I have rented vacation homes around the world. All of the houses I have rented have had printed house info that is usually found in a binder. (trash, Wi-Fi, septic, heat, A/C, local restaurant menus)
the last two we stayed in didn’t have any printed check out or cleaning rules. They only asked that we treat the home like it’s ours. The one before those two only asked that we lock the trash bins if we take trash out.
I think people today just don't have empathy, they just can't put themselves in the place of others, so leaving smelly garbage bags, bringing smelly dogs and ripping mosquito screens is of no consequence to them, but boy oh boy would they have complained had they arrived to find it that way...

I've been up where the house is. Give the Thousand Islands a google, it's pretty neat. It's a chain of 1,800 islands in the St. Lawrence Seaway Between New York and Canada. There are lots of little islands with a single house on them. It you want your own island but the Caribbean is out of your price range, Thousand Islands is a good alternative. They also have the shortest international bridge in the world. And yes, the salad dressing was invented up there.

No one wants to spend the first couple of days at their vacation house cleaning the place and making trips to the transfer station with all that garbage. And i could see the flat wheel on the hammock....the landlord just didnt' prove to the judge's satisfaction that the plaintiff had done it.

It's been a very old (OLD) tactic for when a landlord spends a security deposit instead of putting it into escrow & is unable to return it they'll typically conjure up "damages", that way they don't have to return the money that they don't have, the case winds up with the landlord either making money or they break even and don't have to return a dime...because they don't have it to begin with. Their "damages" could be anything from doctored photos, dirtying the apt themselves, photographing a totally different property, or showing photos of when they first bought the property. The other half do this in order to get out of having to pay out of their own pocket to spruce the place up in between tenants- this one is popular & easy to spot because they almost always bring up the same "damages", being dirty flooring, unclean walls, dirty baseboard heaters, dirt underneath the stove or fridge, etc etc. things they would normally have to clean anyway in between tenants, this way the "damages" pays all of it, it's a free job, then the next tenant comes in and the landlord spends that deposit also & it starts all over again. Oldest trick in the book, been around longer than me and I've been around half a century and have seen this tired old song & dance many times.

Always ask for the most you think even fathomable since it seems you will never, very very rarely, get what asked for with JM. There's always something deducted or minimized and people are never paid for their own time. Homeowner played her hand well but needed more photo proof. That place was just nasty.
I'm confused about the garbage.... what were the renters suppose to do with the garbage.... when I rent a place for a vacation I expect garbage pick up to be included. I shouldn't have to take a weeks worth of trash with me. The owner should have told her up front what to do with the garbage!

Say trash day was Friday, the homeowner can’t possibly expect the next renters to have that trash right outside their house all week much less haul it out themselves on Trash Day. So I’m guessing she hauled it to a dump of some kind or back to where she lived.
I sympathize with the defendant on the dog issue. We rent Airbnb from our basement and people often messages saying that they have a service dog and we’re not allowed to deny their booking because of a service dog. Typically no pets allowed. We reached out to Airbnb and they said that we’re not even allowed to ask what kind of service dog or what the function of the dog is. We just have to blindly accept. Very frustrating!
Well if there’s any damage you can put a clause in there that they’ll be liable for triple the damages and then if they’re actual service dogs and it was a mistake they’ll be trying to provide as much evidence as they can. If not, let them fight it and n court

There's this cool thing called the ADA law where you really can't say anything about service dogs. Can't deny anyone a place to stay or place to eat cause they have a service dog. It's against the law.
Authentic, true , and genuine Service Dogs cannot be refused access unless there are behavior problems with the dog. Emotional support dogs are PETS and have no legal status right to access. A Service Dog assists specific needs related to specific disabilities. Emotional comfort is not a disability for which a Service Dog is needed.
I seriously hope they didn't abuse the right to have a service dog. The few times I've stayed at different places with my service dog She's glued to my hip. She does not wander the house or wander the hotel room. Surely the dogs are what damaged the screens. They're going to ruin it for future service dog handlers

Oh my gosh, in the last 2 years of my father's life 2021 and 2022 I was able to stay with him in a rental home in Melbourne, Florida that had four bedrooms and all the family could come and visit all the Florida family in the New England family. It was such a wonderful time and he had rented it through verbo. This place was just so nice and such a comfortable neighborhood that we rented it the second year of the end of his life and we had such a good time. But this time they literally sent us a lovely handwritten note saying please do not clean the house because we're charging you a $250 cleaning deposit. That's non-refundable and we're going to have a cleaning crew come in and we do this in between every rental. Long story short, me and my daughter spent an afternoon cleaning and we found $40 in cash and a dirty diaper underneath one of the bedrooms comforters underneath the bed. So we put everything that we found all the debris. All the stuff in a pile and said listen. You need to talk to your cleaning crew because if we found this in an hour and a half of cleaning then they're not earning their $250. Love the farland family

As usual people plz take pictures when u rent anything!!!😃 When we went to Vegas I took pictures of my room, bathroom, carpets, walls even the mattresses. I always bring my own linens and comforters I dont even trust the ones given. And especially TOWELS!! I love bath sheets the extra big towels u can wrap up in. I know thus womans case was different but she should have called about trash pickup days. Kinda gross.
What I find odd is that every rental I have used charges a minimum cleaning fee now days, so even though I leave it tidy and dishes done/ laundry started, a cleaning service comes in to finish the deal. So how is this home any different? No cleaning deposit? Damages to the screen and trim I understand. Garbage should have definitely got taken to the curb. But after garbage day having to carry garbage to a deposit seems excessive . Rentals are weird. You pay their monthly mortgage with one week rental and they get to have this extra home that a local person is deprived of? No more sympathy for landlords
In the picture purporting to show all kinds of food on the floor, I didn't see anything other than the poorly-finished floor that looked as if it hadn't been varnished or polished for over a decade, and the picture of "all the trash she'd had to sweep up" looked like a bit of dust and a few wadded up kleenexes. Yes, there was a lot of garbage left in the trash cans, but did the renters know where they were to go to dispose of the trash? Is there no trash pick-up at the rental house? If there is, were they told which day the trash pick-up was? Not that I heard.
I agree that the plaintiff left the place in very poor condition, and that the fair thing to do would be to award the defendant some of the deposit. That’s Marilyn’s personal belief as well. However, due to the defendant not sending the itemized list of deductions, Marilyn’s ruling NEEDS to follow the letter of the law. Even if it doesn’t seem fair, she has an obligation of following the law. So the full deposit needs to be returned and possibly doubled, if that’s what the law states in that particular state. The fact that the contract was never signed is a big issue as well. The defendant should have never allowed them to stay there without that signed contract. I also find it very amusing that the defendant submitted a dust pan with some debris in it as evidence of how the plaintiff left the place “trashed”. Lmao!!! That wasn’t much at all. The only actual evidence she had was that she had to remove tape from the windows, which shows that the windows should have been replaced a long time ago due to the obvious fact that they don’t seal correctly. Then she had evidence of the trash left outside. That’s it. The holes in the screen have not been proven due to the fact there were no before pictures, and the hammock most definitely isn’t ruined because of a “flat”tire, which the photo didn’t prove anyway. Hopefully that’s a lesson to prevent future renters from renting from her. I can picture her walking through the house with a white glove on, looking for a spec of dust so she can sue for thousands. Lmao

I’m on vacation, I don’t want to deep clean your house for you. It should be broom swept. I'm confused about the garbage.... what were the renters suppose to do with the garbage.... when I rent a place for a vacation I expect garbage pick up to be included. I shouldn't have to take a weeks worth of trash with me. The owner should have told her up front what to do with the garbage!

@@carolynrose4525 She had new tenants coming in the same day. Maybe trash day was many days off and she wouldn’t have wanted to obligate the new renters with the responsibility of lugging someone else’s trash to the curb.
@@carolynrose4525 The renters obviously didn’t put the trash out for trash day. This was Sunday, and the new renters had arrived. Did you see how much trash there was?? Say trash day was Friday, the homeowner can’t possibly expect the next renters to have that trash right outside their house all week much less haul it out themselves on Trash Day. So I’m guessing she hauled it to a dump of some kind or back to where she lived.
I sympathize with the defendant on the dog issue. We rent Airbnb from our basement and people often messages saying that they have a service dog and we’re not allowed to deny their booking because of a service dog. Typically no pets allowed. We reached out to Airbnb and they said that we’re not even allowed to ask what kind of service dog or what the function of the dog is. We just have to blindly accept. Very frustrating!

Well if there’s any damage you can put a clause in there that they’ll be liable for triple the damages and then if they’re actual service dogs and it was a mistake they’ll be trying to provide as much evidence as they can. If not, let them fight it and n court

The defendant is crazy for not videoing everything after each renter. The plaintiff is disgusting, even pigs are cleaner. When I rent a house the moment I walking in I video the houses conditions.

If I were the plaintiffs father I'd be so appalled and embarrassed for how my adult child/children treated someone else's home/cabin/property, the way they left that place is appalling and nasty. The father stated the place would be left clean and spotless but yet to walk into a mess like the defendant did she must have been horrified, I bet she regrets not have the contract signed....
If the plaintiff left someone else's property that nasty I can't even imagine what her own home looks like.... I would never rent my children another vacation place again.

Almost Always, when there is a security deposit case, the plaintiff is usually in the wrong and they end up looking bad.
Defendant would've gotten more if she'd had any actual proof about the damage she claimed (paint, hammock). How many litigants have we seen who come in and make all these claims with ZERO proof? Didn't she watch any of the shows before she appeared? PROOF people, that's the key!

I've rented a lot of houses and not ONE has ever expected me to leave it in anything more than broom swept condition. I've never been expected to mop up after myself. Picking up trash and putting it away, of course but mopping? Holy cow. And why did she have to haul the garbage three hours away? Every county has a dump, she should be able to take it to one. The Plaintiff is in the wrong but the Defendant is WAY over-reaching and nitpicking to hell and back.

There's this cool thing called the ADA law where you really can't say anything about service dogs. Can't deny anyone a place to stay or place to eat cause they have a service dog. It's against the law.
Authentic, true , and genuine Service Dogs cannot be refused access unless there are behavior problems with the dog. Emotional support dogs are PETS and have no legal status right to access. A Service Dog assists specific needs related to specific disabilities. Emotional comfort is not a disability for which a Service Dog is needed.

These short term rentals are ridiculous. The “rules & expectations” are always so much greater than they should be. Most expect you to pay a cleaning fee AS WELL as clean it do that they can IMMEDIATELY rent it again. That’s asinine. You don’t clean a motel before you go because your price includes having it cleaned. These rentals CHARGE a fee that specifies that it is for cleaning but still don’t wanna clean it. I don’t understand. Also how dare she enter the premises without contacting them to MAKE SURE they were out? That’s unacceptable.
The tape didn’t hurt the WINDOWS. IT MAY HAVE PULLED PAINT OFF THE WOOD PART OF THE SIDES BUT DID NOT HURT THE WINDOW.

After a week rental you should have the next rental on the same day. There is definitely an unsanitary aspect there.
Oh my gosh, in the last 2 years of my father's life 2021 and 2022 I was able to stay with him in a rental home in Melbourne, Florida that had four bedrooms and all the family could come and visit all the Florida family in the New England family. It was such a wonderful time and he had rented it through verbo. This place was just so nice and such a comfortable neighborhood that we rented it the second year of the end of his life and we had such a good time. But this time they literally sent us a lovely handwritten note saying please do not clean the house because we're charging you a $250 cleaning deposit. That's non-refundable and we're going to have a cleaning crew come in and we do this in between every rental. Long story short, me and my daughter spent an afternoon cleaning and we found $40 in cash and a dirty diaper underneath one of the bedrooms comforters underneath the bed. So we put everything that we found all the debris. All the stuff in a pile and said listen. You need to talk to your cleaning crew because if we found this in an hour and a half of cleaning then they're not earning their $250. Love the farland family

As usual people plz take pictures when u rent anything!!!😃 When we went to Vegas I took pictures of my room, bathroom, carpets, walls even the mattresses. I always bring my own linens and comforters I dont even trust the ones given. And especially TOWELS!! I love bath sheets the extra big towels u can wrap up in. I know thus womans case was different but she should have called about trash pickup days. Kinda gross.

What I find odd is that every rental I have used charges a minimum cleaning fee now days, so even though I leave it tidy and dishes done/ laundry started, a cleaning service comes in to finish the deal. So how is this home any different? No cleaning deposit? Damages to the screen and trim I understand. Garbage should have definitely got taken to the curb. But after garbage day having to carry garbage to a deposit seems excessive . Rentals are weird. You pay their monthly mortgage with one week rental and they get to have this extra home that a local person is deprived of? No more sympathy for landlords
In the picture purporting to show all kinds of food on the floor, I didn't see anything other than the poorly-finished floor that looked as if it hadn't been varnished or polished for over a decade, and the picture of "all the trash she'd had to sweep up" looked like a bit of dust and a few wadded up kleenexes. Yes, there was a lot of garbage left in the trash cans, but did the renters know where they were to go to dispose of the trash? Is there no trash pick-up at the rental house? If there is, were they told which day the trash pick-up was? Not that I heard.

I agree that the plaintiff left the place in very poor condition, and that the fair thing to do would be to award the defendant some of the deposit. That’s Marilyn’s personal belief as well. However, due to the defendant not sending the itemized list of deductions, Marilyn’s ruling NEEDS to follow the letter of the law. Even if it doesn’t seem fair, she has an obligation of following the law. So the full deposit needs to be returned and possibly doubled, if that’s what the law states in that particular state. The fact that the contract was never signed is a big issue as well. The defendant should have never allowed them to stay there without that signed contract. I also find it very amusing that the defendant submitted a dust pan with some debris in it as evidence of how the plaintiff left the place “trashed”. Lmao!!! That wasn’t much at all. The only actual evidence she had was that she had to remove tape from the windows, which shows that the windows should have been replaced a long time ago due to the obvious fact that they don’t seal correctly. Then she had evidence of the trash left outside. That’s it. The holes in the screen have not been proven due to the fact there were no before pictures, and the hammock most definitely isn’t ruined because of a “flat”tire, which the photo didn’t prove anyway. Hopefully that’s a lesson to prevent future renters from renting from her. I can picture her walking through the house with a white glove on, looking for a spec of dust so she can sue for thousands. Lmao
It’s dirty but that’s why you pay a deposit. These vrbo and Airbnb’s that make you do all this deep cleaning on move out are ridiculous. I’m on vacation, I don’t want to deep clean your house for you. It should be broom swept. As for the garbage, maybe the landlord should provide a dumpster or another larger trash system since the trash can’t be taken anywhere for dumping. Another hassle for the renters that they shouldn’t have to deal with.

I'm not sure what the big deal is about the garbage. Every place I've ever stayed in Airbnb, you put the stuff in the bin and you are good to go. Arranging pickup is the host's duty. Why is a picture of garbage cans and garbage bags so shocking?! There's also not a lot of proof that it was super filthy. Yes the floor was dirty, but no pics of anything else? Just mop the floor and you're good to go. JM is way too shocked that there was garbage in a garbage can.
