busy that week and did not keep up on all the paperwork for all the tows and it was not a police tow situation where the courts have documentation , it was a private homeowner calling the tow company .

There are a couple problems with what you're saying, one your car isn't automatically going to be leaning enough for you to notice, two there may have still been some air in both of those tires until he actually started driving on them, that has happened with many punctured tires, he says he drove at most half a block before he noticed the tires were both flat, and you and I might both walk around our vehicles and inspect every inch of it but not everyone thinks like that or would do that, that doesn't mean that the tow company isn't responsible for damage that they caused, in fact this is more likely than not that this tow company did cause the damage, just the fact that the defendant brought in absolutely no paperwork to show how the tow was conducted is enough to show his guilt. He knew that if he brought in the paperwork showing how the tow was conducted it would hurt his case! he didn't forget his paperwork that was done purposefully.

First of all when you release a vehicle from a tow yard, you ALWAYS sign a release form to protect the company from liability such as being sued etc. Second, using a flatbed tow truck you can use the method of strapping all 4 wheels down or using chain hooks on the frame to secure the vehicle. Initially you hook the vehicle with chain hooks to the front control arms or subframe to pull the vehicle on the bed. This is information coming from a current tow truck operator. As an auto tech with over a decade of experience I’m 100% sure the tow popped his tires. The heat shields underneath rot out all the time or the shop that used a “forklift” to move his truck damaged them. If he just had a little more proof.

I know exactly how this happened. If the black top is gone from the street, there is a drop in the driveway. That's how the under plates got damaged. He went straight, instead of on an angle. It also means there's about a 4 inch drop on the sides of the road. If he got too close, to that, it will rub the tires. And if there's a bar sticking out of the concrete...pop goes the tires on the passenger side.
the clue that gets the tow driver off the hook is the fact that both the damaged tires are on the same side of his pick up truck . to me that means the tire damage happened when the truck was being driven and the plaintiff ran into or over something in the road that damaged both the front tire and the back tire as he drove in a straight line .
I don't doubt for one minute that the tires went flat while in the "care" of the tow company. I used to work for a tow company and the drivers including the owner would mess up cars all the time while they were improperly loading them onto a flatbed, towing dollies or anyting else. We have flat tires, body damage and anything else you can think of simply because it was not properly loaded or unloaded correctly. Then the drivers would always lie saying they picked it up that way or they don't know how it happened it must be the customers fault.

The plaintiff said that the tires were 6 months old, but the picture he provided looked like tires were almost done. If you hit a pothole hard enough, that will cause the side wall to pop. If he drove it flat, there was a good chance he could have damaged the heat plate under the truck.

I’ve been a tow truck driver for the last 15 years and I know the tow company didn’t damage his tires. Whether it was on a flatbed or a wheel lift and dollies there’s no touching of the outer sidewalls of the tires. It’s even more of a bogus lawsuit because it was on the same side. The guy bumped a curb or something when he drove out of the lot or down the street. The heat shield he’s talking about wouldn’t be damaged on a tow truck either. Those rust out or bolts come loose and they sometimes rattle. If tow trucks damage tires and other parts of a car they would all be out of business quick. Even if the wrecker driver was negligent the sidewalks of the tires wouldn’t have been touched putting it on or off the truck. Negligence usually causes damage to bumpers or bending a control arm or tie rod when they hook it up wrong. The judge made the right decision on this one at least. I’ve watched a couple others that involved tow companies and I didn’t agree with her verdict against the tow company. It’s hard to understand how something may or may not happen if you don’t know how to operate a tow truck.

The side wall punctures are usually caused by hitting a curb especially if the curb is jagged. Or of course by vandalism. I doubt by towing. The plates underneath being described are heat shields. Way back in the day when I purchased and drove old used cars. The heat shields sometimes would rattle or fall off. If they couldn’t be tightened any longer. I would just have the shield removed. Making sure not to park on grass or leaves

18:25 its never good to run your tank low. Now days all cars have electric fuel pumps in the tank. They stay submerged in the fuel, and the fuel acts as a coolant for the pump. If theres nothing to keep the pump cool it can overheat and fail. And that can be a costly repair. Much cheaper to have at least a quarter tank at all times

The truck was parallel parked with something in front of it and something behind it. The tow truck pulled it out of that spot. They damaged this truck.
I thought that's the whole reason why people have paperwork: if there's any dispute, all the information would be there, no need to remember anything. But, if he doesn't take it to the court, why bother with paperwork and signature?
I disagree with her decision. The tow truck guy said at least 5 times that the way he tower is by having it freely roll into the truck bed. Ok. We e now established that when they got the car the wheels were fine. Then he grabs the car and less than an hour later the wheels are ruined? It’s a lot more probably that something happened in their care than 30 minutes after he picked up his car he drove it on something that damaged it.
I don’t agree with this verdict. They are supposedly supposed to rule with the evidence being more likely than not. And anyone who know how tow companies work, they know how rough they are with cars. What a weird coincidence that they towed his car and then the guy has two messed up tires and the plates under the car are busted . Like really ? I think I know how the story happened. He took his car out of the tow. He was flying down the street because he was pissed off and he didn’t pay attention to the huge pot hole which busted, his right tires and cause the vehicle to need alignment. Now he’s here wanting the tow company to pay for everything.

18:25 its never good to run your tank low. Now days all cars have electric fuel pumps in the tank. They stay submerged in the fuel, and the fuel acts as a coolant for the pump. If theres nothing to keep the pump cool it can overheat and fail. And that can be a costly repair. Much cheaper to have at least a quarter tank at all times
They have NO PAPERWORK. THAT ALONE should be enough to pay for these tires. Those tires didn’t hole themselves on side

Another stupid verdict from this ridiculous judge, tow companies damage cars all the time, I've seen this firsthand on many occasions, the tow rep brought nothing to back up anything on his side, the plaintiff had video and paperwork and yet he gets nothing, the truck was in the tow services care and upon leaving there were immediate issues, ridiculous!
he partially sued for $500 because he didn’t drive do to a rattle. i think something is rattling upstairs.

the video showing the bubbling looks like it’s a slit about 1/2l” to 3/4” long… which says the tires were stabbed with a knife.
there’s not way the flatbed would cause any damage like that.
if you have a very expensive car, do yourself a favor, request a “flatbed tow”. it’s the best way to transport a vehicle in order to “prevent” damage. this clown is trying to sue for damages caused by a flatbed.

The truck was parallel parked with something in front of it and something behind it. The tow truck pulled it out of that spot. They damaged this truck.
I thought that's the whole reason why people have paperwork: if there's any dispute, all the information would be there, no need to remember anything. But, if he doesn't take it to the court, why bother with paperwork and signature?
Never trust any towing company they probably put air in tires right before he picked it up
I think what happened is that someone was mad to have their driveway blocked so they ice picked the car's tires.

I disagree with her decision. The tow truck guy said at least 5 times that the way he tower is by having it freely roll into the truck bed. Ok. We e now established that when they got the car the wheels were fine. Then he grabs the car and less than an hour later the wheels are ruined?
It’s a lot more probably that something happened in their care than 30 minutes after he picked up his car he drove it on something that damaged it.

I don’t agree with this verdict. They are supposedly supposed to rule with the evidence being more likely than not. And anyone who know how tow companies work, they know how rough they are with cars. What a weird coincidence that they towed his car and then the guy has two messed up tires and the plates under the car are busted . Like really ? That’s how they pick up the car by the tires and by hooking underneath by those plates. Bad ruling on this one

I think I know how the story happened. He took his car out of the tow. He was flying down the street because he was pissed off and he didn’t pay attention to the huge pot hole which busted, his right tires and cause the vehicle to need alignment. Now he’s here wanting the tow company to pay for everything.
The towing companies are ALWAYS damaging peoples cars. They steal too! They did my relative the same way and caused so much stress.
Why no paperwork? Also curb rash is a thing that the side walls can get damaged also driving on a flat can do that

maybe the defendant didn't bring the paperwork because the kid was telling the truth and they didn't have him sign anything. And come on, who doesn't believe that they didn't damage his tires - they were fine, he gets towed, and suddenly he has two flat tires. What are the odds that something happened just as he left the lot. The defendant got off really easy here.
She is wrong in this case. The tow did that and for her to start to say he signed for it when there is no paperwork is not right...... Maybe he shouldn't get the money for the plates under the car but absolutely the tires.
Look at the time stamp on the video of the tire bubbling on the side. At least you'd get a Day or Two to the date.
